ARCHITECTURAL GUIDELINES, STANDARDS AND CRITERIA Highland Oaks Preserve Homeowners Association Presented to the Board of Directors September 22, 2015 These Architectural Guidelines are supplemental Guidelines for the recorded Declaration of Covenants Conditions and Restrictions for Highland Oaks Preserve HOA, Inc. Additional requirements may be contained in the recorded documents. Applicants are encouraged to review Covenant Documents for the HOA in addition to these Guidelines prior to submitting a modification request. Adhering to the Covenants and Guidelines is beneficial for all involved in that they are meant to protect the investment of the homeowners, as well as portray a quality community of well-planned homes constructed with and maintained using high construction standards & materials. NOTE: This set of ACC guidelines supersedes and replaces all previous versions, once approved and adopted by the Board of Directors. NOTE: If a homeowner fails to receive an approved/dated ACC form and begins the exterior improvements it will be considered a "VIOLATION" and the BOD and Avid Management INC., will be notified. 1. FENCES AND SCREENING Fences shall not be erected or installed without prior approval of the ACC, and must be constructed of off-white/eggshell PVC vinyl material. a. All fences shall be no higher than six feet. b. Fences will be erected so that all stringer and/or posts shall be placed on the inside of the fence and the side without any supports shall face out from the lot. c. Fences shall not be installed flush to the ground, so that drainage will not be blocked in any way. d. Irrigation systems must be reconfigured to provide complete coverage outside of the fenced area. e. Fences must be kept clean and in good repair. f. Fences for corner lots require close coordination with the ACC due to their unique layout and concerns for vehicle visibility/safety and compliance with existing easements and country building code setback requirements. g. No fences shall be installed on or across easements. h. Signatures from neighbors on all sides of the property where fence will be installed must be on the Fence ACC Application Form at the time of submission. The purpose of the signatures is to notify the owners that workers will be installing a fence and may inadvertently trespass onto their property or have materials on their property. Any damage that may arise to another owner's property during the installation process is the responsibility of the owner who is contracting for the fence installation. i. It is the responsibility of the Owner to comply with all County and/or Association Requirements. 2. SCREENED ENCLOSURES a. Screened enclosures shall be framed on anodized aluminum of a color that matches the existing window mullions and may in no instance be higher than the roofline of the Home nor extend beyond the width of the Home. b. Plans of the proposed screen enclosure must be included with the application and written description showing design, color, height, etc. is also required. 3. TRELLISES, LAWN ORNAMENTS, ETC. a. Site designs and landscape construction documents shall be prepared in accordance with therequirements of all applicable Florida Statues. All landscape and irrigation system designs shallbe consistent with the standards required under 373.228 Florida Statutes.

b. Since landscaping designs· may change or alter the drainage of your property and have anegative impact on neighboring property the ACC may reject the landscape plan based on itsreview of the overall design and impact. The landscaping plan must detail the location of beds,planting materials, and specify the types of plants.

c. Annuals may be planted in the existing beds without approval of the ACC.d. All other modifications to existing landscaping beds or additional landscaped beds must be

submitted to and approved by the ACC.e. No artificial plants or artificial ground cover shall be allowed on the exterior of any house.f. Florida Friendly Landscaping is allowed as approved by Florida Statutes and outlined by the

brochure provided by the University of Florida.g. Permanent decorative borders must be approved by the ACC: wire, plastic and/or wood borders

are excluded.

4. LANDSCAPING

5. IRRIGATIONIn no case shall grass clippings, vegetative material, and/or vegetative debris, either intentionally oraccidentally, be washed, swept or blown off into storm water drains, ditches, conveyances, water bodies,wetlands, or sidewalks or roadways.

6. SWIMMING POOLSa. Any swimming pool to be constructed upon any home site shall be subject to review by the ACC.b. Above ground pools are prohibited.c. In-ground Spas and Jacuzzis must have the prior written approval of the ACC (temp installations

do not require approval.)d. Screening of the pool, spa or Jacuzzi is required either by fencing the property or by a screen

enclosure.e. Pools may not be backwashed into any common areas or other lots. Damage, including erosion,

to common areas due to backwashing will be repaired by the Association and all expensesincurred by the Association will be billed to the Owner.

7. COMMERCIAL VEHICLES AND PARKINGa. No commercial vehicle shall be kept within Highland Oaks Preserve, except in the garage of a

home.b. No vehicles displaying commercial advertising shall be parked within public view with the

exception of vehicles used by a company providing service to the Common Areas or an Owner.8. GARBAGE

All Garbage receptacles may be put out for a period not to exceed 12 hours prior to pick up, and emptycontainers shall be removed by the end of the scheduled collection day.

9. EXTERIOR PAINTING AND OTHER COLOR MODIFICATIONSTheACC shall have final approval of all exterior color plans including materials. Each Owner must submitto the ACC a color plan showing the color of all exterior surfaces that shall include samples of the actualcolors to be utilized and the materials.

a. The ACC shall determine whether the color plan and materials are consistent with the Homesin the surrounding areas and that they conform to the color scheme of the community. (HOAApproved Color Palette available upon request.)

b. Examples of areas that require color change approval: Exterior doors, trim for doorways, allexterior walls, all exterior trim, shingles, window trim, driveway & walkway surfaces (paverstones, concrete stain, etc.), garage doors, etc.

c. Should ACC deny a request for modifications, Owner may appeal to Board of Directors forHighland Oaks Preserve for reconsideration.

10. PETSa. All pets shall be confined to a leash, held by and under the physical control of a responsible

person at all times when they are outside an Owner's property within the Highland OaksPreserve Development.

b. All Pet Owners shall pick-up after their pets in the Development and appropriately dispose ofsuch wastes in a trash receptacle.

11. HOME AND EXTERIOR MAINTENANCEAll homes upon each lot must be maintained in good condition and repair. The condition and repair ofeach home will be evaluated each month by the Property manager, Board member and ACC memberwith recommendations made to the homeowner if a violation of Highland Oaks Preserve HomeownersAssociation is observed. Such maintenance and repair must include without limitation:

a. Roofs must be kept free of extensive moss, branches, leaves and shingle mildew. Guttersmust be kept clean with no evidence of build up or overflow visible from roadway. Gutters areto be kept free of mildew.

b. Paint and/or stain on each structure (house, fence, deck, etc.) must be uniform in color, andwithout significant fading, cracking, or peeling. Color schemes will be provided by the HOAand must be adhered to by the home owner. New color schemes or existing color schemes ofbuildings and structures should be color schemes suggested by the main residence located onthe lot where the building/structure will be sited. The homeowner must submit an ARC formprior to beginning any painting and or repairs. All new or existing color schemes for residentialhomes must be approved by the ACC.

c. Yard/landscape:Owners must properly maintain their yards and landscaping (collectively "yards") and theexteriors of the structures on their properties. Proper and periodic maintenance of yards andstructures is important to the quality and character of the community, and helps maintainproperty values and marketability for the benefit of all members of the community. All exteriorareas must be consistently maintained and kept in a clean and attractive condition, so thelandscaping and all improvements on the lots are kept attractive, and compatible andharmonious with high standards for a well maintained residential community, which includes thefollowing specific areas:

i. Yard Maintenance - Yards must be periodically maintained with the height of the St.Augustine being between 2 to 4 inches. Such maintenance must include withoutlimitation and within reasonable expectation the following: Lawns must be mowed,edged, leaves removed on the street/yard and all trees must be free of standing grass.Lawns should be periodically fertilized and watered, trees and shrubs pruned at leasttwice a year, dead limbs and stumps removed, planters, lawns, shrubs and planting bedskept weeded, woodpiles must be screened from public view, leaf piles and other yardwaste must be removed or placed in an attractive container suitably located andscreened from public view, and all moss and leaves must be removed from drivewaysand walkways.

ii. Home & Exterior Maintenance -All structures upon each lot, including the homes, mustbe maintained in good condition and repair. Such maintenance and repair must includewithout limitation: Paint and/or stain on each structure (house, fence, deck, etc.) mustbe uniform in color, and without significant fading, cracking, or peeling

iii. Trees in excess of 20' in height must have lower branches trimmed to and elevation of6'. Limbs over hanging the street must be trimmed to allow service vehicles (emergency,mail, garbage) access without touching the branches (approximately 10'). Two treesmust be maintained in the front yard of the houses. Replacement of the tree or trees isrequired upon removal of one or both trees. Once a tree or limb/s is deemed diseasedor a safety hazard, said tree or limbs must be removed.

iv. St. Augustine grass is required for lawn sod and should be free of weeds. FloridaFriendly Landscaped lawns are allowed to cover 2/3 of the area with native Florida plantswith the other 1/3 to be sodded with St. Augustine sod. The area free of St. Augustinesod must have a form of ground cover or bark. All Florida Friendly Landscaped lawnsmust be approved by the ACC and meet the criteria/guidelines by the brochure providedby the University of Florida.

v. Watering/sprinkler systems are required to be maintained and in working condition.vi. All street side mailboxes must be free of mildew and any chipping of the paint. If the

mailbox needs to be replaced it must be similar or exact.

12. COLOR DESIGN STANDARDSa. Each home must be painted on the exterior with three different colors: Body, Trim and

Accent/Door.i. To define the above, Body color shall designate the House. Gutter downspouts shall be

incorporated into that of the body color. A garage door may also be classified as anaccent for this the body color may be used.

ii. Trim color shall designate the following including but not limited too; stucco raised orfoam banding around windows, doors, soffits, gutters, fascia, keystones, faux vents orany decorative detail not mentioned above. The only exception to this is should a househave bronze soffits and fascia. A garage door may also be classified as an element forwhich trim color may be utilized if requested by the homeowner and approved by theACC.

iii. Accent/Door colors shall designate that of including but not limited to; the front entrydoor(s), side garage service door, shutters and in certain cases as may be approved, agarage door.

b. The color choices for our HOA should be available for your review at a local Sherwin-Williamslocation. Ask a Sherwin-Williams employee for the Highland Oaks Preserve HOA book once itbecomes available.

i. In addition, the ACC will have a copy of the color book that may be checked out for yourconvenience. DO N~T write, fold, mutilate, or remove any of the pages from this bookor you will be charged for their replacement.

ii. The Board of Directors and the Property Management Company will also have a copyof the book for record keeping and reference purposes.

c. The book of color choices at Sherwin-Williams includes 19 house color combinations from whichto choose. Each of the color schemes includes a Body color, two (2) Trim color options, andthree (3) Accent/Door color recommendations.

i. When you select a color scheme from the book, you must use the Body color and oneof the Trim color options illustrated on that page. You may NOT choose a Body colorfrom one page and a Trim color from another page.

ii. You may not switch the Body and Trim colors. The Trim color may only be used on theTrim and only ONE Trim color may be used on the house. Should either of the twooptions with the house color not be desired, a homeowner may request any of the trimcolors in the color book but the determination of such a variance would be approved bythe ACC.

iii. The Body and Trim colors may be used on the garage doors subject to the review andapproval of the ACC. The Body color may NOT be used on the accent keystones on thetrim.

iv. The house may NOT be painted a single color. A Trim and accent color option orrecommendation MUST be used.

v. The Accent color MUST be used on the front door. It may also be used on the garageside exit/service door subject to the review and approval of the ACC. The Accent colormay NOT be used on the trim or on the accent keystones on the trim.

vi. The recommended sheen for the Body and Trim colors is Satin although Semi-Glossmay be used for the Accent color. Flat or Hi-Gloss are NOT approved for any of theexterior paint colors.

vii. Pending approval of these guidelines and the HOA color palette book at the September22, 2015 Board of Directors meeting, any original house body paint color shall begrandfathered in for the current homeowner only whereas any future subsequent ownermust abide by the color standards and guidelines in effect for the community as outlined.

d. It is not necessary to use Sherwin-Williams paint, but you are required to select your exteriorpaint colors from the HOA color palette book. If you use paint other than Sherwin-Williams, thecolor MUST be an exact color match whereas the homeowner assumes all responsibility for thepaint matching. Most reliable paint stores can color match any sample, but this task is impossibleby sight alone. If the colors do not match, you will be required to repaint immediately at yourown expense. Please note in the color palette book that it lists Sherwin Williams paint namesand color codes, which will allow most any paint seller to match them exactly. The ACC mayrequest you to have a sample area of the house body, trim and/or accent/door colors desiredpainted for review prior to any approval being given.

e. Be sure that the house body color and paint scheme you select is NOT the same as yourneighbors' on either side of you or the home directly across the street from you. The ACCreserves the right at its discretion to also grant exceptions should a house be on a cul-de-sac,corner lot or in a diagonal position but such are only in extreme rare cases, should they everarise.

f. Once you are confident your paint choices meet the guidelines, print an Architectural ReviewRequest (ARC) form online or manually complete the form, submit 3 physical copies to the ACCChairperson. This shall assist in expediting your paint request. Alternatively, you may mail, fax,or email your request to the ACC Chairperson and copy the Property Manager at the addresson the form. Please note such will add delays to the approval process due to additional handling.All paint projects require an Architectural Review Request Form be submitted and approved,PRIOR to the start of the project. Please refer to the ARC form for specifics regarding theapproval process.

g. When you receive a fully executed ARC request form and/or a final approval letter from themanagement company, you may begin painting. Please do not initiate work on your project norpurchase materials without first receiving final written approval from the ACC. This will help usavoid potential problems and conflicts associated with a misunderstanding of the Guidelines andthe unnecessary expense of having to re-do your project. If this requirement is disregarded,fines and subsequent litigation may ensue. Should you have any questions about theseGuidelines, or any other concerns, please send them in writing to [email protected]. Anyreplies do not constitute approval. Approval is granted by the wet ink signature and date of theACC and/or BOD, affixed to the ACC Request form you submitted.

h. Dispute Resolution: If your request is denied by the ACC, you may elect to resubmit your requestor alternatively, you may appeal to the Board of Directors. The Board of Directors will evaluatethe details of your request as well as the adherence to the guidelines and process as set forthin conjunction with the Declarations and Florida law. The Board of Directors has a fiduciaryresponsibility to be objective in their review of any and all appeals. If a member of the Board isthe one appealing, then such member must recuse themselves from any appeal or influence onsuch an appeal made to the Board of Directors.

13. SIGNAGEPlease follow all local regulations when placirlg temporary signs such as garage sales and open houseindicators. Make sure those signs have the homeowner address legibly marked, so there is noconfusion as to which house they apply.
