VILLAGE MANAGER REPORT: Manager Cooper provided a verbal report on COVID19 measures in place for staff and related operational items. Regular Council Meeting May 4, 2020 VILLAGE SEWER STUDY – Responses received to QBS proposal; staff review process begins. NEW BUSINESS: MOTION by WEST, second by BRONKEMA, to consent to the following President’s Appointments: Parks and Recreation Commission - Michael Conrad reappointed to fill a term expiring April 2023. Parks and Recreation Commission - Paula Moyer appointed to fill a term expiring April 2023. All those present voting yes. MOTION CARRIED.

MOTION by TOSCANO, second by MULLALY, to approve RESOLUTION 20-11: Downtown Development Authority Budget Amendment. DDA Chair Karen Simpson provided a presentation on the budget amendment. After discussion, Roll Call Vote: Ayes – Glowicki, West, Bronkema, Janisse, Mullaly, Perlman, Toscano; Nays – None. MOTION CARRIED. Planning and Zoning Administrator Kyle Storey provided a presentation on the RRC program and status. MOTION by TOSCANO, second by MULLALY, to approve RESOLUTION 20-10: Proceed with RRC Certification for Village. Roll Call Vote: Ayes – West, Bronkema, Janisse, Mullaly, Perlman, Toscano, Glowicki; Nays – None. MOTION CARRIED. REOPENING OF THE VILLAGE – Discussion included, but was not limited to, the following suggestions: --Government Center - Consider open by appointment only. Antrim County will be open. --Department of Public Works – Restrooms, porta-johns, “clean team.” Post signs about how often cleaned, add hand sanitizers outside. --Parks – Follow CDC guidelines, playgrounds, benches, etc. --Communications should be strong --DPW and Police Departments should have written protocols. --West to take what is already created to Parks & Rec Commission to Safe Reopening Committee to Council. --Signage – consistency or some differences between spaces? HARBOR COMMISSION MINUTES:

March 9th, 2020

PRESENT: Hansen, Bronkema, Wiltse, Blesma, Orschel, Berck

ABSENT: Fisher

CALL TO ORDER: Meeting called to order at 7:05 P.M.

APPROVAL OF MINUTES:

a. Regular Harbor Commission meeting held February 10th, 2020: Commissioner Berck motioned and Commissioner Blesma seconded to approve minutes from the regular meeting February 10th, 2020. All members present voting yes. Motion carried.

REPORTS:

a. Harbormaster Singleton presented the monthly report to the Commission. b. Council: Trustee Bronkema provided a council report to the Harbor Commission. c. Treasurer: Harbormaster Singleton provided up to date FY2020-2021 revenue and expenditure report.

CITIZENS COMMENT: 0 citizen comment OLD BUSINESS:

a. Harbormaster Singleton updated Commission with information on the Harbor’s break wall progress. A date was set later in the week for onsite inspection with GEI engineers.

b. Discussion regarding the length of stay for the courtesy floating dock on Elk River, Upper Harbor. Appropriate signage will be fabricated and displayed to the boating public. Also, a suggestion was made to Harbormaster to inquire if the Elk Rapids Rotary Club would possibly be interested in partnering with the Harbor for the procurement of the proposed extension to the floating dock.

c. 45th Parallel Marine will assist with the docks that cannot be raised due to the placement of wooden wedges and dowels between the dock pile and cover tube. Barge will be in Elk Rapids by the end of the week of the 16th.

d. Continued discussion of B3 ferry between the Village of Suttons Bay and the Village of Elk Rapids.

NEW BUSINESS:

a. Discussion regarding the commercial fishing vessel seasonal contract cost in the Harbor. Motion by Commissioner Berck to charge the owner of the vessel twice the seasonal rate as a 30’ recreational vessel would pay plus the 2% increase from the 2019 season. Motion second by Commissioner Wiltse. All Commissioners present voting yes; motion carried.

b. Presentation of the current progress of the green infrastructure bioswale made by Program Director, Sarah U’Ren, Watershed Center Grand Traverse Bay. Commissioners requested the Harbormaster revisit and consider a different location of upper harbor bioswale (#2) to a different location and reduce the size of the structure to smaller than proposed 2,200 sq. feet. Furthermore, the commission recommended that the Harbormaster research partnerships with clubs and/or organizations to maintain the bioswale infrastructure in lieu of Harbor personnel.

c. MarinaPro System will have file update with contractor in April. d. Motor Vessel Steelhead from the Michigan DNR will moor up and participate at the Harbor fishing seminar July 1st.

VILLAGE MANAGER’S REPORT May 18, 2020

Over the past week, I have received a couple of questions about how we are doing financially. The primary concern is on revenues we received from the State. Below is a brief comparison between last Fiscal Year and our current Fiscal Year as of April 30. The comparison is on the General Fund, and Act 51 revenues. Projections are saying that Sales Tax Revenues are expected to decline in May, June and July. The same is anticipated for Act 51 funds. As a result, we will do two things:

1. We will be watching our revenues very closely throughout the year. This will not be limited to revenues from the State, but revenues in all funds.

2. We have already started to watch our expenditures, holding off on any non-critical purchases.

After the Village Council meeting, and after talking to a couple of you, I decided that I needed to pull together some form of a summary, by topic/location, in order to come up with a decision(s) as to what we should do, or at least plan to do. I figure this was needed as I do not think we reached any decisions Monday night, we simply talked about concerns and raised some potential issues. This list is taken from what I originally sent to you for the meeting, it is simply reorganized by topic/location as opposed to being organized by Council Member. I did not include duplicate suggestions. After consolidating the comments by topic/location, I will attempt to state my “understanding” as to what we should be doing. It will be up to Council to let me know if I am right or wrong. My comments are in blue. GOVERNMENT CENTER:

• Government Center open only at certain times --maybe an hour in the morning and an hour in the afternoon wearing masks as required.

• There should be an understanding with the township employees on their requirements to keep all of us safe even if they don't care about themselves.

• Delay council meetings at the government center until the governor gives a date for reopening.

• I do have a concern about the cost of additional sanitizing for the meeting room and the other offices if the government center is opened too soon. NOTE: Currently the County is fogging the Government Center every Thursday

afternoon. I understand that this will continue until the emergency is over. This is being done at no cost to the Village.

• Masks at Council Meetings, social distancing for Council and the Public, use of bathrooms and sanitizing.

1. The Government Center will be open daily, but with limited hours. (The

Township is considering reopening and their hours are 9:00 AM to 3:00 PM) 2. Plexi-shields will be place on the counters to help protect our employees. 3. Any employee serving the public directly will be required to wear mask and

gloves. 4. Hand sanitizer will be available at the front counter. 5. We will mark the floor with proper spacing for social distancing. 6. Signs will be place on the front windows with hours, social distancing

reminders and hand sanitizers. 7. Bathrooms will be cleaned as normally done but signs will be placed in the

bathrooms telling people of the cleaning times and reminding them to use at their own risk.

PARKS AND BEACHES: • Veterans park/playground?? Some picnic tables from harbor to be spaced at

park • Beach open Sign reminding social distancing • Benches: stay or remove? I would suggest remove. • Borrow bins at both beaches should be removed immediately. • Do not put out picnic tables until safe. • When picnic tables are safe to use do not put out all of them so it is easier to

sanitize them depending DPW staffs thought. • Keep signs up on the play equipment warning that it is not sanitized. • Keep social distancing signs. • Ask people to stay 6 feet apart. • Ask people to sit 6 feet apart on beach. • If parking lot is full people should not go to beaches/parks. Side street/over

parking areas should be marked to not park to limit traffic. • If people are not obeying social distancing rules, close the park to visitors making

the park resident only using compactor pass to use the beach • Use porta johns in place of public bathrooms until we can safely sanitize public

restrooms regularly. • Let public know that if people are not following the recommendations we will

have to tighten the rules for safety. • Limiting numbers of people using facilities. • Open in stages so it can be monitored. • Secure tennis court gates open to limit people having to open the gates. • Remove items from “borrow bins”. • With the shrinking beaches and health concerns the importance in the parks and

beaches should be making it safe for locals not encouraging tourism. Reconsider allowing Bayfront this summer season at the beach to minimize crowding and sanitation concerns on the beach.

• Do not approve large events for parks (example: ballin by the bay, Harbor Days activities) until large gatherings are deemed safe.

1. Signs will be placed in multiple locations reminding people of social

distancing and informing them that the benches, picnic tables and playground equipment have NOT been sanitized.\

2. Picnic tables and benches will be put out but spaced for social distancing. 3. Signs warning that if social distancing is not followed that it may lead to

closing the park or the beach. 4. Bayfront will not be allowed to operate this year. 5. Hand sanitizer will be placed in the bathrooms. We will work on a way to

secure the sanitizer to assure we minimize it being taken.

PUBLIC RESTROOMS: • Bathrooms: (not including marina) are they safer than porta potty? Some

medical friends don’t see much difference. • Do we have contract for cleaning bathrooms? Not harbor staff

1. Bathrooms will be cleaned/sanitized once daily. Signs will be posted

noting when the bathrooms are cleaned and to ask for people to help keep them clean.

2. We will need to pursue hiring a firm to do the cleaning. 3. Bathrooms will remain closed until at least May 18. Very possibly until

June 1. HARBOR:

• Harbor bathrooms/showers changes in how many can be in at the same time • Grills at harbor removed • Fewer picnic tables at harbor (for distancing). • Ice and pop machine stay or close. • All harbor staff should wear masks & gloves (when dealing with public and each

other). • Place hand sanitizers at boat launches.

1. Bathrooms will be cleaned/sanitized once daily. Signs will be posted

noting when the bathrooms are cleaned and to ask for people to help keep them clean.

2. PPE have already been purchased and staff will be trained and instructed as to how and when equipment will be used.

3. Picnic tables will be placed for social distancing 4. Signage will be similar to the parks.

MISCELLANEOUS:

• Should have hands free hand sanitizer stations at various locations • Can water fountains only dispense for refilling personal water bottles? • Should we think about closing River St (Dexter to Cedar) to vehicular traffic to

allow for restaurants more dining space and social distancing instead of all on sidewalks.

• I am also assuming that masks and sanitizer will be supplied by the Village. (I hope we have already ordered these items).

• Should events such as Harbor Days be approved to go forward? • Our administrative, police, DPW and Harbor staff will qualify for the last tier (4)

and be able to be tested. Ensuring their safety is of paramount importance. We don’t have the necessary PPE equipment nor the required training for them cleaning bathrooms nor harbor bath facilities.

• Returning residents and surrounding cottage owners should observe the quarantine guidelines and have others do errands for them.

• Until we hear the May 15th Governor’s message, I suggest we have the government building, restrooms, marina facilities and playgrounds closed to the public.

1. We will look into hand sanitizers and possible ways to secure them. 2. We will look into keeping fountains off unless we can find a way to limit

usage to bottle filling only. 3. River Street will be closed from Cedar to Dexter. We will need to work with

the DDA to define restaurant spaces and to assure that we have a clear walking path along with Fire Department access.

DPW:

• DPW masks same as above not necessary when cutting grass, etc. • I am assuming that the interior of all vehicles is thoroughly disinfected after each

use. • If we have overflowing trash/pizza box issues again this year we will need to

address due to safety. • Disable and put signage on all drinking fountains.

1. PPE has been acquired. Personnel will be instructed as to when the

equipment must be used. 2. Vehicles are already disinfected each day. 3. Trash should not be an issue, not any more than normal. 4. Same as Misc #2.

A question was asked if we were going to monitor employees with a thermometer. We have ordered the thermometers, but they are not expected until mid-June. In the meantime, we are following the instructions from County Health.

1. We are keeping a record for each day an employee is at work. 2. We have suggested to the employees that they self monitor by taking their

temperature each morning before coming to work. 3. We will ask each employee how they are feeling. 4. If any employee is showing any signs of symptoms they will be sent home

until such time as their symptoms clear, or they will self-quarantine if they develop worsening symptoms.

Based on various comments, we have plans in place for the Government Center, the public washrooms, Harbor bathrooms and showers, park benches, picnic tables and playground equipment. I believe that these have all been covered previously.

Antrim County EOC Leslie Meyers, Antrim County Emergency Services Coordinator, stood up (activated) the Emergency Operations Center (EOC). And since first responders (who would normally fill these roles) would be busy with the upcoming emergency, quality staff from within the County were identified and volunteered to fill critical EOC roles. This team then set about building the foundation of relationships, communication, data tracking and supplies that first responders and residents would so desperately need in the days to come.

What is COVID-19 Coronavirus (COVID-19) is an illness caused by a virus that can spread from person to person.

The virus that causes COVID-19 is a new (novel) coronavirus that has spread throughout the world.

COVID-19 symptoms can range from mild (or no symptoms) to severe illness.

COVID-19 is primarily spread from person to person from cough, sneeze or talking droplets. You can become infected by coming into close contact (about 6 feet or two arm lengths) with a person who has COVID-19.

You may also be able to get it by touching a surface or object that has the virus on it, and then by touching your mouth, nose, or eyes.

Objectives of the Antrim County EOC:

Support public information and crisis communication efforts.

What is an EOC? An emergency operations center (EOC) is a physical or virtual location designed to support emergency response, busi-ness continuity and crisis communications activities. Staff meets at the EOC to manage preparations for an impending event or manage the response to an ongoing incident. By gathering the decision makers together and supplying them with the most current information, better decisions can be made.

The Logistics Section Team has been hard at work acquiring PPE throughout Antrim and distributing to our first responders and essential employees. Donations ranging from homemade face masks to isolation gowns have been given to the EOC from Antrim County residents and small businesses. Additional PPE has ordered in bulk. Antrim County Businesses, Health Centers, and first responder departments have requested supplies from the EOC and we have supplied these entities to the best of our abilities given the national shortage of PPE. The EOC is also responsible for supplying the Township Ambulance Authority and Meadow Brook Care Facility. The Antrim County government and citizens have stepped up to face this health crisis and help each other during these difficult times. The COVID-19 pandemic has put all of us on alert, many of us in crisis mode and others at a standstill. At this time, all levels of government are in a response mode. Governor Whitmer is working with governors from across the Great Lakes Region to determine the best way to reopen the State. Here at the County level, the Antrim County Emergency Operations Center is also beginning to develop a recovery plan. A County-wide recovery plan will consist of at least three parts: 1. Standing down the County EOC – bringing the current EOC down from a full-time staff of nine people down to a single person, our Emergency Management Coordinator. 2. Reopening the County and local government buildings – determining what the “new normal” would look like and find ways to keep government employees and the public healthy; 3. Economic recovery throughout Antrim County – provide resources and creating guidelines that would help Antrim County businesses recover as they navigate the “new normal” that has resulted from this global pandemic. The Emergency Management Coordinator will be meeting with the Antrim County Economic Development Corporation and representatives from local area chambers of commerce to develop the economic portion of the recovery plan. Additionally, EOC staff is working to put together a meeting with representatives from local units of government to develop a plan to reopen local government offices in a way that would keep staff and the public safe and healthy.

The New “Normal”

With all that has happened the last couple of months, everyone feels differently. Some more anxious than others. We are all wondering what the new “normal” will be and if we ever will feel “normal” again. With all of these unanswered questions and unknowns, we need to remember to take care of our mental health as well as our physical health.

Good morning Caroline. I was hoping to have a presentation ready for the Village Council for review at Monday's meeting. I will not be able to complete that at this time. I would like to convey that after careful consideration, Bayfront will not pursue use of the space at Memorial Park Beach this year due to overall COVID-19 concerns and the need to focus on the core of our business. We will continue to rent out of our building and provide pick up and delivery of Kayaks, Stand Up Paddle Boards and River Tubes and have put a comprehensive plan in place to ensure clean and sanitized equipment. We would like to pick up where we left off and provide another presentation in the spring for the 2021 season. We truly appreciate the support we have received from both The Village Council and Parks and Recreation. We look forward to working together to further develop this and other ways to promote positive private/public relationships. This year is business and life unusual for all of us. We feel that our focus needs to be both on our business and working with others in the Elk Rapids community to get through 2020 in a way that allows both recovery and growth. The comment concerned the Short Term Rental ordinance currently being drafted. The citizen referenced the fact that in 2017, Ms. Ragland offered a duplex for sale, which sold through a local realtor in February 2018. The duplex was sold with a deed restriction providing that for a five year period, the duplex could not be leased for less than one year. This fact was previously noted by the village staff and was reviewed by the Village Attorney, Scott Howard. These facts create no conflict of interest for Ms. Ragland. MESSAGE:

Please accept this memorandum as our annual update/report on the work activities of the Elk Rapids Housing Commission and specifically the operations of our only property, Noble Pines Apartments.

The partnership with the Traverse City Housing Commission in now well within its second year and it seems to be going well. TCHC provides property management and maintenance to ERHC under two separate contracts. Both of these contracts are set to expire at the end of this fiscal year (September 30, 2020). ERHC and TCHC are committed to reviewing these contracts during the upcoming summer months.

Move-Ins

In the last 12 months, we had for (4) units open to the next person(s) on the Wait List. General occupancy at Noble Pines is remarkably steady and having four units open up is not typical or atypical – this would be considered slightly above average. In the twelve months prior to this period, we had 3 units open.

Wait List

Currently, there are eleven (11) people on the Noble Pines Wait List. The first name on the list, who will be contacted to move in at Noble Pines when the next unit opens, applied to live at Noble Pines in April of 2019. This is in line with our typical “wait” on this list which is usually 1.5 to 2.0 years. All 11 people on this list are using addresses that would be considered “in the area” which means the Village of Elk Rapids or nearby communities.

Annual Audit

ERHC completed its Annual Audit, conducted by an outside independent auditor at the conclusion of the last fiscal year. There were no findings and this document was submitted to the Village once it was approved and accepted by the Housing Commission.

Commission

We have two (2) new commissioners appointed by the Village Council within the last year and three (3) new commissioner in the last two years. This is an above average turnover rate. Each term is staggered so that no more than one commissioner’s term is expiring during any given year – and you would normally expect a re-appointment or two as well. We have held two (2) New Commissioner Orientation during the last 12 months and three (3) within the last 18 months. That said, we expect a period of stability now and several Commissioners participated in the Orientation sessions so these sessions also served as a reminder to every one of the duties and responsibilities of Housing Commissioners.

Future

The United States Department of Housing and Urban Development (HUD) has been getting more and more serious about “repositioning” its public housing assets on the Housing Choice Voucher funding platform. This will eventually happen at Noble Pines but this not likely to happen within the next 12 months. I should note that this will not have any impact on the residents at Noble Pines Apartments – this would largely be a “back room” transaction and would only effect how the operation is funded from HUD.

We are also in the very beginning stages of conversations regarding the next “40 years” for Noble Pines. This could include, not only the rehabilitation of the asset overall but some additional units being constructed as well. This conversation has been delayed due to the COVID-19 lockdown but we do anticipate this conversation going forward later this year.

Annual Review of 2019 Beautification Commission

Commission Members: Sonja Perry, Susan Green, Carol Haley, Janine Micunek, Sandy Ehlers, Lori Caruso Gardens: Boardwalk Garden was cleared of old and overgrown plant material and is now an open inviting area where picnic tables and a grassy area will be installed. This completion will take place this summer . Triangle garden (back of Yuchasz Walk-thru) was cleared of a messy shrub and hydrangea were planted and more annuals will be added this summer. Median garden on the south end had the tall evergreens removed for better visibility. Chlorination building was planted with perennials on the street side. Harbor Drive will be the focus of 2020 to remove old plantings and broken fence. New and easy care plantings will be added. The Garden Club continues to work closely with the commission to maintain and beautify their ten gardens. The Zupin-Anderson Garden had a complete redo and is now a beautiful butterfly and bee garden. Public Areas: Annual plantings along the tennis court fence line will be completed again using volunteer labor. Weeding, cleaning and mulching the bump outs, Traverse St. Parking, Kid's Pond areas, Terrace Garden and Boardwalk Garden was accomplished with contracted labor. Baskets of flowers were added to the 31 Bridge and this was accomplished with volunteer labor. Baskets will be prepared again this year. Trees: A grant from Consumers Energy was awarded to the Village for Trees and this commission worked with the DPW and DDA to fulfill the grant requirements. These new trees (20+) were planted around the village. This commission has requested additional funds to plant ten more trees this year. The Tree Doctor continues to do spraying and tree care as needed. Brochures: “Amazing Gardens” brochures are printed each year and distributed to the Garden Club, Chamber, Village Office, Local art galleries, museum, antique mall and Honcho Rest Campground. 1. Introduction

The Village of Elk Rapids’ Planning Commission is a body of citizen volunteers that act as an advisory group to Village Staff on issues and policies related to planning, land use regulation, and community development. Planning Commissioners act as citizen planners and work to develop plans and implementation policies that affect how the community manages changes in growth and development. The Village of Elk Rapids has a seven-member planning commission that works to advise the Planning and Zoning Administrator on municipal planning matters. The Village of Elk Rapids’ Planning Commission meets every month on the Fourth Tuesday at 7:00 p.m. to discuss proposed development, planning initiatives, new ordinances, etc. The Planning Commission is comprised of; Chair, Royce Ragland; Vice Chair, Wallace Hibbard; Village Council liaison, Barb Mullaly, Jim Okonoski, Lauren Dake, Richard Smith & Matt Conrad. Staff support to Planning Commission is Planning and Zoning Administrator, Kyle Storey.

The Zoning Board of Appeals is a joint board comprising Village and Township commissioners which reviews land use issues that pertain to the Zoning Ordinance, including proposed variations from the zoning code, special uses that require review to determine compatibility with adjacent properties, and appeals of decisions made by the Zoning Administrator. The board has five members that are appointed. Members include Mike Szymanski, Chair; Myrna Howse, Vice chair; Lauren Dake, Planning Commission Representative; Matt Webb; and Thomas Sommerfeldt. Staff services are provided by the Village Planning and Zoning Administrator, Kyle Storey. Meetings are held on the third Thursday of every month, at Elk Rapids Governmental Center, 315 Bridge St., in Village Council chambers starting at 7:00 p.m.

With sincere gratitude, the Village of Elk Rapids’ staff would like to thank all the citizen volunteers for participating in local governmental services. With their dedication and commitment, the Village of Elk Rapids will continue to grow in the shape and ideals set forth in the Master Plan and Strategic Plan. We strive to have open lines of communication with Commission members to alert of any forthcoming trainings available to help progress their knowledge base. 2. Purpose

The Michigan Planning Enabling Act calls for an annual Commission Report stating

the following, “A planning commission shall make an annual written report to the legislative body concerning its operations and the status of planning activities, including recommendations regarding actions by the legislative body related to planning and development.” A report of this nature increases information-sharing between staff, boards, commissions and the Village of Elk Rapids governing body. Further, it allows for anticipation of upcoming issues and priorities, in order to prepare and budget accordingly, if necessary.

3. Meetings

The Village of Elk Rapids Planning Commission met 8 times from May 2019 – April 2020. This meets the requirements of the Michigan Planning Enabling Act of four annual meetings. Meeting dates include: May 28th, June 28th, July 23rd, August 27th, October 22nd, November 26th, January 28th, and February 25th. Regularly scheduled meetings on September 24th as well as December 24th were cancelled due to lack of agenda items. Regularly scheduled meetings on March 24th as well as April 28th were cancelled due to the Coronavirus pandemic. The next Planning Commission meeting, and necessary meetings moving forward, will be held via an Online based platform adhering to Executive Orders passed by the State of Michigan Governor’s office.

4. Plan Review

In 2018, the Village of Elk Rapids and Elk Rapids Township approved a collaborative

master plan. While the two municipalities are politically distinct, the Township and Village frequently work in partnership on public services and also share an office space. The Planning Commissions and Governing bodies of each jurisdiction determined that it would in the best interest of the greater community to work together, and the Collaborative Master Plan is the culmination of that effort. The plan represents the first time the two communities have collaborated to formally to develop guidelines for future development, while protecting the water resources, other natural resources and the small-town character of the community. This collaborative plan presents extensive information for both the Village and Township, a description and mapping of natural resources, and inventory of existing community facilities. The background information is analyzed to identify important characteristics, changes and trends occurring in Elk Rapids. Community-developed goals and policies are presented to guide future development based on the background studies, key land use trends and community issues.

Elk River enters Grand Traverse Bay in Northwest Lower Michigan. Established in the nineteenth century, it has a historic character that makes it an attractive place to live, work and visit. As we look forward to the future, the Village of Elk Rapids is working to ensure its decision make the best use of resources while reflecting on the community’s priorities. The Strategic Plan goals help to set priorities, focus energy and resources, strengthen operations, ensure that employees and other stakeholders are working toward common goals, and assess and adjust activities in response to a changing environment.

Overall, each Strategic Plan goal has some sort of objective actively being worked on

and determined to be ‘in progress.’ The transition of staff members has played a significant role in the timelines set in the Strategic Planning document. Timelines including objectified start dates shall be adjusted accordingly as new staff members become better acquainted with current projects and forecasted future initiatives. These documented plans will lead the Village to completing visionary goals by outlining specific tasks and resources needed as well as deliverable benchmarks and their approximate completion dates.

5. Zoning Ordinance Amendments

In June 2019, the Planning Commission passed Proposed Ordinance #498: Amendments to Section 529 – Signage Changes in definitions, provisions to general use and location requirements, and to comply with federal regulations. aesthetic values. Motion passed to recommend approval: 6-yes, 0-no. 1-abstained.

Currently, the Village of Elk Rapids’ staff and Planning Commission are actively working on Proposed Ordinance #502 pertaining to regulating Short-Term Rental Units throughout the Village. The following paragraphs outline the purpose statement of the proposed ordinance which is currently in draft format:

The Village Council finds the rentals of dwelling units in the Village of Elk Rapids provides value to our local economy but also brings with it externalities affecting the year-round quality of neighborhoods, housing supply, school enrollment, and health and safety. The Village of Elk Rapids has enacted this ordinance to strike a regulatory balance between the interest of community residents, business owners, visitors, and property owners.

The Village has different expectations for noise, occupant loads, and transient activity in its residential neighborhoods than it does in commercial, and even mixed-use zones where hotels may be permitted. The renting of a home on a short-term basis is substantially more like a business than traditional residential use.

6. Development Reviews & Variances

The number of Permits applied for totals 58. Of the 58 permits applied for, 5 requests were for re-zoning or variances, with 2 being eventually withdrawn. 1 permit request was denied, while 33 out of 58 requests were approved, totaling around 59% of total applications. The remaining 22 approved permits are currently in progress towards completion.

7. Actions by Legislative Body

June - Proposed Ordinance #498: Amendments to Section 529 – Signage Changes in definitions, provisions to general use and location requirements, and to comply with federal regulations. Motion passed to recommend approval: 6-yes, 0-no. 1-abstained.

August - Rezoning Request #2019-034 Applicant: Mike and Maryanne Smith Site Location: Southwest corner of Ames St. and Henry St. (Parcel #05-43-100-032-00) Request: To rezone the parcel from B-1, Local Business District to RM-H, Multi-Family, Residential High Density. The proposed rezoning is to accommodate for approximately 11 townhome units. Application withdrawn.

October - Tourist Oriented Directional Signs (TODS) Request: To keep the TODS and its existing business signs attached to it and add one (1) additional business to that existing sign. Motion passed to approve 5-0.

February – 106 Oak Street B&B – Requests for change in Zoning Ordinance. Application Ongoing.

8. Zoning Map Analyzing the Development Reviews & Variances, in Subsection 7, yields data culminating in 5 total requests over the time span May 2019- Apr. 2020 for Rezoning or Variance related issues. This equates to less than 10% of Zoning related requests over a year span. Quantifying that data leads to confirming that limited amounts of variance and rezoning requests are submitted to the Village of Elk Rapids Planning and Zoning Administrator annually. The specific variance requests, totaling 3 in nature, were due to site specific reasoning and not cause to consider changing the current Zoning Map, at right. The 2 total site-specific re-zoning requests pertained to parcels adjacent to the proposed re-zone request in order to maximize more ‘uses by-right’ than in the previously existing Zoning District. These two rezoning requests were eventually withdrawn. This is not cause of concern as these requests were very limited in nature.

9. Trainings

All commission members must take the MSU Citizen Planner Training. 2020 training webinars, provided by Michigan State University’s Master Citizen Planner Series, will be made available for all members. The specific training topics can be accessed via a live, online session with educators or thru recordings of webinar. The following subject matter is included: Planning and Zoning to Cultivate a Flourishing Food System; Planned Unit Development (PUD): A Unique Land Use Tool; High Water in Michigan The Role of Shoreline Planning and Regulation; Building Trust and Making Better Decisions; The Local Land Division Ordinance: What is it? Should your local unit have one?; and Land Use Planning for All Generations. All Michigan Association of Planning trainings will be offered to Commissioners including 2020 Planning Michigan Conference and Michigan Safe Routes to School trainings.

10. Joint meetings The Village staff plans to hold a joint Planning Commission/Village Council work session pertaining to Short-Term Rental Ordinance specifics on a date to be scheduled in the future. Further, a joint Redevelopment Ready Communities Committee has been forecasted including members of the Downtown Development Authority, Village staff, and Chamber of Commerce to name a few.

11. Other Notable Items:

The Village of Elk Rapids welcomed a new staff member in the capacity of Planning and Zoning Administrator. Kyle Storey joined the Village in Mid-March 2020 after serving in the same role in Manistee County. The main projects in the Planning and Zoning realm, which are currently being worked on, include: Short-Term Rental Ordinance, Redevelopment Ready Communities Certification, a Capital Improvement Plan and Ames Street Corridor amongst regular Planning and Zoning related issues including permit review, citizen engagement and enforcement.

Annual Report Parks and Recreation Commission

Commission Members: Charlie Pryde (Chair), James Dake (VC), Michael Conrad (Sec), Beth Guntzviller, Gordon Stewart, Kwin Morris, Melissa West (Council liaison) Tobacco Free Beach – Commission recommended tobacco-free beaches. No-smoking ordinance passed by Council and appropriate signage installed in parks. Antrim County Day Park – The Commission asked for the county to remove the fence. A compromise was struck whereby the gates were left unlocked all season. There were no problems with gates being open and it does provide easier access for the police to patrol. Public Private Partnerships – The Commission was approached about a couple different public-private partnerships to provide recommendation to Council, which was new ground. Bayfront Beach and Bike was recommended by the commission and approved by Council for one-year to have a kiosk in the park renting tubes, paddle boards, kayaks. A percentage of proceeds was donated to the Commission. The Commission recommended renewed contract. Due to COVID19, Bayfront has opted to not have a kiosk this summer. Ice Rink – The weather did not cooperate. DPW had the rink ready to go in the event we had enough consecutive days of freezing temps. On the other hand, snow removal was not a problem. We look forward to next year! Walk with a Doc – Under leadership/direction of Christine Petersen, this program developed regular supporters and has continued to grow. Big thanks to Christine and all of the health professionals who continue to participate and be supportive. School Partnership – Charlie Pryde and Caroline Kennedy working with Bryan McKenna from Lakeland school on after-school programming partnerships. Ice skating (weather dependent), and Norte mountain bike program at Maplehurst (COVID19) were both planned. Hopefully these plans can be implemented next year. Community Service Projects – Kwin Morris guided students through some community service projects. Last year’s murals were prepared to be hung at the ice rink. This year Cooper Anderson held a family movie night at Lakeland with 55 participants, which raised $221.00 for new skates. Skate purchase due fall/winter 2020. Jada built pond hockey nets. These are complete and ready to go for winter 2020. Paddle Antrim – First state-designated water trail in northern Michigan. Big honor as designation includes water quality component. Completed their signage design. Commission recommended signage approval to Council, which was approved. Commission also contributed to signage program. Paddle Antrim hired Gourdie Fraser to create plan for Rotary Park including UA kayak launch – in progress.

Norte – Slow Rolls continue to grow and be popular, spanning many age groups. Charlie Pryde and Clare took over to lead rides. Much appreciation to Guntzvillers and other regular volunteers. Lauren Dake has led Estrellas programs and bike safety through schools. Now hired by Norte to be the Elk Rapids coordinator. Currently working on can drive for Norte scholarship funding and bicycle “library.” Members: Beth Guntzviller has been hands-on, creative, enthusiastic and a strong advocate. We hope Beth continues to bring her ideas and advocacy to the commission and to join us in our slow rolls. Michael Conrad reappointed and Paula Moyer appointed through 2023.
