KAUKAUNA — The artomey representing sus­pended police officer John Bigelow said today that the Police & Fire Commission had no legal right to consider charges against his client be­hind closed doors.

"They have absolutely no business reviewing those charges in closed session," said Madison attorney Gordon McQuillen. "That is a severe deprivation of my client's rights. I searched the statutes in vain looking of a section that allows them to do that."

After the closed session Tuesday afternoon. Chairman Rinert Wenzel said the commission had scheduled a two-day public hearing to begin July 12 on charges of "dereliction of duty filed against Bigelow by Police Chief William Apple-ton.

Bigelow is accused of ignoring reports in 1975 that Boy Scout Leader Larry Hahn was sexually abusing Sea Scouts. Bigelow, who has been on the Kaukauna police force for 18 years, was an adult adviser to the Scouts and was often at the Scout's "Kaukauna Sea Base in uniform.

Hahn pleaded guilty May 4 to felony counts of d-aegree sexual assault and child pomog-

raphy and to a misdemeanor charge of using a' juvenile for sexual gratification. The investiga­tors who broke the case identified 16 victims and said the sexual abuse of juvenile boys had gone on for almost two decades.

In a letter to Wenzel, Appleton said Bigelow was told by several Sea Scouts in 1975 about an incident in which Hahn attempted to sexually molest a juvenile boy while armed with a knife. Appleton police originally re-fen ed llahn to the district attor­ney's olfice on 24 counts of sexual abuse. In the complaint, police said llahn became friendly with individ­ual Scouts and then engaged sexual activity with them at Ids Ap­pleton home and elsewheie.

Most of the sexual contact in­volved oral sex and masturbation, police said. All three of the boys mentioned in the complaint said llahn took photographs of them in sexually explicit poses. Ilnhn re-poitcdly told the boys the photo­graphs were being sent to Japan. A search of llahn's house turned up one such photograph.

The Knukauna police chief said he became aware of his officer's al­leged involvement in the case when he was contacted by Appleton po­lice investigators.

Van De Hey said he could not discuss the case further because the internal investigation by Kau-kauna police is not complete and the officer has not been charged.

"We are talking about neopl lives, and we are talking noout an officer's career, and until it's re­solved one way or the other, it would be absolutely inappropriate for me to comment," he said.

Assistant Police Chief Patrick Campbell is conducting the depart­ment's internal investigation. He said the officer involved was a reg­ular visitor to the Scout meeting room in Kaukauna. Some of the Scouts considered the officer an adviser, Campbell said.

"The kids have told the Appleton Police Department that they went to him (the Kaukauna officer) with the story (of sexual abuse) and he didn't do anything," Campuell said.

An Appleton couple and their son filed a claim Friday against . the city and the Kaukauna Police Department alleging that the of­

Most of the sexual contact mentioned in the complaint involved masturbation and oral sex. Kahn allegedly told the boys the photographs were being sent to Japan.

The Sea Scouts had a "ship," or meeting room, in Kaukauna, and some of the criminal activity took place there, the complaint states. The investigation also reached north to an is­land near Door County used by the Sea Scouts.

The Sen Scouts are a branch of the Boy Scout Explorer program which is open to boys and girls in high school. It involves just a handful of the 30,000 youths involved in Scout-ing.

"A lot of these people are married and have children, and they never told their family about this until we talked to them," the official said.

A Scouting official, Executive Director John Primrose, said today that Hahn has been sus­pended from the Hoy Scouts of America. The Sea lixlorer, or Sea Scout, program based in Kaukauna has been temporarily disbanded be­cause of the criminal investigation, he said.

The inquiry began when a parent of one of the youths mentioned in the complaint con­tacted Appleton police. The complaint indicates that the investigation is being conducted by Appleton officers Dan Woodkey and Pat Gee-nen.

A former Boy Scout leader ac­cused of enticing teen-age boys into sexual activity appeared in court for the first time" Thursday and quickly entered pleas of guilty to three of seven charges that had been lodged' against him. .

Sentencing for Larry R. Hahn, 45, __ _ was scheduled for 3 p.m. July 12 by Bsggg*-;- . Outagamie County Circuit Judge Dee Dyer, who accepted the guilty pleas after Hahn waived his right flrSJ' to a preliminary hearing. The re­maining four charges were dis­missed and read into the record for consideration in sentencing. A pre­sentence investigation was ordered.

For the past two decades, Hahn " was the leader, or " skipper," of the .. . Bay Lakes Area Sea Explorers, . commonly called Sea Scouts. The charges involved three boys, ages 15. 16 and 17. Two of the boys had . been given the rank of " bos'n" un­der Hahn's leadership. The group met in Kaukauna.

On October 10, 1988, Bruce Chudacoff, VP of Field Operations, who is also an attorney and myself met with Larry Hahn, past Skipper of Ship 5011. Larry Hahn accepted the suspension letter as attached.

Until October 10th, Larry Hahn had been the Skipper of Ship 5011 for many years. We are making no allegations. The Appleton Police (local law en­forcement) are investigating Mr. Hahn and at this early stage of investigation have indentified four youth who said they were sexually assaulted by Mr. Hahn. At least one youth claims Larry Hahn threatened to "break his legs" if he ever shared their secrets. A search warrant by the police found child pornography in the home of Larry Hahn.

The police indicate that while an arrest has been made, a custodial arrest has not, and they may take up to six months to investigate. Probably no media inquires will surface until that time .
