NEW TOWING AND RECOVERY LEGISLATION PROPOSED BY APTOAs we have traveled the state and continue reaching out to our members about the state of the industry we hear a common theme: Ohio towing and recovery companies do not have a path to acquire titles to abandoned vehicles as a result of a vehicle ordered into storage by a law enforcement or public safety official. We have heard you and APTO is currently drafting and advocating for a solution to this problem!
As a quick summary, the Ohio Revised Code 4513.61(C)(1) requires law enforcement to cause a search for and send one notice by certified mail to the owner/lienholder before the sale of an unclaimed vehicle. Ohio Revised Code 4513.62 requires law enforcement provide notice of the sale/disposal of an unclaimed vehicle by advertisement or publication (e.g. newspaper) one day a week for two successive weeks. If, however, the law enforcement entity does not acquire the title to the vehicle, the towing and/or storage company is left with no recourse to acquire the vehicle’s title for proper disposal. APTO is working with legislators to deem these vehicles abandoned, following an appropriate amount of time and after notice is provided by either process (i.e. certified mail or publication). While we do not intend to modify the current process law enforcement may utilize to acquire the vehicle’s title, we aim to provide a method for a towing and storage company to attain the vehicle’s title if it is ultimately abandoned by the law enforcement entity that ordered the vehicle into storage.
We will be working hard through the end of the year and this general assembly to find a solution for the industry.
HEAVY DUTY SIZE AND WEIGHT EXEMPTIONOur second legislative priority is to make the current size and weight exemptions that APTO passed into law permanent. As part of the 2017 Transportation Budget, APTO included an amendment to allow heavy duty wreckers to get to and from jobs without the threat of penalty for exceeding size and weight limitations for towing and recovery vehicles responding to an emergency. The legislature passed this amendment on a temporary basis (it will expire in the spring of 2019) and we are working hard to make this exemption permanent. The current exemptions are as follows: • A person who is engaged in the initial towing or removal of a wrecked or disabled motor vehicle from the site of an
emergency on a public highway to the nearest storage facility;
• A person who is en route to the site of an emergency on a public highway to tow or remove a wrecked or disabled motor vehicle;
• A person who is returning from delivering a wrecked or disabled motor vehicle to the nearest site where the vehicle can be brought into conformance with the requirements of Chapter 5577 of the Revised Code, to the nearest qualified repair facility, or the nearest storage facility after removing the motor vehicle from the site of an emergency on a public highway
NEW PPI TOWING AND STORAGE RATESWe have received many calls and inquiries regarding the new Private Tow-Away Zone towing and storage rates. The new rates are now in effect and may be used by all towing and recovery companies engaged in Private Tow-Away Zone towing. As a reminder, the new maximum towing rates are $129 for vehicles under 10,001 GVW under and $216 for vehicles over 10,001 GVW. In addition, the storage rate was set at $17 and $29 a day, accordingly. RATES ARE NOW IN EFFECT!
As of June 8th, 2018 the new private property rates are as follows:
• For a vehicle with a GVWR less than 10,001the maximum towing and storage fees are $129 and $17 per day.
• For a vehicle with a GVWR equal to or greater than 10,001 the maximum towing and storage fees are $216 and $29 per day.
The PUCO has established new MAXIMUM rates for towing and storage fees for vehicles towed from Private Tow Away Zones in accordance with Ohio Revised Code Section 4513.601. These maximum rates will also be in effect for police ordered tows for vehicles left on private residential or private agricultural property within a municipal corporation, in accordance with Ohio Revised Code Section 4513.60, unless the municipal corporation has established fees for vehicle removal and storage.
All Ohio towers are advised to carefully read each applicable section of the Ohio Revised Code dealing with the newly established rates to ensure full and complete compliance with all of the new laws and rules now in effect. We have updated the APTO Ohio Towing and Recovery Compliance Manual to reflect the new established rates. The manual has all of the information you need, including compliance check lists, to ensure you will be in full compliance with the rules and laws that impact your business.

Elections will be held at the end of this year for all APTO Regional Chairs. A Regional Chair is responsible for organizing each APTO Region, holding meetings, and planning activities.
Also, two APTO Board seats will be on the ballot this year in accordance with the APTO Code of Regulations. In addition to Regional Chairs, Region 2 and Region 5 will be voting to elect a statewide APTO Board member to represent the region on the APTO Board of Directors.
Nominations for each position need to be sent to the APTO office and postmarked by November 15th. The election will be held during the 4th Quarter public board meeting in Columbus. More details on the election and the location of the event will be released soon.

APTO in ACTIONAPTO is dedicated to advocating for the Ohio towing and recovery industry and educating lawmakers, regulators and the public about the industry wherever and whenever we can. APTO representatives Ron Myers (Pine Tree Towing & Recovery and APTO Board Member) and APTO Executive Director Joe Hollabaugh attended the TRAA State Association Breakfast forum to update the industry on Ohio’s recent major legislative and regulatory victories. In addition, both represented APTO at the TRAA Spring Board of Directors and General Members meeting. The third annual APTO Happy Hour at the Florida Tow Show was another huge success! APTO headed to Vegas and Dallas! APTO was asked to give a presentation to the Police Towers of America regarding towing laws, regulations and municipal rate increases. Back in Ohio, APTO helped organize an Enforcement Seminar in Canton to help towers better understand the enforcement of new laws, rules and regulations. Thank you to the Canton Police Department, the Highway Patrol and the PUCO for a great event! We hope to provide more opportunities like this around the state so Ohio towers stay well informed. APTO hosted the second annual Miller Industries/APTO 2-Day Advanced Heavy Duty Training, one of the most elite courses for towing and recovery professionals in the country. Thank you Miller industries, Matheny Motors, Zips, East Penn, Matjack, Beacon Software/Tow Lien, American Enterprises, and all those who attended for making this great event possible! APTO has partnered with WreckMaster to hold training classes around the state. Stay tuned for additional opportunities for Ohio towers to be scheduled through the end of year.
