R. 7007.1800, compliance with the conditions of this permit shall be deemed compliance with the specific provision of the applicable requirement identified in the permit as the basis of each condition. Subject to the limitations of Minn. R. 7007.1800 and 7017.0100, subp. 2, notwithstanding the conditions of this permit specifying compliance practices for applicable requirements, any person (including the Permittee) may also use other credible evidence to establish compliance or noncompliance with applicable requirements. FACILITY DESCRIPTION:

ConAgra Flour Milling Company operates a wheat flour and animal feed mill in Hastings, Minnesota. The facility consists of hardwheat mills, durum mills, durum processing, a rye mill, and associated elevator, storage, and packaging areas. Seventy-five percent of the wheat received is processed into flour and the remaining 25 percent into feed. The facility operates a boiler for heating and wheat tempering during the winter months. Methyl bromide is used for fumigation.

In Permit -001, the facility accepted limits on the amount of wheat to be processed, and on the amount of fumigant (methyl bromide) which may be used. These limits were federally enforceable, and resulted in the facility being a non-major source under the Part 70 permit program, New Source Review, and the National Emission Standards for Hazardous Air Pollutants program.

AMENDMENT DESCRIPTION:

This amendment removes all three Particulate Matter less than 10 microns (PM10) process throughput limits. The process throughput limits are replaced by an overall facility wide 95 tons per year (tpy) PM10 emission limit. The previous permit (-001) had a facility wide Potential to Emit PM10 emission of 95 tpy. Hence, there is no change in the PM10 Potential to Emit or other pollutant emissions.

The Permittee may not makeany change at the source that would make the source a major source under NewSource Review until a permit amendment has been issued. This includes changesthat might otherwise qualify as insignificant modifications and minor or moderateamendments.

The Permittee shall not begin construction of any single project or projects that areconnected or phased which will cause a total increase in actual emissions ofgreater than 99 tons per year for any criteria pollutant without first getting a permitamendment to authorize the project. Connected and phased have meanings asdefined in Minn. R. 4410.0200 subps. 9b and 60. The Permittee shall not beginconstruction of any other project which is listed in Minn. R. 4410,4300 or Minn. R.4410.4400 without first getting a permit amendment to authorize the project. Suchprojects may require the completion of an Environmental Assessment Worksheet oran Environmental Impact Statement prior to the amendment being issued. This is astate only requirement and is not federally enforceable.

Recordkeeping -- Hours of Generator Operation: The Permittee shall maintaindocumentation on site that the generator listed as an insignificant activity inAppendix B of this permit is an emergency generator by design that qualifies underthe U.S. EPA memorandum entitled "Calculating Potential to Emit (PTE) forEmergency Generators" dated September 6, 1995, limiting operation to 500 hoursper year.

Operation and Maintenance Plan: Retain at the stationary source an operation andmaintenance plan for all air pollution control equipment. At a minimum, the O & Mplan shall identify all air pollution control equipment and shall include a preventativemaintenance program for that equipment, a description of (the minimum but notnecessarily the only) corrective actions to be taken to restore the equipment toproper operation to meet applicable permit conditions, a description of theemployee training program for proper operation and maintenance of the controlequipment, and the records kept to demonstrate plan implementation.

Monitoring Equipment Calibration: Annually calibrate all required monitoringequipment (any requirements applying to continuous emission monitors are listedseparately in this permit).

Operation of Monitoring Equipment: Unless otherwise noted in Tables A, B, and/orC, monitoring a process or control equipment connected to that process is notnecessary during periods when the process is shutdown, or during checks of themonitoring systems, such as calibration checks and zero and span adjustments. Breakdown Notifications: Notify the Commissioner within 24 hours of a breakdownof more than one hour duration of any control equipment or process equipment ifthe breakdown causes any increase in the emissions of any regulated air pollutant.The 24-hour time period starts when the breakdown was discovered or reasonablyshould have been discovered by the owner or operator. However, notification is notrequired in the circumstances outlined in Items A, B and C of Minn. R. 7019.1000,subp. 2.

At the time of notification or as soon as possible thereafter, the owner or operatorshall inform the Commissioner of the cause of the breakdown and the estimatedduration. The owner or operator shall notify the Commissioner when thebreakdown is over.

Operation Changes: In any shutdown, breakdown, or deviation the Permittee shallimmediately take all practical steps to modify operations to reduce the emission ofany regulated air pollutant. The Commissioner may require feasible and practicalmodifications in the operation to reduce emissions of air pollutants. No emissionsunits that have an unreasonable shutdown or breakdown frequency of process orcontrol equipment shall be permitted to operate.

Each owner or operator of a stationary source, at whicha regulated substance is present above a threshold quantity in a process, shalldesign and implement an accidental release prevention program. Calculations: By the 15th day of each month, the Permittee shall record theprocess throughput for each of the four process weights, for each day, of theprevious month and calculate each of the four 365-day rolling sum process weightsfor each day. The Permittee shall also calculate the 365-day rolling sum PM10emissions for each day of the previous month.

For each day, the 365-day rolling sum PM10 emissions are to be calculated usingthe following equation:

Periodic Inspections: At least once per calendar quarter, or more frequently asrequired by the manufacturing specifications, the Permittee shall inspect the controlequipment components. The Permittee shall maintain a written record of theseinspections.

1.2. Description Of The Facility ConAgra Flour Milling Company operates a wheat flour and animal feed mill in Hastings, Minnesota. The facility consists of hardwheat mills, durum mills, durum processing, a rye mill, and associated elevator, storage, and packaging areas. Seventy-five percent of the wheat received is processed into flour and the remaining 25% into feed. The facility operates a boiler for heating and wheat tempering during the winter months. Methyl bromide is used for fumigation. The facility had initially accepted (Permit-001) limits on the amount of wheat to be processed and on the amount of fumigant (methyl bromide) which may be used. These limits were federally enforceable, and resulted in the facility being a non-major source under the Part 70 permit program, New Source Review, and the National Emission Standards for Hazardous Air Pollutants (NESHAP) program. 1.3 Description of the Activities Allowed by this Permit Action

The Permittee requested this major amendment (-002) to allow for greater flexibility in operations. As a result, this amendment removes all three Particulate matter less than 10

microns (PM10) process throughput limits. The process throughput limits are replaced by an overall facility wide 95 tons per year (tpy) PM10 emission limit. The previous permit (-001) had a facility wide PTE PM10 emission of 95 tpy. Hence, there is no change in the PM10 Potential to Emit (PTE) or other pollutant emissions.

1.4 Description of all amendments issued since the issuance of the last total facility permit and to be included in the Part 70 Permit.

None.

1.5 Comments made during the Public Notice Period.

In response to the public comment period, the Minnesota Department of Health (MDH) made two comments on December 11, 2003. The first comment recommended that air monitoring be required at the facility property line to ensure that Health Risk Value (HRV) exceedances of methyl bromide do not occur. The HRV for methyl bromide is 2 mg/m3. It is noted that MDA regulates the use of methyl bromide in this application. MDA stated that levels must below 5 ppm, after 3 days, when an entrance (i.e., door) is opened or worker entering the building must appropriately “suit up.” Monitoring is required, under MDA authorities, for the 5 ppm threshold. The second comment requested that ambient modeling be done to determine that the PM10 NAAQS is not exceeded. The MDH expressed concern that the facility’s particulates may be allergens, making them more problematic than most dusts. It is noted that current MPCA policy is to not require PM10 ambient modeling for facilities with less than 100 tpy of actual PM10 emissions. These comments are attached. The MDH comments are related to issues that were not proposed to be modified during this comment period. Minnesota Rule 7001.0190, subp. 1. Accordingly, the MPCA will not be pursuing the MDH comments, as it relates to this amendment. The MPCA recommended to the Permittee, however, that it consider these issues in the long-term operation of its facility. 1.6 Facility Emissions: As a result of this amendment (-002), there are no changes in emissions from the previous permit (-001).

(The following section addresses the entire facility even though this major amendment (-002) only impacts PM10 emissions.)

Part 70 Permit Program

The facility has accepted federally enforceable emission limits, so that the source is permitted as a non-major source.

New Source Review

The facility is subject to a NSR threshold of 250 tons per year for criteria pollutants. The facility is located in an area that is considered attainment for all pollutants. The facility has accepted federally enforceable emission limits, and is permitted as a non-major source under New Source Review.

New Source Performance Standards (NSPS)

The facility operates a boiler that is subject to NSPS Subpart Dc.

National Emission Standards for Hazardous Air Pollutants (NESHAP)

There are no promulgated, proposed, or upcoming NESHAP or MACT standards that apply to this facility. Because the facility has the capability of emitting in excess of 10 tons per year of methyl bromide, it would be subject to the MACT Hammer; however, this permit limits HAP emissions to below the major source thresholds.

3. Technical Information

(The following section addresses the entire facility even though this major amendment (-002) only impacts PM10 emissions.)

3.1 Calculations No calculations are attached. This is because the emission limit is based on four variable process parameters that will be recorded.

It is noted that the emissions from the boiler did not change from Permit -001. The boiler emissions were calculated using emission factors from AP-42 and the maximum capacity of the boiler. The boiler has a 0.96 tpy PTE. This 0.96 tpy PTE is included in the facility PM10 equation.

It is also noted that the actual hourly emission calculation methodology from the grain, feed, and flour operations did not change from Permit -001. The actual hourly emissions will still be calculated using the same emission factors from AP-42, the process throughput of the operation processes, and the control efficiency from Minn. R. 7011.0060-0080. It is noted there were no changes in the April 2003 AP-42 9.9.1 Grain Elevators and Processes revisions.

The PM10 annual emission will limit either/or all the grain, feed, milling, and flour operations, depending on facility choices.

The PM10 emission limit that is added in this amendment (-002) includes all the PM10 emissions from EU001 through EU008. This amendment also requires the daily recording of the milling (EU 004) process throughput in weight.

The development of the PM10 emission limit can be found in Attachment 1 to this document. 3.2 Insignificant Activities

The insignificant activities that are required to be listed are shown in Appendix B to the permit. There are no changes in the insignificant activities. 3.3 Periodic Monitoring In accordance with the Clean Air Act, it is the responsibility of the owner or operator of a facility to have sufficient knowledge of the facility to certify that the facility is in compliance with all applicable requirements.

In evaluating the monitoring included in the permit, the MPCA considered the following:

• The likelihood of violating an applicable requirement;

• Whether add-on controls are necessary to meet the emission limit;

• The variability of emissions over time;

• The type of monitoring, process, maintenance, or control equipment data already available for the emission unit;

• The technical and economic feasibility of possible periodic monitoring methods; and

• The kind of monitoring found on similar units.

Table 4 summarizes the periodic monitoring requirements for those emission units for which the monitoring required by the applicable requirement is nonexistent or inadequate.
