    The law states that any "reasonably segregable" portions ofan otherwise exempt record will be provided to a [FreedomOf Information Act (FOIA)] requester after redaction ofparts which are not to be disclosed. The review process mayinclude redacting (blacking out) material which is exempt.

    However, where non-exempt material is so inextricablyintertwined that disclosure of it would leave onlymeaningless words and phrases, or where the editingrequired for partial disclosure would be so extensive as toeffectively result in the creation of new records, the entirerecord may be withheld. Consult General Counsel ifcontemplating a response which asserts materials arenonsegregable.

    Last summer, the Electronic Frontier Foundation (EFF)submitted a FOIA request in order to obtain moreinformation on the Foreign Intelligence Surveillance Courts

    activitiespursuant to Section 702 of the ForeignIntelligence Surveillance (FISA)which they claimed wereunreasonable under the Fourth Amendment. The DOJsresponse:

    The government has determined that disclosure of theinformation withheld from Plaintiff could result inexceptionally grave and serious damage to the nationalsecurity. Plaintiff obviously cannot contend otherwise. The

    Court accordingly should defer to the governmentsdetermination in this case, uphold the Departmentswithholdings, and grant this motion.

    The Department of Defense has been granted exemptionfrom the Freedom of Information Act (FOIA). In December2005, Congress passed the 2006 Defense Authorization Actwhich renders Defense Intelligence Agency (DIA) operationalfiles fully immune to FOIA requests, the main mechanism by

    which watchdog groups, journalists and individuals canaccess federal documents. Of particular concern to critics ofthe Defense Authorization Act is the DIAs new right tothwart access to files that may reveal human rightsviolations tied to ongoing counterterrorism efforts.
