THE AGRI CUL T URAL PRODUCE ACT

[ I n August, 1926.1

1. This Act may be cited as the Agricultural Produce S!lorttitle.

Act.

2. In this Act- Interpreia-tian.

“agricultural produce” shall mean any of the kinds of

produce mentioned in the First Schedule or in the Eg:duIeFourth Schedule;

“cacao” means cacao beans, whether in the pod or pulp,or separated, and whether cured or uncured, ripe orunripe;

“carrier” means any person who by himself, or by hisservant or agent, conveys in a vehicle along a publicroad any specially protected produce but shall notinclude-

(a) a person who by himself or by his servant or agentconveys in his own vehicle any such prod uce ownedby such person; or

(b ) a person who conveys in a vehicIe any such producefor sale for local consum ption in Jamaica;

“carrying on a trade or business” means any purchase orsale for the purpose of trade in produce although suchpurchase o r sale occurs on one occasion only;

“coffee” means coffee beans, whether in the cherry or pulp,or separated from the pulp, and whether cured or

uncured, ripe OT unripe;

‘‘coconut” means green or water coconuts, and ripe or drycoconuts in shell or peeled, also the kernel and copra;

“consignor” means the owner or shipper, whether jointly

or severally of agricultural produce, and includes any

person authorized by such owner or shipper to ship

agricultural produce. It also includes, in the case ofa company, the managing director, manager, secretary

or other principal officer of the company in the Island;

“contract” means any agreement, arrangement or under-

standing, whether oral or in writing, and whether for

a fixed or indeterminate period, whereby any person

engages to sell or deliver specially protected produce

to an exporter, or to any other person who buys or

receives the same for delivery or sale to an exporter :

Provided that the expression shall not include

transactions in relation to specially protected producefor local consumption or for any local manufacture nor

shall it include any casual sale or delivery to a p o d u e

dealer at licensed premises;

“dealer” means any person holding a current licence under

this Act;

“exporter” means any person, firm or company carrying

on the business of exporting from the Island speciallyprotected produce;

“fruit” means bananas and c i t r u s fruit and any fruit

which the Minister may declare to be fruit for the

purposes of this Act;

“inspected” means inspected under the provisions of this

“licensed vehicle” means a vehicle in respect of which a

“nutmegs” means nutmegs, whether in the pod or separatedfrom the pod, whether cured or uncured, ripe orunripe, and mace;

“place” means any place where any produce mentioned in First

the First or Fourth Schedule is grown, stored, bought F ~ ~ ~ ~

or sold;“premises” shall include any house, shop, depot, wharf,

portion of a wharf, building, room or enclosed placeapproved by an officer appointed for the purpose bythe Minister as a place for the purchase or sale ofagricultural produce and any enclosed land appurten-ant thereto, or used or occupied therewith;

“prescribed” means prescribed by orders of the Ministeror by regulations;

“specially protected produce” means agricultural produceof any of the kinds specified in Class No. 2 of the First Firs1

Schedule;

“unmarketable fruit” means fruit in such a bruised,damaged, poor or immature condition in the opinionof the Inspector at the time of inspection as not to be

fit for shipment and to be prejudicial to the agriculturalinterests of the Island if shipped;

(2) Every person carrying on the trade or business

of buying or selling, or of buying or exporting agriculturalproduce, who desires to buy any agricultural produce at

any place other than on the premises for which he holds

a licence to purchase or buy or export agricultural produce,

may take out a licence to be called a traveller’s licence,

which shall be transferable to any agent or servant

appointed by any such person to purchase agricultural

produce on his behalf. Every person possessing a traveller’s

licence shall be entitled to purchase any agricultural

produce mentioned in any of the classes in the First

Schedule in any parish in the Island, and shall be further

entitled to purchase such agricultural produce on the

premises of the grower or producer, or to purchase by

letter or telegram :

Provided that this section shall not apply to growers ofagricultural produce selling or exporting such produce

grown upon their own property, or to persons buying such

produce for domestic use.

4 . 4 1 ) Any person desiring a licence of any class

mentioned in the First Schedule, or a traveller’s licence,

shall, before the sitting of the Resident Magistrate’s Court

of the parish wherein the premises in respect of which the

application is made are situated and, in the case of atraveller’s licence, of the parish wherein the applicant

resides and at which his application is to be considered,

deposit with the Collector of Taxes of the parish, in the

case of a licence for Class 1, 2 or 3 of the First Schedule,

the sum of two hundred and fifty dollars and in the case ofa traveller‘s licence, the sum of five hundred dollars. The

Collector shall give a receipt for the amount so deposited,

which receipt shall be produced for inspection at the sitting

of the Resident Magistrate’s Court.

(2) Each applicant shall cause to be delivered to the

Clerk of the Courts an application in writing for thelicence, stating his name and residence in full, the class

of licxuce desired, and the particular premises for which

the same is desired; and each person intending to applyfor a licence under this Act shall, ten days at least beforethe sitting of the Resident Magistrate’s Court at whichhis application is to be considered, give notice in writingof such intention to the Chief Officer of Constabulary ofthe parish in which his application is to be made, and shall

set forth in such notice-

(U) his name, address and occupation;

( b ) the situation of the premises in which he proposesto buy or sell agricultural produce and the classof produce he desires to deal in;

(c) whether he intends to deal in wet or dry produceor both;

(d)whether his application is for an original licence

or for the renewal of a licence;( e ) that there is not any unsatisfied judgment against

him in any Court of Judicature of this Islandfor misapplying, or not accounting for moneysentrusted to him for the purpose of enabling himto purchase agricultural produce;

(j)whether he has previously been refused a licencefor any premises in the Island;

(g) a recommendation in writing from a Justice of the

parish, or from a member of the Parish Council,a minister of religion, or a householder payingdirect taxes to the amount of ten dollars yearly.

The Chief ORicer of Constabulary shall make suchenquiries as he may deem necessary, and shall endorse oneach notice the result of his enquiries into the character ofthe applicant, and the correctness of the statements in thesaid notice, and shall forward such notice so endorsed,together with a certificate from the Inspector, which must

be furnished by the applicant, that the applicant has asufficient and suitable place for the storing, grading, and

packing of produce, to the Clerk to be laid before theResident Magistrate's Court at the sitting of the Court atwhich the application is to be considered and in every casein which his report is unfavourable to an applicant, theChief Officer of Constabulary shall, if required by theResident Magistrate, attend and afford such information

on oath as may be required of him.

(3) In the case of an application to deal in wetproduce, each applicant shall forward together with hisapplication to the Clerk of the Courts a certificate from theInspector that he has made suitable arrangements for thecuring of wet produce.

(4) Each applicant shall also cause to be deliveredto the Collector of Taxes of the parish along with the depositrequired by subsection (1) a certificate signed by the ChiefOfficer of Constabulary or a Justice of the parish in whichthe application is made that the applicant is able to readand write the English language and to keep the bookrequired to be kept by a licensed produce dealer.

(5 ) Notwithstanding the provisions of subsection (2)a licensed produce dealer may have his licence renewedfrom year to year on his giving notice to the Chief Officerof Constabulary for the parish of his intention to applyfor such renewal and on the payment of the fees providedfor such licences in section 4(1) to the Collector of Taxesof his parish, and on his forwarding together with hisapplication, to the Clerk of the Courts, in the case of alicence of Class No. 1, the certificate of the Inspector undersubsection (3) where the applicant intends to deal in wetproduce, and in the case of a licence of Class No. 2, thecertificate of the Inspector prescribed by subsection (9) nd

Inspector or an Inspector satisfies the Resident Magistratethat the person claiming to have his licence renewed oughtnot to be licensed, the Resident Magistrate may refuse torenew such licence.

(6) A licence of Class No. 1 in the First Schedule First

Schedulc.shall not authorize the selling or buying of any agriculturalproduce which is uncured or wet or in the skin, pod, cherryor husk-

(a) unless the applicant for the licence has satisfiedthe Resident Magistrate by the production of acertificate from an Inspector that he has suitablefacilities fo r the curing of the said produce, whichin the case of cocoa shall consist of proper meansof drying by artificial heat, sliding trays or hand

trays, and in the case of coffee, proper equipmentincluding pulpers, fermenting tanks, an adequatewater supply, an d facilities for drying; and

(6) the Resident Magistrate has noted on the licencethat he is so satisfied.

(7) A licence of Class No. 2 in the First Schedule FirstSchedulc.shall not authorize the buying of any citrus fruit unless the

applicant for the licence has satisfied the ResidentMagistrate, by the production of a certificate from an

Inspector, that he has a sufficient and suitable storehousefor the storing, grading and packing of such produce, andthe Resident Magistrate has noted on the licence that heis so satisfied.

(8) A traveller’s licence shall not authorize the pur-chasing, otherwise than on premises duly licensed underthis Act, of any agricultural produce of Class No. 1 in theFirst Schedule hereto, which is uncured or wet, or in the First

skin, pod, cherry o r husk.

(9) Notwithstanding anything in this Act contained Pirst

granted or renewed unless the applicant for the licencesatisfies the Res ident Magistra te by the produc tion of acertificate from an Inspector that the premises in respectof which application is made are not situated so near to thebank of any river, stream or watercourse as to conduce tothe spread of Panama Disease.

5. The Resident Magistrate shall openly hear, considerand deal with, all such applications presented as aforesaid.In every case in which the Resident Magistrate shall grantthe application, the C lerk shall when th e licence is confinedto the premises in which the dealer carries on his business,issue a licence in accordance with Form A in the SecondSchedule and in any case in which the applicant appliesfor a traveller’s licence, issue a licence in accordance withthe Form B in the Second Schedule :

Provided always, that any person who has been or shallbe convicted of larceny or embezzlement, or receiving stolenproperty knowing it to have been stolen, or of any offenceunder any enactment for the time being in force relating topr zd ia l larceny or any offence against any enactment for thetime being in force relating to obeah or vagrancy, or whoknowingly employs under his licence any person who has

been convicted of any of the above offences, shall forfeit hislicence, and be precluded for three years from obtainingor holding a licence under this Act.

6. In every case in which an application for a licenceunder this Act is refused, the Clerk shall give the applicanta cer tifica te in writing of such refusal.

7. A licence under this Act may at any time be sus-

pended or revoked by the Resident Magistrate if aftergiving the holder thereof an opportunity of being heard theChief Officer of Constabulary, or the Chief Inspector or an

8,-(1) Every Clerk who shall issue any licence under c lerk to

this Act shall forthwith notify the same to the Chief a n d c h e f

Inspector and to the Chief Officer of Constabulary of the Fz$Afparish, and shall cause the name and address of the person ILcence

licensed to be published in the Gazette.

(2) The production of a copy of the Gazette contain-ing any such notification, shall be prima facie proof thatthe person whose name appears therein is duly licensedunder this Act for the current year.

(3) The Chief Officer of Constabulary shall cause tobe posted up at each Court House, an d a t each police station

in his parish, a list of all persons licensed under this Actin such parish, showing the class of licence that has beengranted, and the place at which the licensee is authorizedto trade.

11 . 41 ) Every licensed produce dealcr shall keep a bookwherein he shall record in the English language at the

time of purchase of any agricultural produce the date ofsuch purchase, the description of such produce, the weight,number, grade according to the number of hands orquantity of such produce, the price paid for the same,the name and address of the person from whom he or any-one on his behalf actually received such produce, the nameand address of the owner of such produce, and where thereceipt is of bananas, coconuts or citrus fruit, the placewhere and the person by whom such produce was grown or

produced; and such book shall be open at all reasonablehours to inspection by any Justice, or any constable, or anyperson authorized under any enactment for the time being inforce relating to przdial larceny, or an Inspector, who maytake possession of such book for purposes of evidence orrecord :

Provided that no person making such inspection as afore-said shall communicate to any other person the informationso obtained except-

(a) for the purpose of providing any evidence orinformation in relation to, and for the detectionof, any offence, or suspected offence under thisAct or any other enactment;

( b ) for any other purpose connected with theadministration of Justice:

Provided further that such inspection may be made, andsuch information so obtained may be communicated, either

before or after any proceedings in relation to any offenceor suspected offence have been commenced.

( 2 ) Any person who communicates any information

obtained under this section in contravention of the

provisions of this section shall be guilty of an offence.

(3) The person making such inspection shall note

in such book, the date of his inspection and shall sign his

name to such noting.

(41 Every person delivering any agricultural

produce to a produce dealer shall furnish to such produce

dealer his full name and address and the name and address

of the owner or each of the owners of the produce delivered,

and where the delivery is of bananas, coconuts or citrus

fruit, the name of the place or places where and the person

or persons by whom the produce was grown or produced.

(5) In all proceedings in any Court of Justice the

book to be kept under the provisions of this section and

all entries therein shall be p r i m facie evidence of the

matters therein recorded.

(2) A licence to purchase and sell agriculturalproduce shall be in accordance with Form A in the Second second

Schedule, where the licence is confined to the parish in

which the dealer carries on his business, and shall be

transferable from place to place within the parish, subject

to the approval of the Resident Magistrate, and shall be

transferable from person to person, on the conditions to

be complied with by the transferee, required in the case ofthe issue of a new licence under this Act. On he transfer

(31 A separate licence shall be necessary for each

separate class of produce, as set out in the First Schedule

and for each separate set of premises used by a licensed

produce dealer for the purchase or sale of agricultural

produce:

Provided nevertheless, that one or more licences, fordifferent classes of produce, may be used on the same

premises :

Provided further that a bona f ide holder of a traveller’s

licence, when purchasing agricultural produce other than

at his licensed premises shall be entitled to purchase myof the classes of produce set out in the First Schedule by

reason of such licence.

(4) Where the licence to purchase produce is a

traveller’s licence, such licence shall be in accordance withForm B in the Second Schedule, and shall be transferable

within any parish in this Island.

13. Any Inspector, Justice, or constable may at any timerequire a dealer or any person acting as his agent to produce

for inspection the licence of such dealer.

14.-(1) Agricultural produce of the kinds specified inClasses No. 2 and No. 3 of the First Schedule and all other

articles of agricultural produce which may be specified

from time to time by order of the Minister shall, whenever

in transit on any water highway or on any public road,

other than a road in the parish of Kingston or on that

portion of the road which passes through or adjoins theproperty on which the produce was grown or produced,

the Minister may from time to time prescribe.

(2) Such forms shall on application be supplied bythe Chief Officer of Constabulary of the parish, in counter-foil books, free of charge, and the sender of the produceshall fill in the counterfoiland also the form.

(3) The certificate shall be delivered to the person

purchasing or receiving the produce and, where the personreceiving the produce is not a licensed produce dealer, theperson receiving the produce shall deliver the certificateto the licensed produce dealer purchasing or receiving theproduce.

(4) Where any such certificate shall have beendelivered to a licensed produce dealer he shall keep suchcertificate along with the book mentioned in section 11

for a period not being less than six months from the date

of such certificate; and such certificate shall be deemed toform part of such book and all the provisions of this Actrelating to such book shall apply to every such certificate.

15. Any person carrying produce of Class 3 of the First Dutyof

Schedule, along any public road or water highway, shall, caw,og

(2) Every exporter, or produce dealer shall, during

the currency of such contract, at the end of each quarter

of every year, transmit to the Deputy Keeper of the Records

a statement in writing specifying the nature and quantity

of the specially protected produce sold or delivered to the

exporter, or to any other person for sale or delivery to the

exporter under such contract, and the Deputy Keeper ofthe Records shall deal with such statement as he deals with

a certificate under this section.

(3) This section shall not apply to Banana

Contracts.

(4) Any person who contravenes any of the

provisions of this section shall be guilty of an offence.

Carriers; Licensed Vehicles

Carrier‘s 17-41) very carrier shall apply for and obtain a

carrier’s licence.

(2) Application for a carrier’s licence shall be made

in writing to the Collector of Taxes for the parish in which

the vehicle is kept for use on any public road and shall

contain-

l icence.

(a) the name and address of the applicant;

( b ) a description of the vehicle intended to be used

to convey specially protected produce with the

registered number thereof; and

(c) a declaration that the applicant is able to read

and to write and to keep the book required to be

kept by a carrier.

(3) The Collector of Taxes shall, on being satisfied

of the accuracy of the particulars contained in the

application, grant the licence.

(4) The licence shall entitle the carrier by himself,his agent or servant, to convey along any public road in

the vehicle specified in the licence specially protectedproduce, and shall be in the form in For m E in the Second Second

(5) Any person, other than a person referred toin paragraphs (a)or (6 )of the definition of carrier in section

2, who conveys in a vehicle any specially protected producealong a public road without being licensed in that behalf,or who, being licensed in that behalf, contravenes any of

the terms of the licence, sha ll be guilty of an offence.

(4) Where the applicant requests in writing the

Collector of Taxes to grant a permit enabling the applicantto use a nother vehicle from time to time during the currencyof the licence, the Collector of Taxes shall grant the permit,

(5 ) Any carrier who uses any vehicle in contraven-tion of any of the provisions of this section shall be guiltyof an offence.

1 9 . 4 1 ) Every vehicle used by virtue of a licence undersection 17 shall have affixed on the right, or off, side thereofthe words “Licensed for carriage” and next thereto thenumber of the licence of the carrier. The letters andnumber shall be at least three inches in height and shall belegibly painted in white on a dark ground.

(2) Any carrier who uses any vehicle in contraven-tion of any of the provisions of this section shall be guilty

of an offence.

2 0 . 4 1 ) The driver, operator or person in charge of alicensed vehicle shall keep on, or in, such vehicle when inuse a book wherein he shall record in the English language,at the time when he receives in such vehicle any speciallyprotected produce, the name and address of each personfrom whom he, or any one on his behalf received suchspecially protected produce, the description of such

produce, the number or quantity thereof, and in the caseof bananas, the grade thereof according to the number ofhands, and the name and address of the owner of suchproduce and the place where, and the person by whom, suchproducewas grown or produced.

(2) Every such book shall be open to inspection bya Justice, or any constable, or any person authorized underany enactment for the time being in force relating to przediallarceny, or any Inspector, and such book when not in use

on, or in, the vehicle shall be kept by th e carrier underwhose licence the vehicle is used.

(3) Every person authorized under this section to

inspect such book shall, on inspection thereof, note there-

in the date of his inspection and shall sign his name to

such noting, and any person inspecting such book who

communicates to any other person the information so

obtained, except in the like circumstances and for the

like purposes as information obtained from a producedealer’s book under section 11may be communicated under

that section, shall be guilty of an offence.

it shall be lawful for any constable, or person authorizedunder any enactment for the time being in force relating toprzdial larceny, or any Inspector, to request such personto account to him by what means such person came by such

specially protected produce, and, if any such person shallrefuse or fail to comply with such request, or shall give an

account which is false in any particular, he shall be guiltyof an offence:

Provided that the provisions of this section shall notapply to a grower of specially protected produce sellingsuch produce grown upon his own property or to a personbuying such produce for local consumption in Jamaica.

(2) For the purposes of this section a person selects

specially protected produce who receives, checks or chooses,on behalf of a licensed dealer, or for the purpose of deliveryto a licensed dealer, any such produce otherwise than onpremises licensed under t h i s Act or on a vehicle licensedthereunder.

Powers of rhe Minister

Minister’B 23. It shall be lawful for the Minister from time to time-

(U ) by order, to remove any of the articles of agricul-tural produce from the First Schedule, or fromone class of the said First Schedule to another,and also in like manner to add any other articleor articles of agricultural produce to any class inthe said Schedule, and thereupon this Act shalltake effect with regard to such articles respectively,as if they had been originally omitted or includedin the said Schedule;

(b) by order, to prescribe that any person packing any

kind of agricultural produce specified in the Thirdand Fourth Schedules (save and except bananas),

to be designated in such order, for exportation forthe purposes of trade from this Island, in anyclosed package, or bag or container, and anyperson exporting such produce for the purposesof trade, shall respectively register for the purposesof this Act, one trade mark under the provisionsof any enactment for the time being in force relatingto trade marks, and shall mark every package orbag or container of any such produce packed orexported by him, with a representation of suchtrade mark, in a plain and conspicuous manner,with the words “Registered Trade Mark” immedi-ately abov e the same; and to prohibit the exporta-tion of any such produce not so marked :

Provided, that any packer or exporter who hasalready registered under any such enactment morethan one trade mark, shall, if he so pleases by

written notice to the Registrar-General, select oneof such trade marks as the trade m ark required bythis Act :

Provided also, that if the same person packsand exports, he shall register one trade mark for

all such produce as aforesaid, packed and exported

by him :

Provided also, that nothing herein containedshall prevent any packer or exporter as aforesaid,from registering and at his pleasure using othertrade marks, in addition to one trade mark soregistered as aforesaid, the use of which by suchpacker or exporter in respect of such produce asaforesaid, is made com pulsory :

(q) to make regulations prescribing, the class of

buildings where produce is to be purchased orgraded or stored;

( r ) to make regulations as he may think necessaryrequiring shipping companies carrying produce

from the Island to notify the dates of the sailingof their ships carrying away any producespecified in Classes 1 and 2 of the FirstSchedule and in the Fourth Schedule, the namesof the ships, the ports at which such ships are tobe loaded, and the countries to which such shipsare to be consigned;

(s) to make regulations as to the standard measureor size of any box, bag, or container to be used

in the purchase of cocoa, coffee or citrus fruit orother produce;

is stored, and require any person having any agriculturalproduce mentioned in the Fourth Schedule intended forexportation to produce the same for inspection, classifica-tion, grading or marking or to perinit the same to be in-

spected, classified, graded or marked; and if such Inspector

has reason to believe that any person has such agriculturalproduce, though he states he has none, or if he has reasonto believe that he has other agricultural produce mentionedin the Fourth Schedule, than that which he has producedor exhibited for inspection, classification, grading andmarking, then such Inspector may enter any place, vesselor boat or vehicle at any time of the day or night andexamine, search and inspect, classify, grade and mark thesame or any part thereof.

(2) It shall be lawful for an Inspector to condemnany agricultural product under this Act which in hisopinion is in such a condition as to be absolutely unfit forexportation and to forbid the exportation of the same andhe may further order the seizure and destruction of thesame. Such seizure and destruction shall be carried out

under his superintendence by a constable:

Provided nevertheless that in the case of bananas he may,at his discretion, cut or order the seller or purchaser to cut

the stems of fruit unfit for exportation.(3) An Inspector may detain for reconditioning any

agricultural produce under this Act which in his opinionis in such a condition as to be unfit for exportation or localuse. Notice of such detention in accordance with Form Fin the Second Schedule shall be given as soon as may be tothe dealer or exporter in possession of the agriculturalproduce at the time of detention.

(4) Where any agricultural produce has been

detained under subsection (3) the Inspector may release itor any part of it either for exportation or for local use if

such agricultural produce has been reconditioned to his

satisfaction, or he may release it for destruction if in his

opinion such agricultural produce is absolutely unfit for

exportation or local use. When the Inspector releases any

agricultural produce under the provisions of this subsection

he shall issue a form of release in accordance with Form GSecond

30. It shall be lawful for the Minister to nominate a tt:yp.yBoard composed of such persons as he shall appoint, withpower to add to their number, or to determine the appoint-

ment of any such person on such Board, and to replace such

person by any other person as he think fit, for the purpose

of advising him in regard to matters connected with thisAct. The Minister shall not, however, be bound to take

the advice of the Board if or when given.

31. Where under this Act or any regulation made there-

under, power or authority is given to an Inspector to $?decide any matter or to make any order in regard to anyprovisions in this Act or any regulation made thereunder,

the decision or order given or made by such Inspector shall

be tinal.

32. In any proceedings taken under this Act, the burden onus

of proving that he is duly licensed or that he is the agent prohandi

of a licensed produce dealer shall lie on the person accused;

and if proof be given of the delivery to any person of any

of the articles of agricultural produce mentioned in the

Schedules hereto, such proof of delivery shall be prima facie

evidence of the sale to him thereof.

(e) having obtained a licence of Class No. 1 in theFirst Schedule causes agricultural produce to be Fint

the place where and the person by whom suchproduce was grown or produced;

(13 being a licensed produce dealer, or any person inthe employment of a dealer, whether licensed orotherwise, purchases agricultural produce from

any person whom he knows or whom, from appear-ance, the Resident Magistrate determines heought to have known to be under the age of fifteenyears;

(k ) being a licensed produce dealer, or personpurchasing agricultural produce on behalf of

such a dealer, wilfully destroys or mutilates anysuch book as is mentioned in subsection (9),orwilfully makes or concurs in making any false

entry in any such book or omits or alters orconcurs in omitting or altering any of the entriestherein as required by this Act;

(0 in selling or delivering agricultural produce toa produce dealer gives a false name and address,or fails to give correctly the particulars requiredby subsection (4) of section 11;

(m) eing a licensed produce dealer, or the agent of

such a dealer, refuses or neglects, without reason-able excuse to the satisfaction of the ResidentMagistrate, to produce his licence for inspectionwhen required to do so under this Act;

(n ) being the sender of agricultural produce specifiedin Class No. 2 or No. 3 of the First Schedule,which is in transit, fails to apply for and fill inthe form of certificate prescribed in Form C in theSecond Schedule, or such other form as may be

prescribed by the Minister for accompanying suchproduce in transit, or to 6ll in the counterfoils

(0) arrying produce of Class No. 2 or No. 3 of theFirst Schedule along any public road or water ~ i ~ ~

highway, on being required by any Inspector or

Justice for the parish in which the demand is made,

or by any constable, forthwith to produce the

certificate required by section 14, refuses to

produce such certificate or fails to produce the

same without satisfactory excuse;

( p ) being the proprietor, manager, overseer, or personin charge of any property, sends or knowingly

permits any produce of Class No. 2 or No. 3 ofthe First Schedule to be

intransit;

or( q ) carries such produce on any public road or water

highway (except in so far as the same adjoins

or passes through the property froin which it is

sent) without a certificate duly filled up in accord-

ancewith FormC n the Second Schedule;

( r ) being a dealer or agent fails or refuses to keep

with accuracy any book or record prescribed under

this Act;

(3) purchases agricultural produce without a licence

and fails to satisfy the Resident Magistrate that

he purchased with no intention to deal in such

produce, as defined by this Act;

( t ) commits a breach of or fails to comply with any

order or regulation made under the authority ofthis Act;

(U) refuses to an Inspector admission to any premises,place, vessel, boat or vehicle, as provided under

this Act, or obstructs or impedes any such

Inspector in the execution of his duty, or assistsin such obstruction or impeding;

(v) negligently or fraudulently gives a false certificateor recommendation under this Act;

(w) whenever any order has been made by the Ministerunder paragraph ( b ) of section 23, and such pro-hibition ordered, packs for exportation or exportsand package of produce not marked as providedin such order;

( x ) disposes of any agricultural produce which hasbeen detained under subsection (3) of section 29

otherwise than in accordance with the form of

release issued by the Inspector under subsection(4) f section 29,

shall be guilty of a n offence against this Act.

Sunirnary 37. All offences against this Act, save as otherwisetrial. provided, shall be tried in a summary manner before the

Resident Magistrate for the parish in which the same shallbe committed, and unless otherwise provided, shall subjectthe offender to a h e not exceeding one thousand dollars,

and in default of payment, to imprisonment, with or withouthard labour, for a period not exceeding three months wherethe penalty exceeds twenty dollars, and not exceeding onemonth i n all other cases, an d for the second and every otheroffence to imprisoninent with or without hard labour for aperiod not exceeding six months :

Provided, however, that in the case of a breach of anyprovision or offence under this Act committed by an officer,employee, servant or agent of a corporation, my fine

imposed under this section shall in the first instance berecovered by seizure and sale of the goods and chattels of

the corporation an d for want of sufficient goo ds and chattels
