    AMENDMENTS TO THE CONSTITUTION

    Amendment XI

    (1798)

    The judicial power of the United States shall not be construed to extend to any suit in

    law or equity co!!enced or prosecuted a"ainst one of the United States by citi#ensof another state or by citi#ens or subjects of any forei"n state$

    jurisdiction thereof are citi#ens of the United States and of the state wherein theyreside$ 4o state shall !a,e or enforce any law which shall abrid"e the pri'ile"es ori!!unities of citi#ens of the United States+ nor shall any state depri'e any person oflife liberty or property without due process of law+ nor deny to any person within itsjurisdiction the equal protection of the laws$

    Section $ 4o person shall be a Senator or .epresentati'e in 6on"ress or elector ofresident and ice resident or hold any office ci'il or !ilitary under the UnitedStates or under any state who ha'in" pre'iously ta,en an oath as a !e!ber of6on"ress or as an officer of the United States or as a !e!ber of any statele"islature or as an executi'e or judicial officer of any state to support the

    6onstitution of the United States shall ha'e en"a"ed in insurrection or rebelliona"ainst the sa!e or "i'en aid or co!fort to the ene!ies thereof$ /ut 6on"ress !ayby a 'ote of two*thirds of each -ouse re!o'e such disability$

    Section &$ The 'alidity of the public debt of the United States authori#ed by lawincludin" debts incurred for pay!ent of pensions and bounties for ser'ices insuppressin" insurrection or rebellion shall not be questioned$ /ut neither the UnitedStates nor any state shall assu!e or pay any debt or obli"ation incurred in aid ofinsurrection or rebellion a"ainst the United States or any clai! for the loss ore!ancipation of any sla'e+ but all such debts obli"ations and clai!s shall be heldille"al and 'oid$

    Section 3$ The 6on"ress shall ha'e power to enforce by appropriate le"islation thepro'isions of this article$

    The Senate of the United States shall be co!posed of two Senators fro! each stateelected by the people thereof for six years+ and each Senator shall ha'e one 'ote$ Theelectors in each state shall ha'e the qualifications requisite for electors of the !ostnu!erous branch of the state le"islatures$

    hen 'acancies happen in the representation of any state in the Senate theexecuti'e authority of such state shall issue writs of election to fill such 'acancies:ro'ided that the le"islature of any state !ay e!power the executi'e thereof to!a,e te!porary appoint!ents until the people fill the 'acancies by election as thele"islature !ay direct$

    This a!end!ent shall not be so construed as to affect the election or ter! of anySenator chosen before it beco!es 'alid as part of the 6onstitution$

    Amendment XVIII

    (1919)

    Section 1$ 0fter one year fro! the ratification of this article the !anufacture sale ortransportation of intoxicatin" liquors within the i!portation thereof into or theexportation thereof fro! the United States and all territory subject to the jurisdiction

    Section 5$ The 6on"ress and the se'eral states shall ha'e concurrent power to enforcethis article by appropriate le"islation$

    Section $ This article shall be inoperati'e unless it shall ha'e been ratified as ana!end!ent to the 6onstitution by the le"islatures of the se'eral states as pro'ided inthe 6onstitution within se'en years fro! the date of the sub!ission hereof to thestates by the 6on"ress$

    Section &$ The 6on"ress !ay by law pro'ide for the case of the death of any of thepersons fro! who! the -ouse of .epresentati'es !ay choose a resident whene'erthe ri"ht of choice shall ha'e de'ol'ed upon the! and for the case of the death ofany of the persons fro! who! the Senate !ay choose a ice resident whene'er theri"ht of choice shall ha'e de'ol'ed upon the!$

    Section 3$ Sections 1 and 5 shall ta,e effect on the 13th day of

    Amendment XXIII

    Section 1$ The =istrict constitutin" the seat of "o'ern!ent of the United States shallappoint in such !anner as the 6on"ress !ay direct:

    Amendment XXV

    Section &$ hene'er the ice resident and a !ajority of either the principal officersof the executi'e depart!ents or of such other body as 6on"ress !ay by law pro'ide

    trans!it to the resident pro te!pore of the Senate and the Spea,er of the -ouse of.epresentati'es their written declaration that the resident is unable to dischar"e thepowers and duties of his office the ice resident shall i!!ediately assu!e thepowers and duties of the office as 0ctin" resident$

    Thereafter when the resident trans!its to the resident pro te!pore of the Senateand the Spea,er of the -ouse of .epresentati'es his written declaration that noinability exists he shall resu!e the powers and duties of his office unless the iceresident and a !ajority of either the principal officers of the executi'e depart!ent orof such other body as 6on"ress !ay by law pro'ide trans!it within four days to theresident pro te!pore of the Senate and the Spea,er of the -ouse of .epresentati'es

    their written declaration that the resident is unable to dischar"e the powers andduties of his office$ Thereupon 6on"ress shall decide the issue asse!blin" withinforty*ei"ht hours for that purpose if not in session$ f the 6on"ress within twenty*onedays after receipt of the latter written declaration or if 6on"ress is not in sessionwithin twenty*one days after 6on"ress is required to asse!ble deter!ines by two*thirds 'ote of both -ouses that the resident is unable to dischar"e the powers andduties of his office the ice resident shall continue to dischar"e the sa!e as 0ctin"resident+ otherwise the resident shall resu!e the powers and duties of his office$
