PREFACE

This is a review on the working of various Work Divisions in Assam for the year

2012-13. This review is prepared to bring out among other things, common and

persistent defects and omission in the maintenance of initial accounts, and also other

financial irregularities noticed during Central and Local Audit.

The irregularities and omissions highlighted in the review are illustrative and not

exhaustive. These are being brought to the notice of the Government and concerned

Heads of Department from time to time for their necessary guidance and effective

remedial measure so that the same things are not repeated subsequently.

The review consists of two parts. Part-I incorporates the irregularities, defects and

omissions noticed during checking and booking of expenditure reflected in monthly

accounts received from various Work Divisions. Part-II depicts common types of

irregularities observed during Central Audit, Details of Audit Notes and Inspection

Report and important irregularities noticed in the local inspection.

The Government may consider taking appropriate measures to rectify the

deficiencies pointed out in the review and implement the best accounting practices to

enable increase efficiency and accuracy of accounts being maintained by the

Divisions.

B.REVIEW PART-I

PARA.1 GENERAL.

There were 263 Works Divisions in the state of Assam during 2012-13.

Out of these 263 Work Divisions, 54 Divisions located in 3 District Council Areas

comprising Karbi Anglong, Dima Hasao and Bodoland furnished 2(two) sets of

accounts one for the fund received from the Council Secretariat and the other against

the F.O.C. received from the State Government against NTA Budget. Thus,

317(263+54) monthly accounts were received per month from those Work Divisions

during 2012-13. The number of Divisional accounts department wise at the end of

PARA.2(A) Delay in submission of Monthly Accounts

As per provision of para 22.4.15 of the CPWA Code read with Article 230 of the

Account Code Vol.-III adopted by the Government of Assam, the monthly accounts of

Work Divisions are due to submit to the Principal Accountant General(A&E)‟s Office

within 10th

of the following month to which the transactions relate.

It is noticed that except a very few divisions most of the divisions did not adhere

to the target in submission of their monthly accounts to the Principal Accountant

General(A&E) Assam. The delays ranged between 02 to 136 days. The delay in receipt of

monthly accounts adversely affected the time schedules fixed for compilation and closing

of accounts, and also led to exclusion of a number of accounts from the Civil Accounts

rendered to the State Government each month. In addition, due to delay in receipt of

monthly accounts from accounts rendering units, the actual financial position of the State

Government could not be reflected in the Monthly Civil Accounts which ultimately

affected the timely finalization of the Finance and Appropriation Accounts of the State

Government for the F.Y. 2012-13.

It is observed that the position was not improved despite the fact had been

repeatedly commented in the previous Annual Reviews on the failure of the Heads of

Departments and the Divisions of works in timely submission of Monthly accounts. The

Principal Accountant General (A&E) Assam had also been periodically reminding the

Principal Secretary of the concerned departments in this regard. But hardly any

accountability of the management and government in respect of public funds spent by

those Divisions was observed.

It is therefore, suggested that effective steps need to be taken so that the

submission of monthly accounts to the Principal Accountant General (A&E) be

streamlined and monitored, and necessary administrative action be initiated against the

defaulting divisions most urgently. A list of defaulting divisions shown in ANNEXUE-I

below.

(B) Monthly Accounts of District Autonomous Councils of Karbi Anglong, Dima

Hasao and Boroland.

As per arrangement with Government, the Principal Accountant General (A&E)

compiles 54 Divisional Monthly Accounts entrusted to three District Councils namely

Karbi Anglong =19 divisions, Dimahasao=10 divisions and Boroland Territorial

Council=25. The Divisional Officers under the three District Councils submit 2(two) sets

of monthly accounts each - one for the expenditure incurred against F.O.C. released by

the State Government from NTA General Budget called State Sector Accounts and

another for the expenditure incurred against fund released by respective council from

Council Budget called council accounts.

The submission of monthly accounts by the divisions under District Councils

has been observed most irregular that had caused inordinate delay in closing and

submission of annual accounts to the State Government for 2012-13.

There is an urgent need for the Government to take effective measures for

ensuring timely submission of monthly accounts by the District Councils so as to enable

the Principal Accountant General(A&E) Assam to incorporate the council accounts in the

month to which such accounts actually relate.

Para 3 Defects in preparation of Monthly Accounts.

As per prescribed forms given in Account Code Volume-III and Book of

CPWA Code, the monthly accounts rendered to the Principal Accountant General (A&E)

for incorporation in State Account for submission to the State Government every month

should invariably be complete and correct in all respects.

It was observed that the accounts received from Divisional Officers contained

many common omissions and mistakes. A few common defects appeared in the monthly

accounts were as follows:-

1. Whether the expenditure incurred belonged to charged or voted was not shown.

2. The classification shown in Classified Abstract(s) i.e. Form-74 and in the

Schedule of Work Expenditure i.e. Form-64 were either incomplete or incorrect.

3. Expenditures were booked without any reference to Sanctioned Estimate and

Budget Grant, and in Schedule of Work Expenditure i.e. Form-64 details

description of works and progressive expenditures were not shown in complete

shape.

4. Current year allotment of funds was not shown in the schedule of work

expenditure against each work, resulting in lack of control and watch over

progress of expenditure at divisional level.

5. Part-II of Schedule of Deposit was not submitted causing inconvenient to

ascertain/check plus-minus of the deposit fund under various classes of deposit

with reference to the item of Deposit Register.

6. Payee‟s acknowledgement against the payment made through work bill/vouchers

was not obtained from contractor‟s concerned in many cases in contravention of

codel provision.

7. Head of accounts under which payments have been made were not shown on the

body of the bills/vouchers submitted along with the monthly accounts.

8. Schedule of Settlement with Treasuries-SST (Form-51) were not submitted even

after closure of divisional monthly accounts.

9. Details of Memo of Miscellaneous Cash Receipt paid into treasuries and

certificate of Cash Balance were not noted in the appropriate column in Form-80.

10. Security Deposit Money against on going work was not deducted from contractor

bills and credited under Class-II deposit in terms of ClauseI(B) of Conditions of

Contracts of APWM & Rule 260 of AFR.

11. Part payment of Running Accounts bill was made on photo copy of the said bill

without preparing proportionate bill showing quantity of work done multiplied by

the rate equal to amount of the proportionate bill to be paid.

12. Regular work of PWD Road divisions were quite often shown under deposit

works by funding from outside of PWD Budget (Finance-Entry Tax) which is not

familiar to PWD system of accounts.

13. In some cases, lump sum money received from other than Government sources

were not bought into accounts of the PWD Division in the month in which it was

received. Sometime the funds for deposit works were being received from

Government sources even after completion of the deposit work, which is not

permissible as per PW Code.

14. At the end of 2012-13 there was a closing balance under Major Head-8671

Departmental Balances amounting to Rs18,32.42 Lakhs which indicate that some

payments items were not reflected against respective Major heads in the Finance

Accounts of the State for 2012-13.

15. Transfer of fund from PW work head without furnishing name of work and

sanctioned estimate as per requirement of Form-64; but charged to final work

head.

Some of these omissions and defects had been pointed out in earlier annual

reviews also, but no action appeared to have been taken to regularize the same. It is

suggested that the Divisional Head and the Divisional Accounts Officers are to be

suitably instructed to rectify the aforesaid persistent defects in accounts.

Para.4 Verification and Reconciliation of Departmental figures with PAG’s figures.

As per rules, all Heads of the Works Departments are required to verify and

reconcile of their departmental figures of receipt and expenditure with the figures booked

by the Principal Accountant General (A&E) before closure of the accounts for a

particular year to ensure correctness.

But it is regular phenomena that except a few, most of the departments did not

come forward for verification and reconciliation of their departmental figures with the

figures booked by the Principal Accountant General (A&E). The position of verification

& reconciliation during 2012-13 is as stated below:-

Para.5 Cash Settlement Suspense Account (CSSA)

During the period under review there is still `82.73 crore(Dr.) and `15.65 crore

(Cr.), net `67.08 crores(Dr.) [`82.73 crores(Dr.) - `15.65 crore(Cr.)] is lying unadjusted

under the CSSA as on March‟2013. The amount is lying unadjusted since Sept‟1979 when

the CSSA had been discontinued. The matter has been repeatedly taken up with the

Government and Heads of the Works Departments for adjustment. Early action for

adjustment of the debit balance at the end of 2012-13 under CSSA may be taken to prevent

possible pilferage or misappropriation of store.

Para.6 Adjustment of WMC Memos

Work Miscellaneous Clearance Memos had been already sent by the Accountant

General (A&E) Assam to various work divisions in connection with the purchases made

through the DGSD for necessary adjustment under concerned Major Heads of Accounts.

The system of purchasing goods through the DGSD had been dispensed with from 2001-

02. In spite of repeated persuasion and holding of meetings for long outstanding WMC

Memos, no satisfactory result yielded and an amount of `108,11,01,258.84 as detailed

below still remains un-adjusted till F.Y. 2012-13:

A time bound programme is to be taken by the Government for settlement of the

long pending issue without further delay.

Para.7 Non-submission/delayed submission of Form-50 & 51 and settlement of

remittance transaction:

Work divisions are to submit Form-50 & 51 –Schedule of Monthly Settlement with

Treasuries immediately either along with monthly account or subsequently showing detail

particulars of cheques drawn by the divisions and cheques encashed by treasuries. Also

remittances made into treasuries and remittances acknowledge by treasuries. These Forms

enable to establish irregularity, if any, while transacting Government money. It is observed

that 232 NTA & TA(State) divisions out of 263 did not furnish Form-50 & 51 to the

Principal Accountant General during F.Y. 2012-13. This has resulted in accumulation of

balances under head of accounts „8782-Cash Remittance‟etc. The position of balances as

on 31.03.2013 is as under:-

8782-Cash Remittance etc.-102 PW Remittance(Rupees in Lacs)

I- Remittance into treasuries `154.28(Dr.)

II-PW Cheques `836.65(Cr.)

The balance `154.28 Lacs(Dr) under „8782-I Remittance into Treasuries‟ represents

moneys had been remitted into treasuries by the divisions; but not acknowledged as per

treasury accounts. There should not be any outstanding balance under „I-Remittance into

treasuries‟ at the close of the financial year; but the unacknowledged remittances as on

31.03.2012 was as high as `154.28 Lacs. The reasons could be ascertained if the divisions

furnish Form-50 at the earliest.

The credit balance of `836.65 Lacs represents the amount of cheques drawn by the

divisions but not encashed in the treasuries. Due to non submission of Form-51 by the

divisions not only the concerned broadsheet could be posted and verified; but even checks

against irregular drawal, if any, could be exercised.

The matter regarding submission of Form50 & 51 deserves top priority from the

Government. The matter has been highlighted on various occasions to the State

Government as well as in earlier reviews.

Para.8 Expenditure on maintenance of National Highways and reimbursement

thereof.

Each year National Highway Divisions of the State undertake the work of repair

and maintenance of the National Highways on behalf of the Ministry of Surface Transport,

Government of India. Expenditure incurred on the works is sanctioned by the Ministry of

Surface Transport and initially met from the cash balance of the State Govt. by debiting to

„8658 Suspense Account-101 PAO Suspense- Item adjustable by Regional PAO, Ministry

of Surface Transport, Govt. of India‟. Claim for reimbursement of State expenditure on

National Highways are preferred by the Principal Accountant General(A&E) to the

Regional PAO, Ministry of Surface Transport(NH), Guwahati on the basis of supporting

vouchers and documents received along with the monthly accounts submitted by NH

Divisions.

The Regional PAO scrutinize the claims and reimburses all such claims which are

found admissible to the State Government through the Principal Accountant General(A&E)

by cheque/Bank Draft who in turn deposit the same to the state exchequer. However,

sometimes a part of the claims is kept withheld. During the year 2011-12 an amount of

`43,34,921/- of Silchar NH Division for the month of Feb‟2012 has been withheld due

wanting of Spill over sanction from the Ministry relating to FDR works placed for

reimbursement which is yet to be settled. Outstanding amount receivable from the RPAO,

Guwahati for 2012-13 is `20,87,10,357/-as on date out of `31,13,10,357/-. The matter is

under correspondence. However, vouchers are treated inadmissible in account for

following reasons also:

a) Expenditure is in excess of sanction

b) Expenditure on items not related to National Highway works

c) Expenditure which are hanged for court case are included in accounts without

obtaining prior sanction from the Ministry.

Further, the expenditure incurred on items other than NH but incorporated as NH

expenditure are required to be written back in PAG‟s Book. Inadmissible expenditure are

transferred from „8658-101 PAO suspense‟ to the concerned service head of accounts of

the State Govt. There is an urgent need to exercise proper checks while submitting accounts

of the NH works with reference to guideline above.

ANNUAL REVIEW ON THE WORKING OF

PUBLIC WORKS DEPARTMENT, IRRIGATION

DEPARTMENT, WATER RESOURCES DEPARTMENT, PUBLIC HEALTH

ENGINEERING DEPARTMENT ETC. FOR THE

YEAR 2012-13

1.Maintenance of Tools & Plant Ledger:-Information gathered in respect of 36 divisions, out of

171 divisions, which were required to maintain Tools and Plant Ledger during the year 2012-13

disclosed the following points:-

(a) Tools and Plants Ledger showing the receipts, issue and balances of T & P articles (Category

wise /itemwise) are required to be closed at the end of September each year but except 19

Division the same was not closed by any of the enlisted divisions including

16 Divisions where neither ledger was maintained nor records were made available to audit.

Details shown in Annexure –„A‟.

(b) Physical verification of available balance of T & P articles was in arrears upto

2012-13 in 36 enlisted Divisions including 21 Division where either such verification was not

done at all or records in respect of physical verification was not made available to audit. Enlisted

divisions are shown in Annexure –B.

2. Priced Store Ledger:-

(a) According to codal provisions, “Priced Store Ledger” showing receipts, issue & balances of

store (item wise) of various works Divisions are required to be maintained for both quantities and

values and should be closed at the end of each month by every works division holding stock and

stores .

Out of 36 Divisions, which held the stock of stores in 2012-13 ,details of stock

transactions were gathered from 36 numbers of divisions and it was found that in

3 Divisions Priced Store Ledger were closed upto March 2012 and in 18 divisions either such

Ledger was not maintained or the records were not made available to audit. Details are given in

Annexure –C.

(b) Excess value of Stock over Reserve Stock Limit:-

As per codal provision, reserve stock should be maintained only after limit is fixed by the

State Government .Out of 36 Divisions from which information have been collected, the value of

the stores held by 9 Divisions was ` 906.79 lakh as on 31-3-13 against the sanctioned reserve

stock limit of ` 91.00 lakh and thereby excess stock of ` 815.79 lakh was held by those

Divisions. Moreover the position relating to retention of stock exceeding the Reserve Stock Limit

could not be determined against 20 Works Divisions as either the Reserve Stock Limit or the

present value of stock could not be made available to audit.The position is shown in Annexure –

„D‟.

(c) Physical verification of stock :-Annual physical verification of stock was in arrear against 14

Divisions .Moreover, against 21 Divisions either physical verification of stock are not done or the

position was not made available to audit. Position shown in Annexure –„E‟.

3. Miscellaneous P.W.Advances:-

Amounts booked under Misc P.W.Advance represents dues recoverable from different

agencies including contractors, outside bodies etc. The clearance of outstanding balance is

necessary to depict a true picture of the accounts.

The balances outstanding under Misc .P.W.Advance against 17 Divisions amounting to `

1353 lakh is shown in Annexure –„F‟. Moreover in 19 Divisions either records are not

maintained to show unadjusted Misc .P.W.Advance or records were not made available to audit

as shown in Annexure –F.

4. Maintenance of contractor ledger:-

As per codal provisions, the contractor ledger should be maintained to show the various

payments made to the contractor i.e advance payment, secured advance, value of store materials

issued to the contractor as well as payment made to the contractor against different work bills and

adjustment made there against, etc, but either this was not maintained or update position not made

available for 11 Divisions, as shown in Annexure –„G‟.

Moreover, position regarding maintenance of Contractors‟ Ledger was not made

available to audit by 1 Division as indicated in Annexure –‘G’.

5. Maintenance of Register of works:-

As required under codal provisions, the Register of works should be maintained to show

sub-head wise sanctioned amount in respect of Scheme/Project work and the expenditure incurred

thereagainst together with monthly/annual progressive total but this was either not maintained or

upto date maintenance was not done in 8 Divisions. Details are furnished in Annexure –„H‟.

Moreover, position regarding maintenance of Register of Works was not made available

to audit in respect of 3 Divisions .

6. Delay in settlement of remittances, transactions and submission of Form-51

Divisional officers are required to effect reconciliation with treasuries in respect of

cheque drawn and amount remitted into treasury.

But this was not done or in arrears in most of the Divisions .Position of reconciliation

with treasury in respect 36 Divisions is furnished in Annexure-1

7. Outstanding W.M.C Memos:-

W.M.C memo received by the Division from the Pr.A.G (A & E ) need to be verified and

adjusted promptly. But many divisions did not take necessary steps to adjust the outstanding

W.M.C memos valued ` 817.38 lakh relating to 16 Divisions. Details are given in Annexure –

„J‟.

8. Outstanding C.S.S.A Claims.

As per codal provision all transactions relating to service rendered or supplies made by

the division should be accounted for in “Cash Settlement Suspense Account”. On closing the

monthly account of the Division, a copy of the part-1 of Form -1 should be sent to the Division

concerned supported by all relevant vouchers. Immediately on receipt of the copy of Form-1 from

the originating Division, the responding Division should make payment by Cheque or Bank Draft

within 10 (ten) days of the receipt of the account so that at the close of the year there should

normally be no balance under this suspense account. Although the operation of C.S.S. A/c was

discontinued w.e.f 1-10-79 vide Govt.of Assams letter no. 133-97/78/53 dtd.12-07-79 ,an amount

of `` 1547.09 lakh (outward claims ` 1163.90 lakh & inward claims ` 383.19 lakh ) was found

unadjusted under C.S.S Account against 25 number of Divisions as on 31-03-13. Moreover,

though required, such records were not maintained by 1 Divisions. Detailed shown in

Annexure „K‟.

9 Settlement of outstanding Inspection Report:-

Under the provision of Rule 148 and 164 of A.P.W.D code (similar provisions

under Rule 94 and 487 of the Assam Financial Rules) the Divisional Officer is required

to take prompt action to send replies to the Audit Inspection Reports within a fortnight to

the Principal Accountant General (Audit) Assam, Guwahati for expeditious settlement of

audit objection of the Inspection Report. Those provisions were not followed by most of

the Divisional Officers, as a result of which there has been inordinate delay in settlement

of 549 outstanding Inspection Reports containing 2653 paras at the end of 31st March

„2013.

However, the process of settlement of Inspection Reports/Paras is in progress

through audit objection committee meetings as well as regular persuasion made from this

end..
