Thismonth,IndiasawoneofthebiggeststrategicdevelopmentsintheU.S.-Indiarelationship.Therecentlyconcluded2+2DialoguewasheldforthefirsttimewiththeForeignandDefenceMinister,withtalkscommittingto“strengthendefence ties further and promote better defence and security coordination and cooperation.” COMCASA, theCommunicationsCompatibilityandSecurityAgreement,wasfinalizedtoenablegreaterinteroperabilitybetweenthetwocountries,therebyenhancingintelligenceandinformationsharing.ThepaneldiscussionwithObserverResearchFoundation(ORF)tofocusondiplomaticanddefensecooperationwasmeaningfulandtimely.

Indiabecameeligible forStrategicTradeAuthorizationTier-1 licenseexemptionand therewere talksofexpanding/facilitatingtradeandimprovingmarketaccess.

Lieutenant General Charles Hooper, Director, Defense Security Cooperation Agency, met AMCHAM’s DefenseCommitteemembersinhisfirstindustryengagementafterthe1+1and2+2U.S.–IndiaDialoguesandhighlightedthepositiveengagementsbetweenSECDEFGeneralMattisandRakshaMantriNirmalaSitharamanduringthe1+1engagement.

InaninteractivesessionwithMr.GilbertKaplan,UnderSecretaryofCommerceforInternationalTrade,U.S.DepartmentofCommerceandMs.DianeFarrell,DeputyAssistantSecretaryforAsia,membersdiscussedtrade-relatedchallengesacross sectors, healthcare, Make in India, transfer of technology, exports, tariffs, medical devices, trade marginrationalizationandstandards,amongothertopics.

Meanwhile,AMCHAM,initseffortstobringtogetherindustryleaderstoacommonplatformtodiscussvariousissuesandcarveoutplans,announcedthelaunchoftheDiversityandInclusion(D&I)Committee.Asignificantstepaswetrulybelievethatdiversityisaharbingerofgrowth.Iurgeallmemberstosupporttheinitiative.

The Anti-Corruption & FCPA Compliance Committee organized its annual signature event, 5th Anti-Corruption Compliance and Risk Management Master Class.Thiseventbroughttogethermemberstounderstandrecenttrends,theireffectoncorporatecomplianceprograms,andtheeffectsoflegislationsonbusiness,intheglobalscenario.

TheAMCHAMCSRCommitteealsocametogethertodiscussfuturecollaborationwithUSAID.Inthesamemeeting,Mr.PankajKamaliya,ChiefOperationsOfficer,GujaratCSRAuthority,GovernmentofGujarat,sharedbestpracticesofitsCSRinitiative.

Wearenowlookingforwardtothe12thbiennial'AeroIndia2019’,whichwillbeheldinBengaluruinFebruary2019.Bestoflucktoallforasuccessfulshow.

Defense Committee Meeting

AMCHAM’sJulyDefenseCommitteemeetingwasheldon 12th July 2018 in New Delhi. Guest speaker, Mr.LaxmanKumarBehera,ResearchFellowattheInstitutefor Defence Studies and Analyses (IDSA), joined the

meeting and discussed the MoD budget scenario atlengthwithmembers.ThecommitteealsodiscussedtheupcomingUSGdefensevisitsandstatusofUSGdefensepolicies.

Briefing Session for Medical Devices Committee with U.S. Embassy Officials

On 18th July 2018, a small small group of AMCHAMmembers from the Medical Devices Committee metwith U.S. Embassy officials under the Chairmanship ofMr. Prabal Chakraborty, Chairman – Medical DevicesCommittee,AMCHAMandVicePresidentandManagingDirector, Boston Scientific India. The purpose of themeetingwas tobriefEmbassyofficialsonkey issuesofthemedicaldevices industryandseek their support forresolution of the same. AMCHAM also requested for aquarterly interaction between members and Embassyofficials.

Key topics of discussion included trade marginrationalization, pricing and regulatory challenges.

Ms. Lord and Mr. Matthew Warren, Acting Director,InternationalCooperationhadcandidconversationswiththegroupon their engagementwith her counterpart atthe DTTI dialogue, about the restructuring of the DTTIJointWorkingGroupsinto5groupsdownfrompreviously8 JointWorkingGroups, namely ArmyWorkingGroup,Navy Working Group, Airforce Working Group, AircraftWorkingGroupandOtherWorkingGroup,withspecificleads to take up the discussions on behalf of theU.S.Government. DTTI Joint Working Groups were earlierbased on projects but with the restructuring they havebeenstreamlinedintodomainworkinggroups.

They also updated the group on the objectives of the

NationalDefenseStrategy,which amongst other items,focusesonstrengtheningalliancesandpartnershipandformulating business cases. It was mentioned that theIndianEmbassyinWashingtonwasconsideringplacingan individual inWashingtonD.C. toonly focusonDTTIandenablefacilitation.

Theyalsourgedindustrytoprovideinputsonsignificantbusinesscasesthatcouldbeadoptedandsignificantroadblocksthatcompanieswerefacingtotakemattersupfordiscussions.Theyalsorequestedforproposalsoninputson behalf of industry that the U.S. Government couldprovide to the Government of India for better DefenceTechnologyandTradeInitiativedialoguesinthefuture.

Cyber Security Committee Meeting

AMCHAM India held its firstCyberSecurityCommitteemeeting for the year 2018-19 on 24th July under theChairmanshipofMr.RakeshKharwal,CountryLead,IBM.Membersdiscussedkeyissuesarounddatalocalization,U.S. Cloud Act, Preferential Market Access in cyber

securityproducts,skillsetincybersecurityandartificialintelligence. After consolidating inputs from members,the committee would raise concerns to the relevantstakeholdersinthegovernment.

Pharmaceuticals Committee Meeting

Members deliberated and suggested their ideas onreviving the committee, which has struggled to getparticipation frommembers in the past and agreed toleverage the AMCHAMplatformwhich enjoys a strongconnectionwiththeU.S.Embassy.ItwasalsosuggestedtostrengthentheengagementwiththeU.S.EmbassyandincreasethefrequencyofinteractionsofmembersandtheEmbassy.ThecommitteedecidedtoworkonincreasingthemembershipofthecommitteebyreachingouttoU.S.basedcompaniesnotyetmembersofAMCHAM.

Membersalsotooktheopportunitytohighlightconcernsregarding issues such as clinical trials and IPR relatedissuesanditwasdecidedthatAMCHAMcouldfocusonthese two issues for advocacy with the government. Itwasalsodecidedtocreate3sub-groupsnamely–clinicaltrials,IPRandpricingwhichwillstarttoworkonapositionpaperforeachoftheshortlistedareas.Mr.ChadNorbergsharedanupdateontheongoingbilateraltalksbetweenIndiaand theU.S.aswellasEmbassyengagementonseveralissueswiththeirIndiancounterparts.

Defense Committee Meeting with Mr. Rajib Kumar Sen, Economic Advisor and In-Charge, DOMW

AMCHAM’s Defense Committee met with Mr. RajibKumar Sen, Economic Advisor and In-Charge,DOMW,on26thJuly2018,forfurtherdiscussionsonAMCHAM’srecommendationssubmittedontherequestforcommentson thedraftmodifications toDefenceOffsetGuidelineson15thMay2018.

Mr. Sen clarified that the thrust of the new guidelineswould be on investments as proposed in the draftcirculated earlier with focus on special projects, joint

venturesaswellas funds.Whileupdatingthegrouponthe key aspects of the newpolicy being structured, heassuredthatthesuggestionssent inbyAMCHAMwerealsoconsideredwhileformulatingthenewpolicy.HealsoofferedAMCHAMtocomebackwithmoreobservationsandcommentsoncethepolicywasrolledoutpreferablyby nextmonth.He agreed that therewere functionalityissues in the electronic submissions and these werebeingworkedupon.

AMCHAM’s Pharmaceuticals Committee met with U.S.Embassyofficialson3rdAugust2018attheLeelaPalace,NewDelhi.ThemeetingwaschairedMr.SanjivNavangul,Chairman–PharmaCommittee,AMCHAMandManagingDirector,JanssenandMs.JyotsnaGhoshal,Co-Chair–Pharma Committee, AMCHAM and Executive Director,PublicPolicyandCorporateAffairs,MSD.U.S.Embassyofficials present included Mr. Darrel Ching, DeputyMinister Counselor for Commercial Affairs, Ms. KomalKalha,SeniorCounsel,U.S.Patent&TrademarkOffice,Dr. Vid Nukala, Senior Advisor – Biomedical Science& Technology and Health, Office of Global Affairs(OGA),HealthandHumanServices(HHS),Ms.BhavnaVishwakarma,CommercialSpecialistandMs.ShilpiJha,

The objective of the meeting was to discuss continuedcollaborationbetweenU.S.industryandtheU.S.Embassyregarding pharma. Some of the topics discussedincludedDPCOguidelines,differencebetweenscheduledformulations and non-scheduled formulations, IPR(notification,compulsorylicensingandworkingofpatents),clinicaltrials(strongregulationsforeffectiveCTenvironmentmeeting global standards), pricing and AayushmanBharat,amongothers.Thecommitteedecidedtopreparea paper on TICFA (Trade and Investment CooperationForumAgreement–anagreementbetweentheU.S.andBangladesh)tosubmittoUSPTO.

The core committee of the AMCHAM’s Infrastructureand Smart Cities Committee, along with Ms. MadhviKataria, Deputy Director General, AMCHAM and Mr.Debasish Roy, Program Director, AMCHAM, met Mr.Kunal Kumar, Joint Secretary, Ministry of Housing andUrbanDevelopment andMissionDirector, SmartCitiesMission on August 14th, 2018. The Mission Directorkindly gave AMCHAMan hour to express four specificpointsthatAmericancompanieswerefacingashurdles

inbiddingforRFPsacrossthecountry.HewasgratefulthatAMCHAMhasbroughtforththeseproblemsindetailso that his Ministry can address them as quickly aspossible.HealsoagreedtoattendaCEOsmeetastheAMCHAM annual summit to understand capabilities ofvariouscompaniesintheInfrastructureandSmartCitiesCommittee.HeencouragedAMCHAMtosendinwritingallproposalsenvisaged tomake thePM’sSmartCitiesMissionmoresuccessfulinlesstime.

AMCHAM’s Tamil NaduChapter breakfastmeeting forJulywasheldonthe24thinChennaionthe‘ChangingLandscape on Accounting for Leases’ featuring guestspeaker Mr. Sandip Khetan, Partner, Assurance – EY.Mr. Sandip Khetan set the context for the meeting bysayingthattheinternationalstatutorybodiesresponsiblefor financial accounting have decided to put the leashon leasing. The Institute of Chartered Accountants ofIndiarecentlyissuedanewaccountingstandard–IndAS19on leases.TheEYpresentationdetailed thevariouschallengesandsolutionsinthenewaccountingstandardsthatmust be followed. The new leasing standards willpose a number of challenges for businesses with asubstantialnumberofoperatingleasesevenbeforetheeffectivedate.

IFRS16–leases(applicablefromJanuary1st,2019)willchange theaccounting treatmentof leasessignificantlyandwillrequirelesseestorecognizeassetsandliabilitiesformost leaseson theirbalancesheetatpresentvalueof lease payments. This will result in higher EITDA asthe leaseexpensewillnowbesplitasamortizationandinterestcostinthestatementofprofitandloss.

The key challenge for lesseeswill be identifying all thelease arrangements that exist and gathering all therequired data to get the leases to the balance sheet.Thenewstandardwill affectmanyactivities across the

organization like procurement, IT, internal audit andfinancefunctions.Sinceinventoryofallleaseshastobecreatedontransition,significantchangestosystemsandprocesses may be required. There are some impactswhich cannot be quantified yet like changes to the taxtreatment of leases until the tax department comes upwithregulatoryguidance.

Thenew lease standardunderUSGAAP (ASC842) isalsoapplicablefromJanuary1st,2019forpublicbusinessentities (January 1st, 2020 for other entities). The ‘Day1’ accounting for leases under US GAAP (ASC 842 –Leases) is similar to IFRS16wheremost of the leasesarerecognisedinthebalancesheet.However,therearesignificantdifferences in ‘Day2’accounting.ThemajordifferenceisthatunderASC842, lesseeisstill requiredtoclassifytheleasesaseitheroperatingleaseorfinanceleaseandtheoperatingleasesexpensewillcontinuetobestraightlinedintheincomestatement.

Inanutshell, theabovechangeswillposeasignificantchallengeforcompaniesreportingunderbothIFRSandUSGAAP.Insummingup,itisimportantforallcorporatebusinesshousestofirstgetaninventoryofallleasesthattheyhave,bothfinancialleasesandoperatingleases.Thiswouldbethefirststepandthisisthebiggestchallenge.Themeetingcametoanendwithaninteractivesessionwithalltheparticipants.

Mr. Rajan Aiyer,Vice Chairman – Tamil Nadu Chapter, AMCHAM andManaging Director, Trimble Information Technologies,chairedthemeetingwhichfeaturedguestspeakerDr.A.K.ViswanathanIPS,AdditionalDirectorGeneralofPolice&CommissionerofPolice,Chennai.

The meeting began by Mr. Rajan Aiyer welcomingparticipantsandCommissionerViswanathan,followedbymembers introducing themselvesand their companies.

Attheoutset,memberswereinformedthattheperceptionofthestateofTamilNaduasaplacewhereviolenceoremotionaloutburstsfollowthedeathofamassleaderhadtochange.Intherecentpast,twopoliticalleadersbothofwhomservedasChiefMinisterandwithmassfollowing,hadpassedaway.Thoughseveral lakhsofpeoplefromacross the state descended onChennai, therewas noviolence,nodestructionofpublicorprivatepropertyandnoinnocentlifewaslost.So,ithasbeenwellestablishedthatChennaiandthestateofTamilNadumaintainspeaceandpublicorderduringanycrisis.

The Commissioner began his address by thankingAMCHAMforinvitinghimtospeaktomembersonpolicinginChennai.HesaidthatChennaiCityPolicejurisdictionspreadsover1,000sqkmwithapopulationof12millionandapolice forceof22,500officers,menandwomen.TheCommissioner said that tomaintain law and orderandforcrimepreventionanddetection,thecityhas135policestationsand35allwomenpolicestations(AWPS).Officersatthesestationsareonlyallowedtorespondtocertaincrimes,suchaspsychologicalviolence,domesticviolence, family violence, as well as specific types ofthreats and sexual violence. Besides that, the city hasSpecial Armed Police units, white collar crime units,cyber-crimeunits,etc.

Dr. Viswanathan stated that in order to keep Chennaisafe, therewas constant patrolling of all areas by foot,motorcycle, jeeps and vans. The response time fordistresscallsisbetween2-5minutes.Hesaidthefocuswastoreachouttothepublicandattendtocomplaints.Underhiswatch,allofficersareavailablebetween8:00amand11:00pm.Healsosaidthatofficershaveafixedtimewhentheyremainattheirofficesorpolicestationstomeetwiththepublicwhoseekpoliceassistance.

The Commissioner was happy to state that there hasbeen no labour related incidents in Chennai city, whilethere has been public agitations related to Jallikattu,NEET,Cauverywateretc,whichwasmanagedwell.Themajor concern that thepolicehave in thecitywas thatof chain and mobile phone snatching by motorcyclebornerobbers.Visiblepatrollinghasbeenintroducedasa preventivemeasure. TheCommissioner said that theNationalCrimeRecordsBureauhasrankedChennaiasthesafestcityforwomeninthecountry.

The other major problem on Chennai’s roads is themenaceofdriving/ridingunder the influenceofalcohol.To combat this, the Commissioner said that he hasintroduceda2shiftnightpatrollingrosterforofficersandmenwho conduct vehicle checks, DUI tests and nightpatrolling.TheCommissionersaidthatthecitydoesnothaveanight lifeandmostrestaurantsandshopsdownby11:00pm.

The Commissioner said that the city police were oftenaccusedofbribetakingandtoreversethetrend,hehasintroduced a system of cashless spot fine payments,whereamotoristwhoiscaughtbreakingthelawcanpay

onthespotusinghiscreditcard,debitcardandobtainareceipt.Alternatively,themotoristcanalsopayatthepostofficeoratcourt.ThetrafficpolicealsocounselmotoristsontheadverseeffectsofDUI.

One of the major policy initiatives introduced byCommissionerViswanathanwas tobring theentire cityunder CCTV coverage. He said that close to 100,000CCTV cameras have already been installed acrossthe city. The Commissioner and his team of officersare appealing to all resident associations/societies,commercial establishments and business houses toinstallCCTVcamerasintheirpremiseswithatleastonecamera focusingon the road.TheCommissionerssaidthat thegovernment toowillpitch inby installingCCTVcamerasat road intersectionsandplaceswherepublicmovement ishigh.Thisdrive isset tobeaccomplishedsoonmakingChennaithefirstcityinIndiatohave100%CCTVcoverage.

Inaboldmove,theCommissionerannouncedhismobilephone number and said that the public can reach him24×7 and it would be best to send him a WhatsAppmessageandexpectaquickresponsefromthetopcopinthecity.ThePoliceCommissioner’smobilenumberis9444000029.

Whiletalkingabouthowthepolicehavetokeepupwithtechnologyandclevermodusoperandiofthecriminals,theCommissionersaidthatwithcheapairfares,criminalgangs fly down to Chennai by an earlymorning flight,indulge in chain snatching at about 4 to 5 places andreturnbytheevening/latenightflightwithabootyofoverRs.10lakh.TheCommissioneralsosaidthatthepolicehavebeenable to solvemanycrimesbyanalyzing themobilephonerecordsofcriminalsandvictimsandhavesuccessfullysolvedmanycrimes.Recentmediareportsstatethatthecriminalshavenowresortedtousinghighend walkie-talkie phone sets to avoid detection. YetanotherchallengetheChennaiPolicewillsoonfindwaystobeat.
