• Agrochemical firms spot a 'generic' promise in patent

expiry in their sector

• Indian agrochemical companies are looking to replicate

the success that the country's generic drug makers

have had with medicines going off patent. They want to

exploit the opportunity opening up with the patent

expiry of several significant agrochemicals in the North

and Latin American markets, India and ROW.

• BASF sued Israel-based Makhteshim Agan and Cheminova for patent infringement based on the process patents.

Section 3 (d) of the

Patents Act, 1970

• In order to prevent ‘evergreening’ (extension of the life of a patent over products that are about to expire on account of minor and incremental improvements in the invention) of patents, section 3 (d) of the Act provides that:

• A mere discovery of a new form/ use/ property/ process etc. of a known substance which does not result in enhanced efficacy is not patentable.

• Salts, esters, ethers, polymorphs, etc. of known substance are to be considered to be the same substance until these differ significantly in properties with regard to efficacy.

• Mere use of a known process, machine or apparatus is not patentable unless such known process results in a new product or employs at least one new reactant.

Some well known products, like Rynaxypyr (Chlorantraniliprole) are in the list as well as some niche products such as the eco-friendly fungicide Isotianil used on rice.

• Bayer holds the most 7 products with patents expiring in the coming 5 years, the same numbers as from Japanese companies.
