authority by the Secretary of the Interior under the Federal Land Policy ManagementAct (FLPMA).

The case was prompted by the Obama Administration's withdrawal from mineralentry of more than 1 million acres in northern Arizona and challenges the use oflarge-scale mineral withdrawals in the absence of a legislative veto (by whichCongress intended to retain the power to disapprove unwarranted withdrawals) whenthat legislative veto power has been ruled unconstitutional.

The amicus brief focuses on the economic impact to the western states of largescale mineral withdrawals, and our nation's need to develop minerals on public landsto meet our demand for critical and strategic minerals for our economic and nationalsecurity.

Participating in the brief in addition to UMA is the Arizona Rock Products Associationand the state mining associations from Arizona, Idaho, Montana, Nevada, NewMexico, Oregon, and Wyoming.

Earthjustice Submits FOIA Request in CERCLA 108(b) Rulemaking

You will recall that the Environmental Protection Agency (EPA) in December decidednot to impose onerous and duplicative financial assurance regulations on the hardrock mining industry under the Comprehensive Environmental Response,Compensation, and Liability Act (CERCLA) Section 108(b).

In February, on behalf of Earthworks and the Idaho Conservation League,Earthjustice submitted a Freedom of Information Act (FOIA) request to the EPAseeking records related to the EPA's decision.

The request asks for all records and communications between EPA andstakeholders that may have advocated for a no-action decision, includingcongressional representatives, states, the Western Governors Association, ForestService, Bureau of Land Management, Small Business Administration and others.

Notably, the Utah Mining Association is the only state mining association mentionedin the FOIA request. Also mentioned are UMA members Rio Tinto and Materion.

Legal challenges to the EPA's no action decision are, of course, expected. Anychallenges to the final decision must be filed by May 22.

UMA Supports Repeal of the Clean Power Plan

The Utah Mining Association joined 14 other state mining associations in a letter toEPA Administrator Scott Pruitt supporting the repeal of the Clean Power Plan (CPP)in its entirety.

In the joint letter, we "endorse and incorporate the National Mining Association'scomments that more fully explain why EPA must repeal the CPP because it isunlawful, inflicts grave harm on our industry and the economy and would produce nodiscernible benefits."

UMA Calls for Expansion of Critical Minerals List

As we reported previously, the U.S. Geological Survey released a draft list of 35critical mineral commodities pursuant to Executive Order 13817, "A Federal Strategyto Ensure Secure and Reliable Supplies of Critical Minerals." The Utah MiningAssociation joined two efforts to expand the draft list.

First, we submitted a joint letter with the Copper Development Association, Copper &Brass Fabricators Council, and the state mining associations Arizona, Montana andNew Mexico urging the inclusion of copper in the Secretary of Interior's list of criticalminerals.

Second, the Utah Mining Association endorsed a letter from the CongressionalWestern Caucus encouraging the addition of copper, molybdenum, gold, zinc, silver,aggregates, nickel, lead, and certain fertilizer components such as phosphate andpotash to the list.

We believe all of the above commodities meet the three criteria of a critical mineralas defined by the Executive Order: 1) a non-fuel mineral or mineral material essentialto the economic and national security of the United States; 2) the supply chain ofwhich is vulnerable to disruption; and 3) that serves an essential function in themanufacturing of a product, the absence of which would have significantconsequences for the U.S. economy or national security.

Our 7th Annual Mining & Manufacturing Safety Conference held earlier this monthwas a resounding success. The Utah Mining Association partnered with theManufacturers Association to present this conference focusing on important safetyissues within the mining and manufacturing industries.

NIOSH Mine Safety & Health Technology Award

Applications are now being accepted for the 2018 National Institute of OccupationalSafety & Health (NIOSH) Mine Safety and Health Technology Award.

The award recognizes a mine or company for "extraordinary achievements inapplying health and safety technology in innovative ways, above and beyondmandatory requirements." Awards will be presented in the Metal Sector and the CoalSector.

Final Workplace Examination Rule Published

The Mine Safety & Health Administration (MSHA) this month published the final ruleon Examinations of Working Places in Metal and Nonmetal Mines.

Throughout May and the first week of June, MSHA will hold a series of stakeholderpublic meetings on the final rule. You may view the list of public meetings here.

The rule is effective June 2, 2018.
