Architectural Guidelines

Presidential Heights #1 Community Association GENERAL INFORMATION 1.1 Overview

1.1.1 The Board of Directors (“Board”) of Presidential Heights #1 Community Association

(“Association”) has established these Architectural Guidelines (“Guidelines”) in accordance with the authority granted to them by the provision of the Covenants, Conditions and Restrictions (“CC&R’s”). The Guidelines are established to assure uniform and fair interpretation of the CC&R’s. The Guidelines are intended to provide all homeowners in Presidential Heights #1 information about the type, color, quality and grade of material, which may be used in construction of various types of improvements; the size and location of such improvements, and for the procedures followed by the Association for reviewing applications for proposed improvements.

1.1.2 These procedures and Guidelines may be amended by the Board from time to time as it deems necessary and appropriate. 1.1.3 Presidential Heights No. 1 was built in the early 1970's in contemporary residential style featuring rustic wood exterior detailing typical of that era. 1.2 Authority 1.2.1 CC&R’s recorded June 22, 1972, Document No. 24015, Book 10187, Page 822, Orange County,

CA, Article III, paragraph 7 and Article VII, paragraphs 1 through 4. Also, By-Laws, Article V, Section 1, paragraphs (a), (b) and (c).

1.3 Architectural Committee 1.3.1 The Board will appoint an Architectural Committee (“AC”) to ensure that the architectural and

aesthetic integrity of the community are maintained as originally intended by the builder. The Board may remove members and add new members at their discretion.

1.4 Members of the Committee

1.4.1 The Board shall appoint no less than four Committee members from community volunteers. All

property owners of the community are eligible for membership. In the selection of Committee members, the Board shall make every effort to establish a broad geographical and diverse representation of the community.

1.4.2 The AC may, from time to time, if authorized by the Board, consult architects, land planners, and

other persons, whose advice may be helpful to the AC, provided that such consultant shall not be a resident of the community or the homeowner of a dwelling unit therein.

1.5 Officers of the Committee 1.5.1 The AC Chairperson shall be appointed by the Board and shall be responsible to the Board.

The AC Chairperson shall make reports, orally or in writing as required, through the Board Liaison for the AC Committee.

1.5.2 The term of office of the Chairperson shall be one year or until a successor is appointed by the

Board.

1.5.3 The Chairperson shall appoint or the Committee may elect a Vice-Chairperson and Secretary.

Additional officers may be appointed or elected as deemed necessary for the functioning of the AC.

1.5.4 The AC Secretary shall be responsible for recording the minutes of all meetings, maintaining

records and all correspondence of the AC. A copy of the AC’s minutes and agendas shall be given to the Board Secretary

1.5.5 The AC Secretary shall give adequate notice to the Committee members of all regular and any

special Committee meetings, which are called by the Chairperson.

1.5.6 At the end of the Chairperson's term, all closed files are to be given to the Board Secretary for filing. Open files and papers of a reference nature, including these guidelines, are to be passed along to the appointed and approved succeeding Chairperson.

1.6 Responsibilities of the AC

1.6.1 The CC&R’s confers on the Committee the responsibility to make determinations on all matters of architectural integrity and technical specifications concerning additions, changes, repairs, alterations or improvements to the outside of any unit or building or common area owned by or within the responsibility of the Association. 1.6.2 The CC&R’s empower the AC to approve or deny Architectural Applications. The right to hear appeals from AC decisions rests with the Board. 1.6.3 The AC shall schedule a meeting to be held at least once a month. If there is no business to conduct, no meeting need be held. 1.6.4 In the event the Committee fails to approve or disapprove any plans, specifications, plot plans or work description within thirty (30) days after homeowner's submission to the Chairperson, then the application will be deemed to have been approved.

1.7 Application Process

1.7.1 Changes to the outside appearance of homeowner’s unit require prior written approval from

the AC. Unless stated otherwise in writing, a complete application with all supporting documents is required.

1.7.2 Homeowner must:

a. Carefully plan the improvement or modification to conform to these guidelines. b. Submit a completed application form with all supporting documents.

c. If applicable, attach site plans, floor plans, and elevations showing location of proposed modification, addition or improvement, relationship to the property lines and adjacent dwellings. A photograph of the proposed area of the alteration is recommended. In order to show the visual impact of proposed room expansions or add-ons, a wooden framework, aka "Story Poles", outlining the silhouette of the proposed expansion or alteration may be required.

d. A sample of the material and color is required. e. Include the information requested in the appropriate section on the application.

f. Mail, hand-deliver or e-mail the completed application to the AC in care of the Management Company at: Presidential Heights #1 Architectural Committee

g. If application is delivered via e-mail. Proof of notification to the adjacent owners must be submitted as well as acknowledgment from the notified owners h. If application is delivered via e-mail. Any elevation changes, room additions and room enclosures MUST be also submitted to the AC on a 8.5 "by 11" size paper at a minimum.

1.7.3 The AC will review and either approve or deny the application. Homeowner is notified of this

decision by the Management Company by e-mail or mail.

1.8 Time Period

1.8.1 The AC shall consider each application in a prompt and timely manner and approve or deny it as soon as practical. An application may be tabled in order to request additional information from the Applicant or their Contractor. In the event, however, the AC fails to approve or disapprove, or otherwise acknowledge, any plan submitted within thirty (30) days after submission of the application, then the application shall be deemed to have been approved. (See Section 1.6.4).

1.8.2 Applications that have been approved are valid for six (6) months from the date of approval. If the project is not started by that date, the homeowner must re-apply. The AC Chairperson may, at his/her discretion, extend the approval period.

1.8.3 Construction of the approved alterations shall be pursued diligently and completed no more than ninety (90) days from the date of commencement of work.

1.8.4 Homeowner is required to notify the AC via the Management Company, in writing or via e-mail, when the project is completed and schedule time for the AC to inspect the job.

1.9 Appeal Process

1.9.1 The applicant may appeal an adverse AC decision to the Board, which may sustain, reverse, or modify such decision.

1.9.2 The appeal must be submitted in writing or via e-mail to the Management Company. The appeal must be made within thirty (30) days of the date of denial.

1.10 Building Permits

1.10.1 Approval by the AC will allow the homeowner to apply for a building permit from the Building

Department of the City of San Clemente, if required. Such permits are the sole expense of the homeowner. 1.10.2 The City has enforcement powers that are outside the purview of the AC and the Board of Directors.

1.10.3 Building permits are required, but not limited to, the following alterations, additions,

improvements or repair: a. Building Additions

e. Portable Spas f. Gas Fireplaces g. Air Conditioners h. Skylights i. Replacement of existing windows and sliding doors. j. Solar Panels

10.10.4 The AC shall review any changes issued by the City of San Clemente on previously approved applications prior to commencement of construction.

1 .11 Insurance

1.11.1 A Building Code violation could have an adverse effect on a fire and/or liability insurance claim

settlement. 1.11.2 A homeowner may not create a condition which would cause an increase in the premium or the

cancellation of the fire and/or liability coverage of the Association’s insurance.

1.12 Common Area 1.12.1 The placement of any object within the common areas must have written approval of the AC. 1.12.2 For projects involving common area encroachment, see Section 2.6.

2. PROCEDURES

2.1 Previously Approved Modifications

2.1.1 Previously approved modifications are included in Section 3.0.

2.1.2 It is important to note that even though a certain approved structural modification may be present at one or more locations in the community, it is not to be assumed that the AC will automatically approve a similar construction or modification at another residence.

2.2 Approval of New Modifications

2.2.1 To apply for a New Modification, not specified in Section 3.0, follow the standard procedure. When the application is received by the AC, it will investigate as to whether the proposed project falls under its stated authority. If it is found to be so, then the standard review and approval process will be followed and the approval or denial will be reported to the Board.

2.2.2 If any such modification requires a homeowner to incur specific monetary, space, usage,

maintenance or other obligation unique to the modification, the homeowner and Association President shall sign an appropriate document, which may include a covenant running with the land, prior to making any such modifications. The AC acts as a processor of the documents. The document is then forwarded to the Management Company to be recorded as a part of the specific property deed restrictions, if required, or filed. If recorded, the homeowner will be furnished a copy of the document by the current Management Company. The original document remains in the Association’s file. If the services of the Association’s legal counsel are required, homeowners will be required to pay for all legal expenses.

2.2.3 If any findings are of a nature outside of the AC stated duties, the process is as follows:

a. Application is forwarded to the Board for review and instruction. The Board has the final approval for any new non-architectural applications.

2.3 Non-Responsibility

2.3.1 Approval of plans, drawings and/or specifications by the AC does not constitute any

responsibility on the part of the AC as it relates to the conformance of the plans, drawings and specifications to the Building Codes of the City of San Clemente.

2.3.2 The Association is not responsible for any defects in workmanship or materials related to the Architectural Application or modification related to the project. 2.3.3 The homeowner assumes all liability for problems resulting from their respective project(s).

2.4 Financial 2.4.1 All expenses in connection with building permits, plans, recordings, or legal fees are the responsibility of the homeowner. 2.4.2 Special fees or assessments to the applicant may be recommended by the AC and imposed by the Board, in the event a modification to the original structure results in increased maintenance costs to the Association.

2.5 Policies

2.5.1 Additions, deletions, and revision of these guidelines may be accomplished at the regular meeting of the AC subject to coordination with other Committees, if affected, and approved by the Board. Approved proposed revisions shall be submitted to the Members subject to the "Notice of Rules Changes" provision of California Civil Code §4360.

2.5.2 There is no intent by these guidelines to supersede the Articles of Incorporation, By-Laws or

the CC&R’s which shall take precedence in the event of conflict.

2.6 Common Area Encroachment

2.6.1 Common area is defined as the area outside the footprint/structure of each individual residential lot.

a. Residential lots are defined by tract maps. Generally, the property lines are as follows: In the case of a B or E model, on the entry side, the common area begins outside the perimeter of the garage door and front gate, respectively. To the rear, the common area starts at the edge of the originally-built concrete patio slab. Reference CC&R Section I, Definitions, page 2, “residential lots”.

b. Residential lots are defined by the tract maps. Generally, the property lines are as follows: In the case of C or D (end) models, the property line extends 10 feet out from the stucco wall and is flush with the garage wall and the end of the original patio. The common area is adjacent to the property line and there is no overlap. The property of the C & D (end) models is considered part of the common area for maintenance and liability insurance purposes only. Reference CC&R’s, Section I, Definitions, page 3, “common area”.

c. Reference CC&R’s, Section XII, Encroachment Easements. There is a 4 foot encroachment easement beyond the property line on all exposed sides for supporting construction elements as defined in that section. (See Sec. 2.7 below).

2.6.2 Encroachment beyond what is defined in the CC&R’s are not encouraged. Permitted encroachments are rare and must not be considered an entitlement. Encroachments beyond what is defined in the CC&R’s are strictly regulated by California Civil Code. Encroachments are permissible only under the following exceptions, as stated in Section 4600, subdivision (a), and (b, (3) E and F).

a. California Civil Code, Section 4600, subsections (a) states: “Unless the governing documents specify a different percentage, the affirmative vote of members owing at least 67 percent of the separate interests in the common interest development shall be required before the Board may grant exclusive use of any portion of the common area to a member”.

b. Exceptions to subsection (a) are listed in Civil Code, subsection (b), the most applicable of which are:

Civil Code, subsection (b), 3 E, which states: “To transfer the burden of management and maintenance of any common area that is generally inaccessible and not of general use to the membership at large of the association”.

Civil Code, subsection (b), 3 F, which states: “To accommodate a disability”.

2.6.3 Encroachments beyond what is defined in the CC&R’s are temporary in nature and may be revoked at any time for cause.

2.6.4 The Architectural Committee has the principal responsibility to review encroachment applications and request further review either by the Landscape Committee, the Facilities Committee or both, before consideration by the Board for approval or disapproval.

2.6.4.1 Homeowners seeking to make such an encroachment must submit an application to the Architectural Committee, including a plot plan showing the existing lot lines, the proposed encroachment and other applicable plans and specifications.

2.6.5 The Architectural Committee will review the application with respect to the following requirements:

a. If the application is in compliance with Code, as stated above.

b. If the proposed encroachment could “be used in such a manner as to obstruct or interfere with the enjoyment of the occupants or other residential lots or annoy them by unreasonable noises or otherwise”. CC&R’s, Sec. III, (5).

c. If the application is suitable with respect to the architectural style and character of the community, as well as considerations of neighbor’s privacy, views, and other applicable standards.

d. If the encroachment would obstruct or impede access to such infrastructure, including easements, as in CC&R’s, Sec III, (6).

e. If the application needs consultation with other committees of the association.

2.6.6 If the Architectural Committee has approved the proposal, the project will then be required to go for a hearing by the Board.

2.6.7 If the Board finds that the proposed encroachment is in compliance with both Code, as stated in 2.6.2, a. and b. and community standards, as above, the project may be approved.

2.6.8 Owners of all approved projects that encroach beyond what is defined in the CC&R’s into the common area will be required to enter into a covenant running with the land, and to pay for the preparation of such a covenant by the association’s legal counsel. A deposit for the costs to prepare the covenant will be required prior to approval by the Board.

2.6.9 The association’s landscape contractor or handyman shall be responsible for removal of any association’s structures such as sprinklers, French drains, etc., at the sole expense of the owner.

2.7 Encroachment Easements

2.7.1 An Easement is defined as a non-possessory right to use and/or enter onto the real property of another without possessing it.

2.7.2 As stated in the CC&R’s, Sec XII, “The Declarant reserves for itself and its successor in ownership of residential lots in the Community certain easements as follows:

a. Easements in the portion of the common area lying within four (4) feet of any boundary of such a lot for encroachment into the common area of:

1. Eaves 2. Fireplaces 3. Doorsteps 4. Foundation footings for masonry walls 5. Garage Doors

6. Utility meters and other appurtenances or fixtures which, in the normal construction or use of a single family dwelling or garage, would project beyond the external surface of the outer walls thereof.

b. An easement in each residential lot for the encroachment of overhanging eaves of

the dwelling on to the adjoining residential lot, as such overhanding results from: 1. The original construction of dwellings within the Community, or, 2. From any reconstruction of modification of a dwelling pursuant to plans acted

upon and approved by the Architectural Committee.

3. GUIDELINES BY TOPIC (alphabetical order)

All additions, alterations, improvements and new construction must have prior written approval from the AC and, if required, meet the City of San Clemente approved site plans, construction plans, building permits and any other local construction requirements. The architectural design, character, form, scale and proportion of all additions, alterations, structures and improvements will be harmonious with the design and character of the existing dwelling, adjacent dwellings and structures. The location of any structure, alteration, improvement, or addition will not impair the view of any property.

3.1 Address Numbers

3.1.1 Address numbers are required on all garage doors.

3.1.2 Address numbers shall be 7-inches in height, ¾-inch thick, made of Modified Density Fiberboard (MFD) in font style “Arial Rounded”. Numbers can be ordered through Woodland Manufacturing 1-800-705-4020.

3.1.3 Numbers shall be screwed onto garage doors using 1.25-inch stainless steel screws and countersunk into the MFD.

3.1.4 Screw holes shall be puttied or caulked prior to painting.

3.1.5 Numbers shall be painted “Weathered Brown” on all sides for waterproofing.

3.1.6 Numbers shall be installed on the garage door nearest to the dwelling entrance.

a. garage doors without windows shall be installed on the highest panel.

b. garage doors with windows shall be installed on the panel immediately below the window.

c. installation shall be ¼-inch up from the bottom of the panel.

3.1.7 Address numbers shall mounted horizontally and have 2-inches in between each number.

Architectural Guidelines Presidential Heights #1 Community Association 3.2 Air Conditioners 3.2.1 Air conditioning units may not be installed in windows, garage doors or garage door windows. 3.2.2 No through the wall or permanent window mounted room AC units are permitted. 3.2.3 Central Air Conditioning Systems need to comply with the following requirements:

a. The approved location for a condensing unit is on the patio slab, in a location to be approved by the AC. b. Homeowner must present the AC with specifications of the proposed unit detailing noise level

with the application. The approved sound rating shall not exceed 72dBa. c. All repair and maintenance of an air conditioning unit will be the responsibility of the homeowner. d. Insurance on the air conditioning unit is the responsibility of the homeowner. e. Any and all damage caused by the installation and existence of the air conditioning unit is

the sole responsibility of the homeowner. f. Written approval by the AC is required prior to installation. g. A permit from the City of San Clemente is required. 3.2.4 Ductless air conditioning systems are allowed under the following conditions:

a. The approved location for a condensing unit is on the patio slab in a location to be approved by the AC.

b. The Seasonal Energy Efficiency Ratio (SEER) to be higher than 16.

c. All repair and maintenance of an air conditioning unit will be the responsibility of the homeowner.

d. Insurance on the air conditioning unit is the responsibility of the homeowner. e. Any and all damage caused by the installation and existence of the air conditioning unit is

the sole responsibility of the homeowner. f. Written approval by the AC is required prior to installation. g. A permit from the City of San Clemente is required.

3.3 Cell phone range booster - roof vent collar mounting

3.3.1 An application, including plans, specifications, location of proposed cell phone range booster, brochures and samples of colors should be submitted to the AC.

3.3.2 Any and all damage resulting from the installation and existence of the cell phone range booster is the sole responsibility of the homeowner.

3.3.3 All perpetual maintenance of the cell phone range booster is the responsibility of the homeowner.

3.3.4 The homeowner is responsible for any damage to the roof or structure caused by wind, heat, and or moisture related to the cell phone range booster.

3.3.5 The homeowner is responsible for all costs involving the cell phone range booster to allow for re-shingling and/or vent collar repairs by the association.

3.3.6 The cell phone range booster will be installed on the vent collar that exists on the roof. The length and width of the cell phone range booster shall not be greater than 10 x 10 inches.

3.3.7 The color of the cell phone range booster and mounting hardware shall be black or bronze so as to blend as closely as possible with the color of the roof and be as inconspicuous as possible.

3.3.8 If no longer in use, the homeowner shall remove the cell phone range booster and restore the roof to the original condition.

3.3.9 Written notification to the AC and the Board is required prior to installation.

3.3.10 A building permit may be required from the City of San Clemente.

3.3.11 Yagi antennas are not permitted.

3.4 Decks

3.4.1 All decks must be approved by the AC with respect to the location and the standard, type, color

and quality of material used in construction. Acceptable materials include cedar, redwood, pressure-treated lumber, composite alternative wood material or other materials to be approved by the AC. All decks must be painted to match existing trim/fence color.

3.4.2 Besides the materials described in Section 3.4.1. Clear tempered glass may be used as a fence

on decks on a case by case basis subject to AC approval. If clear tempered glass is used, the railing and post material must be metal or aluminum and must be paintable to match the existing trim color.

3.4.3 Unacceptable materials include, but are not limited to plywood sheeting, corrugated plastic or

metal, concrete blocks, rough poles, logs, slab wood or Plexiglass.

3.4.4 No deck shall impede drainage on the property to cause water flow on an adjacent property. 3.4.5 No deck shall impede the view or infringe the privacy of adjacent, contiguous or surrounding

homeowners. 3.4.6 As with all modifications, the proposed deck must be compatible or in “harmony” with the

architectural characteristics of the community, as determined by the AC on a case by case basis.

3.4.7 The size of the deck will be considered on a case-by-case basis.

3.5.2 Glass can be clear or have a light gray tint. Glass tint shall be manufactured and not done “after market." 3.5.3 All French door exterior trim and casing must be dark bronze, or match the existing trim color. 3.5.4 Glass must be clear, without mullions, and meet the adopted City of San Clemente building code. 3.5.5 No dimensional modifications are allowed to the door opening without prior written approval

of the AC and the Board. 3.5.6 A manufacturer’s specification and drawing attached to the application is required. 3.5.7 A sample of the trim is required with the application. 3.5.8 Written approval by the AC is required prior to installation. 3.5.9 Trim around French Doors is required. The trim can be wood or foam stucco and shall be

3.6 Doors – Front Entry

3.6.1 All front entry doors shall be constructed of good quality (exterior grade) wood, or embossed wood grain fiberglass, or steel.

3.6.2 Front Entry Doors may have raised or decorative panels, provided such designs are compatible

with the Architectural theme of the community. Approval of the design to be determined by the AC on a case by case basis.

3.6.3 Dutch doors are allowed. 3.6.4 Doors may have glass insets that are clear, etched or beveled. 3.6.5 Doors must be installed in a neat and workmanlike manner. 3.6.6 Doors finishes shall be either a clear stain over natural wood surfaces or painted to match

existing color palette. 3.6.7 Written approval by the AC is required prior to installation. 3.6.8 Trim around front entry doors is required. Trim can be wood or foam stucco and shall be replaced

“in-kind”.

3.7 Doors – Garage

3.7.1 The follow are the approved guidelines for replacing the original solid wood garage doors with roll-up steel doors:

a. Replacement garage doors must be of sectional, roll-up construction. The panels may be the flat panel or raised panel style. b. Doors must be 24-gauge or heavier insulation steel with a wood grain textural appearance. c. Two car garages shall have four rows of panels across and four columns of panels down. d. Single car garages shall have two rows of panels across and four columns of panels down. e. All garage doors must have 1½” or greater steel back insulation and appropriate weather

stripping. f. Paint color shall be as, per the Association’s pre-approved paint palette. g. There shall be no structural changes made in the garage door opening. h. House numbers are required on garage doors. Please see Section no. 3.1 of these guidelines for

details as to size and placement of address numbers. i. Written approval of all new garage doors is required prior to installation.

3.7.2 The following are the approved guidelines for window panels in new garage doors:

a. All requirements and specifications described in Section 3.7.1 must be met, in addition to items b thru f in this section. b. Two car garage doors shall have four long panel windows on the top row of the door. c. Single car garage doors shall have two long panel windows on the top row of the door. d. Window glass shall be translucent in clear or light gray tint. Tint shall be manufactured in the glass, not applied after market. e. Glass shall be provided by the door manufacturer. f. Approved style for window panels are shown on the following page. No mullions or decorative overlays in the glass panels are allowed.

3.7.3 Homeowners may remove the decorative wood trim on garage door. 3.7.4 Written approval by the AC is required prior to installation.

3.10.1 An application including plans, specifications, and samples of the color and materials of the

proposed project, must be submitted to the AC for approval. 3.10.2 Acceptable materials for fences include cedar, redwood, pressure-treated lumber or composite

alternative wood material, or other materials to be approved by the AC on a case by case basis. 3.10.3 Fences shall not exceed 5’6” in height. 3.10.4 Barbed wire, picket, chain link, split rail or lattice, and vinyl fences are not allowed. 3.10.5 All fences must be painted to match the existing trim. 3.10.6 Fences for rear patios may use clear tempered glass as per the City of San Clemente Building

3.11 Gas Fireplaces – Interior

3.11.1 Gas fired, wall-mounted or free-standing fireplaces are permitted under the following conditions:

3.11.2 The homeowner must submit an application with plans and specs to the AC for approval. 3.11.3 The chimney shall extend 24 inches above the shingle roof. 3.11.4. The homeowner shall be responsible for perpetual maintenance of the chimney. Any and all

damage caused by the installation and existence of the chimney is the sole responsibility of the homeowner.

3.11.5 The homeowner must obtain a building permit from the City of San Clemente, sign a deed

restriction to be prepared by Association legal counsel, and pay for the cost of preparing the necessary documents.

3.11.6 Written approval by the AC is required prior to installation.

3.12 Gates

3.12.1 Gates conforming with the overall design and construction of the fence are permitted. 3.12.2 An application, including plans, specifications and, samples of the materials and color of the proposed project must be submitted. 3.12.3 Acceptable materials for gates include cedar, redwood, and pressure-treated lumber and composite alternative wood material as approved by the AC on a case by case basis. Vinyl gates are not allowed. 3.12.4 All gates shall be painted to match the existing building trim and/or the wood fence color. 3.12.5 A solid wood gate is allowed with an approved stucco wall or the existing open wood fence. 3.12.6 Within a given 6 or 12 pack, the AC will strive to have the same design in all solid wood gates. Differences in the gates may be approved on a case by case basis by the AC. 3.12.7 All gates must be functional and not blocked by items in the patio, including plants in pots or other private decor. 3.12.8 Written approval by the AC is required prior to installation.

3.13 Hot Tubs & Spas – Exterior

3.13.1 An application, including plans, specifications and samples of the materials, color of the proposed project must be submitted to the AC. 3.13.2 The application must also include details as to the operational noise level. Equipment noise shall not exceed 72dB. 3.13.3 A permit from the City of San Clemente Building Department is required. A copy of the permit must be furnished to the AC. 3.13.4 The tub or spa must be located in an enclosed patio area. The patio area must be enclosed by an approved fence that provides adequate safety to the area and complies with local Building Code regulations. 3.13.5 Homeowner is responsible for fencing, access gate, locks and any other regulation the City of San Clemente may require. 3.13.6 The tub or spa shall be portable in nature and will not be installed by constructing it into the patio area. The tub or spa must sit on top of the patio floor. 3.13.7 The hot tub or spa must be a self-contained type, generally considered an appliance. Separate operating equipment is not allowed. All necessary equipment, such as pumps, controls, filters, electrical and heating system shall be contained in the tub or spa. 3.13.8 The tub or spa must have a cover, as recommended by the manufacturer, and must be in place at all times when not in use. 3.13.9 The tub or spa size shall be limited to a maximum of 300 gallons of water to fill. 3.13.10 The tub or spa will be furnished with equipment requiring no more than 110 volt, 20 amp electric services. 3.13.11 Draining of the tub/spa must meet the City of San Clemente Building Department requirements and may require a permit. 3.13.12 Draining the tub/spa directly onto common area or planted or greenbelt areas is strictly prohibited.

3.13.13 Any and all damage caused by the installation and existence of the hot tub or spa is the sole responsibility of the homeowner. 3.13.14 Non-compliance of any of the above guidelines or conditions will result in the cancellation of the approval and the homeowner will be required to remove the device.

3.15 Lights – Security/Motion Detection

3.15.1 Security lighting is permitted with AC approval. An application including plans showing location

for lighting and photos or brochures of proposed security light fixture is required.

Presidential Heights #1 Community Association 3.16 Mailboxes 3.16.1 An application including plans or drawings showing the location for the mailbox as well as a photo or brochure of the proposed mailbox is required. All mailboxes must be maintained in a good condition and meet all federal guidelines. 3.16.2 Mailboxes must be metal construction dark bronze in color or painted to match the approved color palette. 3.16.3 Mailboxes must be installed in a horizontal position with the opening at the top, maintained in good condition and meet all federal guidelines.

3.16.4 Through-the-wall mail slots are allowed but only if installed through a garage wall located nearest the entrance of the dwelling.

3.17 Patio Covers - Trellis Type

3.17.1 An application must be submitted to the AC, including: plans showing the location of the proposed patio cover, specifications, including dimensions and details showing how the cover will be attached to the dwelling, as well as samples and colors.

3.17.2 The application must also include an Un-Enclosed Accessory Structure Approval Form from the Orange County Fire Authority. 3.17.3 Units with a second story must install the patio cover trellis with material that is spaced to allow egress from the second level to the first level. 3.17.4 A City of San Clemente Building Permit is required. A patio cover detail is available from the City of San Clemente Building Department. 3.17.5 Trellis type patio covers will be permitted if compatible with the existing architectural design of the community. 3.17.6 Acceptable materials for trellis patio covers include cedar, redwood, and pressure-treated lumber or composite alternative wood material. Materials such as metal or alumawood are also permitted. If the material selected is metal or alumawood, the texture of the material MUST resemble wood. 3.17.7 Metal awnings are not permitted. 3.17.8 The patio cover must match the existing trim of the dwelling. 3.17.9 The patio cover must be consistent with the visual scale of the unit. 3.17.10 The patio cover must not block the view of any adjacent or contiguous neighbor. 3.17.11 The patio cover must be maintained in good condition. 3.17.12 Written approval by the AC is required prior to installation.

Allowable materials for a patio floor include brick, stone and tile. 3.19.2 As with all modifications, the proposed flooring must be compatible or in “harmony” with the architectural style of the community. 3.19.3 Method of installation including a description of any grading change is required on the application. 3.19.4 Homeowner is responsible for all repair and replacement of any damaged material. 3.19.5 Approval from the AC is required prior to installation.

Presidential Heights #1 Community Association 3.20 Rain Gutters and Downspouts

3.20.1 Removal of rain gutters and downspouts is prohibited. 3.20.2 An application detailing materials and location of rain gutters and downspouts to be added

must be submitted to the AC.

3.20.3 Rain gutters are the responsibility of the homeowner.

3.20.3 Rain gutters must be made of sturdy material as to support the weight of a ladder placed against it.

3.20.4 Replacement or additional gutters and downspouts must match the design flow function of the original gutters and downspouts.

3.20.5 The color of the gutter must match the existing trim and the color of the downspout must match the color of the stucco.

3.20.6 Any downspout discharge must not adversely affect drainage on any properties.

3.20.7 Missing, hanging or broken gutters and downspouts shall be repaired or replaced within 30 days or a penalty may be assessed.

3.20.8 Written approval from the AC is required prior to installation of new gutters or downspouts. 3.20.9 Replacement of rain gutters and downspouts do not require an AC application

3.21 Satellite Dishes and Wireless Cable Antennas

3.21.1 An application, including plans, specifications, and proposed location of satellite dish should be submitted to the AC. 3.21.2 Satellite dishes and wireless cable antennas are permitted. 3.21.3 Satellite dish must be less than 40 inches in diameter. 3.21.4 Satellite dish should not project above the visual profile of the roof, unless this requirement

would unreasonably increase the cost of the installation or prevent the homeowner from receiving an acceptable quality signal.

3.21.5 Roof installation is discouraged. 3.21.6 All cable to the dish or antenna must be painted to match the wall or trim color and should be

as inconspicuous as possible. 3.21.7 All exposed cable and wires must be secured. 3.21.8 Homeowner is responsible for all maintenance on the dish or antenna. 3.21.9 Any and all damage caused by the installation and existence of the satellite dish is the sole

responsibility of the homeowner. 3.21.10. Written notification to the AC is required prior to installation.

3.22 Security Doors and Cameras

3.22.1 An application, including plans, specifications, and a photo or brochure of the proposed security apparatus must be submitted to the AC. 3.22.2 Security doors must be ornamental in appearance, the design as approved by the AC, must be maintained in good condition. 3.22.3 Security doors must be painted to match the approved paint palette. 3.22.4 Installation must meet all fire department regulations. 3.22.5 All maintenance, including painting, will be the homeowner’s responsibility. 3.22.6 Security cameras are allowed. Cameras must be directed only to the homeowner’s personal area. Cameras pointed in the direction of common areas or courtyards are strictly prohibited. 3.22.7 Written approval by the AC is required prior to installation.

Presidential Heights #1 Community Association 3.23 Signs and Flags 3.23.1 Signs meeting the following conditions do not require an application. Signs not listed below are not permitted.

3.23.2 Real Estate Signs.

a. Only one sign advertising a property for sale or for rent may be displayed. Signs may not be larger than two square feet in size.

b. Real estate "For Sale" signs shall be removed once the unit is sold. Adding “sold” or “in escrow” is not allowed.

c. Sign must be placed within ten feet of unit property line. d. Free-standing signs are limited to five feet in overall height. e. “Open House” signs may be used under the following conditions:

1. “Open House” signs or flags may be placed on the Association common area during the day of the open house; however, the ‘”Open House” sign or flag must be removed at the end of each day.

3.23.3 Security Signs

a. Security signs shall not exceed one square foot in size. b. Security signs must be located near the dwelling entrance. c. Small signs (alarm systems) may be placed in windows.

3.23.4 Garage Sale Signs.

a. Signs used to promote a garage sale may be posted on the dwelling where the sale will occur, beginning the day before the sale and must be removed by the day after the sale.

b. "Garage Sale” signs or flags may be placed on the Association common area during the day of the garage sale; however, the “Garage Sale” sign or flag must be removed at the end of each day.

3.23.5 Contractors Construction Signs.

a. Signs may be posted by contractors only on dwellings where work is being performed by the contractor, beginning when the work commences and ending at the completion of the work.

b. Such signs may not be larger than two square feet in size. 3.23.6 Political Signs

a. Signs may not be larger than two square feet in size. b. Signs cannot be placed on common ground. c. Signs must be removed seventy-two (72) hours after the election.

3.23.7 US Flags are permitted at all times. They must be in good repair and properly hung with respect, and in accordance with the customs and etiquette of the US Flag Code

3.23.8 Only one additional flag may be displayed on the unit.

3.24 Skylights

3.24.1 An application, including, plans, specifications, location of proposed skylight, and samples of material and color must be submitted to the AC. 3.24.2 Installation of skylights are allowed under the following conditions:

a. No more than two skylights are allowed in a "B" unit including the garage. No more than four

skylights are allowed in all other units including the garage. b. The cumulative/total area of all skylight(s) shall not exceed 16 square feet, as measured inside

the curb opening. c. The mounting curb shall be constructed, as required by the City of San Clemente Building Code. d. The skylight configuration must be low profile or flat. e. If installed on a sloping roof, the light transmitting material shall be a dark gray tone and the

light transmittance shall not exceed 40%. f. If installed on a flat roof, the light transmitting material may be either clear or dark gray tone.

3.24.3 The homeowner shall have the responsibility for perpetual maintenance of the skylight. 3.24.4 Any and all damage resulting from the installation and existence of the skylight is the sole responsibility of the homeowner.

3.24.5 All skylights must be fixed in position and not openable.

3.24.6 The homeowner shall obtain a building permit from the City of San Clemente and provide a copy of the permit to the Association upon completion of the project.

3.24.7 Written approval by the AC is required prior to installation. Homeowners are advised that they will be required to enter into a covenant running with the land, and to pay for the preparation of such covenant by the Association's legal counsel. A deposit for the cost to prepare the covenant will be required prior to approval.

3.25 Solar Attic Fans

3.25.1 An application, including plans, specifications, and location of proposed solar attic fan, brochures and samples of colors must be submitted to the AC.

3.25.2 Any and all damage resulting from the installation and existence of the solar attic fan is the solar responsibility of the homeowner.

3.25.3 All perpetual maintenance of the solar attic fan is the responsibility of the homeowner.

3.25.3 The homeowner is responsible for any damage to the roof or structure caused by wind, heat, and or moisture related to the solar attic fan.

3.25.5 The homeowner is responsible for all costs involving the solar attic fan to allow for re-shingling

3.25.6 The plane of the solar attic fan will be installed parallel to the plane of the roof. The top surface of the solar attic fan shall not be higher than 10 inches above the plane of the roof. The length and width of the solar attic fan shall not be greater than 30 x 20 inches.

3.25.7 The color of the solar attic fan shall be black or bronze so as to blend as closely as possible with the color of the roof and be as inconspicuous as possible.

3.25.8 If no longer in use, the homeowner shall remove the solar attic fan and restore the roof to the original condition.

3.25.9 Written approval is on a case-by-case basis by the AC and the Board Is required prior to installation. Homeowners are advised that they will be required to enter into a covenant running with the land, and to pay for the preparation of such a covenant will be required prior to approval.

3.25.10 A building permit may be required from the City of San Clemente.

3.26 Solar Panels

3.26.1 An application, including plans, specifications, location of proposed solar panel, brochures and samples of materials and colors must be submitted to the AC. 3.26.2 Any and all damage resulting from the installation and existence of the solar panel(s) is the sole responsibility of the homeowner. 3.26.3 All perpetual maintenance of the solar panel is the responsibility of the homeowner. 3.26.4 The homeowner is responsible for any damage to the roof or structure caused by wind, heat, and or moisture related to the solar unit. 3.26.5 The homeowner is responsible for all costs involved in moving the solar unit and accessories to allow for re-shingling, painting or stucco repair by the Association. 3.26.6 The plane of the solar panel system will be installed parallel to the plane of the roof. The top surface of the mounting platform shall not be higher than 3 inches above the plane of the roof. Stilt supports are prohibited.

3.26.7 The color of the solar panel system shall be black or dark bronze so as to blend as closely as

possible with the color of the roof and be as inconspicuous as possible. Connecting tubing, pipes or conduits shall be painted the same color as the building background.

3.26.8 Non-glare sun reflector covers shall be used to eliminate projections or reflections on other units.

3.26.9 Piping shall be covered with metal and painted the same color as the stucco.

3.26.10 Homeowners must sign a covenant prepared by the Association's legal counsel confirming the obligation to maintain the panel system and to be responsible for any damage to roofs caused by the panels or their installation. A deposit for the costs to prepare the covenant will be required prior to approval.

3.26.11 If no longer in use, the homeowner shall remove all components of the solar panel system and restore the affected area to the previous condition.

3.26.12 Written approval on a case-by-case basis by the AC and the Board is required prior to installation. 3.26.13 A building permit from the City of San Clemente is required.

3.27 Sunroom Enclosures or Patio Enclosure

3.27.1 Use of the enclosed patio/sunroom as a bedroom is prohibited. 3.27.2 The homeowner must submit plans and specifications with the application to the AC for approval. 3.27.3 The homeowner must obtain a building permit from the City of San Clemente. 3.27.4 The homeowner assumes all responsibility for the maintenance of all interior and exterior glass surfaces of the enclosed Sunroom, the ceiling and all other interior walls, including those walls previously considered exterior walls.

3.27.5 The homeowner understands after completion of the Sunroom construction, the Association will assume maintenance responsibilities relative to:

a. the approved extended roof area (except glass or skylight areas) b. the painting of all exterior surfaces

3.27.6 The homeowner assumes all responsibility for any and all damage incurred by the addition of the sunroom or patio enclosure, of any water leaks in and immediately adjacent to, the glass roof and also shall be responsible for all water damage inside the dwelling resulting from such leaks.

3.27.7 Written approval by the AC is required prior to installation. Homeowners are advised that they will be required to enter into a covenant running with the land, and to pay for the preparation of such a covenant by the Association's legal counsel. A deposit for the costs to prepare the covenant will be required prior to approval.

Presidential Heights #1 Community Association 3.28 Walls – Stucco 3.28.1 An application, including plans detailing the location of the wall, specifications, materials and colors must be submitted to the AC.

3.28.2 Written approval by the AC and Board is required prior to installation.

3.28.3 Stucco walls for entry patios are allowed on a case-by-case basis on B and E units.

3.28.4 Walls must meet the following criteria:

a. Walls must be made of reinforced concrete block or wood frame on a reinforced concrete footing

conforming to San Clemente Building Department Code requirements, with stucco over concrete block or wood frame and topped with a painted wood cap on top to match the existing color palette.

b. Walls must not exceed 5’6” in height unless approved by the AC on a case by case basis between

neighbors in two story dwellings. 3.28.5 The walls must not create adverse drainage conditions. 3.28.6 Homeowner must correct any drainage problems that do arise within 30 days. 3.28.7 Wall must be finished in stucco and the color must match the existing color of the dwelling walls. The define cap must match the dwelling trim color. 3.28.8 A City of San Clemente permit is required.

3.29 Windows 3.29.1 An application, including plans, location of window, manufacturers' specifications, samples of materials and colors must be submitted to the AC.

3.29.2 All exterior windows are to be constructed of good quality (exterior grade) wood, vinyl, metal or fiberglass, with UV-rated glass.

3.29.3 Glass can be clear or have a light gray tint. Glass tint shall be manufactured and not an aftermarket product.

3.29.4 All exterior window trims or screen frames must be, dark bronze, or match the existing trim color. 3.29.5 Glass must be double paned, in compliance with the City of San Clemente building code.

3.29.6 Screens shall be installed on the outside of the windows.

3.29.7 No dimensional modifications are allowed to the window opening without prior approval of the AC and Board.

3.29.8 Bay windows are allowed if located within a fenced or walled-in patio. 3.29.9 Written approval by the AC is required prior to installation.

3.29.10 A permit by the City of San Clemente is required

3.29.11 Trim around windows is required. The trim can be wood or foam stucco and shall be replaced either “in-kind” or a rectangular/square box (90 degree corners). The trim shall be 5.5 inches in width if the trim cannot be replaced “in-kind” due to the presence of 9.5” decorative fascia board placement on some units.

3.30 Window/Slider Outdoor Shades

3.30.1 An application, including a color sample, material sample, brochure, and a plan showing the location of the shade must be submitted to the ARC. 3.30.2 Sunsetter Shade or similar may be used. 3.30.3 Housing color: Sunsetter “cream” or similar. 3.30.4 The color must be Sunsetter “Desert Sand” or similar without stripes or patterns. 3.30.5 The fabric must be smooth in texture. 3.30.6 The shade must have tracks or brackets which prevent the shade from moving in windy conditions when deployed. 3.30.7 The shade will only be permitted to be down from 6:00am to sunset and never down overnight. 3.30.8 Maintenance of the shade is the homeowner’s responsibility. 3.30.9 Written approval by the ARC prior to installation

PRESIDENTIAL HEIGHTS #1 Guidelines for Completing an Architectural Application

4.1 • Contact the Management Company for an Architectural Change or Replacement Application or download the

form the Presidential Heights I website (www.presidentialheights1.com).

• Complete the Architectural Application for a proposed project. Any exterior dimensional change must include a detailed sketch or plan, pictures or brochures, and samples of materials and colors illustrating the proposed project.

• Notification to adjacent neighbors of the proposed project, including expected start date, is required.

• Submit completed application to the Management Company for AC review. Incomplete applications will result in

unnecessary delays and/or denial of an application.

• The AC meets every month to review homeowner applications. Although it is not mandatory, an applicant’s attendance is highly recommended to answer any questions from the AC. The AC can approve an application or deny an application for nonconformity. Neighbors objecting to a project can provide their comments at the AC meeting. The AC may also table the application in order to request additional information from the applicant or their contractor.

• An application denied by the AC can be appealed to the Board by the Homeowner. The appeal must be

submitted in writing to Management Company to have it placed on a future agenda for discussion. The appeal must be made within 30 days of the date of the denial. The homeowner is encouraged to attend the Board meeting to address the reasons for appealing the decision. Neighbors objecting to a project can provide their comments at the Board meeting. The Board’ decision is final.

• Approval by the AC and the Board will enable the homeowner to apply for a building permit (if required) from

the City of San Clemente Building Department. A Building Code violation could have an effect on fire and liability

insurance claim settlements. In addition, the City has enforcement powers to ensure that corrections be made to bring the condition (addition, improvement, etc) up to current Building Code. If such corrections are not made, the City can have the illegal condition removed and/or have it done, in writing, at the homeowner’s expense.

• The Management Company will notify the homeowner by mail of the AC's and Board’s decision.

• Architectural applications that have been approved are valid for six months from the date of approval. If the

project is not started by that date, the homeowner must re-apply.

• Construction of the approved alteration shall be pursued diligently and completed no more than ninety days from the date of commencement of work.

• The homeowner is required to notify the AC in writing (through the Management Company) when a project is

completed. The AC will conduct final inspection of the completed project and close out that application. I have read and understand the Architectural Application process.
