Much of t he pub lic con cer n ove r C-32 rel ate s to the unb ala nce d app roa ch bei ng taken with rega rds to digital lock s. By failing to ensure that wor ks containing di git al locks are subjec t to the same acc ess right s and exe mptio ns as works in th e non- digi tal realm, the govern me nt is cr eat ing a two-ti ere d lev el of right s for cons umer s and educ ator s. Inst ead of l egal certa inty, Cana dian citi zens will fac e arbitrary limitati ons on their legal rights of access. Min iste r Moo re's commen ts tha t such co ncerns ref lec t "ra dic al" or "extreme" viewpoi nts must be cha lle nged. The fac t tha t Min ist er Moore ma de these comments while defen ding Canada's nee d to me et inter national trade obligat ion s could cre ate the mist aken per cep tio n that the di git al loc k prov isi ons of C-3 2 are neces sar y in orde r to co mply with existi ng inte rnat iona l treat ies . Not hin g cou ld be fur ther fro m the truth. It is simply not cre di ble to defe nd such an un bal anc ed app roa ch as bein g nec ess ary to bring Can ada into compliance wit h WIP O and the Berne Convention. If this were the case, the govern men t would be able to show tha t it has vett ed the dig ita l loc k
