1 INTRODUCTION This appendix to the Addendum EIAR provides the details of the public participation process conducted for the notification of the release of the Addendum EIAR for the proposed regional General and Hazardous Waste Management Facility (GHWMF) in the Eastern Cape. The EIA process provides for the involvement of Interested and Affected Parties (I&APs), in ways that allow them to voice their opinions and concerns, at an early stage of the proposed project, and as the project progresses to maturity. Such engagement is critical in the EIA, as it contributes to a better understanding of the proposed project among I&APs, and raises important issues that need to be assessed in the EIA process. There are three key steps within the overall public participation process. These include -

Notifying I&APs of the EIA process;

Making provision for I&APs to review and comment on all reports before they are finalised and submitted to the competent authority; and

Making a record of comments and concerns submitted, and responses from the developer and the EAP, available to I&APs.

Each of the above mentioned steps, which comprised the September 2016 public participation process of the proposed development, are discussed below



2 NOTIFYING I&APS As stipulated in Section 41 (6) of the EIA Regulations (GN R982) which states that, “the person conducting a public participation must ensure that-

a) Information containing all relevant facts in respect of the application or proposed application is made available to potential interested and affected parties; and

b) Participation by potential or registered interested and affected parties is facilitated in such a manner that all potential or registered interested and affected parties are provided with a reasonable opportunity to comment on the application or proposed application”

Below is the process followed to ensure that the above has been complied to.

2.1 Release of Addendum EIR and Integrated Application Final Draft Addendum EIR and Integrated Application were made available for public review and comment for a 30-day period from 23rd September and 24th October 2016. 2.1.1 Written notices Registered I&APs and members of the Coega Development Corporation Environmental Liaison Committee (ELC) were informed by e-mail message and SMS about the availability of the above documents for review and comment. 2.1.2 Newspaper Notices Members of the general public were informed about the availability of the above documents for review by means of a notice – copy below - published in the Herald on 22nd September 2016.

2.2 Site Notices An electronic notice was placed onto the CDC’s e-notice board in their head office foyer – copy of notice below - for the duration of the public review and comment period.

Please ensure that I am registered as an I&AP for this project and that I receive copies of all future documents associated with the EIA process. My few comments on the Addendum Report / Integrated Application are as follows: 1. While the Aloes HH facility has recently been extended, considerably increasing the lifespan of that facility, having an approved alternative / future HH waste site is good planning practise. In addition, Condition 2.12 of CDC's 2002 RoD for the establishment of the Coega IDZ states: "CDC must facilitate the establishment of the necessary licensed general and hazardous waste disposal sites ...".

Thank you for the comments you have provided, please see response to your comments below: It's clear in the Addendum that a combination of factors has extended the lifetime of the Aloes facility, and as a consequence have pushed the date by which the proposed new facility will be required to some as yet undefined time in the next 20 years or so. One of the recommendations in the Addendum is for continual communication between the operators of the Aloes facility and the CDC in respect of the remaining lifetime of the Aloes facility. Waste beneficiation isn't specifically mentioned in the documents for review, but any initiative that serves to reduce the volumes of waste that requires treatment or disposal - the bottom level of the waste management hierarchy - will push out the date by which the new facility will be required. Waste beneficiation sensu the NMBM Integrated Waste Management Plan 2016-2020 will have consequences for the time when the proposed new facility is required to be in operation, but it doesn’t have consequences for this application, which will be submitted to DEA as soon as all necessary

2. It is obvious that a landowner agreement with PPC is a critical requirement. 3. Does the NMBM's recent Waste Beneficiation Project and any of their future waste management plans have any consequences for this application? Their input as a key stakeholder is presumably required. 4. I am in full support of an extended validity period of the Environmental Authorisation if the application is successful given the uncertainty of when a new facility will be required - with the main emphasis being to ensure that there is always a HH facility available in the region. However, given that there are likely to be future changes in legislation and perhaps other parameters / conditions affecting the proposed site prior to design and construction commencing, the EA needs to take a precautionary approach and updates to the EMPr / updates to studies / public comment / amendments to the EA conditions may be required if there is an extended period prior to the project commencing.

The recommendation in question was made by the Eastern Cape Provincial Air Quality Officer as a member of the Coega ELC. The purpose of the paragraphs that follow in the Addendum is to respond to the recommendations.

Addendum, page 20, section 4.7.1 - Greenhouse gases, last paragraph: A Pollution Prevention Plan must be prepared.

This is recommended in the Addendum in respect of GHG emissions. However, it must be noted that the preparation of such a plan is not obligatory in terms of the regulations, and that the relevant regulations are currently only in draft form.

Addendum, page 23, Upgrading the Motherwell to Addo Road (R335): The road must be upgraded before the Waste Facility is commissioned.

This is strongly recommended in the Addendum (page 22, section 4.10). However, it must be noted that DWA has instructed that the question of the upgrade of the road and the authorisation of the waste facility must be kept separate.
