Personal information from international students is collected during enrolment in order to meet The Academy’s obligations under the Education Services for Overseas Students Act 2000 and the National Code of Practice for Providers of Education and Training to Overseas Students 2018, and to ensure student compliance with the conditions of their visa and their obligations under Australian immigration laws generally. The authority to collect this information is contained in the Education Services for Overseas Students Act 2000 (‘ESOS Act 2000’), the Education Services for Overseas Students Regulations 2001 and the National Code of Practice for Registration Authorities and Providers of Education and Training to Overseas Students 2018 (‘National Code 2018’). Information collected about you on this form and during your enrolment can be provided, in certain circumstances, to the Australian Government and designated authorities and, if relevant, the Tuition Assurance Scheme and the ESOS Assurance Fund Manager. W Terms and Conditions

1. ATTENDANCE REQUIREMENTS

The Academy will systematically monitor, record and assess students’ course progress for all students enrolled in a vocational course with The Academy. Students enrolled at SELA into an ELICOS course are required to maintain a minimum of 80% attendance in their course of study. The Academy will be proactive in implement The Academy’s International Strategy in notifying and counselling students who are at risk of failing to meet course progress requirements and attendance requirements and will report students who have breached the course progress requirements and attendance requirements as per Standard 8 of the National Code 2018.

2. OVERSEAS STUDENT HEALTH COVER (OSHC) All international students are required to pay Overseas Student Health Cover (OSHC) and maintain cover for the full duration of their visa. It is also the responsibility of the student to check the conditions of this health cover.

3. FEES A non-refundable Enrolment fee of $250.00 are required at the time of enrolment. Students who fall behind in the payment of their fees or fail to pay their tuition fee on the due date, may be charged a late payment fee of $100.00 after 7 days of the due date. Should the tuition fee still remain outstanding after 4 weeks, an additional $100.00 will be added to the account? If the tuition fee still remains outstanding, then the student will be reported to the debt collector and to DoHA for being non-financial.

4. REFUNDS AND CANCELLATION Cancellation Prior to Your Scheduled Course or Package Commencement Date a) When The Academy receives written notification of cancellation 28 days or more before your originally accepted course or package

commencement date, a refund equivalent to 75% of the tuition fees will be made. Please note that offers for deferred commencement dates do not extend the period where a refund of 75% can be claimed.

b) When The Academy receives written notification of cancellation less than 28 days before your originally accepted course or package commencement date, a refund equivalent to 50% of the tuition fees will be made. Please note that offers for deferred commencement dates do not extend the period where a refund of 50% can be claimed.

c) If your Australian visa application is refused, The Academy will refund all tuition fees less the lesser of 5% of the total amount of pre-paid tuition fees or the sum of $500 after receiving evidence from the relevant Australian authority that your visa application was refused. Any tuition received whilst awaiting visa approval must be paid for on a proportionate basis.

Withdrawal on or After Your Scheduled Course or Package Commencement Date a) No refund of tuition fees will be made after your scheduled course or package commencement date. b) In case of withdrawal from a commenced course or package, you must give The Academy four weeks’ written notice prior to your next instalment

due date or pay four weeks in lieu of notice. The total number of academic weeks delivered to you will form part of the withdrawal fee calculation.

c) Any amounts that fall due prior to your withdrawal being submitted must be paid in full at the time your withdrawal is processed. For example, if a tuition payment or late fee is due this must be paid in full at the time you submit your withdrawal.

d) Apart from refusal of your initial visa prior to course commencement, no refunds or credits will be provided for situations where your visa or eCoE status prevents you from studying. This includes time missed where you have been reported for breaching a visa condition, irrespective of whether your visa is subsequently not cancelled, and no refunds will be provided in student default situations.

e) You must complete a minimum of six months of your principal course (being the highest qualification level in a package of courses) before you will be able to change to another provider.

Cancellation Due to Unmet Entry Requirements It is essential that applicants understand and are capable of meeting all course entry requirements as specified in the conditions of offer in this document. Where a release letter is unable to be provided all tuition fees will be refunded less the Enrolment Fee. Our standard refund policy applies in all other circumstances where entry requirements are not met. Homestay and airport pick-up fees a) The Homestay Placement Fee is non-refundable. b) If you cancel your homestay or wish to leave your homestay early, you must give The Academy two weeks’ notice or pay two weeks rent in lieu of

notice. c) If you cancel your airport pick-up with less than 24 hours’ notice, there will be no refund payable. If your flight details change, you must notify

The Academy at least four hours before the original arrival time or pay an additional airport pick-up fee. d) If your application for an Australian visa is refused, The Academy will refund all homestay rent and airport pick-up fees after receiving evidence

from the relevant Australian authority that your visa application was refused. Provider Default Under section 46A of the Education Services for Overseas Students Act 2000 (‘ESOS Act’), The Academy is in default in relation to an overseas student or intending overseas student and a course at a location, if

The Academy fails to start providing the course to the student at the location on the agreed starting day; or

After the course starts but before it is completed, it ceases to be provided to the student at the location; and the student has not withdrawn from the course before the default day.

Under section 46B of the ESOS Act, The Academy must notify the Secretary and TPS Director (via PRISMS) in writing of the provider default within 3 business days after the default occurring. Under this section The Academy must also notify students in writing in relation to whom it has defaulted. Under section 46D of the ESOS Act, The Academy will have 14 days after the day of the default (the provider obligation period) to satisfy its tuition protection obligations to the student as set out in this section.

Under section 46F of the ESOS Act, The Academy will have 7 days after the end of its obligation period to give a notice to the Secretary and the TPS Director of the outcome of the discharge of its obligations. This notice must comply with the requirements of section 46F of the ESOS Act. Student Default Under section 47A of the ESOS Act, an overseas student or intending overseas student defaults, in relation to a course at a location, if: the course starts at the location on the agreed starting day, but the student does not start the course on that day (and has not previously

withdrawn); or

the student withdraws from the course at the location (either before or after the agreed starting day); or The Academy refuses to provide, or continue to provide the course to the student at the location because of one or more of the following:

o the student failed to pay an amount payable to the provider for the course;

o the student breached a condition of his/her student visa;

o misbehaviour by the student (Note: the student is entitled to natural justice under subsection 47A (3) of the ESOS Act.

If the student or intending student defaults then The Academy must provide a refund in accordance with the requirements under either section 47D or 47E of the ESOS Act, depending on which section applies to the circumstances of the default situation.

5. MISCELLANEOUS a) The Enrolment Fee is non-refundable. b) Overseas Student Health Cover is non-refundable once you have commenced your course or package of courses. c) Course materials fees including text books for ELICOS courses are non-refundable once your course or package has commenced. d) Requests for refunds must be made in writing to the Registrar by email to [email protected] or mail to Level 2, 401 Sussex Street, Sydney,

NSW 2000 as soon as practicable and should include any relevant documentary evidence. Refunds will be processed within 28 days after receiving your written request and made to the payment source, i.e. directly to you or your nominated agent.

e) This agreement and the availability of complaints and appeals processes does not remove your right to take action under Australia’s consumer protection laws.

Refund process Refund applications for full or partial refunds must: a) Be made in writing on the Refund Request Form b) Be accompanied with supporting documents setting out the reasons for the application c) Be forwarded to [email protected] or in person to the reception This agreement and the availability of complaints and appeals processes, does not remove the right of the student to take action under Australia’s consumer protection laws. The refund policy is subject to review from time to time. 6. COMPLAINTS The Academy is committed to providing all its students the best possible environment in which to study. The Academy however understands that there may be instances where there may be dissatisfaction and acknowledges that the cause(s) must be addressed and rectified immediately. In such instances, The Academy will invite feedback from the dissatisfied party so that a resolution can be reached which will provide The Academy with an opportunity to review its policies and practices for future continuous improvement purposes. The Academy’s complaint management system is intended to: a) enable us to respond to issues raised by people making complaints in a timely and cost effective way b) boost public confidence in our administrative process, and c) provide information that can be used by us to deliver quality improvements in our products, services, staff and complaint handling. There is no cost for lodging a complaint. All complaints will be treated with integrity and privacy will be maintained at all times as per the Privacy Act 1988. The complaints process will give the student the opportunity to formally present his or her case; and be accompanied or assisted by a support person. 7. APPEALS The purpose of the Appeals Policy is to ensure that The Academy will ensure that it will address all students’ appeals in a way that contributes to The Academy’s supportive and fair environment and is consistent with the principles of fairness, equal opportunity and natural justice. There is no cost for lodging an appeal. All appeals will be treated with integrity and privacy will be maintained at all times as per the Privacy Act 1988. The appeals process will give the student the opportunity to formally present his or her case; and be accompanied or assisted by a support person. 8. STUDENT CODE OF CONDUCT Students are expected to adhere to The Academy’s policies and procedures at all times. The Academy reserves the right to suspend or expel students for serious breaches of The Academy’s policies and procedures. No refunds will be made in such cases. Everyone associated with The Academy have the same rights. Therefore, any form of harassment, bullying, victimization and discrimination will not be tolerated. Students should contact the Student Services Coordinator if they feel they are a victim of bullying and harassment. The Student Services Coordinator might escalate it to the Principal who will establish a formal inquiry if the complaint is serious or might refer it to external authorities within Australia.

9. ACADEMIC PERFORMANCE/ELIGIBILITY FOR AWARD QUALIFICATIONS – VOCATIONAL STUDENTS Qualifications are awarded to students who can demonstrate competency in all units of their course of study, where full fees for the qualification have been paid. The Academy is required to report Student Visa holders for unsatisfactory course progress to the Department of Home Affairs (DoHA). Your performance is deemed unsatisfactory where you have failed 50% or more of units in a term across two consecutive terms. Refer to our Course Progress Policy which is available from our website www.sbta.com.au

10. CHANGE OF COURSE OR SHIFT Course and shift change requests incur an administrative fee and are subject to availability. Although The Academy will endeavour to satisfy a student’s choice of shift wherever possible, the ultimate choice of shift, the timing of a shift change and the availability of shifts remains at the sole discretion of The Academy, and your shift may be subject to change. 11. LEAVE Regular holidays are scheduled for vocational students throughout the year. Requests for leave outside the set holidays will incur a fee and will only be approved under compassionate and compelling circumstances only upon receipt of a Leave Application form with attached evidence for the reason for applying for leave. Students will need to extend their course at additional expense to cover all classes missed. Fees continue to be payable whilst on leave. English language students are entitled to one week’s leave for every ten weeks studied, up to a maximum of four weeks. Leave requests must be received in writing at least one full working day prior to the first day of leave requested.

12. OVERDUE FEES Should fees be overdue more than seven days you will incur a late payment penalty and will not be permitted to attend classes or appear for assessments, nor shall The Academy grant any administrative requests. The Academy reserves the right to cancel your enrolment, notify Department of Home Affairs (DoHA) and take legal action where fees remain overdue, and pass your personal information and debt details on to a credit reporting and/or debt collection agency. All recovery costs will be charged to you in addition to the outstanding fees.

13. CREDIT TRANSFER (CT)/ RECOGNITION OF PRIOR LEARNING (RPL) Applications for credit transfer/ recognition of prior learning will only be accepted prior to course commencement and will incur a cost. 14. VARIATIONS TO PRODUCTS AND SERVICES The Academy reserves the right to alter its fees and class schedules, amend its policies and procedures, prerequisite conditions for admission to The Academy and any other matter or detail pertaining to the provision of the course at any time. As The Academy operates within the Australian National Training Framework, The Academy reserves the right to change, alter or amend curricula, syllabi, course structure and length as required due to changes within the Training Package.

15. CHANGE OF ADDRESS As per the National Code 2018, you are obliged to notify The Academy of any change of address, including email address, during your course of study. Important information, including warnings regarding breaches of policy and procedures or visa conditions, may be sent to the email address and mobile telephone number that you supply. You will be in breach of your visa conditions and will be reported to DoHA if you fail to notify The Academy of any change of address, including email address and phone number.

16. RECORDS MANAGEMENT The Academy will retain records of all written agreements, as well as receipts of payment made under the written agreement, for at least two (2) years after the overseas students ceases to be an accepted student which is consistent with the record keeping requirements under section 21 of the ESOS Act and 3.04 of the Education Services for Overseas Students Regulations 2001. The Academy will retain records of any AQF certification documentation that has been issued for a period of thirty (30) years. All student records are stored securely in the Student Management Systems which is protected by industry standard encryption and protection and is constantly maintained to the industry standards.

17. DISCLAIMER The Academy accepts no responsibility whatsoever for any loss of, or damage to, property or the financial status of a student.

18. WAIVER A waiver of any term or condition herein shall not be effective unless in writing and signed by an authorised officer of The Academy.

Appendix A Disability supplement

Introduction

The purpose of the Disability supplement is to provide additional information to assist with answering the disability question.

Disability in this context does not include short-term disabling health conditions such as a fractured leg, influenza, or corrected physical conditions such as impaired vision managed by wearing glasses or lenses.

Hearing/deaf Hearing impairment is used to refer to a person who has an acquired mild, moderate, severe or profound hearing loss after learning to speak, communicates orally and maximises residual hearing with the assistance of amplification. A person who is deaf has a severe or profound hearing loss from, at, or near birth and mainly relies upon vision to communicate, whether through lip reading, gestures, cued speech, finger spelling and/or sign language.

Physical A physical disability affects the mobility or dexterity of a person and may include a total or partial loss of a part of the body. A physical disability may have existed since birth or may be the result of an accident, illness, or injury suffered later in life; for example, amputation, arthritis, cerebral palsy, multiple sclerosis, muscular dystrophy, paraplegia, quadriplegia or post-polio syndrome.

Intellectual In general, the term ‘intellectual disability’ is used to refer to low general intellectual functioning and difficulties in adaptive behaviour, both of which conditions were manifested before the person reached the age of 18. It may result from infection before or after birth, trauma during birth, or illness.

Learning A general term that refers to a heterogeneous group of disorders manifested by significant difficulties in the acquisition and use of listening, speaking, reading, writing, reasoning, or mathematical abilities. These disorders are intrinsic to the individual, presumed to be due to central nervous system dysfunction, and may occur across the life span. Problems in self-regulatory behaviours, social perception, and social interaction may exist with learning disabilities but do not by themselves constitute a learning disability.

Mental illness Mental illness refers to a cluster of psychological and physiological symptoms that cause a person suffering or distress and which represent a departure from a person’s usual pattern and level of functioning.

Acquired brain impairment Acquired brain impairment is injury to the brain that results in deterioration in cognitive, physical, emotional or independent functioning. Acquired brain impairment can occur as a result of trauma, hypoxia, infection, tumour, accidents, violence, substance abuse, degenerative neurological diseases or stroke. These impairments may be either temporary or permanent and cause partial or total disability or psychosocial maladjustment.

Vision This covers a partial loss of sight causing difficulties in seeing, up to and including blindness. This may be present from birth or acquired as a result of disease, illness or injury.

Medical condition Medical condition is a temporary or permanent condition that may be hereditary, genetically acquired or of unknown origin. The condition may not be obvious or readily identifiable, yet may be mildly or severely debilitating and result in fluctuating levels of wellness and sickness, and/or periods of hospitalisation; for example, HIV/AIDS, cancer, chronic fatigue syndrome, Crohn’s disease, cystic fibrosis, asthma or diabetes.
