AGREEMENT FOR LEASE UPON EXPIRATION OF EXISTING LEASE WITH
ANOTHER, CONDITIONED UPON NEW LESSEE'S REPAIR OF PREMISES
This agreement made this ___th day of_____________, 20____, between
_______________________, of legal age, Filipino, single (or, married to__________________________________________________), residing at______________________________________ with post-office address at_____________________________________, hereinafter called the Lessor, and_________________________________, likewise of legal age, Filipino, single (or marriedto__________________________), a resident of______________________with postaladdress at__________________________hereinafter called the Lessee, witnesseth:
Whereas, the Lessor is the owner of the premises hereinafter described, subject toan existing contract of lease dated the ___th day of____________, 20____, and made
between the Lessor and____________________________whereby said premises wereleased and demised for a term of_______________(___) years, which will expire on the___th day of_____________, 20_____, and whereas, the herein Lessee is desirous oftaking a lease of said premises from the expiration of said term of the existing lease,which Lessor is willing to grant upon the condition of the Lessee making such alterationsand repairs in the premises as are hereinafter specified.
Now, it is hereby agreed as follows:
1. The Lessor shall grant and the Lessee shall accept a lease of (urban or ruraltenement or chattel) situated at___________________________________________and
described as follows: (description), for the term of_________________from the_____thday of_______________, 20____, date when the existing lease shall terminate, at the_______________ rent of __________________________ Pesos (Php________),payable by equal _________________ payments within the first days of each

2. The Lessee shall within_______days after the said____th day of__________,20___, make the alterations and repairs specified in the schedule hereto annexed andsigned by herein parties. The Lessee shall effect such repairs and alterations to thesatisfaction of____________________architect of the Lessor, and pay his fees in thepremises, not exceeding_____________________Pesos (Php_________). The Lessseeshall be entitled to enter upon the premises on the day following the expiration of the saidexisting term therein but the granting of the lease herein provided for is conditional uponthe due making of said alterations and repairs, time being of the essence of the contract;and in the event that the same shall not be made within the period hereinbefore limited,the Lessor shall be entitled to re-enter upon the premises, and thereupon all the interest ofthe Lessee therein under this agreement shall terminate, and the Lessor may forthwithrecover possession of the premises by legal process.

3. It is mutually agreed and understood by and between the parties herein that theLessor does not guarantee that the present tenant of the premises subject of thisagreement shall peacebly vacate said premises on said ____th day of___________,20_____. Failure for this reason of the Lessor to deliver unto said Lessee on said date the
aforementioned premises shall not render said Lessor liable for any damage, nor for suchreason shall this agreement be avoid or voidable, but in this event the Lessee shall not beliable for rent until such time as the Lessor can deliver possession and the term of this rentshall be corresponding extended.
4. It is further agreed that the Lessee shall have said premises free of any rent untilthe present tenant shall vacate said premises, at which time the term of the leasementioned and provided in this agreement shall commence.
5. It is also agreed that the Lessee shall assume all responsibility of eviction, ofnecessary, of the present tenant of said premises, but the Lessor to serve as witness
should his testimony be required.
6. The lease contract shall be in the form hereto attached and signed by theparties.
7. The Lessor shall cause said lease contract to be prepared in___________________________, and it shall be so executed by the Lessor and theLessee respectively when so required by either party after the completion of thealterations and repairs hereinbefore specified. The expenses for the execution of saidinstrument shall be defrayed by the_____________________.
