    A Company Model

    ALCOHOL-FREE WORKPLACE POLICY AND PROGRAM

    The (Company name) adopts this alcohol-free workplace policy and program to ensure a

    safe and healthful workplace. In this regard, all employees shall abide by the terms andconditions of this policy.

    I. ALCOHOL PROHIBITED

    The company explicitly prohibits the following

    !. "se, possession, solicitation or sale of alcohol in the workplace# or$. Impairment or under the influence of alcohol which may cause%causing ad&erse effect

    on employee's work performance, safety of co-employees or Company's reputation.

    II. DEFINITION OF TERM

    !. ssessment Team- group of persons composed of occupational safety and healthpersonnel, human resource manager, employer's representati&e and employees'representati&e who are trained to address all aspects of pre&ention.

    $. Cause Testing- form of alcohol-test assessment conducted by the Company when anemployee is suspected to be under the influence of alcohol. The Company reuest itssuspected employee to submit himself to alcohol test.

    *. +In&ol&ed in an on-the-ob accident or inury+- n accident of any person within theworkplace immediately or proximately caused by the employee under the influence ofalcohol.

    . ear /iss- n incident which could ha&e led to any inury or fatality of employeesand%or considerable damage to the employer had it not been curtailed.

    0. 1ost-ccident Testing- form of alcohol-test assessment conducted by the Companyto those employees in&ol&ed in an on the ob accident or inury.

    2. 3andom Testing- form of alcohol test assessment conducted by the Company4mployees may be selected at random for alcohol testing at any inter&al determinedby the company.

    5. 6orkplace 7 ny office or property owned, leased or operated by the Company or atany other place where an employee performs work for the Company.

    III. PRE!ENTI!E MEA"RE

    The (Company name) shall post in conspicuous place and notify in writing all its employeesof this policy and shall establish an alcohol-free workplace policy awareness program. Thecontents of such awareness program are as follows

    I!. TETING PROCED"RE

    A. Ca#$e-Te$%

    !. If an employee's demeanour caused the Company to suspect that he is using,

    possessing, soliciting or selling alcohol in the workplace, the latter will reuest theformer to submit himself to a cause-test. If the employee obects to subect himself tocause-test, he must state his obection and the reason thereof in writing. TheCompany shall immediately decide whether the ground for obection is &alid or not.9hould the Company found that the obection is not &alid and the employee stillrefused to submit himself to the cause-test, the refusal will be considered as aground for disciplinary action# and

    $. If the cause-test showed a positi&e result, the employee will be referred to theassessment team for further examination. :owe&er, if the employee still disagrees

    with the result of the assessment team, he will be subected to another alcoholtesting at the nearest medical facility.

    B. Po$% A&&'den%-Te$%

    !. If an accident or a near miss has been immediately or proximately caused byemployees engaged in using possessing, soliciting or selling alcohol in the

    workplace, all employees in&ol&ed in the on the ob accident shall be subected to apost accident-test. If the employee obects to subect himself to cause-test, he muststate his obection and the reason thereof in writing. The Company shall immediatelydecide whether the ground for obection is &alid or not. 9hould the Company foundthat the obection is not &alid and the employee still refused to submit himself to thecause-test, the refusal will be considered as a ground for disciplinary action# and

    $. If the cause-test showed a positi&e result, the employee will be referred to theassessment team for further examination. The findings of the assessment team shallbe considered final.

    C. Random Te$%

    !. t any time during the working hours, the Company may conduct a random alcoholtest with its employees. If the employee obects to subect himself to cause-test, hemust state his obection and the reason thereof in writing. The Company shallimmediately decide whether the ground for obection is &alid or not. 9hould theCompany found that the obection is not &alid and the employee still refused tosubmit himself to the cause-test, the refusal will be considered as a ground fordisciplinary action# and

    $. If the cause-test showed a positi&e result, the employee will be referred to theassessment team for further examination. :owe&er, if the employee still disagreeswith the result of the assessment team, he will be subected to another alcoholtesting at the nearest medical facility.

    !. CONFIDENTIALITY

    The (Company name) shall obser&e at all times confidentiality of the results relati&e toalcohol tests done to employees.

    !I. TREATMENT( REHABILITATION AND REFERREAL

    The ssessment Team shall determine whether or not an employee found addicted toalcohol would need referral for treatment and%or rehabilitation in a 8epartment of :ealth-

    ccredited Center. This benefit is only gi&en to employees who seek help from the assessmentteam.

    !II. MONITORING AND E!AL"ATION

    The implementation of the alcohol-free workplace policy and program shall be monitoredand e&aluated periodically by the ssessment Team to ensure that the goal of an alcohol-freeworkplace is met.

    !III. DICIPLINARY ACTION

    !. ;ailure to submit to cause-test, post accident-test, random-test, or alcohol test by anearest medical facility shall be a ground for a disciplinary action with a penalty ofone (!) month suspension without pay#

    $. If an employee found guilty for &iolation of any of the acts prohibited under paragraph

    I of this policy shall be subected to a disciplinary action with a penalty of one (!)month suspension without pay# or

    *. If an employee found to ha&e been guilty for &iolation of this policy, repeatedly&iolated the pro&isions thereof shall be subected to a disciplinary action with apenalty of three (*) months suspension or dismissal from ser&ice.

    I). EFFECTI!ITY

    This company policy is effecti&e immediately to all employees.
