Petitioner Ronald Chappell, a prisoner, filed a habeas corpus petition seeking the

immediate.release from prison.. However, we find that Chappell failed to comply with R.C.

2969.25 and his petition should be dismissed.

Chappell failed to inciude a statement that sets forth the balance in his irnmate account for

eacia of the preceding six months as required by R.C.2969.25(C). Instead, in his affidavit of

waiver of the prepayment of courf, filing fees, he inalces the statement, "My inmate account has

not been over $ 10 for the .entire preceding 6 months." This statement is insufficient to fulfill the

requirements of R.C. 2969.25(C). His failure to provide the balance for each of the six months,

certified by the. institutiona,l cashier, as required under R.C. 2969.25(C)(1) requires a dismissal of

his action. The requirements of R.C. 2969.25 are mandatory; and failure to comply with them

subjects an inmate's. action to dismissal. Boles v. Knab, 129 Ohio St.3d 222, 951 N.E.2d 389,

2011-Ohio-2$59 (court of appeals did not err in dismissing inmate's petition for a writ of habeas

corpus because inmate must include a statement setting forth the balance in his inmate account

for each of the preceding six months, as certified'by the institutional cashier); State ex r°el.

Thacker v. Evans, O' Dist. No. 05CA4, 2005-Ohio-933.

Because Chappell has failed to comply with the requirements of R.C. 2969.25(C), we

hereby DISMISS his petition for a-writ of habeas corpus.

The clerk shall serve a copy of this order on all counsel of record at their last known

addresses by ordinary mail. The clerk shall serve relator by certified mail, return receipt

requested. If returned unserved, the clerk shall serve relator by ordinary mail.

PETITION DISMISSED. COSTS TO PETITIONER. IT IS SO ORDERED.
