ORDER OF COURTAND NOW, this 17th day of December 2015, the Court

hereby incorporates the Order of July 5, 2007, and amends it as follows:

4 (A) The Central Booking Centers and the video conferencing system may be utilized by the Magisterial District Judges on a 24-hour a day basis. If the arrest occurs at times other than during normal business hours of the Magisterial District Courts, the defendant shall be taken to a Central Booking Center for processing. Magisterial District Judges shall not be required to handle preliminary arraignments during the hours of 11:00 p.m. until 7:30 a.m. MDJs shall remain available during those hours for an emergency or contempt order for a Protection of Abuse/Elder Abuse matter, protection of victims of sexual violence or intimidation, a search warrant, an arrest warrant, or a preliminary arraignment of an individual charged with Homicide. This requirement shall not apply to persons arrested and released pursuant to PA.R.CRIM.P. 519 (B) who shall proceed in accord with paragraph 5.

4 (B) If the arrest occurs during normal business hours of the Magisterial District Courts, the arresting officer may take the person arrested to the Magisterial District Court for the preliminary arraignment. During business hours, each MDJ may determine on a case-by-case basis whether to process an arrestee at the CBC prior to commencing the preliminary arraignment. Should the MDJ determine the arrestee does not need the pre-arraignment process, the arrestee will be arraigned at the Magisterial District Court and given notice to report to a CBC at least five (5) days prior to the scheduled preliminary hearing.

If the person arrested is released, the MDJ shall give him the ‘Notice—Central Booking Required’ set forth in No. 5. If the person arrested is committed to prison, he shall first be taken to a CBC for processing.

6 Upon request, CBC staff shall provide copies of photographs, fingerprints and prior record to the police prosecutor, the MDJ who conducts the preliminary arraignment and who conducts the preliminary hearing, and to the District Attorney of Northampton County.

The CBC Processing Fee shall be set, and may be changed, by Court Order of the President Judge after consultation with the County Executive. The Order setting the fee is and should be a whole separate Order.

Administrative Order 2009-1 is hereby rescinded. This Order shall be effective on January 8, 2016 at 8:30 a.m.

Plaintiffs allege in their Complaint that on January 13, 2013, dirty sewer water entered their basement in large quantities due to a blockage in the sewer line owned by Defendant and damaged their property, creating a dangerous condition and causing monetary damages. Plaintiffs set forth causes of action for trespass and negligence in their Complaint. Defendant filed Preliminary Objections in the nature of Motions for More Specificity under Rule 1028(a)(3) of the Pennsylvania Rules of Civil Procedure, arguing that the Plaintiffs failed to set forth material facts in support of their allegations in both Counts of the Complaint.

The Court sustained the Preliminary Objections in part and overruled them in part. With respect to the trespass claim in Count I of the Complaint, the Court found that no facts pled in the Complaint would support a claim of an intentional entry as required under the Restatement (Second) of Torts. Therefore, the Court sustained the Preliminary Objections with regard to Count I. As for the negligence claim, however, the Court overruled the Pre-liminary Objections, finding that Plaintiffs had set forth their cause of action for negligence with sufficient particularity, and that the allegations were more than “boilerplate” averments of negligence.

STATEMENT OF REASONS

Facts and Procedural History

On December 19, 2013, the Plaintiffs, Anil Thakrar and Rama Thakrar, filed a Praecipe for Summons against the Defendant, City of Bethlehem. On May 11, 2015, the Plaintiffs filed their Complaint, alleging that on January 13, 2013, dirty sewer water entered their basement in large quanti-ties due to a blockage in the sewer line owned by the Defendant and dam-aged their property, creating a dangerous condition and causing monetary damages in the total amount of $12,989.14. See Complaint, 05/11/15,

¶¶3-13, 16, 18. The Plaintiffs further allege that the claim made to their insurance company was denied, as the insurance company verified the blockage in the Defendant’s sewer lines. See id. at ¶¶14-15. The Plaintiffs set forth causes of action against the Defendant for trespass (Count I) and negligence (Count II). Id.

On May 26, 2015, the Defendant filed Preliminary Objections to the Plaintiffs’ Complaint in the nature of Motions for More Specificity under Rule 1028(a)(3) of the Pennsylvania Rules of Civil Procedure. The Defen-dant argues that the Plaintiffs have failed to set forth material facts in sup-port of their allegations in both Counts of their Complaint, and have instead relied upon boilerplate allegations of negligence. See Preliminary Objec-tions, 05/26/15, ¶¶10, 15. The Defendant filed its Brief in Support on May 26, 2015.

On June 4, 2015, the Plaintiffs filed their Brief in Opposition, in which they argue that the Defendant has breached its duty to maintain and inspect the sewer lines, and that the averments contained in their Complaint are sufficiently specific.

This matter was placed on the July 28, 2015 Argument List and was submitted on brief.

Legal Standard

Rule 1028(a)(3) of the Pennsylvania Rules of Civil Procedure pro-vides that preliminary objections may be filed with regard to the insufficient specificity of a pleading. See Pa. R.C.P. 1028(a)(3). Rule 1019(a), moreover, requires that “[t]he material facts on which the cause of action or defense is based shall be stated in a concise or summary form.” Pa. R.C.P. 1019(a). In Pennsylvania, a complaint must “[apprise] a defendant of the nature and extent of the plaintiff’s claim,” as “[p]leadings serve the function of defin-ing issues and giving notice to the opposing party of what the pleader intends to prove at trial so that the opposition may, in turn, prepare to meet such proof with its own evidence.” Laursen v. General Hospital of Monroe County, 259 Pa. Super. 150, 160, 393 A.2d 761, 766 (1978) (citations omit-ted).

“[T]he lower court has broad discretion in determining the amount of detail that must be averred since the standard of pleading set forth in Rule 1019(a) is incapable of precise measurement.” Pike Cty. Hotels Corp. v. Kiefer, 262 Pa. Super. 126, 134, 396 A.2d 677, 681 (1978) (citations omitted). Further, parties cannot be required “to plead purely evidentiary matters or matters which are the ... subject of discovery; to hold otherwise would be to emasculate Rule 1019(a).” Id. at 135, 396 A.2d at 682.

DiscussionI. Trespass Cause of Action

First, with regard to the Plaintiffs’ claim for trespass:One is subject to liability to another for trespass, irrespec-

tive of whether he thereby causes harm to any legally pro-tected interest of the other, if he intentionally

(a) Enters land in the possession of the other, or causes a thing or a third person to do so.

Restatement (Second) of Torts §158(a) (1965); see also, Rawlings v. Bucks County Water and Sewer Authority, 702 A.2d 583 (Pa. Commw. 1997) (applying Section 158 of Restatement (Second) of Torts).

Here, the Plaintiffs aver in their Complaint that a “blockage in the line” caused the sewer line to discharge water into Plaintiffs’ basement. See Complaint at ¶¶6 and 7. The Plaintiffs also averred that the “water coming into plaintiff’s [sic] basement was an unprivileged entry” into the property. See id. at ¶8. As a result of the entrance of the dirty sewage water onto their property, they allege that they sustained damages in the total amount of $12,989.14. See id. at ¶¶9-10.

There are no facts pled in the Complaint which would support a claim of an intentional entry as required under the Restatement (Second) of Torts for a trespass claim. As such, the averments lack specificity to support the claim of trespass.

THEREFORE, we SUSTAIN the Defendant’s Preliminary Objections seeking more specificity regarding the trespass claim. 1

II. Negligence Cause of Action

With regard to the averments asserted in support of the negligence claim, however, we are on a different footing. It is well established that “a cause of action in negligence requires allegations that establish the breach of a legally recognized duty or obligation that is causally connected to the damages suffered by the complainant.” Bilt-Rite Contractors, Inc. v. The Architectural Studio, 581 Pa. 454, 470-71, 866 A.2d 270, 280 (2005) (cita-tion omitted). Further, “[t]he primary element in any negligence cause of action is that the defendant owes a duty of care to the plaintiff.” Id. at 471, 866 A.2d at 280 (citation omitted). With regard to a negligence action, moreover, “it is fundamental that the plaintiffs [must] establish the Duty owed by (the defendant[]), the breach of which might give rise to injuries alleged to be suffered by the plaintiffs.” Pike Cty. Hotels Corp., supra at 134, 396 A.2d at 681 (quoting Otto v. American Mutual Insurance Co., 241 Pa. Super. 423, 429, 361 A.2d 815, 818-19 (1976)).

The Plaintiffs aver in their Complaint that the Defendant owed them a duty of care, as the water and sewer services for their property are pro-vided by the Defendant and the Defendant “owns, operates, and maintains water and sewer facilities in the right of way, which are connected to Plaintiffs’ residence.” Complaint at ¶¶3-4. The Plaintiffs further aver that the Defendant breached this duty of care by failing to properly maintain the sewer line, despite the fact that “problems with back-ups in the sewer ———

line was a dangerous condition that created a reasonably foreseeable risk of exactly the kind of loss that Plaintiffs suffered here, namely, an intrusion of dirty sewer water in the basement of the residence.” Id. at ¶¶12-13. Fi-nally, the Plaintiffs allege that the Defendant’s breach of its duty to prop-erly maintain the sewer lines caused significant property damage and monetary losses totaling $12,989.14. Id. at ¶¶16, 18.

We find that the Plaintiffs have set forth their cause of action for negligence with sufficient particularity and that these allegations are more than merely “boilerplate” averments. See Connor v. Allegheny General Hospital, 501 Pa. 306, 311 n.3, 461 A.2d 600, 602 n.3 (1983) (prohibiting general, “catch-all” allegations of negligence). At this juncture, the Plaintiffs need not set forth the evidentiary matter of precisely how the Defendant failed to maintain or inspect the sewer pipes, as that is the proper subject of discovery. See Pike Cty. Hotels Corp., supra at 135, 396 A.2d at 682.

THEREFORE, the Defendant’s Preliminary Objections seeking more specificity regarding the negligence claim are OVERRULED.

R.C.P. 4003.8 governing pre-complaint discovery, the Court evaluated the motion and found the majority of the requested discovery is material and necessary to the filing of a complaint. Specifically, the Court found that the requested discovery was narrowly tailored in scope and time to address a limited class of issues, and without the requested discovery, the Plaintiff would be unable to sufficiently plead the timing of the alleged defamatory remarks in satisfaction of the statute of limitations. Ac-cordingly, the Court granted the motion in part and denied the motion in part and the Court granted the corresponding motion to compel depositions.

At Home Health Service (“Defendant At Home”) by Writ of Summons on March 6, 2015. After the filing of the Writ of Summons in this matter, counsel for Plaintiff reached out to counsel for the Defendants indicating his desire to conduct pre-complaint discovery. Defense counsel responded to the request by filing a praecipe for issuance of a rule to file a complaint on April 6, 2015. Thereafter, Plaintiff’s counsel served defense counsel with notices of deposition addressed to Defendant Stonich and to the cor-porate designee of Defendant At Home on April 22, 2015. On April 16, 2015, defense counsel responded to the notices of deposition by correspon-dence indicating his objection to pre-complaint discovery. The instant Motion to Compel Depositions and Extend Deadline to File Complaint then came before the undersigned in Motions Court on or about April 27, 2015. A briefing schedule was issued, and briefs having been received, the matter is now ready for disposition.

Standard of Law

(a) A plaintiff may obtain pre-complaint discovery where the information sought is material and necessary to the filing of the complaint and the discovery will not cause unreasonable annoyance, embarrassment, oppression, burden or expense to any person or party.

(b) Upon a motion for protective order or other objection to a plaintiff’s pre-complaint discovery, the court may require the plaintiff to state with particularity how the discovery will materially advance the preparation of the complaint. In decid-ing the motion or other objection, the court shall weigh the importance of the discovery request against the burdens im-posed on any person or party from whom the discovery is sought.

Pa. R.C.P. 4003.8 (2007).Litigants often cite to the case of McNeil v. Jordan, 586 Pa. 413, 894

A.2d 1260 (2006) as setting forth the standard for pre-complaint discovery. However, as noted in the 2007 comment to Pa. R.C.P. 4003.8,

Case law governing pre-complaint discovery has not developed a general rule of application. In his opinion address-ing pre-complaint discovery in McNeil v. Jordan, 894 A.2d 1260 (2006), Justice Baer stated in a footnote that the matter would be referred to the Civil Procedural Rules Committee to consider the adequacy of the existing rules and ‘to recommend any amendments that might clarify this vexing area of civil procedure.’

New Rule 4003.8 has established in subdivision (a) a two-prong test for pre-complaint discovery: (1) the information sought must be material and necessary to the filing of the com-

plaint and (2) ‘the discovery will not cause unreasonable an-noyance, embarrassment, oppression, burden or expense to any person or party.’ The first prong incorporates the language of the opinion quoted above that the information sought be both ‘material and necessary’ to the filing of a complaint in a pend-ing action. The requirement of the opinion that there be ‘prob-able cause’ that the information sought is material and necessary has not been included in the rule. The language of the second prong that the discovery not cause ‘unreasonable annoyance, embarrassment, oppression, burden or expense’ is taken ver-batim from present Rule 4011(b) governing limitation of scope of discovery and deposition.

Pa. R.C.P. 4003.8, cmt. (2007). Accordingly, the Court will analyze the instant motion pursuant to the dictate of Pa. R.C.P. 4003.8.

Discussion

By its motion, Plaintiff alleges that it “has been the victim of a series of malicious and false reports and complaints made to the Department of Human Services concerning the conditions of care at Plaintiff’s facility,” triggering “numerous investigations by ... [the] Department.” Plaintiff’s Motion to Compel Depositions and Extend Deadline for Filing Complaint, ¶2. Plaintiff further avers that it “believes that the malicious and false reports and complaints were made by the Defendant Patrick R. Stonich ... who is the principal of At Home Health Service ... and/or by other employees of At Home.” Id. ¶3. Further, Plaintiff avers its belief that “Defendants’ false and malicious reports might have been motivated either by as [sic] desire by Defendants to gain competitive advantage over Plaintiff or to deflect the attention of public authorities from the deficiencies in health care services that At Home was providing to patients of Plaintiff’s facility.” Id. ¶4. Fi-nally, Plaintiff alleges that it has:

probable cause to believe that Defendant Stonich maliciously and falsely filed reports and complaints with the Pennsylvania Department of Human Services in that on March 24, 2015, inspectors from the Pennsylvania Department of Human Ser-vices, upon completing their investigation of Plaintiff’s facil-ity in response to a complaint received by the Department of Human Services, allowed one of Plaintiff’s employees, Jason Harvey, to read the complaint which included the statement that ‘Nemo,’ the administrator of Saucon Valley, and her ‘hench-women’ had bullied the families and the residents to get them off services with At Home and that the facility had taken away all his residents. The complaint to the Department also stated that Nemo would pay for doing this.

Based on these averments, Plaintiff alleges that it “needs discovery in order to prepare a complaint ... in that Plaintiff needs to learn which employee or representative or [sic] At Home made complaints or reports to the Pennsylvania Department of Human Services, when those commu-nications were made, whether they were made verbally or in writing, and the full extent and nature of those communications.” Id. ¶10.

As to the scope of discovery sought by Plaintiff, the Notices of De-position request that Mr. Stonich and At Home’s corporate designee produce:

1. All correspondence from September 1, 2014 to the present, including writings, fax communications, electronic communications (email) and electronic images or photographs from or to you or any entity in which you have any ownership interest or over which you exercise any control, pertaining to the actions, inactions, quality of care provided by, or violations of any applicable regulations or standards of care by Namita Kapoor-Atiyeh, Saucon Valley Manor, Inc. (‘Saucon Valley’), Whitehall Manor, Inc. (‘Whitehall’), and/or the staff of either Saucon Valley or Whitehall. Such documents shall include, but not be limited to, all communications to or from the Pennsyl-vania Department of Health, its representatives or personnel the Lehigh County Agency on Aging, its representatives or personnel; the Northampton County Agency on Aging, its representatives or personnel; the Coroner of Lehigh County, its representatives or personnel; the Coroner of Northampton County, its representatives or personnel; any current or past resident of Saucon Valley or Whitehall; or any family member or legal representative of any current or past resident of Saucon Valley or Whitehall.

2. As a threshold matter, the Court must determine whether the re-quested discovery is “material and necessary to the filing of the complaint.” Pa. R.C.P. 4003.8(a). In its brief, Plaintiff argues that the requested discov-ery is material and necessary to pleading a cause of action for defamation.

The Uniform Single Publication Act, A. 42 Pa.C.S.A. §§ 8341-8345, sets forth the elements of a prima facie case in a defamation action. The burden is on the plaintiff to prove:(1) The defamatory character of the communication.(2) Its publication by the defendant.(3) Its application to the plaintiff.(4) The understanding by the recipient of its defamatory mean-ing.(5) The understanding by the recipient of it as intended to be applied to the plaintiff.(6) Special harm resulting to the plaintiff from its publication.(7) Abuse of a conditionally privileged occasion.

42 Pa.C.S.A. § 8343(a).Joseph v. Scranton Times L.P., 959 A.2d 322, 335 (Pa.Su-per.2008).

Foster v. UPMC South Side Hospital, 2 A.3d 655, 663-64 (Pa. Super. 2010).Although Plaintiff’s motion sets forth certain allegations with respect

to an alleged report against it to the Pennsylvania Department of Human Services, Plaintiff argues that these allegations are insufficient to support a pleading absent information as to the date or content of the alleged report. As to content of the alleged report, the Court agrees with Defendants that the facts alleged in Plaintiff’s motion are sufficient to allow the Plaintiff to plead this element of the claim. With regard to Plaintiff’s claim that dis-covery is necessary to satisfy the timing element of their claim, the Court notes that the statute does not explicitly require a pleader to aver the timing of an allegedly defamatory statement. Further, the case law cited by Plain-tiff for the proposition that it must plead the time when the allegedly de-famatory statements were made is merely persuasive to this Court. How-ever, the Court recognizes that the timing of an allegedly defamatory statement, although not a stated element of the offense, is certainly neces-sary to the establishment of the statute of limitations.

By their final argument in support of its motion, Plaintiff contends that absent the requested pre-complaint discovery, it is without sufficient information to aver claims related to the suspected filing of false and mali-cious reports to the Lehigh and Northampton County Offices on Aging and the Lehigh and Northampton County Offices of the Coroner. In support of the motion, Plaintiff contends that its request is narrowly tailored to address the elements of a defamation claim or claims against Defendants, and should therefore be granted.

By way of opposition, Defendants point to the fact that the discovery request seeks information relating to reports to the Pennsylvania Depart-ment of Health, the Lehigh and Northampton County Agencies on Aging, and the Lehigh and Northampton County Offices of the Coroner, while the motion speaks only to a claim against the Pennsylvania Department of Human Services. As such, Defendants contend that the requested discovery is “not necessary to the filing of a legally sufficient pleading.” Defendants’ Letter Brief at 5.

Upon consideration of the parties’ arguments, Plaintiff’s motion, and the scope of the requested discovery, the Court finds that, with limited exception, Plaintiff has sufficiently demonstrated that the requested discov-ery is material and necessary to the filing of a complaint in defamation. As to Defendants’ contention that the requested discovery is not necessary to the filing of a legally sufficient complaint insofar as it seeks disclosure of information relating to reports to the Pennsylvania Department of Health, the Lehigh and Northampton County Agencies on Aging and the Lehigh and Northampton County Offices of the Coroner, the Court notes that al-though Plaintiff fails to state so in its motion, its brief alleges its awareness “that false complaints and reports were made to the other governmental agencies” identified in the discovery request. Plaintiff’s Letter Brief at 5-6. As such, the Court finds these lines of inquiry discoverable in the instant case. Further, it is clear that without the requested discovery relating to any reports or complaints Defendants may have made with regard to the Saucon Valley facility, Plaintiff will not be able to set forth a sufficiently specific claim or claims for defamation.

However, to the extent that Plaintiff seeks pre-complaint discovery relative to Whitehall Manor, Inc., the Court finds that Plaintiff has failed to establish the elements of materiality and necessity, as Whitehall Manor is not a party to this action, nor does Plaintiff aver any connection between it and Whitehall Manor in the motion now before this Court.

The materiality and necessity of the requested information relating to Plaintiff having been established, the Court must consider whether the requested discovery is narrowly tailored to avoid any “unreasonable an-noyance, embarrassment, oppression, burden or expense” to Defendants. Pa. R.C.P. 4003.8(a). In this regard, Defendants assert that the conduct of depositions and the disclosure of written discovery before the filing of a complaint in this matter would amount to an impermissibly limitless “fish-ing expedition.” Additionally, Defendants urge that the request is overly burdensome because it requests materials dating back to September 1, 2014. In refutation of Defendants’ assertions, Plaintiff urges that its discovery request is sufficiently and narrowly tailored in scope and in time to address a very narrow class of issues. Upon review and consideration, the Court agrees. Specifically, the Court is satisfied that excepting any reference to Whitehall Manor, Inc., Plaintiff’s request for pre-complaint discovery is

directly related to their allegations against Defendants, and narrowly tailored to avoid any “unreasonable annoyance, embarrassment, oppression, burden or expense” to Defendants. Pa. R.C.P. 4003.8(a). Sharp v. Travelers Per-sonal Security Insurance Co., 36 D. & C.5th 521 (Pa. Com. Pl., Lackawa-nna Cnty. 2014) (Discovery request spanning a five-year period not un-duly burdensome); Weber v. Campbell Soup Company, 41 D. & C.3d 229 (Pa. Com. Pl., Clearfield Cnty. 1985) (Discovery permitted for a period spanning two years).

Accordingly, Plaintiff’s Motion to Compel Depositions and Extend Deadline to File Complaint is hereby GRANTED IN PART and DENIED IN PART, as set forth in the attached Order of Court.
