In this case the Commission will need to determine the impact the proposed business will have on the surrounding uses, where it is located, and what impacts will need to be mitigated to make the use in character with the site. Petitioner/ Developer’s requested action: The applicant requests approval of a conditional

use permit to allow a vehicle graphics, signs, and large format printing business to locate in an

existing building at 2665 Lincoln Avenue within the CBD Zone.

What the Planning Commission reviews

The Planning Commission reviews the conditional use permit for compliance with land use

ordinances and the conditional use criteria found in Ogden City Code 15-7-4. These require a

determination that:

A. The use will not be detrimental to persons or property;

B. The use is consistent with the General Plan;

C. The use is compatible with the character of the site and surrounding neighborhoods;

D. The design is compatible with character of the site and surrounding neighborhoods; and

E. The proposal complies with land use regulations.

As per Utah State Law, conditional uses are considered permitted uses, with conditions the

Planning Commission’s determination for action

Possible Commission findings and actions.

1. Find that the conditional use permit complies with land use regulations and the General

Plan, is compatible with surrounding neighborhoods, will not be detrimental to persons or

property, and approve the conditional use permit.

2. Find that the proposed conditional use complies with the applicable land use standards,

may have detrimental impacts on surrounding neighborhoods, that these detrimental

impacts may be mitigated with the following conditions (list), and approve the conditional

use permit with conditions.

3. Find that the proposed conditional use does not meet the applicable land use standards,

that there are no legal modifications, conditions or mitigations that may be imposed to

mitigate the impacts of the proposed use, into conformity with the standards, and deny

the requested conditional use permit for the following reasons: (list)

Planning Staff’s Recommended Action

Staff recommends approval of the proposed conditional use permit, subject to the following:

1. Obtain building and other necessary permits for any changes to the building.

2. Obtain sign permits for any installed signs.

3. Stripe the parking lot as shown on the submitted plan. Include an appropriately signed

and marked ADA parking space at the shortest accessible route of travel to an

accessible facility entrance.

Description of request

The applicant, Wilson Rodriquez, Forza Creativa, requests a conditional use permit to locate a

vehicle graphics, large format printing, and sign manufacturing business in an existing building.

The building is at 2665 Lincoln Avenue and is zoned CBD. The applicant does not propose any

changes to the building or site.

Factors for consideration of action

The property is zoned CBD. The following is listed a conditional use in this zone.

Manufacturing establishments solely engaged in the assembly of already processed materials

or the substances into new products, provided the activity is conducted and all materials are

stored within a completely enclosed building. Manufacturing in this chapter is limited only to food

products for human consumption, clothing, textiles, printing, and publishing, and plastic

consumer products, e.g., bakery, beverage, dairy products, apparel, textiles, newspaper

publishing, book publishing, toys, cases, helmets.

The proposed use would fall in this classification and thus requires a conditional use permit.

The site formerly was a confectionary manufacturer, which had a conditional use permit.

The site is bordered on two sides by manufacturing or contractor businesses. It is across the

street from an office building. To the south are existing nonconforming single-family dwellings.

The site is configured so only a block wall faces the single-family dwellings. The use itself will

generate minimal amounts of noise, odor and traffic. Therefore, staff does not recommend any

special conditions to mitigate impacts.

Striping in the parking lot has disappeared with wear. Staff recommends a condition to restripe

the parking lot and install an ADA compliant parking space to comply with land use ordinances.
