ASSOCIATION OF

MULTIMODAL TRANSPORT

OPERATORS OF INDIA

AMTOI, The Association of Multimodal Transport Operators of India, was formed with the object of organizing Multimodal Transport Operators at the national level and improving the quality of their services. The members of the Association are Multimodal Transport Operators registered with the Directorate General of Shipping, Mumbai under the Multimodal Transportation of Goods Act, 1993 which also includes some associate members like CFS operators, tank container operators etc.

The Association is a non-profit making body registered under the Indian Companies Act and is managed by the Managing Committee comprising of 7 members elected by the Operator members. The Committee is assisted by a Board of Advisors consisting of the representatives of Government / Public Sector Organizations. Also, it has various trade association representatives on its extended board and is thus likened to an apex body.

As a unique initiative, AMTOI has set up a forum called the Grievance Redressal Forum (GRF). The objective of this Forum is to create a platform for dispute resolution and thereby addressing grievances of the members of the trade.

The Association has a two-tier membership – Ordinary members who are registered as MTOs and Associate members who are not MTOs themselves but who are involved in operations connected with multimodal transport. The Associate members are not eligible for voting rights or contest in the Elections.

The Association from time to time has made suggestions for the consideration of Government and in fact the suggestion for amending the Multimodal Transportation of Goods Act and for adopting other related measures.

AMTOI has been able to secure representation on Government bodies like the Standing Committee on Promotion of Exports, (SCOPE Shipping and SCOPE Air), Task Force on Multimodal Transport and various other forums of the Ministries of Shipping, Commerce & Finance of the Government of India. The Association is also a member of the International Multimodal Transport Association based in Geneva and has thus acquired international recognition.

For the benefit of its members, regular training courses are conducted be it on tax issues, insurance or other such related subjects.

An awaited event of the year is the MULTIMODAL DAY or an AMTOI DAY which the Association organizes as an 'Annual Day' for the last many years wherein the entire shipping fraternity of Shipping Lines, Ports CFS operators, Freight Forwarders, NVOCC's, CHA's, Airlines, Government authorities in addition to MTO's come together to network and interact with each other under one roof.

Members are kept abreast of the happenings in the industry by MULTIMODAL TIMES or AMTOI Newsletter which is published as a quarterly magazine currently and we hope to graduate into a monthly publication which will attempt to capture critical issues that are close to the industry and along with opinions of the industry leaders.

Lastly, keeping abreast with the advancing technologies, AMTOI continuously improvises its website and offers tools for various industry players to come together and thus endeavoring to be a leader in its class.

Mr. R K Rubin, Vice President

Is the Managing Director of Transcon Freight system Pvt Ltd who undertakes transportation, customs broking and freight forwarding as a multimodal transport operator. Specializaing in haz chemical handling and distribution in many locations around the globe, he is currently serving as Vice President of AMTOI.

Mr. Xerxes Master, Hon. Secretary

Mr. Xerxes P. Master is the Joint Managing Director of Master Group of Companies having diversified interests in Shipping, Logistics and Power.

He is the Hon-Secretary of The Association of Multimodal Transport Operators of India (AMTOI) and he is also on the Sub-Committee of Logistics for the year 2015-16 with the Confederation of Indian Industry (CII). He has been the Past President of the Indo-Belgian-Luxembourg-Chamber of Commerce & Industry (IBLCCI) and an ex-committee member of the Air Cargo Agents Association of India (ACAAI).

Mr. Vivek Kele, President

Is a post Graduate in Management and currently Director at Teamglobal Logistics. He has over 23 years' experience in the Shipping and Transport field. He is currently also on the Ports and Shipping Committee of IMC, He has been the president of Rotary Club of Mumbai Lakers for the year 11-12 and has served in several positions at the Club and the Dist Level. He is visiting faculty at various Industry seminars and conferences.

He is a marathon runner and also part of the organising team of 'The Powai Run' which is a leading sport event in Mumbai, the commercial Capital of India. He is an avid reader and also a world traveller. He is currently serving as President of AMTOI.

Mr Shantanu Bhadkamkar, Managing Committee Member

is the Managing Director (Group CEO) of ATC Group, a leading Customs Broker & International Freight Forwarder in India. In addition he is also the President of Maharashtra Chamber of Commerce, Industry & Agriculture (MACCIA) - an Apex Chamber of State of Maharashtra and the Chairman of IFCBA (International Federation of Customs Brokers Association). He is also the Immediate Past Chairman of FFFAI & CSCMP RT Mumbai, Managing Committee Member of AMTOI. He is also with other local, regional, national & international NGOs currently activelyin active positions.

He has been awarded the World Customs Organisation's Certificate of Merit; and has been a recipient of awards from many organisations for service rendered to the industry.

Mr. Nailesh Gandhi, Hon. Treasurer

the Director of M/s. Express Global Logistics Pvt Ltd., and other group companies, handling Projects, Freight Forwarding, Supply Chain, Cargo handling Equipment and Hospitality.

He has been on the board of BCHAA, FFFAI, and trustees of MBPT and JNPT. He is currently serving as Hon. Treasurer of AMTOI.

Mr. Anand Arvind Sheth, Advisor

Is a Graduate and Currently Managing Director of CKB Group of companies involved in the logistic industry since 1917. He has 32 years of experience in freight forwarding & logistics industry. Actively involved in managing the growth of the business. Instrumental in growing the business from 1 office with 40 employee's to 22 offices with over 300 personnel and also an overseas office in USA. The managing director of the group having interests in all areas of logistics. He is the Advisor of AMTOI and also Convenor of GRF.

A post graduate with PGDFM & PGDIL and having 30 years of rich experience in the Shipping & Logistics Industry. Mr. Varadarajan leads a very cost effective and environment friendly multi-modal logistics company in India, Shreyas Relay Systems Ltd a Transworld Group Company.

Before his career at SRSL, Mr. Varadarajan looked after the Transworld Group agency division for Messina Line as CEO for more than a decade and Project Leader for group CFS venture (joint venture with CONCOR in Dadri, Nepal and group own CFS at Mundra)

Mr. Sailesh Bhatia, Immediate Past President

Is the Managing Director of Bhatia Shipping Pvt Ltd and is in the business of logistics since past 30 years.

He is currently Trustee on JN Port, Sr. Vice President of BCHAA, and immediate Past President of AMTOI

Mr. Shashi Tanna, Advisor

Is the Managing Director of Links Cargo Agencies handling Customs clearance and freight forwarding as well as multimodal transport. He is also on the Board of Advisors of AMTOI.

Mr. Mahesh Trikha, Convenor, Northern Regional Chapter

He is a Post Graduate in Marketing & Sales from Bhartiya Vidya Bhavan, New delhi.

He has been in the International trade of Imports and Exports since 1977. After having the experience of working with Continental Carriers and Bax Global for almost 10 years, He started Cargo Channels as Custom Broker with the head office in Delhi in June 1995 and now has a network Pan India in 7 cities. His overall experience with International Trade/Ocean and Air/ Logistics etc has been more than 35 years.

He has been actively associated with DCCAA (presently MC member too) and ACAAI (Presently chairman NR) for several years.

Currently he is the Convenor of Northern Regional Chapter of AMTOI.

Mr. Yogesh Parekh, Special Invitee, Managing Committee Member

Director - Orchid Shipping Pvt. Ltd (part of Parekh Group).

A commerce graduate and a fellow of the Institute of Chartered Shipbrokers, London.

Having experience of more than 15 years in shipping & logistics industry. Actively participates in the day to day functioning of group concerns and provides able leadership to the group personnel.

Mr. George Abrao, Special Invitee, Managing Committee Member

Managing Director – Triton Logistics & Maritime Private Limited the logistics & MTO arm of the Group.

The group in addition to providing Intergrated logistic solutions, also acts as agents for some of the large container shipping lines, and provides Ship to Ship lighterage service for Oil and Natural gas in the Indian sub-continent. He is the Special Invitee – MC Members of AMTOI.

Mr. Uday Bhaskar Reddy, Convenor, Southern Regional Chapter

Have put in more than 15 years of service in Sanco Trans Ltd., A public limited company headquartered out of Chennai and having branches / associates indiawide. He started his innings as a Manager Marketing and has added head couple of divisions. Before assuming the current position of Whole Time Director on the board of the company. He is Convenor of the Southern Regional Chapter – AMTOI.

Mr. Pramod Kumar Srivastava, Convenor, Eastern Regional Chapter

Is the Director and CEO of The PDP Group a renowned name in the logistic Industry. He started second company “PDP International Pvt Ltd” specialized in Freight Forwarding and warehousing and is accredited with ISO 9001 : 2008 and ‘MTO’ accreditations. The company is IATA Agent and is a member of AMTOI, FFFAI, Federation of Indian Exports and International Freight Forwarders Association. He opened an ICD in Durgapur namely ‘Allied ICD Services Ltd’. Under his leadership, the grew company grow from 20 employees to 350 employees. He is currently Convenor of Eastern Regional Chapter - AMTOI.

Mr. Anand has over 40 years of experience in this Industry. He joined New Globe in 1965 and has spearheaded its growth ever since. He expanded its activities from ocean freight to Air Freight in the early Eighties and created relationships with global giants like Panalpina and Expeditors. He has extensive and deep relationships within the Industry - be it carriers, foreign agents or competitors. He served as the President of A.C.A.A.I (Air Cargo Agents Association of India).

He was awarded "Star Of Asia Award" from International Business Council, New Delhi on 26th May, 2015.

Mr. Anand holds a Bachelors of Science Degree from Mumbai University.

Capt. Ashok Kumar Bhattacharjee passed out from the premier shipping institution T.S Rajendra in the year 1979 after obtaining extra first class. He spent 16 years at sea rising to command various type of vessels. His shore sojourn commenced in year 1995 and has spanned experience in various shipping verticals like shipping agency, liner trade, Container freight stations etc.

Mr. Ramakrishna is Head Rail business at DP World Intermodal (CRRS)

He has 20 years of International Experience in Shipping multi Logistics and Infrastructure Industry he leads the operations and business development process of the company. He is also on the Advisory council member of Logistics forum, FICCI and a member of CII Logistics and PHDCC task force on Logistics Management and a Extended Board member of AMTOI.

Mr. Ramakrishna has a Bachelors degree in Mechanical Engineering and has a Masters in Computer applications and have sleuth of experience on ERP software's specialized in supply chain Logistics.

Ms. Sumeet Sahi

Women's International Shipping & Trading Association

is Director of Sitara Shipping Ltd and is handling the NVOCC, Ship Chartering , CFS Business under the Aegis of Capt S.S Sahi.

She has also been active in making " Sitara" is one of the key players in the ODC cargo segment. Having several firsts to its credit Sitara has been first NVOCC to import containers ex-bond after SCI and the first MTD BL was issued by their office.

She is founder member of Indian Chapter of WISTA and is currently serving her 2nd term as Jt Secretary in the WISTA India board.

She believes strongly in encouraging women and young talent to be part of the maritime industry.

Dear Friends,

Season’s Greeting and a Very Happy New Year !

This is my first official communication to you since taking over as a president of our association. At AMTOI we have always strived to get various segments of our industry together through our extended board, discuss issues of common interest and find solution jointly. As the world faces issues of climatic changes, rising incidents of terrorism, declining crude prices and continued down turn, it has direct impact on the shipping industry globally and at home in India.

Whilst the above is true, we are at an advantageous position in India where our industry is under going several positive changes and a few challenges. The Changes are the several far reaching steps being taken by the Modi Govt in building transportation infrastructure, in the last 18 months we have seen several infrastructure projects as in ports, terminals, Dedicated Freight Corridors, New highways, Developing port of Chabbhar in Iran either being as announced as new projects or the existing ones are being fast tracked. Additionally there has been slew of policy changes as in advent of GST, promotion of Indian Flag ships through equitable tax regime, promotion of Inland Waterways, signing of Indo Bangla Coastal Shipping Agreement and many more,

On the other hand the Challenges that our industry is facing is Notices being received by our members on payment of Service Tax on Freight and Fright Differentials, Delay in passing of GST Bill in the parliament, continuous decline in Exports due to falling global demand in the developed countries etc

It is very clear that the changing infrastructure landscape opens huge opportunities for Logistic Service Providers whilst the challenges keep us busy on a tactical mode. The development of infrastructure will ensure that the movement of goods is expected to be much faster in future, however just addition of infrastructure is not sufficient, we need to compliment the same by automation of various processes and weeding out of wastages in the supply chain. On a Daily basis we see that the smooth movement of goods is constantly interrupted by procedural hurdles like payment of tolls, congestion at the Port gates, delays in passing of documents so on and so forth. As you can see that most if not all these issues are Man Made and its totally in our hands weed out these wastage so that together we can promote the free and last movement of Goods across the country and across the borders.

Whist every one wishes that India should fare better on the Logistics Performance Index and Ease of Doing Business and the expectation is that the Govt should do something about it, Whilst this is true, even we can do something about it individually and at an association level. At AMTOI we have realised that we

have several industry associations working individually to address issues of their members which are specific to a particular segment. Whilst this is needed there is an absence of an umbrella organisation which can combine these voices and be a common face to the Govt. When this issue was deliberated at the Extended Board Meeting of AMTOI it was realised that we need to form a Confederation of Logistics Associations and AMTOI was mandated to coordinate these efforts.

We have also identified common agenda points for the Confederations, these will be Promotion of Cargo Community System and Skill Development! So whilst the Confederation is being Conceptualised, AMTOI in the interim has already started working on the common agenda points and we hope to announce some developments on this front in the coming months,

Lastly on the issue of Service Tax on Freight and Freight Differential we at AMTOI have a very clear view that the same is not payable and we have issued an Advisory to our members detailing the reasons as to why the Service Tax is not payable. Members to whom this advisory has not yet reached should contact the AMTOI Secretariat on [email protected]<mailto:[email protected]> for the same.

Editorial

The focus of AMTOI is growth of Multimodalism in India and its proliferation in all the segments of Supply Chain Management. Among the various initiatives of AMTOI include participation in Government Policy Formulation, Creation of Awareness about advantages of Multimodalism among the service user community and collaboratively organising all the stakeholders of the EXIM Trade, for universal spread of Multimodal Transport, on a common platform.

The transportation demands of each segments of economy and each commodity is different, furthermore the transportation needs of each port or manufacturing cluster or trading hub is different; there is a lot of benefit that can be derived by sharing practical experience and developing a cooperative approach. This is particularly important during times of economic stagnation where on one hand competitiveness is at a premium and on other hand investors are shy about long term investments. AMTOI is thoroughly committed for creating an environment of cooperative approach and enhancing efficiencies in the transportation system particularly by facilitating Multimodal Transport. AMTOI now has expanded its horizon for creating a platform for development of Multimodal Transport by encouraging like-minded organisations engaged in international transportation of goods from other countries. AMTOI has therefore taken an initiative to invite the Office Bearers and Members of Associations representing interest of international transportation from other countries. We had representation from 7 nationalities, who participated in the AMTOI DAY - 2015. We expect larger participation from more countries in the forthcoming AMTOI DAY – 2016 as AMTOI DAY continues to grow in popularity and participation every year, not just in India but also in Countries which are India's major trading partners.

This month's AMTOI Managing Committee Meeting (December 2nd 2015) coincided with the Foundation Day of AMTOI. The Managing Committee Members celebrated it with great pride. The next Foundation Day will be a larger event, and we will look forward to have participation from all the members and other stakeholders in the international trade.

There has been change of guard in AMTOI, transition as always has been smooth and seamless, and by consensus. The new leadership will bring new ideas, new energy, new initiatives and will maintain the environment of freshness and assimilation of everything that is new & good.

Internationally there have been concerns on issues such as SOLAS Amendment about container weight verification, usage of 3d printers of cargo thieves to make fake security etc.

On the regulatory side, the international organizations, particularly the intergovernmental organizations are discussing various issues such as increased illicit wildlife trade (how to control it), mandatory provisions for Trade Facilitation in Bali Package of World Trade Organization (WTO), special initiatives for capacity building and countering counterfeit and piracy (intellectual property rights).

An interesting court case was reported where shipping lines has sued a merchant for container detention charges but the judge ruled that the container detention charges should have ceased when it becomes known that it exceeds with the value of buying the new containers. The high container detention charge does

hurt the merchants, but it hurts the Transport intermediaries, Customs Brokers, International Freight Forwarders and Multimodal Transport Operators. / NVOCCs even more. While it is very easy for the shipping lines to recover the cost or damages from the transport intermediaries; the transport intermediaries in turn, particularly in India, find it extremely hard (almost impossible) to recover the dues from the merchants.

UNCITRAL is discussing various legal issues related to usage of electronic transferable records. A working group was constituted to consider draft provision for functional equivalence and technology neutrality, and achieve the same without dealing with the matters governed by the underlying substantive law(s); leading to formulation of International Convention or Draft Model Law for all the countries to adopt. The documents that were taken into consideration are like “Bills of Exchange”, “Promissory Notes”, “Bills of Lading” etc.

Perhaps the most important issue that is currently being discussed globally, is the issue of Global Climate Change and Increased Carbon Emission. Sustainable growth is therefore is a serious challenge that needs to be tackled global Political Leadership, Regulatory Authorities, manufacturing sector & scientists.

AMTOI true to its national character had meetings at different corners of the country namely Chennai, Goa, Kolkata and has been invited as speakers or panelists for various events from all round the country. Special efforts have been taken for launching North India Chapter (New Delhi) & East India Chapter (Kolkata). By the time we present our next quarterly issue of AMTOI News we will have more interesting updates about growth of Chapters.

Efforts of WTO such as mandatory provision for trade facilitation and greater opening up of economies have had little impact so far on the challenges of stagnation due to global slowdown. Perhaps we need to be more patient, as said by Haruhiko Kuroda, the Governor of the Bank of Japan, “Structural reforms, deregulations… are very important in the long term and they will have significant impact for growth potential, but by nature it takes time so I hope people are more patient”. The silver lining is, from a drop of two ranks from the position of 140 in 2014 of World Bank's Ease of Doing Business Index Ranking to 142 in 2015; India has improved the ranking by a jump of 12 positions to 130 in 2016. It is a significant improvement in ranking. However, not only the same needs to improve at an even faster pace but in addition the momentum has to be sustained over a long period to achieve the government goals of having ease of doing business rank of below 50. Big country like India, where the market conditions are very competitive and the consumers are extremely price sensitive, the ease of doing business in India needs to be amongst the top 20 for attracting investors; it is so not just global capital but equally so for the local investors. Failing which, the advantages of growing middle class and the demographic advantage of India will be frittered away, and the next emerging leader (country) will steal the initiative.

India has been in the focus globally and almost all the countries look towards India as an engine of growth, with the Prime Minister of India personally traveling and visiting numerous countries to meet the global political leadership, global business leaders and Indian Diaspora, the already high expectations are now even higher.

Seminar on Transfer Pricing and Service Tax.

A Seminar was held by AMTOI on the Transfer Pricing & Service Tax on 26th March, 2015 at the head office of the Maharashtra Chamber of Commerce, Industry and Agriculture (MACCIA).

The event was well attended by a cross section of the shipping industry wherein Mr. Sushil Lakhani, a renowned tax expert, presented a brief on Transfer Pricing followed by an inter- active session on service tax by Mr. Deni Shah, Associate partner of BMR Associates. The discussions were followed by a question/answer session with the panelists.

AMTOI held its 1st ever Managing Committee meeting in Kolkata and created history by starting its Eastern Chapter on 4th August, 2015 at the Palladian Lounge, Bengal Chamber of Commerce & Industry with the co-operation of Mr. Ashok Janakiram of ASIC.

This was subsequently followed by an inter-active session with the Kolkata Shipping fraternity wherein Mr. Sailesh Bhatia welcomed the audience and gave them a brief on AMTOI's intentions and goals. This was followed by a presentation on the benefit of becoming a Multimodal Transport Operator and AMTOI member by Mr. Xerxes Master and Mr. Tej Contractor. The same was followed by a question/answer session. Thereafter Mr. Varadarajan of Shreyas Relay Systems and MC member of AMTOI made a presentation on Coastal Shiping.

In his concluding speech Mr. Vivek Kele, Hon.Secretary advised the audience as to how AMTOI is helping its members through various international tie-ups with the likes of Port of Antwerp - Belgium, Peel Ports - UK, National Association of Freight and Logistics (NAFL) - UAE amongst others. He thanked Mr. Ashok Janakiram for co-ordinating this event and members of the trade who were present to understand the nuances of Multimodal Transport and activities of AMTOI.

AMTOI held its 16th AGM on 2nd September, 2015 at the Royal Bombay Yacht Club. The following office bearers were elected for the term 2015-16:

The outgoing President Mr. Sailesh Bhatia addressed the audience and briefed them on the various achievements in the previous year and thanked everyone related to AMTOI for their unstinted support during his tenure.

As per tradition, AMTOI had organized some interesting speakers post the AGM. The first speaker was Mr. Sujan Hajra, a leading Economist in our country, earlier with the Reserve Bank of India and currently Chief Economist of the Anand Rathi Group. He made an interesting presentation to the audience as to how developments in recent times in the global economy like reduction of oil prices, devaluation of Yuan and the potential development of the US Fed increasing the interest rates will have a far reaching impact on global trade. He shared some interesting statistics on global commerce, peer countries and the Indian economy to elucidate his views. In the Indian context, he spoke about our Governments investment in Logistics infrastructure

in areas of Port Terminals, Dedicated Freight Corridors and its impact of these developments on the Indian Transport Sector.

T h e 2 n d s p e a k e r w a s M r . G i r i s h Venkataraman, CEO - IIFL Investment Adviser and Trustee Services Limited who spoke about preserving family wealth. Since most of the business in the logistics industry are family run and controlled the audience was captivated by his presentation wherein they were made aware about the challenges on protection of family and business assets. The presentation was followed by a question and answer session.

The AGM was well attended by the shipping fraternity and prominent members of the trade who were present were Capt. M M Saggi, Director NMIS, Mr. Dinesh Lal of AMI India, Mr. Nityam Khosla of Teamglobal Logistics, Mr. George Abrao of Omega Shipping, Mr. Prithwijit Maitra of Maersk India amongst others.

AMTOI signed an MOU for Skill Development at the 3rd AMTOI Managing Committee meeting held at the Waterstone Club, Andheri on 7th October, 2015. The MOU was signed between AMTOI and the Narottam Morarjee Institute of Shipping (NMIS) to provide skill development to the shipping industry.

The purpose of this MOU was to develop skill based academic and education co-operation associated with Shipping and Logistics related functions of Multimodal Transport Operators to promote mutual understanding and growth between the two organizations. Both these organizations agreed to develop a joint set of activities in the academic areas of mutual interest on basis of equality and reciprocity.

Both AMTOI and NMIS are also looking to work closely with the office of D G Shipping to expand the scope, scale and credibility of this programme across the country in different segments of the industry.
