Section 1 – Applications Received
Inspection of licence applications can be requested under the provisions of Regulation 9 of the Goods Vehicles (Licensing of Operators) Regulations 1995 by anybody who holds statutory objector status. Applications may be inspected free of charge at the Office of the Traffic Commissioner in Leeds by any person who carries written authorisation to act in that capacity.
Objections against published applications may be made in writing by a Chief Officer of Police, a local authority, a planning authority or a prescribed trade union or association within 21 days of the date on which notice of an application is published in Applications and Decisions. Objections must be made either on the grounds that any of the requirements listed in Section 13 of the Goods Vehicles (Licensing of Operators) Act 1995 are not met and/or that a nominated operating centre will be unsuitable for use as such. A copy of the objection must be sent by the objector to the applicant at the same time that it is sent to the Traffic Commissioner. The onus of proof in terms of the grounds on which an objection is lodged lies with the objector.

Classification of Operator Licences – There are three classes of licence:
A Restricted (R) licence authorises the use of a goods vehicle on public roads in Great Britain for the carriage of the licence holder’s own goods in the course of his trade or business. The licence holder cannot carry goods for other people for hire or reward;
A Standard National (SN) licence allows the licence holder to carry both his own goods and goods for other people for hire or reward, on public roads in Great Britain. He can also carry his own goods on journeys abroad;
A Standard International (SI) licence allows the licence holder to carry both his own goods and goods for other people for hire or reward. These activities can be undertaken both in Great Britain and on international journeys.

Section 3 – Schedule 4 Applications
Schedule 4 to the Goods Vehicles (Licensing of Operators) Act 1995 allows, in certain situations, the transfer of operating centres from one existing licence to either another existing licence or as part of a new licence application. A range of qualifying criteria has to be met, with approval at the Traffic Commissioner’s discretion. An important consideration in the process is any environmental history relating to the subject operating centre or any potentially adverse environmental impact resulting from the transfer. Legislation prevents any statutory objection against the Schedule 4 element of an application.

New Applications (Section 3.1): where the Traffic Commissioner has given a direction that the provisions of paragraph 2 of Schedule 4 shall apply, objections may only be lodged against the published application under Section 12(1)(a) of the 1995 Act, disregarding the suitability of the operating centre for use as such by the applicant as set out in Section 13(5)(d) of the Act.

CONFIRMATION OF AN ORAL DECISION
1.Subject to the undertakings set out below the licence will continue but is curtailed indefinitely to two vehicles with effect from the 2nd January pursuant to Section 26(1) (a), (b), (c)(iii), (e) and (f) of the Goods Vehicles (Licensing of Operators) Act 1995.
2.The operator is advised that he may apply for an increase in the authorisation of two vehicles when he can demonstrate full compliance in four consecutive audit reports submitted in accordance with Undertaking 10 set out below.
3.Mr Campbell, solicitor acting for the operator made an application for me to defer the decision to curtail the licence pending advice to his client regarding appeal. I agreed to defer commencement of the curtailment to the 2nd January 2014. If by that time the operator has appealed a formal Application for Stay Pending Appeal will be necessary if those advising the operator consider that course appropriate.
4.For the avoidance of doubt there is no deferment of the undertakings given by the operator to day which take immediate effect. The operator is warned that a breach of undertakings entered into at a Public Inquiry is a very serious matter which is likely to adversely affect his fitness to hold an operator’s licence.
UNDERTAKINGS GIVEN BY THE OPERATOR
1.That henceforth the operator will continuously employ a qualified CPC holder as his Transport Manager.
2.That within 28 days the operator will produce to the Office of the Traffic Commissioner copies of signed Contracts of Employment for each of his drivers which are specifically linked to the Instructions in the Driver’s Handbook and to a formal written Disciplinary Procedure.
3.That safety inspections will be pre-planned and never more than four weeks apart. The safety inspection reports will be fully and properly completed and be retained for 2 years.
4.That the Maintenance Agreement and driver defect documentation will be amended to ensure that the use of vehicles which have a safety defect are prevented until repair is properly effected. Copies of amended documentation will be forwarded the Office of the Traffic Commissioner within 28 days.
5.That both the maintainer and the operator will keep a forward planning chart setting out relevant maintenance information relating to the vehicles.
6.That there will be a daily “nil” defect reporting system maintained by the drivers. Defect reports will show rectification and all reports will be retained for 2 years.
7.That the operator will undertake a random audit of one driver per week to ensure the drivers are undertaking their walk round checks correctly The findings will be recorded, kept for 2 years and made available to staff from VOSA or the Office of the Traffic Commissioner on request.
8.That all authorised vehicles will have a rolling road brake test every 8 weeks not including the MOT. The results will be recorded, attach to the appropriate safety inspection sheet and kept for 2 years
9.That all authorised vehicles will have a thorough and effective pre-MOT inspection. Records will be kept for 2years.
10.That maintenance systems, maintenance documents, safety inspection records, tachographs and drivers hours records and procedures will be audited by a recognised trade body or other acceptable organisation every four months with the first audit being completed by 31st March 2014. The chosen auditor is to be notified to the Office of the Traffic Commissioner within 28days. The audit reports will be prepared, acted
27upon, and retained for 2 years. A copy of each audit report will be forwarded to the Office of the Traffic Commissioner within 14 days of its receipt together with the operator’s proposals for implementing its recommendations.
