Here we go again. The federal government, spe­cifically the Environmental Protection Agency and the Food and Drug Administration, is once more trying to "help” us. It’s bad enough trying to com­ply with the EPA and FDA separately, hut now the two agencies are in cahoots with each other in their efforts to “pro­tect” the American people. Ear­lier this year the FDA, at the be­hest o f the EPA, issued an ad­vance notice o f proposed ralemaking (shorthand for “we' re letting you know ahead o f time before we get you”) announcing that it is beginning a transition leading to a ban of certain me­tered dose inhalers. Those are devices that asthmatics and other people with respiratory ailments turn to for relief.

Metered dose inhalers use small amounts of chlo- rofluorocaibons (CFCs) which release chlorine into the atmosphere and may contribute to the thinning of the earth’s ozone layer. In 1987 the U.S. signed the Montreal Protocol, agreeing to phase out pro­duction o f CFCs. Manufacturers have had to de­velop CFC substitutes for all sorts of products from air conditioners to refrigerators to cosmetics. Cer­tain exemptions were carved out for medications considered essential to human health - medical de­vices such as inhalers that deliver life-saving medi­cation.

The administration publicly expressed its concern for asthmatic chi ldren in J une when it announced its support for massive changes to the current clean air standards - in the absence of any credible scientific evidence of any public health benefit. Now the same ■dministration is quietly considering taking asthma- relieving inhalers away from those same children.

Currently, the FDA regulates 25 cents out of ev­ery consumer dollar. Its primary responsibility is the regulation of food, drugs and medical devices. As aresult, the agency touches the life of each and every American. As if this power was not enough for a $ 1 billion agency, it also hopes to get involved in the regulation of our environment with the pro­mulgation of this new rule.

The FD A , at the urging of the El’A, is proposing to ban devices, which use CFCs, as long as at least one CFC-altemative product with the same active ingredient as the CFC-propelled device is avail­able. The consequences are pretty obvious: with

only one inhaler on the market, the price is sure to go up for insurers and, more significantly, for those without insurance who will be forced to make up the difference out o f pocket. Equally important, the array ol treatment choices currently available to

physicians and patients would be severely limited.

Pharmaceutical companies are currently working to develop inhal­ers that do not use CFCs. A CFC- free inhaler is available; but that does not mean the government should ban all the others. That ac­tion would be the equivalent of ban­ning all vehicles with combustion engines once one reliable electric vehicle is available. Ilie fact is that not all patients are alike. The rea­son 70 different types o f inhalers

are already o the market is that one size does not fit all. Limiting patients' treatment options is inappro­priate and potentially dangerous.

Once again the federal government is stepping in to regulate without thorough analysis of the costs, benefits and side effects o f its actions. Less than one percent o f the overall atmospheric chlorine - the standard measure of risk to the ozone layer - comes from these inhalers. In contrast, developing countries are still permitted to use CFCs for any purpose, including non-medical uses, and will be allowed to continue until 2010. That is not giving the EPA pause, though. In an effort to showcase its green credentials, the agency is advocating its proposal to the rest of the world as a model o f regu­latory virtue.

Fortunately, the public health community is react­ing. Former Surgeon General C. Everett Koop has weighed in against the lunacy of the proposed rule, as have a host o f allergists, respiratory physicians and other health care providers. Several members of Congress have introduced legislation expressing opposition to the rule. The executive branch is be­ing Hooded with comments from physicians and other concerned citizens about the negative conse­quences o f this proposed rule.

The temptation of adopting environmental regu­lations for the sake of “doing something” is almost irresistible to overzealous bureaucrats. The pro­posed ban of metered dose inhalers gives Congress one more reason to say "no" to unelected rulemakers and rein in bureaucracy run amok.
