Firstly a huge thank you to all
those people who have donated
hours of their own personal time
to support Arch Hill.Tanks to all those that have attended
our street party, enjoyed our movie night,
bought a t-shirt or some beer and to
those that have donated or loaned money
to the Arch Hill Residents Association
fund to fight the Bunnings application.
As you know, and following a decision by
the community, we have lodged an appeal
to the Environment Court against the
proposed development. As part of
this process there is opportunity for
mediation between participating parties
which is currently being considered.
Te main challenge presented by going
to the Environment Court is that it is
expensive. We need to be clear about the
state of the Associations funds.
Tere is a grant available for communities
going to E. C. and Katie has put a hugeeffort in to submitting an application. We
have had to present a full account of the
costs to the Residents
Association and an audit of
our accounts. So now is a
good time for us to share these:
Estimated costs* of taking our case to theenvironment Court as follows:
$165,000 full environment court
case (this is if we go to mediation and
Bunnings wont mediate or accept our
bottom line)
$150,000 straight to the environment
court (no mediation)$95,000 mediation only
*Tese figures are worst case scenario.
We would receive a maximum of
$40,000 from the fund if our application
is successful and this will be confirmed
in February. At present our Associationis in debt. We need to act on this
with urgency. What we owe and will
owe as a result of these proceedings is
nothing compared to the ramifications
of allowing this development to proceed
unchallenged. We have an opportunity to
at worst force Bunnings to make changesthat are more suitable to the community
and at best...have the whole, non-
compliant grant over-turned.
