STATE ENTITIES TO IMPLEMENT THE AFFORDABLE CARE ACT
The Alaska Health Care Commission was established in state statute 18.09 in June 2010 to serve as the state
health planning and coordinating body. It is responsible for providing recommendations to the governor and the
legislature on comprehensive statewide health care policy and on strategies for improving the health of Alaskans.
New commission members were appointed September 14, 2010. The commission continues to meet.
State Health Insurance Exchange
Governor Sean Parnell announced on July 17, 2012, that Alaska will not create a state-run health insurance
exchange, opting instead to allow the federal government to do so.

Background
In April 2010, former Governor Arnold Schwarzenegger formed the Health Care Reform Task Force to implement key short and long-term provisions of the ACA. The task force is no longer active. Since 2010, the Office of Statewide Health Planning and Development (OSHPD) has worked with the California Workforce Investment Board to develop a comprehensive strategy for workforce development related to the implementation of the Affordable Care Act. State Health Insurance Exchange

Background Former Governor Bill Ritter issued Executive Order B-2010-006 in April 2010, to create the Interagency Health Reform Implementation Board which provided quarterly reports to the governor on the status of implementation, and developed Implementing Health Care Reform: A Roadmap for Colorado, a strategic plan for implementing health reform in the state. The board is no longer active. The executive order also named a director to oversee 10 state agencies responsible for implementing health reform and created a new inter-agency task force. State Health Insurance Exchange In 2011, Colorado passed SB 200, Chapter No. 246 establishing a state health benefit exchange and creating the Legislative Health Benefit Exchange Implementation Review Committee. Background
On April 14, 2010, former Governor M. Jodi Rell issued Executive Order No. 43 creating the Health Care Reform
Cabinet. Members included commissioners from various state health agencies. The cabinet produced its last
progress report in September 2010.
The Office of Health Reform & Innovation was later established within Lieutenant Governor Nancy Wyman’s office
to coordinate Connecticut’s statewide approach to federal health reform. The office continues to work with state
agencies to implement health reform projects statewide.
The SustiNet Health Care Cabinet, created the within the office of the Lieutenant Governor by Public Act No. 11-
58 of 2011, is responsible for advising the Governor and the Office of Health Reform & Innovation on issues
related to federal health reform implementation and development of an integrated health care system for
Connecticut. The cabinet continues to meet.

In 2011, Connecticut passed SB 921, Public Act 11-53 establishing a health benefit exchange.

Background
The Delaware Health Care Commission is charged with overseeing Delaware's implementation of federal health reform. The secretary of health & social services is leading the effort. The commission's activities will be supported by an interagency staff workgroup. The commission will create working groups of pertinent public and private stakeholders to assist in implementation policy discussions. Title 16, chapter 99 of the Delaware code created the Delaware Health Care Commission in 1990. State Health Insurance Exchange

State Health Insurance Exchange
Governor Nathan Deal issued an executive order on June 2, 2011 to establish the Georgia Health Insurance
Exchange Advisory Committee. The committee issued its final recommendations to the governor on
December 15, 2011. In June 2012, the governor announced that the state will wait until after the November
elections to decide whether it will establish its own health insurance exchange.

STATE ENTITIES TO IMPLEMENT THE AFFORDABLE CARE ACT
Background
In July 2011, Governor Neil Abercrombie issued Executive Order 11-22 creating a healthcare transformation
coordinator to provide recommendations on how the state can achieve universal coverage, taking into account
provisions of the ACA. The coordinator is responsible for making recommendations to improve the organization
and delivery of healthcare, to promote efficient provision of state government healthcare services and consider
the roles and responsibilities of state agencies and programs. To do so, the coordinator may consult with existing
entities and convene working groups.
The healthcare transformation coordinator heads the governor’s Office of Healthcare Transformation, and
established the Hawaii Healthcare Transformation Initiative, a public-private partnership that aims to engage
stakeholders in identifying strategies to improve health care. The initiative is supported by the Transformation
Council, which includes representatives of state and county government, the private sector, and various health
care organizations. The Office of Healthcare Transformation continues to be an active entity.
State Health Insurance Exchange
In 2011, Hawaii passed SB 1348, Act 205 establishing Hawaii Health Connector, the state’s health benefit
exchange. The Act also establish an interim board of directors, which delivered a report and recommendations to
the legislature December 29, 2011.

Background
The Idaho Health Care Task Force, a legislative committee, was not created specifically in response to the
Affordable Care Act, but given its broad charge, implementation of the Affordable Care Act falls under its purview.
Governor C. L. Otter issued Executive Order 2011-03 in April 2011, prohibiting executive branch agencies
from implementing the Affordable Care Act in Idaho. In September 2011, he announced that he would permit the
Idaho Department of Health and Welfare and Idaho Department of Insurance to apply for federal funding to
establish a health insurance exchange.

Background
In July 2010 Governor Pat Quinn issued Executive Order 10-12 creating the Illinois Health Reform Implementation Council, which was made up of various state agency directors. The council is responsible for making recommendations to the governor on implementation of the Affordable Care Act. Recommendations focus on reforming Medicaid, increasing the health care workforce, pilot programs, insurance reforms, electronic medical records, and identifying possible funding.
State Health Insurance Exchange
Illinois passed SB 1555, Public Act 197-0142, a bill of legislative intent to establish a state based insurance exchange. The act also creates the Illinois Health Benefits Exchange Legislative Study Committee to investigate the establishment of the Illinois Health Benefits Exchange. The committee delivered its final report to the governor and leadership of the general assembly in October 2011. The committee continues to meet.

2009 Iowa Acts, S.F. 389, §1 created the Iowa Legislative Health Care Coverage Commission to develop health care reform strategic plan. Although the commission is no longer active, it was responsible for conducting a review and analysis of options for health care coverage, providing prioritized recommendations and examining state health reform options. Links to the commission’s recommendations are listed above.

The Maine Legislature created a Joint Order establishing the Joint Select Committee on Health Reform
Opportunities and Implementation, a bi-partisan group of 17 legislators responsible for studying the federal law
and determining the role of the state in implementing health reform. The committee produced its final report in
December 2010 and is no longer active.
In April 2010 former Governor John Baldacci issued an Executive Order Implementing National Health Reform in
Maine (Executive Order 12), establishing the Health Reform Implementation Steering Committee. Although the
committee is no longer active, it produced a report in conjunction with the Advisory Council on Health Systems
Development.

In April 2012, Governor Paul LePage stated that Maine will not use the Level One Establishment grant awarded to

Background
In March 2010, Governor Martin O'Malley issued Executive Order 01.01.2010.15 amending Executive Order 01.01.2010.07, which established the Maryland Health Care Reform Coordinating Council. The council’s final report includes policy recommendations and implementation strategies. The council continues to meet.

Background Laws 2010, First Special Session, Chapter 1, Article 22, Section 4 authorized the governor to convene the Health Care Reform Task Force to advise and assist the governor and the legislature on state implementation of the ACA. On October 31, 2011, Governor Dayton issued Executive Order 11-30, establishing the Health Care Reform Task Force. The task force produced a report with recommendations for state law, program changes and implementation. The group’s primary deliverable is the Roadmap to a Healthier Minnesota, which will include policy recommendations and is expected to be presented to the governor and legislature in November 2012. The task force continues to meet. State Health Insurance Exchange The Department of Commerce, with support of Governor Mark Dayton, is pursing action through the establish-ment of the Health Insurance Exchange Advisory Task Force. Senate Joint Resolution 35 created a 2009 and 2010 interim committee within the Children, Families and Health and Human Services to study federal and state efforts related to health care reform and to make recommendations for state-level initiatives to be considered by the 62nd Montana Legislature. All aspects of the study, including presentation and review requirements were due by September 15, 2010.

In 2011, the legislature enacted Joint Resolution 33, creating an interim study committee to examine the feasibility of establishing a state-based health insurance exchange. Background
Multiple entities are working on implementation in Nevada. The Health Care Reform Policy Planning Group was created by the Department of Health and Human Services; the Health Care Reform Implementation Working Group is led by the Administrator of the Division of Health Care Financing and Policy and focuses on how the new law will affect the state's Medicaid policies; and the Division of Health Care Financing; and Policy Administrator Charles Duarte oversees an implementation work group to examine in significantly greater detail the intricacies of the legislation and what affect it will have on state policies and procedures regarding Medicaid. Expanding the Medicaid program is one of the primary tools for expanding health insurance coverage in the reform bill, and many changes to Nevada’s Medicaid program will be required in order to conform to the legislation and accommodate new enrollees.

Governor John Lynch signed HB 1297 on June 18, 2012, prohibiting the state from participating or facilitating a
state-based health insurance exchange. The law does allow state agencies to work with the federal government

Background
Prior to the passage of the ACA, SJM 1 (2010) created the New Mexico Health Reform Working Group to make recommendations to the governor and the legislature regarding implementation and supplementation of federal and state health care reform measures. The working group made its recommendations and is no longer active. In April 2010, former Governor Bill Richardson issued Executive Order 2010-012, establishing the New Mexico Health Care Reform leadership team for the implementation of national health reform. The leadership team issued its strategic plan, Implementing Federal Health Care Reform-A Roadmap for New Mexico, in July 2010. In August 2010, former Gov. Richardson signed Executive Order 2010-032, establishing the New Mexico Office of Health Care Reform and expanding the leadership team. The Office of Health Care Reform continues to work with the leadership team to help the executive branch create policies, priorities, and objectives for reaching implementation goals.

Background
In May 2010 then- Governor David Paterson established the Cabinet to Implement Federal Health Care Reform in New York. The cabinet will advise and make recommendations to the governor on all aspects of federal health reform, including identifying any changes needed to state statute, regulation, policy or procedure in order to implement the ACA. It will also develop a strategic plan to guide implementation. State agencies will make up the health reform cabinet and an advisory group will also be appointed to assist and advise the cabinet on reform provisions and include stakeholder and public engagement. On August 31, 2010, the former governor also formed the Health Care Reform Advisory Committee to ensure stakeholder and public engagement. These groups are no longer active.

Background
The state established eight workgroups on health care reform through the North Carolina Institute of Medicine which are coordinated by an Overall Advisory Group. The workgroups meet monthly to examine implementation issues including prevention, safety net, health professional workforce, health insurance exchange and insurance oversight, Medicaid, new models of care, quality, fraud and abuse. Members include representatives from state government, academia, insurers, provider groups, and consumer advocates. The group’s interim report is available here.
Health Insurance Exchange
North Carolina passed HB 22, Session Law No. 2011-391, a bill of legislative intent to establish a state based insurance exchange. Establishment legislation did not pass. The North Carolina Department of Insurance continues to plan a state-based exchange.

In 2010, the Legislative Management committee created the Interim Industry, Business, and Labor Committee to examine health care reform in conjunction with a study of factors impacting the cost of health insurance. The committee’s role is to receive information relating to federal health reform’s impact on the state from state agencies and other interested parties. The chairman of Legislative Management has the authority to direct studies during the interim to monitor federal health reform.

Background Created in 2009, the Oregon Health Policy Board serves as the policy-making and oversight body for the Oregon Health Authority. In 2009, Oregon enacted HB 2009 which established the Oregon Health Care Authority in the executive branch. The authority is charged with implementing health care reform; the bill includes many provisions similar to or that will be enhanced by the federal health reform law. State Health Insurance Exchange In 2011 Oregon passed SB 99, Chapter 415 establishing a state health benefit exchange. In February 2012, the nine member governing board released the Oregon Health Insurance Exchange Corporation Business Plan, which was required under the establishing statute. Former Governor Edward Rendell issued Executive Order 2010-02 in July 2010, creating the Commonwealth Health Care Reform Implementation Committee and the Commonwealth Health Care Reform Advisory Committee. STATE ENTITIES TO IMPLEMENT THE AFFORDABLE CARE ACT
Background
The Joint Legislative Committee on Health Care Oversight was created to help Rhode Island prepare for the
implementation of the new federal law and to oversee the state’s health care activities. The committee, originally
created in 2000, monitors, studies, reports and makes recommendations on all areas of health, insurance, liability,
licensing, cost and delivery of services, and the adequacy, efficacy and efficiency of statutes, rules, regulations,
guidelines, practices, and programs related to health care, long-term care or health insurance coverage.
Additionally, Governor Lincoln Chafee signed Executive Order 11-04 in January 2011 establishing the RI
Healthcare Reform Commission. The commission, chaired by Lieutenant Governor Elizabeth Roberts, is
responsible for coordinating changes to the state’s healthcare system in accordance with federal mandates, seek
federal funding, and make recommendations to the governor.
Resolution No. 2010-341 created in June 2010, established a 17-member special Senate commission to study
cost containment, efficiency, and transparency in the delivery of quality patient care and access by hospitals. At
its own discretion, the commission may also study the development and establishment of a state-based insurance
exchange. The members met regularly beginning September 15, 2010 and December 31, 2011 and presented its
findings and recommendations on exchanges to the clerk of the Senate in March 2011.
State Health Insurance Exchange
In September 2011, Governor Lincoln Chafee signed Executive Order 2011-09 which established the Rhode
Island Health Benefits Exchange as a division within the Executive Department.

This executive order was issued before the passage of federal health reform legislation, but was created in anticipation of federal health reform. Background
The Virginia Secretary of Health and Human Resources, Dr. Bill Hazel announced the establishment of the Health Care Reform Initiative on May 14, 2010. The Health Care Reform Initiative created an advisory council to manage activities related to federal health care reform, serves as the liaison between the governor's office, agencies and entities affected by health care reform, and assume lead development of the required Health Insurance Exchange among other duties. The Advisory Council formed six working groups to make findings and recommendations addressing Medicaid reform, insurance reform, health care delivery and payment reform, capacity, technology, and purchasers and is required to submit a report and recommendations in January of every year, through January 2014.

Background
In April 2010, Governor Christine Gregoire issued Executive Order 10-01 creating the Health Care Cabinet, which is responsible for providing leadership and accountability for implementation of state and federal health reform. The cabinet was required to submit a work plan by August 1, 2010, outlining structures and processes needed by state agencies for implementation. Click here to view a list of cabinet members.
SB 6444 (Section 694) The legislature also passed a budget proviso in April 2010 establishing a Joint Select Committee on Health Care Reform, to be co-chaired by the chairs of the health committees of the senate and the house of representatives. Leadership of the two largest caucuses in the senate and the house of representatives shall each appoint two additional legislators to serve on the committee. The co-chairs may direct the formation of advisory committees, to focus on specific topic areas, such as insurance regulation, access and expansion of public and private programs, and workforce issues, and may invite interested stakeholders and additional experts to advise the committee. The committee continues to meet.
State Health Insurance Exchange
In 2011, Washington passed SB 5445, Chapter 317, Laws of 2011 establishing a state health benefit exchange. In 2012, HB 2319, also related to implementation of the health benefit exchange, passed, removing previous limitations on the board’s governing authority over the exchange.

The Legislature created the Governor's Office of Health Enhancement and Lifestyle Planning (GOHELP) through
SB 414 during the 2009 Legislative Session to coordinate health care reform.
State Health Insurance Exchange
In 2011, West Virginia passed HB 408, Act No. 100, establishing a state health benefit exchange.

Background
In April 2010 former Governor Jim Doyle issued Executive Order #312, creating the Office of Health Care Reform. The Office of Health Care Reform was responsible for developing a plan that used national health care reform to build on the state's existing programs, provide transparent access to information, assess insurance markets reforms to prepare for national health reform, develop a plan to pursue federal funding for implementation, and create a health insurance purchasing exchange. The office no longer exists.
In January 2011, Gov. Scott issued Executive Order 10, creating the Office of Free Market Health Care. Nearly one year later, the governor issued Executive Order 57, which repealed the previous order, discontinued development of the health exchange and closed the Office of Free Market Health Care.

Background
Former Governor Dave Freudenthal convened a State Agency Leadership Team to determine how the health reform acts affect state programs and the people they serve. This group is no longer active.
State Health Insurance Exchange
HB0050, Act No. 102 created the Wyoming Health Insurance Exchange Steering Committee, which is responsible for studying whether the state should establish a health insurance exchange or participate in a regional exchange. In late 2011, SF 0058, Act No. 42 passed, allowing the Steering Committee to continue research on exchange implementation until 2013.
