I. CALL TO ORDER
A. Roll Call
The meeting was called to order at 9:00 a.m. on Thursday, May 19, 2016 and 8:30 a.m. on Friday, May 20, 2016. The following members were present: E. B. Declaration of Quorum A quorum was declared with nine Board Members present on May 19, 2016 and May
20, 2016. Dr. Francine Parker, Ms. Baker and Ms. Price were not present on May 19, 2016 and May 20, 2016.
C. Statement of Compliance with Open Meetings Act
Prior notice of this meeting was posted on the Secretary of State’s website in accordance with the Alabama Open Meetings Act.
D. Review of Agenda 1. Additions, Modifications, Reordering
Ms. Hill made a motion to add number 5 to the Reports/Executive Officer, VI A: Delegate Selection for the 2016 NCSBN Annual Meeting in Chicago, IL on August 17-19, 2016. Ms. Bailey seconded. Motion carried without objection.

V. POLICY
A. New Rules: Advanced Practice Loan Repayment Program 610-X-12
The state legislature recently approved a new program which enables advanced practice nursing students and nurses to submit applications for loan repayment to the Board. The approval of a loan requires an agreement to serve in an area of critical need as specified by the Board. The loan repayment agreement will contain the service and program requirements the student/nurse must meet for the program. The proposed rules will enable the board to implement this new law effectively. The area of critical need will be determined by the Board at a later Board meeting this year and annually thereafter.
Ms. Benson discussed the need for language clarification from the 2016-353 Act to determine if the loan can be given to previous graduates or if the loan is for current students only. The legislative intent discussed during the legislative process was to include loan for advanced practice nurses who had previously graduated. However, the actual language in the act 2016-353 is not clear and needs to be reviewed and determined prior to implementation. The best option is for the Board to seek an Attorney General’s opinion.
On May 19, 2016, Ms. King moved that the Board approve the proposed rules for
The Creation of Alabama Administrative Code 610-X-12 Loan Repayment
Program for Advanced Practice Nursing. Ms. Bailey seconded. Motion carried
without objection.
On May 19, 2016, Ms. Bailey moved that the Board approve a resolution
requesting the Attorney General’s opinion related to 2016-353. Ms. McDonnell
seconded. Motion carried without objection.
B. Graduate Nursing Scholarship Chapter 610-X-11 The Board rules are currently more restrictive than required in law and the way monies are paid may create a hardship on students. On review of other Board’s current internal scholarship program process, the new rules are far less restrictive and allows nurses to receive the money as a onetime payment annually. The promissory note will contain the service and program requirements the student must meet for the scholarship.
On May 19, 2016, Ms. Bailey moved that the Board approve the repeal and
replace revisions to Alabama Administrative Code 610-X-11 Graduate Nursing
Scholarships. Ms. Hill seconded. Motion carried without objection.

2. FYI
Ms. Benson provided a draft copy of the Attorney General Opinion Request Regarding Loan Repayment Program letter to each of the Board members.
3. Sunset Committee Review/Update Ms. Benson gave the Board a brief report of the Sunset Committee Review/Update.
4. Scholarship recipient
Ms. Benson discussed a student situation related to the required academic hours for the graduate scholarship program. The curriculum map did not have two consecutive semesters of 6 hours and would through no fault of the student interfere with the scholarship payments. On May 19, 2016, Ms. Bullard moved that the Board approve a ABON Scholarship wavier based on a review of student records to Ms. Tameka Pritchett. Ms. McDonnell seconded. Motion carried without objection.
5. Delegate Assembly Selection
On May 19, 2016, Ms. Hill moved that the Board accept Dr. Baker as a delegate for the 2016 NCSBN Annual Meeting in Chicago, IL on August 17-19, 2016 and Ms. Bullard moved Ms. King as the second delegate. Ms. Bailey seconded. Motion carried without objection. On May 19, 2016, Ms. Hill moved that the Board accept Dr. Wright as an alternate delegate for the 2016 NCSBN Annual Meeting in Chicago, IL, on August 17-19, 2016 and Ms. Carpenter as the second alternate delegate. Ms. Bailey seconded. Motion carried without objection.

C. Finance
1. Report
Mr. Glasscock, Chief Fiscal Officer, provided a written report of Revenues, Expenditures Summary, Revenue, and Expenditure Budget Comparison as of March 31, 2016. The Board reviewed and discussed the reports presented with Mr. Glasscock.
D. Legal Division
1. General Counsel/Deputy Attorney General
A written report of the Activities of the Legal Division from March 3, 2016 to April 29, 2016 , including the number of open disciplinary cases, the number of pending cases on the docket of the General Counsel, and the number of cases on appeal or subject to litigation was accepted, as information, on the Consent Agenda.
2. Assistant General Counsel Report A written report on the number of pending cases on the docket of the Assistant General Counsel as of April 28, 2016, was accepted, as information on the Consent Agenda.
3. Voluntary Disciplinary Alternative Program
A written report on VDAP participants and terminations as of April 29, 2016, was accepted, as information, on the Consent Agenda.
4. Investigations Report A written report of active investigations per investigator as of April 29, 2016, was accepted, as information, on the Consent Agenda.

Probation Monitoring Report A written report on the number of nurses monitored on probation, the number of outstanding probation violations, the number of past due fines, the number of nurses met with for probation reviews or new board orders, the number of nurses released from probation, and the number of cases resulting in revocation by Board Order as of May 2, 2016, was accepted, as information, on the Consent Agenda.

F. Legislative Update None G. ANRC Report
1. Report The ANRC Activity Report was accepted on the Consent Agenda.
2. General Conference Planning In January, the Board received information on the Alabama Nursing Resource Center (ANRC) being the means by which the Board would meet its mandate of providing CE to licensees. Both the plan Document and Phased of Implementation overview cited the provision of education through educational conferences. The Board staff requested direction to aid in planning a general nursing conference. The Board reviewed and discussed possible options for education and determined to do the 2017 annual conference in the early Spring around late April or early May on a Friday in the Birmingham area.
VII. BOARD DEVELOPMENT None VIII. ADVANCED PRACTICE
A. Report
A written report was accepted, as information, on the Consent Agenda.
B. Dermaplane Leia Hunt, Family Nurse Practitioner (FNP) and Clancy Johnson, MD, Dermatology, received approval for collaborative practice in May 2013. The practice is located in
Cullman, AL where Dr. Johnson has hospital privileges at Cullman Regional Medical Center; there are no remote practice sites associated with this collaboration. Ms. Hunt is approved for the following specialty legend drugs: Antineoplastic agents, Non-Biologic DMARDs, Biologic DMARDs, and Non-tumor Necrosing Factor Inhibitors; and the following skills: ultra-violet therapy, maintenance and direction, and superficial depth chemical peel. Dermaplane is requested to improve the performance of superficial chemical peels and remove vellus hairs. The procedure will be performed at the discretion of the nurse practitioner in the absence of any identified contraindications. Dr. Johnson will be on-site during the procedures or readily available by phone. Ms. Hunt completed dermaplaning and skin peel training with the vendor’s (SkinCeuticals) licensed aesthetician in April 2016. Dr. Johnson will validate initial competency through supervised practice to include 20 procedures (simulated or performed) and an annual competency validation. The Quality Assurance review will include a monthly review of 10% of all procedures and 100% of all adverse events.
On May 19, 2016, Ms. Dearmon moved that the Board approve that the
Dermaplane procedure is within the legal scope of practice for a certified
registered nurse practitioner with documented education, training and
experience. Ms. Hill seconded. Motion carried without objection.
C. Botox for Chronic Migraines Sarah Ann Driscoll, Family Nurse Practitioner (FNP) and Diane Counce, MD, Neurology, received approval for collaborative practice in January 2016.
In October 2004, the Board of Medical Examiners determined the injection of Botox, Restylane, and Collagen to be the practice of medicine and may only be performed by a physician. Botox injections involving a total of 31 IM injections in 3 regions of the head and neck; forehead, temples, occipital region, and neck. It is a well-defined treatment paradigm established in clinical trials by Allergan. The patients will have evaluated in a clinic appointment prior to the procedure and have normal exams 99% of time. Injections are given in precise anatomical locations as described in paradigm, using 1 cc syringes and 30 gauge needles with Botox brand medicine. Injections are given every 3 months. Expected results-85% of patients show improvement after the 1st, 2nd, or 3rd injection. Aftercare is minimal. Follow up to the patient is made 6 weeks after the 1st injection and then variably after that point, depending on the results of treatment.
On May 19, 2016, Ms. Hill moved that the Board approve to provide direction to
the staff if additional information is required to determine whether Botox
injections for treatment of chronic daily migraines may be performed by a
CRNP in collaborative practice with a physician qualified to perform the
procedure. Ms. Dearmon seconded. Board denied approval.

IX. EDUCATION A. Report
A written report on Nursing Education Program was accepted, as information, on the Consent Agenda.
B. NCLEX 2nd quarter Analysis
A written report on NCLEX 2ND Quarter Analysis for NCLEX-RN and NCLEX-PN results for January 1, 2016 to March 31, 2016 was accepted, as information, on the Consent Agenda.
X. NATIONAL COUNCIL LICENSURE EXAMINATIONS
A. FY 16 2nd Quarter NCLEX-PN Results
The 2nd Quarter NCLEX-PN Results for FY 2016 were accepted on the Consent Agenda.

XII. BOARD TRAVEL
A. 2016 NCSBN Annual Meeting, Chicago, IL. August 17-19, 2016
Dr. Baker and Ms. King were approved as delegates to attend the 2016 NCSBN Annual Meeting in Chicago, IL. on August 17-19, 2016 with Dr. Wright and Ms. Carpenter as alternate delegates. Ms. McDonnell, Ms. Dearmon, Ms. Hill, and Ms. Bailey will also be attending. ABN Staff members attending will be Ms. Abby Migliore and Ms. Angela Kennedy.
XIII. DISCIPLINARY CASES – Executive Session – May 20 @ 8:30 a.m. On May 20, 2016, Ms. Hill moved that the Board enter into Executive Session to discuss the general reputation and character, professional competence, and physical or mental conditions of specific applicants and licensees. Ms. Bailey seconded. Motion carried with all in favor: (Melissa Bullard, Peggie Carpenter, Valorie Dearmon, Jill Hightower, Judith LaDonna McDonnell, Chrystabell King, and Helen T. McAlpine) Dr. Wright estimated that the Board would reconvene in open session at approximately 9:30 a.m. The Board reconvened in open session at 9:20 a.m. and voted on the Consent Orders.
A. Consent Orders
1. Jackson, Margaret Ann - RN 1-066469 (Active) Ms. Jackson signed a Consent Order that would place her RN license on practice probation for a period to run concurrently with court-ordered probation, and require her to complete a course on Ethics of Nursing Practice.
On May 20, 2016, Ms. Hill moved that the Board accept the Consent Order. Ms.
Bailey seconded. Motion carried without objection.
2. Owens, Christie Michelle - RN 1-095095 (Active); LPN - 2-047386 (Lapsed)
Ms. Owens signed a Consent Order that would place her RN and LPN license on practice probation for a period to run concurrently with court-ordered probation but not less than twelve (12) months, and require her to pay a $300.00 fine and complete a required course on Professional Accountability and Legal Liability for Nurses.
On May 20, 2016, Ms. Hill moved that the Board accept the Consent Order. Ms.
Bailey seconded. Motion carried without objection.
3. Wilburn, Wendy B. - RN 1-069275 (Active)
Ms. Wilburn signed a Consent Order that would terminate her May 5, 2015 VDAP Order and will place her RN license on probation for a period of sixty (60) months with the usual substance use disorder stipulations and require her to pay a $500.00 fine.
On May 20, 2016, Ms. Carpenter moved that the Board accept the Consent
Order. Ms. King seconded. Motion carried without objection.
4. Ball, Margie Winell - LPN 2-047727 (Active)
Ms. Ball signed a Consent Order that would place her LPN license on suspension until payment of $500.00 fine, documented completion of courses/programs on Elder Abuse, Ethics of Nursing Practice and Managing Assaultive Behavior for Healthcare Professionals and receipt of employer notification. In no event will this period of suspension extend beyond twelve (12) months of the effective date of this Order. Should such occur, Ms. Ball’s licensure status will be considered as and listed as revoked.
On May 20, 2016 Ms. Bailey moved that the Board accept the Consent Order.
Ms. Hightower seconded. Motion carried without objection.
5. Clark, Kristee Tanay - RN 1-122972 (Active); LPN 2-055663 (Lapsed)
Ms. Clark signed a Consent Order that would place her RN and LPN license on probation with illegal/illicit drug use stipulations for a period of twelve (12) months and require her to pay a $500.00 fine and complete required courses on Mandatory Class Part 2-Standards of Practice & Scope of Practice, Professional Accountability and Legal Liability for Nurses and Understanding Substance Use Disorder in Nursing.
On May 20, 2016 Ms. King moved that the Board accept the Consent Order.
Ms. McAlpine seconded. Motion carried without objection.
6. Batchelor, Martha Jean - RN 1-108368 (Active/Probation); LPN 2-032396 (Lapsed)
Ms. Batchelor signed a Consent Order that would terminate her July 18, 2014 Board Order and place her RN and LPN license on probation for a period of twelve (12) months with illegal/illicit drug use stipulations, require her to complete a course on Professional Accountability and Legal Liability for Nurse, and provide documentation of completion to the Board, and require her to pay a $500.00 fine.
On May 20, 2016, Ms. King moved that the Board accept the Consent Order.
Ms. Hill seconded. Motion carried without objection.
7. Black, Latoya Shae - RN 1-104965 (Active/ Probation); LPN 2-050120 (Lapsed)
Ms. Black signed a Consent Order that would terminate her November 13, 2015 Board Order and will suspend her RN and LPN license until completion of Board-
approved courses/programs on Documentation: A Critical Aspect of Client Care, Mandatory Class Part 2-Standards of Practice & Scope of Practice, Professional Accountability and Legal Liability for Nurses, and Understanding Substance Use Disorder in Nursing and provide documentation of completion to the Board; receipt of employer notification; and payment of a $600.00 past due fine. In no event will this period of suspension extend beyond twelve (12) months of the effective date of this Order. Should such occur, Ms. Black’s licensure status will be considered as and listed as revoked. Upon reinstatement, Ms. Black’s license will be placed on probation for twenty-four (24) months with the usual illegal/illicit stipulations, and she will be required to pay a $500.00 fine.
On May 20, 2016, Ms. King moved that the Board accept the Consent Order.

8. Burke, Laura Lee - RN 1-143992 (Active/ Probation)
Ms. Burke signed a Consent Order that would terminate her January 17, 2014 Board Order and will place her RN license on probation for sixty (60) months with the usual substance use disorder stipulations and require her to pay a $500.00 fine.
On May 20, 2016 Ms. King moved that the Board accept the Consent Order.
Ms. Hill seconded. Motion carried without objection.
9. Hammock, Myka Annette - RN 1-114681 (Active/Probation)
Ms. Hammock signed a Consent Order that would terminate her July 19, 2013 Board Order and will suspend her RN license until such time as she provides documentation of: (a) completion of required evaluations; (b) successful completions of the initial phase of an approved treatment program, if treatment is recommended; (c) participation in an aftercare program, if treatment is recommended; (d) negative random monthly drug screens; (e) active participation in abstinence-oriented support group meetings; (f) accrual of requisite continuing education contact hours; (g) completion of required Board-approved course/programs on Understanding Substance Use Disorder in Nursing, if not deemed in need of treatment; and (h) payment of appropriate fees. If Ms. Hammock be deemed in need of treatment and upon documented completions to the above terms her license will be reinstated on probation for sixty (60) months with the usual substance use disorder stipulations, and she is required to pay a fine of $500.00. If not deemed to be in need of treatment, Ms. Hammock license will be placed on probation for twenty-four (24) months with the usual illegal/illicit stipulations and she would be required to pay a fine of $500.00.
On May 20, 2016, Ms. King moved that the Board accept the Consent Order.
Ms. Hill seconded. Motion carried without objection.
10. Jackson, Cynthia - LPN 2-038054 (Lapsed/ Probation)
Ms. Jackson signed a Consent Order that would terminate her November 14, 2014 Board Order and suspend her LPN license until completion of Board-approved course/programs on Disciplinary Actions: What Every Nurse Should Know and provide documentation of completion to the Board, receipt of Notification of Receipt of Board Order, and require her to pay a fine of $500.00. In no event will this period of suspension extend beyond twelve (12) months of the effective date of this Order. Should such occur, Ms. Jackson’s licensure status will be considered as and listed as revoked. Upon reinstatement, her license will be issued on probation for twelve (12) with the usual practice-related stipulations.
On May 20, 2016 Ms. King moved that the Board accept the Consent Order.
Ms. Hill seconded. Motion carried without objection.
11. Killian, Joanna Magdaline - RN 1-094850 (Active/ Probation)
Ms. Killian signed a Consent Order that would terminate her September 19, 2014 Board Order and will place her RN license on probation with illegal/illicit drug-use stipulations for twelve (12) months and require her to pay a $500.00 fine and complete a Board-approved course/programs on Professional Accountability and Legal Liability for Nurses and provide documentation of completion to the Board,.
On May 20, 2016, Ms. King moved that the Board accept the Consent Order.
Ms. Hill seconded. Motion carried without objection.

B. Formal Hearing
On May 20, 2016, Ms. Hill moved that the Board enter into Executive Session in
its capacity as a quasi-judicial body to deliberate and discuss evidence and
testimony presented during contested case hearings and vote on the
outcomes. Ms. Carpenter seconded. Motion carried with all in favor (Melissa
Bullard, Helen T. McAlpine, LaDonna McDonnell, Valorie Dearmon, Chrystabell
King, Cheryl Bailey, and Jill Hightower).
Dr. Wright reported that the Board would reconvene in open session at approximately 10:00 a.m. The Board returned to open session at 9:50 a.m.

4. Duke, Patty Lucretia - LPN 2-056270 (Active)
On May 20, 2016, Ms. Bullard moved that the Board accept the Findings of
Fact, Conclusions of Law, and the Recommendation of the Hearing Officer,
and suspend Ms. Duke’s LPN license until (a) documentation of completion of
a comprehensive substance use disorder evaluation with a Board-approved
provider and the initial phase of any approved treatment program, if
recommended; (b) initial participation in an aftercare program, if
recommended; and (c) documentation of satisfactory completion of a Board-
approved course/program on Substance Use Disorder, if treatment is not
recommended. If Ms. Duke fails to meet the aforementioned requirements
within eleven (11) months, her licensure status shall be considered as and
listed as revoked. Should Ms. Duke be deemed in of treatment and upon
documented completion of the above terms her LPN license will be placed on
probation for sixty (60) months with the usual substance disorder stipulations
and she will be required to pay a $500.00 fine. If not deemed to be in need of
treatment, Ms. Duke’s LPN license will be placed on probation for twelve (12)
months with the usual illegal/illicit stipulations and she will be required to pay
a $500.00 fine. Ms. Hightower seconded. Motion carried without objection.
5. Gray, Misty Lynn - RN 1-081059 (Active); LPN 2-042844 (Lapsed)
On May 20, 2016, Ms. Dearmon moved that the Board accept the Findings of
Fact, Conclusions of Law, and the Recommendation of the Hearing Officer,
and revoke Ms. Gray’s license. Ms. Bullard seconded. Motion carried without

6. Jerkins, Camellia Kilpatrick - RN 1-114809 (Active/Probation)
On May 20, 2016, Ms. Bailey moved that the Board accept the Findings of Fact,

On May 20, 2016, Ms. Dearmon moved that the Board accept the Findings of
Fact, Conclusions of Law, and the Recommendation of the Hearing Officer
grant Ms. McCarty’s endorsement application, issue her a public reprimand
and require her to pay a $500.00 fine. Ms. Hightower seconded. Motion
carried without objection.
8. Smith Reid, Sandra Delois - LPN 2-039351 (Active)
On May 20, 2016, Ms. Bailey moved that the Board accept the Findings of Fact,
Conclusions of Law, and the Recommendation of the Hearing Officer and
issue Ms. Reid a public reprimand and require her to pay a $300.00 fine. Ms.

Conclusions of Law, and the Recommendation of the Hearing Officer and

On May 20, 2016, Ms. Hill moved that the Board accept the Findings of Fact,
Conclusions of Law, and the Recommendation of the Hearing Officer and
suspend Ms. Thomas’s RN license until completion of: (a) documentation of

D. Reinstatement: Formal Hearings
1. Upshaw, Lenette Louise - LPN 2-046511 (Revoked)
On May 20, 2016, Ms. Bailey moved that the Board accept the Finding of Fact,
Conclusions of Law, and the Recommendation of the Hearing Officer and
approve application for reinstatement of Ms. Upshaw’s revoked LPN license.
Upon licensure, Ms. Upshaw’s LPN license will be placed on probation for
thirty-six (36) months with the usual substance use disorder stipulations and
she will be required to pay a $500.00 fine. She may apply for early release
after eighteen (18) months of satisfactory compliance with all the stipulations
of this Order. Ms. Hill seconded. Motion carried without objection.
2. White III, Charles Cavet - RN 1-082622 (Revoked)
On May 20, 2016, Ms. Bailey moved that the Board accept the Findings of Fact,
Conclusions of Law, and the Recommendation of the Hearing Officer and
approve application for reinstatement of Mr. White’s revoked RN license.
Upon licensure, Mr. White’s RN license will be placed on probation for thirty-
six (36) months with the usual practice stipulations until completion of Board-
approved courses/programs on Anger Management, Alcohol Problems,
Addiction and Wellness, required to pay a $300.00 fine and receipt of
employer notification.
