Response to Comments Issued by EEPAC following review of the London RT SLSR (WSP, 2017)

1 Kentucky coffee on campus “According to 2012 NHIC data, naturally occurring Kentucky Coffee trees have only been documented at 20 locations in southwestern Ontario, and none are recorded for the City of London and surrounding area (MNRF, 2015d). Consultation with the MNRF will be necessary to discuss how the Endangered Species Act, 2007 applies to the Kentucky Coffee trees noted during the site investigation. Naturally occurring trees are protected under the Endangered Species Act, 2007, while planted trees are not.” (SLSR report) I would add, although it is outside the study area, I found Kentucky Coffee Tree ponds near the London Hydro site overlooking the weir near Labatt’s.

Additional Kentucky Coffeetrees were found within the study area during the 2017 field investigations. Some of these trees were young and appear to have seeded naturally from nearby mature trees. A meeting with MNRF confirmed that both planted and naturally seeded Kentucky Coffeetrees are protected under the ESA. Habitat within 20 m is considered critical habitat and is also protected. Continued consultation with the MNRF will be necessary at the detailed design phase when the footprint of disturbance has been delineated. Measures to mitigate impacts to this species are provided in the EIS report, but will need to be confirmed with the MNRF during detailed design.

2 Plants near Ponds - The 2015 report (North-South Environmental Inc.) found 28 ELC communities, and 346 species of plants, including 3 that are provincially rare and 3 that are regionally rare. Two of the regionally rare plants, Watershield (Brasenia schreberi) and Sweetflag (Acorus americana) were recorded within the area identified as Site 6 in this study.

The plants in question appear to have been observed beyond the area to be impacted as part of the proposed infrastructure works. These species were not observed by WSP during the field investigations carried out at Site 6. Nevertheless, it has been recommended that the area of impact at Site 6 be surveyed during the summer prior to construction to identify and transplant regionally rare species, if present.

3 Birds (Swifts and Swallows) near campus sites 3A

and 4 (see appended material from Swift Watch).

Additional comments and information presented

by Swift Watch with respect to foraging, roosting,

and nesting were reviewed and considered in the

preparation of the EIS.

Additional surveys for Barn Swallows, Cliff Swallows and Chimney Swifts

(and suitable nesting habitat) were completed during the 2017 field season.

Methodology is outlined within Section 4.3.1 and results are summarized in

Section 5.2.1 (following Section 5.2.1.7).

Cliff Swallows were found nesting on the University Bridge at Site 4. Nesting

by SAR bird species was not observed. Based on 2017 observations and the

preliminary alternatives evaluated in this EIS, direct impacts to Barn

Swallows and their nesting habitat are not anticipated. However, due to the

long implementation phase of this project, WSP has recommended that

additional surveys be completed prior to alteration or construction to verify

occupancy by at-risk species to ensure that appropriate measures under the

ESA are taken.

Surveys were completed to identify the presence of suitable uncapped

chimneys in areas along the RT corridors where the proposed infrastructure

extends beyond the ROW into private lots. Expropriation and demolition of

buildings may impact Chimney Swift nesting habitat where suitable chimneys

are present. WSP has recommended that additional surveys be completed at

detailed design to confirm presence/absence if demolition is to occur at

properties with suitable chimneys.

Potential impacts and recommended mitigation measures for SAR species are

provided in Appendix G, along with requirements for additional work or

consultation, as anticipated.

Consultation with the MNRF will be necessary to determine future

requirements for these species.

4 Why is EIS for Mud Creek SWM EA not

included? CH2M has worked on this and the ESR

is about to be placed on the Public Record. This is

a project of the City’s Stormwater Management

group.

The final Environmental Study Report for the Mud Creek Stormwater

Management EA was obtained and reviewed. Relevant information was

included in the existing conditions sections of the EIS report, where Site 1 was

discussed.

A meeting was held with CH2M staff and the RT project team on November

27, 2017 to better understand the timing of the works under both projects, and

the anticipated environment that would be present at the time the RT works

are undertaken (2025 to 2028). The discussion at this meeting informed the

impact assessment, mitigation and net effects discussion for Site 1.

Any impacts that cannot be avoided should have

compensatory mitigation as per OP Policy 15.3.3

The full extent of the impacts on the Westminster Ponds ESA / PSW / ANSI

will be determined at detailed design. The alternative presented and evaluated

for the purpose of the EIS is considered preliminary and is subject to change.

Within the southern portion of the site, adjacent to the Dry-Fresh Deciduous

Woodland (WODM4) and Cattail Mineral Shallow Marsh (MASM1-1) which

is part of the PSW, the infrastructure is located within the ROW; but to the

north, adjacent to the Buckthorn Deciduous Shrub Thicket (THDM2-8)

portions of the multi-use trail encroach into the ROW. Grading is required to

achieve a suitable cross-section and encroachment is most significant within

the southern portion of the Site (Figure 33). Efforts were made to reduce

encroachment into the natural area; however, encroachment could not be

completely avoided.

Mitigation in the form of habitat replacement at greater than one-for-one land

area will be required for the loss of wetland and woodland habitats within the

ESA. Further, due to the significance of this area, additional compensation has

been recommended to offset impacts to the function of this natural area.

River EA. It may be too late for any Medway surveys.

c) Threatened fish in Medway near sites 3 and 4 (Black Redhorse, Silver Shiner) Wavy-rayed Lampmussel at Sites 2, 3, 4 and 5.

a) Passive mussel searches were completed in September 2017 at those sites where potential in-water works were anticipated (Sites 3 and 5) to confirm potential presence of SAR mussels within the anticipated impact areas. Searches could not be completed at Site 4 as water levels were too high. Passive searches were not conducted on those sites where in-water works were not anticipated to eliminate any un-necessary disturbance to SAR mussels potentially in the area of the road crossings. Searches were completed at Site 7 even though in-water works were not anticipated as access was easy and there have not been any searches previously carried out by other agencies to WSP’s knowledge. Fish community sampling was also completed at Site 7.

b) Available data from the One River project was reviewed and included in the EIS; however, it only contained data for fish sampling.

8 Northern Map and Spiny Softshell turtles were photographed by a citizen photographer in 2013 in the stretch between Western Road and west to just past the bridge opposite the entrance to Windermere Manor off Windermere Road (western edge of Site 3A/3B). The spiny softshell was on a rock just west of that second bridge on the north side. A photo with both turtles was taken about 2/3 of the way westward between the two bridges (outside the study area). According to the photographer, there were there most of the summer. (see thread at the end of this page showing the communication with the City, Dillon Consulting and the species at Risk biologist at the UTRCA.

Thank you for the additional data. Through continued consultation with MNRF and UTRCA, the presence of Northern Map Turtle, Spiny Softshell and Snapping Turtle has been considered as part of the impact assessment. All three species are thought to occur at Sites 2, 3, 4 and 5.

9 Changes to ELC. Section 5.1.3.7 of the SLSR notes a change to the forested polygon along Wellington Road from CUT to WODM4-4. The City should update its records and Management Zone information for this section of the Ponds. Mixed dry woodlands do not even appear on the 2006 list prepared by Bergsma and DeYoung. Does this mean it is a locally unusual ecosite for London?

Further assessment of the ELC polygons at Site 6 were completed during 2017. These new polygons and vegetation communities/ecosites are shown on Figure 24.The WODM4-4 unit was reverted to WODM4 – Dry-Fresh Deciduous Woodland. The northern portion of the unit was identified as THDM2-8 – Buckthorn Deciduous Shrub Thicket. Descriptions and rationale for newly assigned codes are provided in the EIS (Section 5.1.3). ELC field sheets are provided in Appendix D.

10 6.5.3 AQUATIC SAR AND SCC HABITAT POTENTIAL The reaches of the Thames and North Thames Rivers in the Study Area have been designated by Fisheries and Oceans Canada (DFO) as “under consideration for listing” for protection under the Species at Risk Act (SARA) (Conservation Ontario, 2014). The fish species considered for protection in these reaches include Pugnose Minnow and Silver Shiner. Silver Shiner is also listed under the Ontario SARO list. Mussel habitat is also found within the Thames River, including at the crossing on Wellington Road (Figure 11). Note that along the reach in the Study Area, only areas that meet the criteria for critical habitat are protected.

The reason for listing this section of the report within the comment document was unclear. As part of the EIS, continued consultation with MNRF and DFO was completed to better understand the species and critical habitats that are to be considered at each site. This information is touched on in Section 5.3 (Aquatic Habitat) and summarized in Section 6.5.2 (Aquatic Species at Risk). Potential impacts and recommended mitigation for each species is provided in Appendix G, along with requirements for additional work / consultation, as anticipated.

11 Confirmed SWH habitat is present along the North Thames River within the vicinity of Site 4 and within the South Thames River at Site 5 (Figure 26). The North and South Thames Rivers possess suitable soft and muddy substrate. Further, numerous turtles, including Northern Map Turtle, Spiny Softshell (current study) and Snapping Turtle (NRSI, 2013b) were identified during the field surveys.

The reason for listing this section of the report within the comment document was unclear. Significant Wildlife Habitat within the Study Area is discussed in Section 6.6 of the EIS. Turtle Nesting Areas have been identified at or near Sites 2, 4 and 5, but have the potential to occur at all sites if suitable conditions are created. Turtle Wintering Areas are thought to occur within the vicinity of Sites 4 and 5, although specific brumation sites have not been identified. Potential for overwintering also exists at other sites where water levels and substrates are appropriate. Continued consultation with regulatory agencies at detailed design will be necessary to ensure the most current information is considered.

of the species within the adjacent floodplain forest. Official records that may verify the origin of the two trees are not

contained in the Sherwood Fox Arboretum records. You also noted that both trees are affected by Butternut canker, but

SAR Distribution mapping (Maps 20 and 21) for potential species at risk to be considered during the design process. I am

hoping that you can confirm for me the list of potential species that we should be considering for our four watercourse

crossing locations, and if possible any potential SARA issues we may need to consider as we move forward.

I have attached a google image (and kmz file) of the four areas in questions (labelled Sites, 2, 3, 4 and 5). I note that a

portion of the mapping within our area of concern also indicates potential critical habitat for a list of species. Can you

please confirm what species the mapping is representing in our area?

Site 2 – North Thames River at Queen Street in London (Lat 42.9823, Long -81.2567)

Appears to be coloured for critical habitat within this portion of the Thames River. We know that Wavy-rayed

Lampmussel are in the area generally but can you confirm what other species should be considered in this location and

confirm what the critical habitat is for?

Site 3 – Medway Creek at Western Road Crossing (Lat 43.0146, Long -81.2766)

Appears to be coloured Green on the mapping. We were able to confirm Wavy-rayed lampmussel at this location based

on passive searched completed this year. What other potential species should we be considering in this area? The table

suggests the potential for Grass Pickerel, N. Brook Lamprey, Pugnose Minnow, River Redhorse and/or Spotted Sucker.

Site 4 – North Thames Crossing at University Drive (Lat 43.0076, Long -81.2680)

Appears to be coloured Green on the mapping. We are aware of records of Wavy-rayed Lampmussel in the general

vicinity of the crossing. Is this what the colour is coded for at this location and are there additional species we should be

including in our assessment?

Species at Risk (SAR): The Species at Risk in Ontario (SARO) List (http://www.ontario.ca/environment-and-energy/species-risk-ontario-list) is Ontario Regulation 230/08 issued under the Endangered Species Act, 2007 (ESA). The ESA came into force on June 30, 2008, and provides both species protection (section 9) and habitat protection (section 10) to species listed as endangered or threatened on the SARO List. MNRF recommends that DFO be contacted regarding critical habitat for aquatic species at risk and potential authorization under the federal Species at Risk Act.

Please note that this is an initial screening for SAR and the absence of an element occurrence does not indicate the absence of species. The province has not been surveyed comprehensively for the presence or absence of SAR and MNRF data relies on observers to report sightings of SAR. Field assessments by a qualified professional may be necessary if there is a high likelihood for SAR species and/or habitat to occur within the project footprint. It is important to note the following:

• Changes may occur in both species and habitat protection which could affect whether proposed projects may have adverse effects on SAR.

• The Committee on the Status of Species at Risk in Ontario (COSSARO) meets regularly to evaluate new species for listing and/or re-evaluate species already on the SARO List. As a result, species designations may change, which could in turn change the level of protection they receive under the ESA 2007.

• Habitat protection provisions for a species may change if a species-specific habitat regulation comes into effect.

Barn Swallow, Chimney Swift and Cliff Swallow

− Given the timelines of the project, MNRF suggests that detailed surveys to determine presence of nests/breeding activity be completed as close to the proposed project start date as possible.

− Impacts to structures that are habitat for Barn Swallow and Chimney Swift may be eligible for the online registry process. More information on altering structures that are Barn Swallow and/or Chimney Swift habitat can be found at:

− Section 9 of the ESA (prohibiting kill, harm, harassment of SAR individuals) still applies if work is proposed on structures that provide habitat to Barn Swallow and/or Chimney Swift but impacts to the nest/roost are to be avoided. In these scenarios, mitigation measures, such as timing of work, would be required to avoid impacts to SAR and remain in compliance with the ESA 2007.

− Cliff Swallow is not currently protected under the ESA 2007. However, Cliff Swallow, Barn Swallow and Chimney Swift are all protected under the Migratory Birds Convention Act, 1994.

Significant Wildlife Habitat (SWH): Significant wildlife habitat (SWH) may be present on or adjacent to the above-noted subject lands (within 120 m). Please consult the Significant Wildlife Habitat Technical Guide (SWHTG, OMNR 2000), the Natural Heritage Reference Manual (NHRM) and the Ecoregion Criteria Schedules for criteria on identifying and determining significance of wildlife habitat. SWH is identified by planning authorities using the criteria and processes recommended in the SWHTG and Ecoregion Criteria Schedules. As a follow-up to our EIS Scoping meeting on April 10th for the London Rapid Transit project, I wanted to email you about

some additional data requests. Michelle Fletchers name came up as a potential SAR contact – would you be involving

her or a different biologist on the file?

As there is potential for in-water works at several of the crossings, we were hoping to obtain the following information

to help inform our impact assessment and recommendations for the design team as we move forward:

• Critical habitat for SAR within our study area (fish, mussels and turtles)

• Recent fish and mussel sample data, where available

• Permissible in-water works timing windows

I would also like to discuss how best to address concerns with respect to Barn Swallows and Cliff Swallows that may be

nesting on the underside of bridges. The extent to which the bridges will be altered has not yet been determined, and in

most cases the work is unlikely to commence in the next year or so. There is a ten year time frame for implementation,

but it is unclear at this stage the sequence of the work and which bridges will be under construction and when. For this

reason, we would like to make some general recommendations within the EIS, but with the understanding that

additional work will be required for permitting at the detailed design phase. At the very least, we will document whether

nests are present, but I am not sure if completing detailed surveys to determine occupancy is worthwhile at this stage.

The same applies to potential Chimney Swift nesting structures within residential properties (or others) along the route

that may need to be appropriated to permit road widening.

Please let me know if you have some time to discuss the project and these specific concerns.

Wellington Street, between Exeter Road and the 401 (please refer to the attached figures for additional information).

The Murray Drain, a tributary of Dingman Creek wraps around the southern edge of the study area, and the site is, for

the most part, located within the UTRCA regulated area / maximum hazard line as delineated on Schedules B-1 and B-2

of the London OP.

Do you have any data on the area that you could share with us? I sent an email to Christine Creighton and Mark

Snowsell (below) to request input from a planning perspective, but have not yet received a response. Is Christine the

best point of contact for fisheries and benthic data, or would you recommend someone else?

and benthic data, and other relevant information that would be helpful in our review of the site as part of the larger EIS

for the Rapid Transit EA. I will approach Scott Gillingwater for information pertaining to species at risk, but am not sure

of the best avenue for obtaining the other information. Kindly advise.

As mentioned in my message, we are deploying field crews to this site as early as next week and would like to have a

better understanding of the likelihood of development in this area for the purpose described. I would greatly

Hey Erin,

I finally have some office time, so here are the details on the London site visit on June 22.

I’ve attached the breeding bird field sheet that has location notes of the meadowlark we heard. I’m not actually sure I

saw the bird or not, I was walking towards the call and saw something fly off, and then the calling stopped, so I believe

this was the meadowlark. During that survey we also saw a number of monarch caterpillars on a large patch of

milkweed, and a young woodcock, both which are described in the notes. I’ve attached a couple photos mostly for

interest ☺. Check out how well the woodcock is camouflaged! I’ll be uploaded all photos onto ecollab today also.

Here are my notes from the bridge surveys looking for BARS, CLSW, and turtles:

Front St Bridge (site 5)

• Bridge almost entirely smooth underneath, few areas for nesting.

• ROPI nesting on one small available ledge, EUST nesting in drainage pipe

• A number of BARS seen foraging and collecting mud from the river, and flying under the bridge, but it looks like

they are carrying the mud elsewhere. I watched for a while, and didn’t see any building or occupying nests on

the bridge. The area definitely provides general habitat.

• No turtles, but 1 bullfrog calling (breeding bullfrogs may make it significant wildlife habitat)

Western Rd Bridge (Site 3)

• Bridge almost entirely smooth underneath, few areas for nesting.

• No birds or nests underneath.

• No swallows seen foraging

• No turtles

• Giant bullfrog basking on northern bank, he was at least 10 inches in length!

Richmond St Bridge (Site 4)

• Bridge has lots of ledges and those metal support brackets/struts/trusses (?) see photos.

• At least 15 CLSW nests present, 1 phoebe, and 1 house sparrow.

• Osprey also seen foraging.

• Spiney Softshell (5!) and Map turtle (2) seen basking south of the bridge in a rocky area

Oxford St bridge (Site 2)

• Bridge similar to Site 4, with lots of metal brackets good for nesting.

• 23 nests seen on east side of the bridge, 45 seen on west side. The bridge also has a middle section that cannot

be seen from underneath. There is likely another 30 or nests under this section. The river provides excellent

foraging habitat, and muddy areas for nest building. no CLSW

• No turtles, despite what looks like decent habitat
