International Bar Associationthe global voice of the legal profession

The International Bar Association (IBA), established in 1947, is the world’s leading organisation of international legal practitioners, bar associations and law societies. The IBA influences the development of international law reform and shapes the future of the legal profession throughout the world. It has a membership of 30,000 individual lawyers and more than 195 bar associations and law societies spanning all continents. It has considerable expertise in providing assistance to the global legal community as well as being a source of distinguished legal commentators for international news outlets.

Grouped into two divisions – the Legal Practice Division and the Public and Professional Interest Division – the IBA covers all practice areas and professional interests, providing members with access to leading experts and up-to-date information. Through the various committees of the divisions, the IBA enables an interchange of information and views among its members as to laws, practices and professional responsibilities relating to the practice of business law around the globe. Additionally, the IBA’s high-quality publications and world-class conferences provide unrivalled professional development and network-building opportunities for international legal practitioners and professional associates.

The IBA’s Bar Issues Commission provides an invaluable forum for IBA member organisations to discuss all matters relating to law at an international level.

The IBA’s Human Rights Institute works across the Association to promote, protect and enforce human rights under a just rule of law, and to preserve the independence of the judiciary and the legal profession worldwide.

Other institutions established by the IBA include the Southern Africa Litigation Centre and the International Legal Assistance Consortium.

Arbitration Committee overview

The Arbitration Committee focuses on laws, practice and procedures relating to the arbitration of transnational disputes. Through its publications and conferences, the committee seeks to share information about international arbitration and promote its use and improve its effectiveness.

The committee has four subcommittees, namely Recognition and Enforcement of Arbitral Awards, Investment Treaty Arbitration, Conflicts of Interest, and Rules of Evidence. The committee also has established two task forces: the Task Force on Attorney Ethics in Arbitration; and the Task Force on Arbitration Agreements.

The committee publishes a newsletter which is issued twice a year. The newsletter is packed with articles from practitioners worldwide. The committee’s publications include the IBA Guidelines on Conflicts of Interest in International Arbitration and the IBA Rules on the Taking of Evidence in International Commercial Arbitration. Committee members also receive the IBA’s Dispute Resolution International journal which is issued twice a year.

The committee has more than 2,300 members from over 90 countries.

European Regional Forum overview

The European Regional Forum was established in 1989 to provide a focus originally on the work undertaken by the IBA, in developing the practice under changing legal systems of lawyers in Eastern and Central Europe. The forum was also intended to act as a channel for IBA communication with the bar associations of these local lawyers.

Since 2004 the forum has been developing and strengthening the existence of the IBA within the whole of Europe by promoting the goals of the IBA to members, non-members and others, disseminating professional know-how, and assisting the committees and other constituencies of the IBA to increase their presence in the different sub-regions of Europe, including parts of North Africa and the Middle East.

The goals of the forum include addressing current and long-term needs of the professional organisations and individual members within the geographical reach of the forum, as well as increasing membership and participation in the IBA and integrating them within the organisation. The forum will also facilitate cross-border activity between lawyers and bars in different European countries. The forum has particular focus on cross-disciplinary activities.

International Dispute Resolution Services

LCIAOne of the longest established of the international arbitration institutions, the LCIA is also one of the most modern and forward-

looking. It is an international organisation offering a worldwide service.

Based in London, the LCIA provides efficient, flexible and impartial administration of arbitration and other ADR proceedings, regardless

of location, and under any system of law. Typically, 80% of the parties involved in pending LCIA cases are not of English nationality.

LCIA arbitrationThe LCIA deals with disputes arising out of a very wide and varied range of commercial contracts, including telecommunications;

insurance; oil and gas exploration; construction; shipping; aviation; pharmaceuticals; shareholders agreements; IT; finance and

banking; and general sale of goods. Sums in dispute range from US$50,000 or less to more than US$5 billion.

LCIA mediationThe LCIA administers mediation under its international mediation procedure, which may be used by parties who are already

committed to mediate, by virtue of contractual dispute resolution provisions, and by parties who have not provided for mediation,

but who wish to mediate their dispute, either in an attempt to avoid, or during the course of, litigation or arbitration.

NeutralsThe LCIA draws on its own database of the most eminent and appropriately qualified arbitrators and mediators, from a wide range

of professional backgrounds and disciplines. There is, however, neither a closed list of individual arbitrators or mediators nor a closed

list of nationalities. All arbitrators and mediators are required to declare and to maintain their independence and impartiality.

Other ADRThe LCIA also administers expert determinations, adjudications and other alternatives to arbitration and mediation, for which

purpose recommended procedures and clauses are available on request from the LCIA Secretariat.

ChargesThe LCIA strives to keep the cost of dispute resolution reasonable, to which end the LCIA’s charges, and the fees charged by the

tribunals it appoints, are not based on the sums in issue. It also seeks to give the parties as much control as possible over the

proceedings and to ensure that proceedings are concluded as expeditiously as is conducive to the proper determination of the dispute.

Conferences and MembershipIn addition to its dispute resolution services, the LCIA has a general membership for which it organises a worldwide programme of

conferences, seminars and other events of interest to the arbitration and ADR community.

Young International Arbitration Group (YIAG) YIAG is an LCIA sponsored association for younger members of the arbitration community. It holds a number of symposia each year,

at venues throughout the world, and publishes an e-newsletter for its members. The upper age limit for membership, for which

there is no subscription, is 40 years. Please email [email protected] for further information.

Overseas officesThe LCIA has associated offices in Dubai, at the Dubai International Financial Centre (The DIFC-LCIA Arbitration Centre), and in

New Delhi (LCIA India).
