Division Mission Statement

The mission of the Division of Buildings & Regulatory Compliance is to maintain

and enhance the quality of life within our urban neighborhoods and to ensure a

safe and positive living environment for residents and visitors of our capital

city. The Division of Buildings & Regulatory

Compliance encourages beautification of our community by implementing

programs that address and eradicate blight and erosion in our neighborhoods, and

by enforcing state and local laws.

Partnerships between public and private parties are essential to achieving this

goal. The Division works with businesses, individual citizens, neighborhood

organizations, not for profit entities and government agencies to achieve

compliance through an efficient, fair and transparent process.

INTRODUCTION

In 2012, Mayor Jennings transformed the Division of Buildings and Codes to the newly titled

Division of Buildings & Regulatory Compliance. A new director was appointed to manage the

staff and programs of the Division. These changes brought about an approach to code

enforcement that is proactive, encourages resident participation, and fosters partnerships with

neighborhood associations, business leaders and community organizations.

A new mission statement was created, and is included on the previous page. The Division of

Buildings & Regulatory Compliance is unwavering in its commitment to achieving the goals set

forth therein. Furthering this commitment was the Mayor’s proposal for the hiring of eight new

code enforcement inspectors to proactively perform inspections, prosecute irresponsible

landowners, and respond to quality of life complaints.

One of the quality of life issues affecting neighborhoods in urban America is the presence of

vacant buildings. To address this issue and identify vacant buildings, the City Code provides

that the Division submit a vacant building report to the Common Council and the Mayor. As

the Division began reviewing the information to provide such a report, we realized that better

information need to be obtained.

Under such circumstances, the Division elected to postpone the release of the report, and focus

its efforts on getting the best information available by cross checking several databases,

meeting with residents and neighborhood associations to receive their information, and sending

out teams of inspectors to physically inspect reported vacant buildings. Subsequent to vigorous

research and hundreds of inspections, this report was generated.

We are confident in the reporting of the information. This data, however, may change daily as a

result of our continued interaction with property owners, our continued filing of court cases to

prosecute noncompliant property owners, and our commitment to performing hundreds of

inspections by the end of the year.

Moving forward, the Division will release timely reports, working with the Mayor, the

Common Council and all stakeholders to provide the most accurate and up to date information

available.

NARRATIVE

The rise in the number of vacant buildings is an issue facing every urban area in America. The

recent economic downturn exacerbates this issue. The amount of foreclosed properties has

skyrocketed in the past four years. In many circumstances, the owner of record has left the

building to be foreclosed; yet, the financial institution is not foreclosing on the mortgage.

Further, the county is not foreclosing on many properties until several years have passed. We

also have seen a change in living patterns and a development of additional neighborhoods causing

a further increase in the number of vacant premises, as our building stock outnumbers our

population. These factors create a climate in which buildings decay and deteriorate.

Under the vision and leadership of Mayor Jennings, to combat this growing problem, the City of

Albany, in 2006, established the Vacant Building Initiative. Albany was a leader nationwide to

proactively initiate such a program. Indeed, several municipalities across several states have

contacted our office to learn of the City’s Initiative and duplicate it.1 Early establishment of this

Initiative has lead to greater successes and a lower vacant building rate per capita than many other

municipalities.2

Since the inception of the Vacant Building Initiative, the Division of Buildings & Regulatory

Compliance identified 1750 vacant buildings. Of the vacant buildings identified, 941 are

completed, i.e., no longer vacant. This is a completion rate of 54%. This completion rate has

been met independent of any State or Federal resources. Rather, our successes have resulted from

the direction and leadership of the Mayor, with cooperation from the Common Council, all of

whom invested in a program that eradicates blight and enhances the quality of life in our

neighborhoods. Of the 941 completed properties, nearly 600 are occupied, with approximately

250 demolished; the remainder of the buildings are unoccupied and secured by normal means.

Since January 2012, the Division of Buildings & Regulatory Compliance has created a living

database documenting vacant buildings in the City of Albany. To create this database, the

Division reconciled the Division of Building and Codes Vacant Building Registry with the

Department of Fire and Emergency Services Vacant Building Database. This first reconciliation

yielded a list of approximately 750 vacant buildings. The Division then reconciled that list with

lists from neighborhood associations and lists from the Department of Assessment and Taxation.

Additionally, the Division began aggressively inspecting vacant buildings within the City. As of

September 14, 2012, there are 809 vacant buildings within the City of Albany. Over 600 have

been inspected, with the remainder to be completed by the end of the year.

Of the 809 buildings, 164 are currently registered, 605 have been cited, 370 have a pending

registry court action and 31 are exempt. For those properties where the owner is unable to be

located, the Division has forwarded these cases to Corporation Counsel’s Office to secure

supplemental service from the Court. In some instances, an arrest warrant has been issued for the

property owner. In 2012, the Division filed over 550 vacant building court cases.

This year, the Division sent out over 1,000 letters advising owners of the vacant status of their

properties. This mailing has generated an overall positive response from vacant building owners;

many have registered their buildings, some have sought extensions of time to register, and others

have made contact with the Division, updated their contact information, and requested further

information regarding vacant building requirements. Additionally, the Division has issued over

500 Notices of Violation to vacant building owners.

It is realistic to expect that one-third of the total vacant buildings may require demolition at some

future point. The properties are “upside down.” That is, the cost for the owner to renovate or

remove the structure far exceeds the rate of return on the investment. If the owner were to

renovate, the rents received would not be sufficient to pay the debt service associated with the

cost of renovation. Also, the costs associated with a private demolition would far exceed the

value of the lot remaining after demolition. As a result, we are left with a situation where the

owner walks away from the property, provides no maintenance and fails to comply with the

vacant building registry. The actions of such an owner should not be a surprise when the

situation is reviewed from a fiscal point of view. Unfortunately, this creates a shifting of the

burden from the owner to the taxpayers to shoulder the expense of demolition or stabilization.

Recently, the Mayor proposed, and the Common Council approved, bonding legislation that

assists the Vacant Building Initiative. The money from the bonding will go toward emergency

demolition and stabilization costs. This money is well-needed and serves as a catalyst to

economic development and eradication of blight. The monies expended for demolition and

stabilization shall be recouped. The redeveloped land shall yield increased tax revenues that pay

for the cost of demolition over ten years. Additionally, the properties surrounding the

redeveloped area shall see an increase in value.

Through this Initiative, we have removed blighted properties and fostered partnerships that create

opportunities for redevelopment. An example can be found in the several blocks of the South

End where Habitat for Humanity and the Albany Housing Authority have begun the

redevelopment of areas where the City eradicated blighted properties. The City shall continue

strategic emergency demolitions throughout the South End, Arbor Hill and West Hill, and

continue to foster public and private partnerships that spur economic development in these areas.

REVENUE

The Division has collected $104,000.00 in vacant building fees this year, with an expected yearly

total of $150,000.00. This number far exceeds the $64,000.00 collected in 2011. Further, it is

anticipated that revenues in 2013 shall exceed $200,000.00. The purpose of the Initiative is not to

generate revenue, but rather to gain compliance and remove vacant buildings from our

streetscape. Accordingly, we may see a growth in revenues over the next couple of years as we

prosecute more cases and more owners come into compliance with registration. However, it is

anticipated that revenues shall eventually decrease as the total number of vacant building are

completed through rehabilitation or redevelopment.

CONCLUSION

New leadership and a commitment of resources resulted in great strides in the Vacant Building

Initiative. This year we developed and operate a living database containing an accurate count and

description of all vacant buildings. This was possible through our efforts to gain information

from a multitude of resources, including individual residents and neighborhood associations.

By the end of 2012, every vacant building will have been inspected at least twice – that is over

1,600 vacant building inspections. If we have identified a building as vacant, and the owner has

failed to maintain the building, and/or failed to register, that owner shall be brought to court and

prosecuted by the Corporation Counsel. This year, the Division shall have brought over 600

cases to court for prosecution.

We are confident that the Vacant Building Initiative shall yield a decrease in blight, an increase in

property values and a beautification of our neighborhoods, resulting in a healthier and safer

quality of life for all residents and visitors in this great capital city. This confidence stems from

the commitment of the Mayor and Common Council, the dedicated efforts of the Division’s staff

and the desire of our citizens.

Together, as one team, with one goal, for one city, we are able to unite and overcome any

challenges facing our neighborhoods.

APPENDIX

INTRODUCTION

Included in the Appendix are the addresses for properties that have been identified as vacant

through the Vacant Building Initiative. These properties are separated into two categories:

“Vacant” and “No Longer Vacant.” The beginning of the list identifies buildings currently

vacant. The end of the list identifies buildings no longer vacant. Provided for each listing is a

“Current Status.” For vacant buildings, possible status includes the following:

Court Active

Buildings which have a pending court action for registration or maintenance,

or both;

Registration Current

Buildings which have been registered in the Vacant Building Database and

where the owner has paid the fee for the current anniversary year;

Inspection Current

Buildings which have been inspected in 2012. The inspection process

includes a first inspection, after which, if violations are cited, a Notice of

Violation is sent to the owner and/or agent. A re-inspection is then

performed to verify correction of violations. If the violations have not been

corrected by the re-inspection date, the owner and/or agent is then prosecuted

in court.

Many of the buildings currently listed as “Inspection Current” may be

prosecuted in court within the next few months;

Inspection Scheduled

Buildings which have not yet been inspected for the current year, and for

which the inspection process is scheduled to begin within the next couple of

months;

Supplemental Service

Buildings which have owners who are unable to be located. The files have

been sent to Corporation Counsel for them to seek supplemental service.

Buildings which are no longer vacant have, at some point within the last six years, been either

demolished, occupied, or secured by normal means and maintained according to code.
