    PLAINTIFFS, A&J MANUFACTURING LLC and A&J MANUFACTURING, INC., byand through their attorneys, and for their Complaint against Defendants ACADEMY, LTD. andNINGBO HUIGE OUTDOOR PRODUCTS CO., LTD, state and allege as follows:

    I. PARTIES AND NATURE OF SUIT1. This is an action for infringement ofUnited States patents, in violation of

    35 U.S.C. 271, 281, 283-285, and 289. Plaintiffs seek monetary relief against Defendants,and equitable relief in the form of a permanent injunction against Defendants, barring the

    manufacture, sale, offer for sale, use or importation of goods that infringe the patent rightsasserted.

    2. Plaintiff, A&J Manufacturing, LLC is a limited liability company organized andexisting under the laws of the state of Georgia, having a place of business at 2465 DemereRoad, St. Simons, Glynn County, Georgia 31522.

    3. Plaintiff, A&J Manufacturing, Inc. is a corporation organized and existing underthe laws of he state of Florida, having a place ofbusiness at 903 Lake Asbury Drive, GreenCove Springs, Florida 32043.

    4. A&J Manufacturing, LLC is the owner, by assignment, of all right, title andinterest in U.S. Patent No. 8,381 ,712 , entitled "Simultaneous Multiple Cooking ModeBarbecue Grill" (the '"712 patent"). A copy of he '7 12 patent is attached as Exhibit A.

    5. A&J Manufacturing, LLC is further the owner, by assignment, ofall right, titleand interest in U.S. Patent No. D660,646 , entitled "Pair of Lids for a Dual Grill" (the '"646patent"). A copy of he ' 646 patent is attached as Exhibit B.

    6. A&J Manufacturing, LLC is further the owner, by assignment, of all right, titleand interest in U.S. Patent No. D662,773, entitled "Set of Smoke Stacks for a Dual Grill"(the '"773 patent"). A copy of the '773 patent is attached as Exhibit C.

    7. A&J Manufacturing, LLC is a leading designer, developer, manufacturer anddistributor of outdoor grilling products, including multiple-mode grill products that embodythe inventions of he '712 patent, the '646 patent, and the '773 patent.

    8. A&J Manufacturing, LLC, in cooperation with A&J Manufacturing, Inc. ,(hereafter referred to collectively as "A&J"), sells and distributes, within this district andnationwide, multiple-mode grill products, including those sold under the trademarks CHAR-

    GRILLER DUO and CHAR-GRILLER TRIO, both of which embody the inventions of the'712 patent, the '646 patent, and the '773 patent. Images ofthe genuine A&J products arereproduced below:

    Sports+Outdoors ("Academy") is a corporation organized and existing under the laws of hestate of Texas, having a principal place ofbusiness at 1800 North Mason Road, Katy, Texas77449.

    10. On information and belief, Defendant Ningbo Huige Outdoor Products Co., Ltd.("Huige") is a corporation organized and existing under the laws of the People's Republic ofChina, having a principal place of business at Room 1406 Building # 15 , Huaxin InternationalBusiness Center, Fenghua City, Zhejiang Province China.

    II. JURISDICTION, VENUE AND JOINDER11. This Court has original subject matter jurisdiction over the causes of action for

    patent infringement asserted herein, pursuant to 28 U.S.C. 1331 and 1338.12. On information and belief, Academy offers to sell and sells, within this judicial

    district, barbecue grill products that infringe one or more claims of the '7 12 patent, the claimof the '646 patent, and the claim of the '773 patent. The accused barbecue grill products are

    described more fully below. On information and belief, Academy has purposefully directedinfringing activities toward residents of this district, and has engaged in acts of infringementwithin this district. Therefore, this Court has personal jurisdiction over Academy.

    13. On information and belief, Huige offers to sell, sells and imports into the UnitedStates infringing barbecue grill products offered and sold by Academy in this judicial district.On information and belief, Huige has purposefully directed infringing activities towardresidents of this district, or has engaged in acts of infringement within this district. Therefore,this Court has personal jurisdiction over Huige.

    14. The acts of nfringement alleged herein against both Defendants arise out of thesame transaction, occurrence or series of ransactions or occurrences related to the sameaccused product. Further, questions of fact common to both Defendants will arise in thisaction. Therefore, joinder ofboth Defendants in this action is authorized by35 U.S.C. 299(a).

    15. Venue is proper within this judicial district pursuant to 28 U.S .C. 1391 (c) and(d), as Academy is a corporation subject to personal jurisdiction within this district, andHuige is an alien corporation. Further, venue is proper pursuant to 28 U.S.C. 1400(b), asAcademy's and Huige's acts of patent infringement have taken place within this district.

    III. DEFENDANTS' PRODUCTS16. Academy offers to sell and sell s within this judicial district a simultaneous

    multiple cooking mode barbecue grill, the "Outdoor Gourmet Model No. CG3023E."17. An image of said product is reproduced below:

    Academy Outdoor Gourmet DLX 201222. On information and belief, Defendant Huige manufactures these three multiple

    cooking mode barbecue grill products in China, offers to sell and sells the products in theUnited States, and imports them into the United States for sale in this district and elsewherein the U.S. Alternatively, on information and belief, Defendant Academy and DefendantHuige jointly import infringing multiple cooking mode barbecue grill products into theUnited States for sale in this district and elsewhere in the U.S.

    23. Among other features, each of these products comprise a wheeled frame

    supporting a gas cooking unit having a grilling surface, hinged lid and exhaust, together witha second cooking unit configured to cook with a solid fuel such as charcoal, and having aseparate grilling surface, hinged lid and exhaust.

    IV. FIRST CLAIM FOR RELIEF(Infringement of U.S. Patent No. 8,381,712)

    24. A&J incorporates the allegations of he foregoing paragraphs as if fully set forthherein.

    25. The actions of Defendants in making, offering to sell, selling and/or importinginto the United States at least the above-described Outdoor Gourmet CG3023E, DLX2013

    and DLX 2012 products constitute infringement of one or more claims ofA&J's ' 712 patentin violation of35 U.S.C. 271(a).

    26. A&J has been damaged as a direct and proximate result of Defendants' conduct inan amount to be proven at trial, but in no event less than a reasonable royalty.

    27. Furthermore, Defendants' infringing acts are ofa continual and ongoing nature,resulting in harm to A&J for which A&J has no adequate remedy at law. For that reason,A&J is entitled to equitable relief including injunctive relief pursuant to 35 U.S.C. 283.

    28. On information and belief, Defendants are aware ofA&J's patent rights, andDefendants are willfully infringing A&J's '712 patent.

    V. SECOND CLAIM FOR RELIEF(Infringement of U.S. Patent No. D660,646)

    29. A&J incorporates the allegations of he foregoing paragraphs as if fully set forthherein.

    30. Defendants' actions in offering to sell, selling and/or importing within this judicialdistrict the Academy Outdoor Gourmet CG3023E product constitute infringement of theclaim ofA&J's ' 646 patent in violation of35 U.S.C. 271(a).

    31. A&J has been damaged as a direct and proximate result of Defendants' conduct inan amount to be proven at trial, but in no event less than a reasonable royalty.

    32. By virtue of their infringement ofA&J's '646 patent, Defendants are liable toA&J to the extent ofDefendants' total profits made from the infringement, pursuant to35 U.S.C. 289.

    VI. THIRD CLAIM FOR RELIEF(Infringement ofU.S. Patent No. D662,773)

    35. A&J incorporates the allegations of he foregoing paragraphs as if fully set forthherein.

    36. Defendants' actions in offering to sell, selling and or importing within this judicialdistrict at least the above-described Outdoor Gourmet CG3023E, DLX2013 and DLX 2012products constitute infringement of the claim ofA&J' s '773 patent in violation of35 U.S.C. 271(a).

    37. A&J has been damaged as a direct and proximate result of Defendants' conduct inan amount to be proven at trial, but in no event less than a reasonable royalty.

    38. By virtue of their infringement ofA&J's '7 73 patent, Defendants are liable toA&J to the extent ofDefendants' total profits made from the infringement, pursuant to35 U.S.C. 289.

    39. Furthermore, Defendants' infringing acts are ofa continual and ongoing nature,resulting in harm to A&J for which A&J has no adequate remedy at law. For that reason,A&J is entitled to equitable relief including injunctive relief pursuant to 35 U.S.C. 283.

    40. On information and belief, Defendants are aware ofA&J' s patent rights, andDefendants are willfully infringing A&J's '773 patent.

    PRAYER FOR RELIEF

    WHEREFORE, A&J respectfully requests that this Court grant the following re liefagainst Defendants:

    A. That pursuant to 35 U.S.C. 283, Defendants, together with their officers,agents and employees, and all persons acting in concert with them, be permanentlyenjoined from making, using, importing, selling or offering to sell products thatinfringe the claims ofthe '712 patent, the ' 646 patent, and the '773 patent, includingat least the Outdoor Gourmet CG3023E, DLX2013 and DLX 2012 products;

    B. That an award of damages enter in favor of A&J and against Defendantsadequate to compensate A&J for Defendants ' infringement ofA&J' s patent rights, inno event less than a reasonable royalty, together with prejudgment interest from thedate infringement began;

    C. That, pursuant to 35 U.S.C. 289, Defendants be ordered to disgorge theirentire profit realized from sales ofproducts that infringe the '646 patent and/or the'773 patent, and the profits thus di sgorged be awarded to A&J;

    D. That the Court assess increased damages by virtue of Defendants' willfulinfringement, and award said increased damages to A&J along with the award ofA&J' s reasonable attorney fees pursuant to 35 U.S.C. 285 ;

    E. That A&J be awarded costs, expert witness fees, and such other andfurther relief as the Court may deem just and proper.

    This application claims the benefit of priority to U.S. provisional patent application Ser. No. 60/592,428, entitled"Simultaneous Multiple Cooking Mode Barbecue Grill,'' andfiled on Jul. 31, 2004, and to U.S. provisional patent applica- 10tion Ser. No. 60/592,429, entitled "Heating of Radiant Materials for Preparation of Barbecue," and filed on Jul. 31, 2004,both of which are incorporated by reference herein.

    BRIEF DESCRIPTION OF DRAWINGSFIG.1 shows an exemplary multiple mode barbecue grill inaccordance with exemplary embodiments of the invention.FIG. 2 shows an alternate exemplary multiple mode barbecue grill in accordance with exemplary embodiments of heinvention.This application is related to U.S. nonprovisional patentapplicat ion Ser.     FIG. 3 shows another alternate exemplary multiple modebarbecue grill in accordance with exemplary embodiments ofthe invention.DETAILED DESCRIPTION OF EXEMPLARYEMBODIMENTS OF INVENTIONECHNICAL FIELD

    The present invention generally relates to cooking equipment, and more particularly, to a simultaneous multiple cooking mode barbecue grill.

    BACKGROUND OF INVENTIONBarbecue enthusiasts have the need to prepare barbecueusing various modes (methods, mam1ers, etc.) of cooking. Forexample, sometimes barbecuing with a charcoal based fuel(e.g., charcoal briquettes) is needed. Other times, barbecuingwith a wood based fuel is needed (e.g., for a smoker process).Yet other times, barbecuing with a gas based fuel (e.g., propane) is needed. Furthermore, other types of fuel may beneeded to satisfy the barbecuing objective.Existing options typically consist of a barbecue grill thatcan only prepare barbecue in a single mode. For example,

    some options provide for charcoal grilling, others for wood orsmoker grilling, and yet others for gas grilling. For the "multimode" barbecuer, these options require the use of more thanone separate grill. A few options consist of a grill that can beconverted between two modes, for example, charcoal and gas.However, these options are still limited in that they can onlybe operated in one mode at a time and typically requirecomplicated reconfigurations to switch between cookingmodes. Moreover, these existing options lack sufficient capability for controlling the various cooking modes in or der toobtain performance that is even comparable to existing singlemode grills.Therefore, there is a need in the art for a barbecue grill thatis capable of cooking in multiple modes simultaneously whileoffering the control and performance capabilities for eachmode that is at least comparable to a corresponding singlemode grill.

    SUMMARY OF INVENTIONThe invention, in accordance with exemplary embodiments described herein, provides a simultaneous multiplecooking mode barbecue grill. In a general embodiment, thesimultaneous multiple cooking mode barbecue grill caninclude a first cooking mode uni t configured to prepare foodin a first cooking mode, a second cooking mode unit configured to prepare food in a second cooking mode, and a supporting structure that supports the first cooking mode unit andthe second cooking mode unit so that the first and secondcooking mode units can be moved securely and operated

Moreover, the multimode grill1 00 may include additional cooking mode units inaccordance with some exemplary embodiments of he invention. For example, the multi-mode grill100 may also include55 a third cooking mode unit 140, which can provide anothermode for cooking with the grill100. For instance, the thirdcooking mode unit 140 may be an auxiliary or side burner unitthat can provide a radiant hea t cooking mode by, for example,radiating heat, flames, etc. at one or more of ts surfaces (e.g.,60 via a burner component, structure, assembly, etc.) by theburning (combustion, etc.) of a gas based fuel such as propane. In that regard, the third cooking mode unit 140 may also

In that regard, the grill 200 includes some ofthe same (or similar) features as the grill1 00 discussed above.For example, the grill 200 includes a first cooking mode unit210 and a second cooking mode unit 220. The first cookingmode unit 210 may include an openable cover 211 withexhausts 212, and the second cooking mode unit 220 mayinclude an openable cover 221 with exhaust 222. Furthermore, the grill 200 includes a common supporting structure(assembly, platform, base, frame, etc.) 230 that can supportthe cooking mode units 210, 220 as well as additional components, such as a fuel container 214, all which may beattached, connected, or otherwise secured to the structure 230by means, methods, apparatuses, etc. that may be known inthe art and/ or apparent to one of ordinary skill in the art basedon the disclosure herein. Moreover, the grill 200 may includeadditional cooking mode units such as a third cooking mode(e.g., a side burner) unit 240. Additionally, in accordance withsome exemplary embodiments of the invention, the grill200may include a supporting surface (shelf, platform, etc.) 250(e.g., as depicted in FIG. 2), which can be used for variouspurposes such as to support food, cooking utensils, etc. thatmay be used along with the grill 200.

    FIG. 3 shows another alternate exemplary multiple modebarbecue grill 300 in accordance with exemplary embodiments of the invention. Similar to the foregoing grill 200, thegrill300 also includes some of the same (or similar) featuresas the grill100, which was discussed above. For example, thegrill300 includes a first cooking mode unit 310 and a secondcooking mode unit 320 supported on a common supportingstructure (assembly, platform, base, frame, etc.) 330, whichcan also support additional components such as a fuel container 314, and these components may be attached, connected, or otherwise secured to the structure 330 by means,methods, apparatuses, etc. that may be known in the art and/orapparent to one of ordinary skill in the art based on thedisclosure herein. The first cooking mode unit 310 mayinclude an openable cover 311 with exhausts 312, and thesecond cooking mode unit 320 may include an openablecover 321 with exhaust 322. Furthermore, the grill 300 mayinclude a third cooking mode (e.g., a side burner) unit 340.Additionally, in accordance with some exemplary embodiments of the invention, the grill 300 can include a fourthcooking mode unit 324. This unit 324 may operate separatelyto prepare food in another cooking mode or may operate inconjunction with the second cooking unit 320. For example,the second cooking unit 320 may operate in a smoker cookingmode (e.g., wood burning), wherein the fourth unit 324 mayoperate as a firebox (offset firebox, side firebox, smoker box,etc.) in which fuel materials can be burned or combusted toprovide heat and/or smoke to the second cooking unit 320through an interconnection of the two units 320, 324 to prepare smoked barbecue. Furthermore, the fourth cookingmode unit may operate in other cooking modes, such as aseparate barbecue or smoker grill unit for example.

    13. The barbeque grill of claim 10, wherein the first meansfor cooking and the second means for cooking are operableindependently of each other.

    14. The barbeque grill of claim 10, further comprising:at least one substantially vertical panel positioned between

    the first means for cooking and the second means forcooking.a firebox supported by the supporting structure and configured to provide heat or smoke to the second cookingunit when a fuel material is burned or combusted in thefirebox;wherein the firebox simultaneously operable with the sideburner, the first cooking unit, and the second cooking

    unit.

    15. The barbeque grill of claim 10, wherein the structure20 means comprises a means for holding at least one fuel container.

    4. The barbeque grill of claim 1, wherein the first cookingunit and the second cooking unit are operable independently 25of each other.

    5. The barbeque grill of claim 1, further comprising:at least one substantially vertical panel positioned betweenthe first cooking unit and the second cooking unit.6. The barbeque grill of claim 1, wherein the support structure is configured to hold at least one fuel container.8. The barbeque grill of claim 1, wherein the first andsecond cooking units are each configured to hold food over a 35flame.9. The barbecue grill of claim 1, wherein the configuration

    of the at least one exhaust of the first cover includes a configuration of at least two exhausts.10. A barbecue grill having multiple means for cooking, 40comprising:a first means for cooking food using gas cooking fuel, thefirst means for cooking including at least one first grilland an openable first cover means for selectively covering the first grill, wherein the first cover means is 45attached to the first means for cooking and includes atleast one exhaust;

    16. The barbecue grill of claim 10, wherein the configuration of the at least one exhaust means of he first cover meansincludes a configuration of at least two exhaust means.17. A barbecue grill having multiple cooking units, comprising:a support structure configured to support a plurality ofcooking units;a first cooking unit supported by the support structure, thefirst cooking unit having a substantially cylindricalshape, the first cooking unit configured to cook foodusing gas cooking fuel, the first cooking unit including atleast one first grill and an openable first cover attached tothe first cooking uni t that selectively covers the first grill,wherein the first cover includes at least one exhaust; anda second cooking unit supported by the support structure,the second cooking unit having a substantially cylindrical shape, the second cooking unit configured to cookfood using solid cooking fuel, the second cooking unitincluding at least one second grill and an openable second cover attached to the second cooking unit that selec-tively covers the second grill, wherein the second coverincludes at least one exhaust,wherein the first cooking unit and the second cooking unitare simultaneously operable to cook food and the firstgrill and second grill are selectively and independentlycoverable.
