reserve area by adjoining owners of Queens Avenue, Vaucluse. Recommendation: A. That Council decline the requests to purchase the sites of encroachments on the road reserve

adjoining Nos 5, 7 and 11 Queens Avenue, Vaucluse. B. That the parking space at 11 Queens Avenue, Vaucluse be formalised by the grant of a lease

under the Roads Act, subject to payment of Council’s costs related to this matter. C. That the building encroachments at 11 Queens Avenue, Vaucluse be formalised by the grant

of an Easement to Permit Existing Structures to Remain, to continue for the life of the building, or the redevelopment of the site, or the redevelopment of the structures, whichever occurs first, subject to payment of monetary compensation and all Council’s costs related to this matter.

D. That the lease rental and easement compensation payable in regard to the encroachment by

the adjoining owners of 11 Queens Avenue, Vaucluse be determined by a registered Valuer.

Subject: Annual Fee for Mayor and Councillors

payable to the Mayor and Councillors. Recommendation: A. That, in accordance with Section 248 of the Local Government Act 1993, Council fix the

annual fee for Councillors at an amount of $15,500 per Councillor for the period 1 July 2009 to 30 June 2010.

B. That, in accordance with Section 249 of the Local Government Act 1993, Council fix the

Subject: 39-41 New Beach Road, Darling Point – Section 82A Review of Refusal – 6/3/2009

Author: Caroline Owen – Assessment Officer File No: DA543/2007 Reason for Report: A Section 82A review of determination is required to be determined by a

higher level of delegation than the originally determined development application. In this instance, the original development application was determined (refused) by the Development Control Committee. Accordingly, the subject review of determination application is referred to Full Council for determination.

Note: A division of votes is required to be recorded for this planning decision. Recommendation: That the Committee defer Development Application No. 543/2007 for mechanical ventilation – refurbish flat building on land at 39-41 New Beach Road Darling Point and refer the matter back to the Development Control Committee on 22 June 2009 for staff to write to the applicant requesting that they provide evidence that the air-conditioning plant complies with acoustic requirements (noise criteria) as stipulated in the previous development consent condition and for staff to confirm the distance of separation between the proposed mechanical ventilation enclosures and the balconies of the adjoining property to the rear (2 Annandale Street).

been called to full Council by Councillor Shoebridge for the following reasons: demolition of substantial contributory item in Heritage Conservation Area and substantial loss of housing stock in the municipality and should be voted on by full Council.

Item No: R1 Recommendation to Council

Subject: Nominations for Joint Regional Planning Panel

Author: Jacquelyne Jeffery—Team Leader Strategic Planning File No: 696.G Reason for Report: To notify that the Joint Regional Planning Panels will commence operation

on 1 July 2009. To advise that Council should nominate two persons, and a third as an alternate, to the Joint Regional Planning Panel for the Sydney East Region.

Recommendation: A. THAT Council decide on the process for selecting nominees to the Joint Regional Planning

Panel by election at full Council in the same manner as the election of the Mayor and Deputy Mayor (with nominations to be provided to Council before 8.00pm on the 15 June 2009).

B. THAT Council confirms its opposition to Joint Regional Planning Panel on the basis that:

i) The State Ministerial appointees will control the matters before the JRPP. ii) Communities have the right to be heard.

C. THAT nominations include all qualification referenced in the criteria. D. THAT in the even that two members are unavailable, that the Mayor appoint panel

members. E. THAT further details regarding the operation of the Joint Regional Planning Panel be

brought back to the Urban Planning Committee as it becomes available.

Subject: Questions Without Notice

25 May 2009 and for Councillors to ask Questions without Notice in accordance with Council’s Code of Meeting Practice.

Recommendation: That the responses to previous Questions without Notice be noted. Background: The provision for Councillors to ask Questions Without Notice is contained in Section 3 of Council's Code of Meeting Practice which states:

(1) As a standard practice, “Questions Without Notice” shall be listed in all agendas of Ordinary Meetings of Council

(2) Questions shall be in writing. (3) The Mayor shall direct the question to the General Manager or responsible Division

Head; or if the question is directed to another Councillor, the Councillor concerned. There shall be no requirement to answer the question immediately.

(4) If the answer to a question can be given immediately then such shall be done and a

record made in the Minutes of the Meeting. If an answer can be given, but not immediately, then the Mayor shall indicate to whom the question is to be directed and the basis upon which the answer is to be provided (whether in writing and direct to the Enquirer, or by means of a report to an appropriate Committee, or otherwise.)

(5) In the spirit of achieving the expeditious discharge of Council business the agenda item

“Questions Without Notice” shall generally be limited to not more than 30 minutes duration unless the Council determines otherwise, on the evening in question and by way of specific resolution.

Councillor Boskovitz asking: Mr Coker in relation to my question about Double Bay regarding the issue of occupancy, when will the formal reply be ready? Director Planning and Development in response: Surveys carried out by the Double Bay Partnership as of 31 March 2009 reveal that there were 24 street frontage vacancies within the Double Bay commercial centre at that time. The data previously provided by HillPDA did not itemise the vacancies but identified a vacancy rate. The partnership has requested access to the original data used by HillPDA but this has not been available. For this reason it is not possible to draw a firm conclusion at this time about changes in vacancy rates between the HillPDA work and the more recent work carried out by the Double Bay Partnership. Once the original data is made available further analysis will be undertaken to determine trends in vacancy rates. Councillor Boskovitz asking: There have been come concrete barriers installed on Old South Head Road adjoining Newcastle Street. It is obvious that the barriers are there for safety of vehicles travelling along Old South Head Road. The problem is that people turning out of Newcastle Street into Old South Head Road are almost totally blinded by the barrier. Can we determine a solution to this problem because if we do not I fear there will be an accident between vehicles moving out of Newcastle Street and with people driving along Old South Head Road? Manager Engineering Services in response: The RTA's Road Safety section has confirmed that these barriers have been placed to improve safety for the Child Care Centre on the corner of Old South Head Road and Newcastle Street as this location has had a number of vehicles travelling north in Old South Head Road lose control on this bend and crash into this Centre. A site inspection was undertaken and confirms that there is a single through lane travelling north in Old South Head Road at its intersection with Newcastle Street. Old South Head Road just north of Newcastle Street is 2 lanes wide. Therefore any vehicle turning left from Newcastle Street into Old South Head Road (the right turn is banned) has its own lane to turn into and this left turn is also covered by a Stop Sign. Councillor Boskovitz asking: I understand there was a resolution of the Community & Environment Committee stating that no more works on bike lanes should be undertaken until we determine to continue works. However two notices that bike lanes and bikes insignia have been painted on Hopetoun Avenue where work had been conducted for the last 6 months. Why were these works undertaken contrary to the resolution of the Community & Environment Committee? Director Technical Services in response: The only works that have been undertaken relate to the restoration of the line markings. No new works have been conducted. Manager Civil Works & Infrastructure further in response: Line marking renewal works have been undertaken in Hopetoun Avenue including: Remarking of the intersection at Hopetoun Avenue and New South Head Road; Double centre line marking in Hopetoun Avenue between Serpentine Road and Fitzwilliam Road; Edgeline renewal, in Hopetoun Avenue near the intersection of Village Lower Road.

Councillor Boskovitz asking: The cleanliness of the Municipality commercial centres, streets, parks and gardens is at a crossroads. The condition they are in are close to the worst they have been in my time on Council. Why is this so? Cleanliness of the Municipality is a core business of Council and we have no one else to blame for this but ourselves. Can we please look carefully at our systems that are in place and make sure that our staff work with a fine tooth comb to ensure that our Municipality is clean and tidy? Mayor in response: That is your opinion and not necessarily everyone else’s. It’s your observation. Director Technical Services further in response: No evidence has been provided to support the assertion that the cleanliness of Woollahra commercial centres, streets, parks and gardens is “close to the worst they have been in (the Councillor’s) time on Council”. However, our systems are continually under review and we have recently made some changes to further improve the effectiveness of our services. There are 16 Street Cleaning staff who currently commence work at 5am and work in 3 teams, and 2 who currently commence start work at 11am driving the afternoon road suction sweepers. They are responsible for the cleaning of 294,000 meters of kerb and gutter, 408,000 square meters of footpath and 27 pedestrian walkways, at intervals from each day up to 6 weeks depending on the location and pedestrian usage. (Street Cleaners do not operate in the 11 business centres). The Street Cleaners collect approximately 6,000 tonnes of litter and leaves from the gutters and footpaths each year. They also collect approximately 1,100 tonnes of household clean up on one to two days each week, carry out 200 paid household pick ups per year, and responded to 835 reported illegal dumps last year. There are 20 Business Centre staff responsible for the daily cleaning and minor maintenance of Council’s 11 business centres, main roads and car parks attached to business centres. They are responsible for the cleaning of 12,800 meters of kerb and gutter and 42,500 square meters of footpath. Works carried out include gutter and footpath cleaning, emptying of street bins, beach and park litter bins, maintenance and upgrades of street furniture and footpath paving and cleaning of beaches and promenades. They use 1 large road suction sweeper and 1 small footpath/laneway sweeper. The new Street Cleaners and Business Centres Enterprise Agreements and schedules are designed to improve the current services as follows: • New schedules will provide for all residential streets to be swept a minimum of once a month

(currently up to 6 weeks). • Set rosters will be followed for cleaning of bus shelters, slipways and jetties in all areas,

including regular steam cleaning of bus shelters. • 6am start time will reduce noise complaints, as we will not be in residential areas until 7am at

the earliest

• Supplementing household clean up collection with Business Centre staff will ensure it is finished in 1 day; Business Centre staff will be available to assist with sweeping up of heavy leaf fall and berries when not needed to assist in the collection of household clean up, which will facilitate Street Cleaners completing their set schedules.

• Reducing the number of household collections per year to three will increase by 11 the number of days we are able to clean streets, which will more evenly distribute the work load, provide extra hours to facilitate meeting schedules and improve schedules for some streets by two weeks.

• Reducing afternoon road suction sweepers to one, will allow the other sweeper driver to hand sweep areas around boats and trailers etc., attend to customer requests and respond to emergencies

• On Monday mornings, when household collections are taking place, using the two morning suction sweeper drivers to do some of the areas currently covered by the afternoon sweepers, will free up afternoon sweepers to do hot spots, bus shelters and weeds in the Watsons Bay and Vaucluse areas.

• New beach cleaning rosters and new beach rake provide faster, more efficient cleaning of beaches, to a set schedule, depending on tides.

Councillor Wynne asking: Could I please have an update regarding the possibility of implementing signage at Nielsen Park which would prohibit camping overnight? Director Technical Services in response: We are currently installing signage in Nielsen Park and New Beach Road. The Mayor further in response: We have written to the Department of National Parks and Wildlife, however they have not responded to us. We will proceed to install the signage regardless. Team Leader Open Space & Recreation further, further in response: The signs have been ordered and will be installed as soon as possible. Councillor Medcraft asking: What progress are we marking in identifying a suitable bin for household organic waste for Paddington? Manager Depot & Waste Services in response: A suitable small 50lt wheelie bin with handles and a lockable lid has been sourced. The utilization and roll out of the bin will be reported to Council in the report on the exhibition of our Waste Reduction & Resource Recovery Strategy and Policy, as the cost to residents will need to be added to our fees and charges.

Councillor Shapiro asking: As I have been involved in the Gap Park Masterplan from the very beginning, I was angry and frustrated that the Federal Government has refused to provide any funds. I find it difficult to believe that a Cricket Pavilion and Fruit Fly Circus obtained funds but our plan which could save numerous lives has received nothing. How has Council responded to this? Mayor in response: In your absence we have done as much as we can, radio interviews, press releases etc, we are disappointed that the press has not picked up as much as we would have liked, but the Wentworth Courier certainly did. I have done some radio interviews but at the end of the day we are now at a point we are writing a letter to Prime Minster Rudd and we will be setting out in detail in a very nice fashion exactly why we think the project should be funded and if I don’t get a reply or whatever comes back in that time, I will report back in a couple weeks time and we will then work out what we will do after that. Team Leader Open Space & Recreation further in response: Council has issued a media release regarding the lack of support for funding for the Gap Park project. We have since forwarded letters to the Prime Minister stating our situation and await reply. On the 6 June 2009, the Sydney Morning Herald published a story relating to the lack of support received from the Federal Government. Councillor Carmichael asking: Mr Mayor are you aware after the last Council Meeting in the carpark, objectors of Villa Rossa verbally harassed the applicant? As the Mayor could you please comment on your views regarding this sort of behaviour? Mayor in response: It was brought to my attention the next day, I was also subject to abuse in the car park, this is now the third time this has occurred, I find this astonishing, I find these people coming with clean hands and then to behave the way they have. I have never experienced in 18 years of Council anything like the performance of those residents ever and I think they should all be ashamed of themselves quite frankly. Councillor Carmichael asking: Are you aware the keep left sign on the pedestrian crossing near the corner of Riddell Street and Bellevue Road is very loosely flapping in the wind and could Council seek to repair the sign? Manager Civil Works & Infrastructure in response: Sign to be fixed as required.

Councillor Shoebridge asking: Have we had any advance on the pedestrian crossing at New South Head Road at the dangerous crossing point at Rushcutters Bay Park? Manager Engineering Services in response: Subsequent advice is that the project has been delayed by other RTA commitments but is still planned to proceed. We await advice of a date. Councillor Shoebridge asking: Is it true that we have had a substantial reduction in the number of Land & Environment Court appeals this year compared to last year? If so, to what extent? Manager Development Control in response: In the 2007/2008 financial year Council received a total of 66 class 1 appeals to the Land and Environment Court. In the 2008/2009 year to date Council has received 46 class 1 appeals to the Land and Environment Court. On average that is approximately 4 appeals a month in the financial year to date. Projecting on that basis it is probable that Council will end this financial year with approximately 50 appeals lodged in the Land and Environment Court. Councillor Shoebridge asking: Is it true that the Community & Environment Committee resolved to stop all work on our local bike paths? If so, when and when will work recommence? General Manager in response: Ill take that on notice, I believe the resolution passed was to not commence any new works but I will need to check with the Director of Technical Services in terms of works that were in train at time. Director Technical Services further in response: The resolution was to proceed with quarterly review and to do no new work on the local bike plan, until the review of the bike plans has been finalised. Councillor Shoebridge further asking: When do we expect that report to be submitted?
