Would it withstand public scrutiny? A conflict of interest is a clash between private interest and public duty. There are two types of conflict:

Pecuniary – regulated by the Local Government Act and Department of Local Government

Non-pecuniary – regulated by codes of conduct and policy. ICAC, Ombudsman, Department of Local Government (advice only)

The test for conflict of interest:

Is it likely I could be influenced by personal interest in carrying out my public duty?

Would a fair and reasonable person believe I could be so influenced?

Conflict of interest is closely tied to the layperson’s definition of “corruption” – using public office for private gain

Important to consider public perceptions of whether you have a conflict of interest Identifying problems

1st Do I have private interests affected by a matter I am officially involved in?

2nd Is my official role one of influence or perceived influence over the matter?

3rd Do my private interests conflict with my official role? Whilst seeking advice is generally useful, the ultimate decision rests with the person concerned. When making a Declaration of Interest the reason for making the declaration should be clearly stated. 10.01 NOTICE OF MOTION – ZONE OF LAND ON O’CONNELL ROAD

Summary Seeking investigation into zoning in the LEP for land north of the Oberon town area.

Motion That:

1. Oberon Council investigate how the area north of Oberon town area got changed to B6

Zone when Council of the day decided it was to be Light Industrial.

2. Council consult a possible change to Light Industrial.

Commentary LEP was changed. Area: Oberon Freighters, Clift Engineering, Howards Auto Port and Drake Bulk Haulage.

11. COUNCILLOR AND DELEGATES REPORTS

11.01 OBERON BUSINESS AND TOURISM ASSOCIATION MEETING

Summary Councillor Sam Lord attended the last meeting of the Oberon Business and Tourism Association held on 13 September 2016 at the Oberon Golf Club.

Recommendation That report item 11.01 is received as information.

Comment It was mentioned that the nominations for Australia Day Awards 2017 close on 28 October 2016. An update was provided in regards to the Shop Local Vouchers. The Shop Vouchers are being purchased and used often and there is good support from the Golf Club and RSL Club. The 2016 Business Awards will be held at the Oberon RSL on Friday 25 November 2016. A category list will be published in the Oberon Review. Nominations can be submitted online or forms can be placed in boxes provided at Arrows Newsagency, Oberon Pharmacy and the Post Office. Nominations will close on Friday 14 October 2016. A list of those nominated will be available for viewing on Thursday 27 October 2016. The Oberon Review will have a $250 prize for best local business. The nomination forms for this prize will be in the Review prior to the awards. It was noted that the OBTA membership forms and annual fee of $145.00 are due. There was a motion moved to have a membership of $45 for non business owners that are involved in OBTA. This reduced fee may encourage community groups and members to become members in OBTA and assist with meetings and events. It was also mentioned that OBTA is concerned regarding the Destination NSW area divisions. A verbal Mayoral report was given at the OBTA Meeting. CENTROC is looking at gathering information from each member Council in regards to tourism and a tourism marketing campaign will be created. It was advised that there were no updates regarding amalgamation at this stage. It was mentioned that the Chifley Command liaison officer will be in contact with U3A in October. Jen Capel gave an update on the photo competition. The OBTA Facebook page has had over 1,200 views. Entries for the winter section close on 30 September, the spring competition commences in October. The theme will be Our Town/Adventure. The winning photos can be viewed on the Experience Oberon Facebook page or at the Visitor Information Centre. Alison McClure from Mayfield Gardens gave an update of events happening in October. Mayfield Kitchen Café has a new chef Heath, who was formerly a chef at Cobblestone Lane, Bathurst. Heath has created a new menu. Some new additions to the garden including a croquet pitch and large chess board. The spring opening will commence on 15 October 2016 and finish on 30 October 2016. Next meeting will be on Wednesday 12 October, 6pm at the Oberon Golf Club.

11.02 UPPER MACQAURIE COUNTY COUNCIL

Summary Councillors John Morgan and Neil Francis attended the last meeting of the Upper Macquarie County Council held on 16 September 2016.

Recommendation That report item 11.02 is received as information.

Comment There were no delegates from Lithgow Council present as no appointments have been made due to their recent elections. A comprehensive report from the Chief Weeds Officer, Laurie Waddell was tabled at the meeting. This answered the proposal from last meeting that "each property should be inspected and a report provided on the state of noxious weeds on that property" prior to sale. The report showed that this same proposal was rejected by NSW Government in May 2014. The number of properties inspected by Oberon's Weed Officer, Jill O'Grady was 46. Training and certification continued to be undertaken amounting to six days plus a further six days on administration. It was advised that the majority of the backlog for "Best Practices" has now been completed allowing staff to concentrate on field work. The General Manager presented fourteen policy documents to Council in which all were adopted. The next meeting is to be held 4 November 2016

Comment FOLLOWING are the Minutes of the Local Emergency Management Committee held 29 August 2016. The following is a summary of the Committee discussions and outcomes:

Council are commencing the review of its Emergency Management Plans and sought input from all agencies to ensure that the plans are as accurate as possible and that contacts listed are current.

Representatives gave updates on their areas for the preceding period. The next meeting of the Committee will be held on Monday 14 November 2016, commencing at 2.00pm in the RFS building, North Street, Oberon.

1. ATTENDANCE & APOLOGIES – see above lists 2. EMERGENCY MANAGEMENT PLAN Chris Schumacher explained that Oberon Council is commencing the review of all its Emergency Management Plans. The current plan handed around for discussion at the meeting was to highlight some of the updates and changes that will need other Agency review and input to ensure that the plan is accurate as possible and that all the relevant contacts are current. Chris/Rebecca Burgess to send out the ‘Draft’ copy to all agencies for their review and feedback as part of finalizing the first stage of the plan review. 3. REPORTS – from Agencies/Members The following is a brief summary of reports provided by members:

Brett Jackson (Fire & Rescue Oberon) – Advised that F&R Oberon will be holding a formal training exercise in conjunction with Woodchem (Aaron Evans) at their facility in Lowes Mount Road at 11.00am 15 September 2016. The aim of training is to simulate a real event scenario so that agencies can grasp and practice what may be expected in the event of a real occurrence at the Woodchem facility.

Brett Jackson to confirm details and exact date for the practical, information to be distributed to Craig Bowra and LEMO (Chair). F&R continuing to recruiting for new personnel 20 call-out responses for last quarter – no major fires to report during this period.

David Abercrombie (NSW Police) – Advised that one incident at Trunkey Creek during the quarter (Mt Fitzgerald). Minor motor vehicle accidents during the July snow event with cars insisting to travel closed roads. David indicated frustration of NSW Police with RMS who insisted on opening snow closed roads against their advice.

Kim DeGoverick (NPWS Oberon) – Advised that the refresher and formal training for NPWS fire crews has now been completed pre-season to summer. Subject to favourable weather conditions NPWS Fire crews are scheduled to commence controlled spring burns at Mt Werong from the 1 October 2016.

John Kanne (NSW Ambulance) – Advised that during his time in Oberon there have been numerous call outs to the Abercrombie Hill regarding motor vehicle accidents on the first steep section (corner) of the Abercrombie Hill. Would like to see speed limit review to 60kph and additional advance warning signage erected. John raised concern about ‘Event Notification’ and the lack of information passed onto NSW Ambulance in order to create stand-by staff roster numbers. Oberon Council (in its capacity) has given a guarantee to notify NSW Ambulance and NSW Police if said events are known to Council. Residential Numbering was raised as an ongoing concern, NSW Ambulance struggles to find houses in streets within in Oberon due to the lack of or poor numbering of properties along frontages. John has asked for Oberon Council assistance to run a campaign to increase awareness and look for funding to assist numbering on kerbs adjacent to houses for both day and night time recognition. Suggested that Council run a media campaign through, media, local Council column, rates notice’s etc.. Chris suggested that Councils grants officer will look for funding to assist this issue.

Aaron Evans (Chemwood) – Aaron highlighted Chemwood intention to run a simulated training exercise for their facility during the month of September, date to be confirmed.

Alistair Gordon-Smith – Local Land Services – Nothing to report.

Mark Darling ( Sate Emergency Service – Oberon) – Advised during the last quarter that the SES has been called out to 65 individual jobs ( a total of 265hrs), of those jobs 22 calls for assistance were received during 1 day. 560 hours have been put into training staff and completion of equipment maintenance. Burraga had 12 call-outs during the quarter totalling 103hrs of emergency assistance time. 230 hrs of training with the Burraga SES team.

Greg Sims (Rural Fire Service) – Introduction of Greg Sims replacing Greg Wardle). Greg reported that the last quarter has been reasonable steady with the wetter then average weather conditions experienced. However, it is expected with the warmer weather approaching fire activity levels are predicted to increase as per usual expectations. RFS are currently seeking new recruits, currently Oberon is 4 operators down, it is hoped to recruit back to full levels in the immediate short-term and create 2 new fire crews for the upcoming season. Fire Hazard Reduction works are scheduled in the coming months to help reduce ground fuels and seasonal growth to a minimum in known hot-spots. IMX Pre=season Training is planned for Wednesday 21 September 2016 at the Old Bathurst Fire Control Centre, commencing at 9.00am.

Minutes of the Oberon Local Emergency Management Committee Meeting held on 29 August 2016

Chris Schumacher – (Oberon Council) – Advised that with the recent bout of winter snow and icy road conditions a number of accidents occurred in which involved Council being called to assist with Traffic Control and Road Closures. Council currently reviewing Snow and Ice Road Management Plans in conjunction with Roads & Maritime Services. Council continuing to review EMPlans and update to current formats and structure.

5. GENERAL BUSINESS John Kanne (NSW Ambulance) raised concern about the lack of NSW Police assistance during confrontational call-outs to attend treating patients. Recent incident in Oberon, hostile situation in which NSW Police back-up was requested and was not forthcoming for a substantial amount of time (1-1.5 hrs). NSW Ambulance have concern for their staff well-being would like NSW police to be more aware that there is an increasing prevalence of both Drug and Alcohol related incidents in Oberon, as such present safety issues for treating paramedics.

David Abercrombie (NSW Police) – Not personally aware of the event that occurred in Oberon. Indicated that 6 staff are assigned to the Oberon LGA, as such these staff are on-call or as required basis. 6. NEXT MEETING DATE AND MEETING CLOSE. Comment FOLLOWING are the Minutes of the Oberon Sports Facilities Committee held on 21 September 2016. A summary of the Committee discussions and outcomes is listed below:

A Long Jump Pit at the Recreation Oval, as well as permanent wire netting to the discus and shot put circles has been completed prior to the opening of the Oberon Little Athletics season for 2016.

Council’s Works and Engineering Director to seek quotations for sporting ground signage.

Council’s Works and Engineering Director to arrange installation of new equipment and materials to upgrade the existing sprinkler system inclusive of a new electronic timer system and rain gauge. The system to be installed during October 2016.

Council’s Works and Engineering Director and Council’s WHS Risk Coordinator have established the new parameters for the creation of appropriate signage for local sporting and recreational park areas. Quotations for these signs will be sought for budgeting purposes and rollout.

The Committee agreed on the Green and Yellow rectangular style signage embossed with Oberon Council Logo and ground name for each individual field or park. 13. REPORTS FOR DECISION

13.01 OBERON COMMUNITY GARDEN

Summary Council is currently developing the Oberon Library and Community Centre into a Community Hub. At the rear of this land, between the Oberon Library, the Robert (Bob) Hooper Community Centre and the Tally’s Lane car park, there is land that is not currently utilised. It is an ideal location to create a community garden.

Recommendation: That Council approve the establishment of a Community Garden at the rear of the Oberon Community Hub.

Comment A planned design of the community garden FOLLOWS this report. Community gardens increase a sense of community ownership and stewardship. They bring people together from a wide variety of backgrounds; foster the development of a community identity and spirit; building community leaders; offer opportunities to meet neighbours; teach youth the importance of community and environmental sustainability; provide inter-generational exposure to cultural traditions; teach the youth job and life skills; and are recognised by the police as an effective community crime prevention strategy. Community gardening is a healthy, inexpensive activity for youth that can bring them closer to nature, and allow them to interact with each other in a socially meaningful and physically productive way. Studies have shown that community gardeners and their children eat healthier diets than non-gardening families. Eating locally produced food reduces asthma rates, because children are able to consume manageable amounts of local pollen and develop immunities. Exposure to green space reduces stress and increases a sense of wellness and belonging. Using several raised garden beds around the perimeter of the fenced area and some free standing beds in larger vacant areas would benefit community members where they can enjoy the experience of growing vegetable and other plants with the company of others. Beds would need to have access around them so more than one person could work at the garden together. Beds would also need to be at varying heights to accommodate wheelchair access. Vegetables, herbs and flowers could be grown organically by community members by producing compost from food waste collected from cafes and restaurants in Oberon. A flat wall water tank and a small garden shed fitted to existing walls would be required. Raised flower beds inside the triangle area on the corner of Talley’s Lane and Fleming Street would beautify the corner. Benches and tables could be installed to use for lunches, etc. There could be a designated day each week where everyone can come together to work the gardens and learn techniques from others. The Community Centre kitchen could be made available to have a cuppa and chat.

The community garden would be open all days of the week for keen gardeners to enjoy. It is proposed that Council’s Community Services staff manage the garden. They will look for community engagement from all aspects of the community, including the Youth Council, Oberon Garden Club, Daffodil Fairies, and local schools. It would be an area for small projects during each of the Oberon Council School Holiday Activities. The Oberon Library has many books on gardening which community members will be encouraged to use the Library for reference purposes. The benefits of such a program include community engagement, friendship, reduced isolation, reduced loneliness, educational, experience, a sense of achievement, enhanced wellbeing, and enhanced physical activity. The cost to create and maintain a Community Garden will be via grant opportunities such as from the Veolia Mulwaree Trust. Oberon Council’s in kind support, and in-kind support from Oberon business community could also benefit this project..

13.02 COMMUNITY HUB DEVELOPMENT

Summary Council has $320,000, including the promised $100,000 funding from the State Government, for the Oberon Community Hub. The Boffa Robertson Group were engaged to draft plans for the extension. This report provides the draft plans for Council’s adoptions and public exhibit to gain community feedback and support.

Recommendation: That Council resolve to accept the draft Community Hub plans and place them on public display for a period of 28 days for public comment.

Comment Boffa Robertson Group have developed a draft plan for the proposed Community Hub that FOLLOWS this report. Through discussions with Council Library, Community Technology Centre, administrative staff and the Community Precinct Working Party, the configuration and use of the new Community Hub has been established. We are looking for a space that all community members can visit for a wide range of services or entertainment. The Oberon Library building will connect to the Robert (Bob) Hooper Community Centre to create a Community Hub with an additional 65m2 of floor space. The expansion will also provide space to incorporate the Community Technology Centre. The objectives of this project are to:

Enable more community members and visitors to utilise the Community Hub comfortably and in more varied ways, including activities such as story time, author talks, group meetings, computer access and/or lessons, community functions and exhibition spaces.

Support a youth culture by expanding the way the library is used by young people aged 12-18 years, who are currently under-represented as library users.

Create a multipurpose space that facilitates the development of community programs and partnerships that brings people together from diverse backgrounds, age groups and cultures.

Preserving the traditional functions of the Library by providing a quiet place for older people to enjoy the library.

Promoting young people’s interest in library activities, assuring that Oberon Library has “customers for tomorrow”.

The new design creates a new main entrance to the Community Hub, by moving the existing entrance to the new extension. Community members will be able to access the Library, Community Centre or Community Technology Centre through the main entrance. When the Library is closed, the wide range of activities can continue in the Community Centre through the existing Community Centre ramp entries at the front and back. There is disability access to all areas of the Community Hub, with a ramp down into the existing Library building, a ramp into the main entry foyer, an existing ramp to the Community Centre, and a ramp to the back grassed area and car park.

Council staff have commenced work on the car park at the rear of the Community Hub in Tally’s Lane, which will provide an additional 20 off street parking spaces. Councils Community Engagement Strategy endorses community involvement in these types of projects. It is considered that upon the assessment of the community ideas the plans will be redrawn and prepared for a Development Application to be lodged for Council consideration. Further exhibition of the revised plans will be undertaken through the development assessment process.

13.03 TOWN IMPROVEMENTS – ALBION STREET FOOTPATH

Summary This report seeks additional funding to complete the last 100m of unfinished footpath extension along the southern side of Albion Street, Oberon.

Recommendation: That Council allocate an additional $10,000 from Section 94 funding to complete the last 100m section of missing concrete footpath on the southern side of Albion Street during the 2016/2017 financial year.

Comment Council will recall that staff recently constructed approx. 200m of new concrete footpath along the southern side of Albion Street as part of this financial years Town Improvement funding allocations. To date $20,000 has been spent on constructing 200m of the missing link of path in which will assist the facilitation of pedestrians to vital links in and around the Oberon Township. The majority of earthworks have already been completed to finalise the last 100m, with only labour and material costs now as part of the $10,000 funding request. Should Council elect to proceed with the finalisation of the last 100m section of concrete path, funding can be obtained from reserve section 94 contributions.

13.04 DEVELOPMENT APPLICATION 10.2016.46.1 – DWELLING

File No: Property/PR259-92 Author: Health and Building Surveyor, Kerry Davison

Summary A Development Application has been received for the construction of a dwelling at Lot 12 in DP 603429, being known as 92 Ferndale Road, Oberon. The two bedroom dwelling is proposed to be located on an existing excavated site within 350m of the existing approved quarry which may be reduced to a 270m setback in the future, due to an approved expansion in September 2012. The submitted Statement of Environmental Effects has identified;

“A ridge between the proposed dwelling site and the quarry provides a significant barrier between the dwelling site and the quarry operations”, which would provide shielding to the proposed dwelling from noise impacts associated to the quarry.

The applicant has proposed additional noise attenuation measures through double glazing and added insulation which has been indicated by a consultant to provide “sufficient acoustic attenuation” within the proposed dwelling. An existing consent Development Application 10.2011.1.1 for a proposed dwelling was approved by Council in December 2011, in the same location. This consent will be withdrawn prior to the issue of any further approval. The proposed dwelling site is within Council’s 500m buffer zone to an existing extractive industry, Mudgee Stone Company and the applicant is seeking a variation to Clause A2.6 of Oberon’s Development Control Plan, 2001. At its August Ordinary Meeting Council resolved to defer the outcome of the proposal until after a site inspection.

Recommendation: That:

1. Council resolve to approve the variation to Clause A2.6 of its current DCP 2001 and delegation be granted to Council Acting General Manager to approve DA10.2016.46.1 for a proposed dwelling located 232m from its Eastern boundary on Lot 12 in DP 603429 being known as 92 Ferndale Road, Oberon.

2. A division be called in accordance with Section 375A of The Local Government Act 1993.

Comment At its September Ordinary Meeting Council resolved to defer a matter pertaining to the erection of a dwelling until a site inspection was organised and carried out.

On 5 October 2016 a site inspection was carried out in relation to the application with Councillors Gibbons, Lord, Francis, McCarthy, Morgan, Council staff and the owner. The following was discussed during the inspection;

That there is an existing consent on the lot for a dwelling in the same location, which the owner could construct however she has submitted a new application for a smaller dwelling.

The quarries current approval 07_0122 approved by the Minister for Planning and Infrastructure allowed for a 37dBa noise emission on Lot 12 and the proposed dwelling will be designed to cater for 40dBa noise level.

The site selected for the dwelling is not visually impacted by the quarry and is well protected from wind.

As a result of the site meeting the application has been prepared and submitted to Council for consideration. PROPOSAL Development Application 10.2016.46.1 was received by Council on the 9 June 2016 for a proposed dwelling at 92 Ferndale Road, Oberon within the RU1 Primary Production Zone. Plans together with the proposed site plan were provided to the 20 September 2016 Ordinary Council Meeting and further copies can be provided upon request. Part A2.6 (f) requires the following in regards to Buffers:

In order to minimise land use conflicts and avoid undue interference with the living amenity of residents, residential development shall be located so as to ensure the following minimum buffer areas around intensive agriculture establishments, the Oberon Industrial area, quarries, sewerage treatment plants and the other existing land uses with a nuisance potential: Extractive Industry (as defined in Standard LEP) - 500 metres (from footprint of operations and is to be provided wholly within the proponent’s land or by appropriate lease over the buffer area. Council may consider less stringent conditions based on partial use and/or annual production volume having regard for public benefit).

Lots 12 and Lot 13 (now known as Lot 2 in DP 1089826), currently owned by Mudgee Stone Company, were created as concessional lots under the Oberon Interim Development Order No.1 for the purpose of dwellings and as a dwelling is permissible under Clause 4.2B(b) of Oberon Local Environmental Plan 2013. On the 23 June 2003, Development Application 110/03 was lodged with Council for a “Dwelling Entitlement” and subsequently approved on the 8 August, 2003. Condition 3 of DA110/03 required that the location and design of a dwelling on the land shall take into account the presence or potential presence and the impacts or potential impacts of any proposed or existing quarry operations on the adjoining land. A subsequent Development Application 23/09 was received by Council on 14 August 2008 for a proposed dwelling on Lot 12 which was referred to Council and consequently refused due to the application not addressing the noise attenuation issues. On 14 January 2011, a Development Application 10.2011.1.1 for a proposed dwelling was submitted in the same location and approved by Council on 20 December 2011.

The applicant has indicated the proposed site was selected for the following reasons;

The site has already been excavated and cleared,

The site provides protection from winds,

The site has a pre-existing Bushfire Asset Protection Zone, alleviating the removal any further vegetation and

The site was previously approved for the location of a dwelling. Neighbour notification was undertaken to the adjoining Mudgee Stone Quarry. Submissions closed at 4pm on 25 July 2016 with no submissions received. It is important to note that Part A2.6 has been varied by Council for this location in the past and it is considered that the approval can be supported in this instance.

14.01 MONTHLY ACTIVITY REPORT – ACTING GENERAL MANAGER

Commentary 1. PLANNED ACTIVITY FOR OCTOBER and NOVEMBER LEGAL ACTION – On 13 October 2016 the Crown Solicitors Office advised that an undertaking has been given by the Minister refraining from amalgamations until 7 days after the delivery of the Court of Appeal Judgement in the Woollahra appeal. This is a good starting point to enable appropriate information gathering processes to be undertaken. LAND SALES – Offers have been received on 3 of the residential blocks in Edith Road. Negotiations continue on the conditions of sale. It is anticipated that these will be finalised directly. Work will continue to advertise and positively advocate for sale of the remaining allotments. COMMON – Work is continuing on the implementation of projects from the Common Master Plan. Currently Stage 1 works are being undertaken with the construction of additional car parking and BBQ areas. Significant work continues to occur to re establish the fountain and reticulation infrastructure in the ponds. Opportunities for the sale of land in the Industrial Subdivision continue with AGM fielding several queries in relation to the land. RE START NSW – On 4 October 2016, Member for Bathurst, the Hon Paul Toole MP announced Oberon will receive $4.95 million in funding to upgrade the Oberon Sewerage Treatment Plant under the NSW Governments Regional Water and Waste Water Program. As Councillors are aware, this has been generated from our interest. A further report outlining requirements moving forward on this project will be tabled at the upcoming Works Committee Meeting. OBERON LANDFILL FACILITY – On 4 October 2016, Member for Bathurst, the Hon Paul Toole MP announced Council had been successful in its application for NSW Government Landfill Consolidation and Environmental Improvements program. Funding of $42,790 has been allocated to assist with improvements to the Oberon Waste Facility and to address environmental issues. Funding will be used to construct a concrete bunker for glass storage, erect directional and informational signage, roadworks, installation of a surveillance camera, erection of a gatehouse and shaping of the site to control surface water run-off. This sits within our current Waste Strategy.

The Western District Historic Vehicle Club stayed 5 days with 16 members and partners attending. The Austin 7 Club spent 2 days in Oberon and district with 16 members and partners attending. In addition a BMW Mini club stayed overnight. It is estimated these groups injected over $20,000 into the districts economy during the week it highlights the importance of targeting specific groups to visit. Visitor numbers were increased during the school holiday period. The Visitor Information Centre was also busy with a large volume of phone enquiries concerning road conditions and flooding in the region. National Parks and Wildlife provided advise that the road to Kanangra Boyd River camping ground was accessible via 4WD only from the camp ground out to the Walls; the Kowmung River Fire Trail is also closed until further notice. The Yerranderie caretakers advised that there were no issues with the road to Yerranderie and they had accommodation available for the school holidays and long weekend. On Friday 16 September a large number of motor bikes were in the area for the Biblio Turismo visit to Oberon Library and also the Police annual charity ride from Western Australia. 16 campervans visited the Information Centre during their rally from the Central Coast. Large numbers of Caravanners were also travelling through on their way to Canberra for a rally and Floriade visit. Friday 30 was the opening night for the annual Tarana Art Show. The OBTA ‘Experience Oberon’ Winter Photographic Competition entries closed on 30 September. Spring Competition entries are now being accepted – categories for this season have changed to ‘Our Town’ ‘Adventure’ and an OPEN section for the children with the age being extended to 8 - 15yrs. Executive Coordinator attended the Land and Environment Court on Friday 7 October 2016 to hear Chief Justice Preston hand down the judgement in the Oberon Council legal challenge. 5. 14.02 MONTHLY ACTIVITY REPORT - WORKS AND ENGINEERING

Summary Providing a summary of the work activities in the Works & Engineering Department for the month of September 2016 and including scheduled work for the coming month of October.

Comment 1. UPCOMING/PLANNED WORKS The following works will commence during the month of October 2016: Maintenance Grading – Roads maintenance activities will be completed on Gilmandyke Road, Knapsack Road, Springmount Road, Bastard Point Road, Moss Grove Road, Sloggetts Road, Kanangra Walls Road. Boggy Road Outbreaks – Full to the brim water tables continue with more recent boggy outbreaks on Sloggetts Road, Mackie Road, Gilholmes Road, Curry’s Lane. Council crews have been temporarily fixing most of these road issues to make them passable in the interim period. Dog Rocks Road – The last base layer of material has been placed on the Dog Rocks Road and will be ready for bitumen sealing later this month. LIRS Funded Works – Due to wet weather delays staff will continue improvements to drainage and gravel re-sheeting improvements on Sheep Station, Keith Armstrong and Tuglow and Millers Lane will finalised during October. Abercrombie Road – Heavy Patch stabilisation works will continue on the Abercrombie Road this month. Several large areas of road pavement require full restoration due to the pavement failure from ground water and aging cracked pavement. RMCC Trunkey Road – Staff will continue to work through October undertaking full road reconstruction works on MR 54 at Trunkey. Abercrombie Hill Project – Staff have commenced the installation of new drainage and piped culverts on the first 1km section of the Abercrombie Hill. It is expected that half of the project will be completed prior the Christmas break. Tally’s Lane Carpark – Staff will finalise the new carpark construction works during October. It is envisaged that the carpark will by fully operational by end of October. Parks and Gardens Activity – In between the periods of rainfall staff have been mowing our parks and playing fields. Crews will be very busy keeping up with the growth as the warmer weather arrives.

Shade Sail Installation – Contractors will be installing 2 x new shade sail structures at the pool entrance frontage between the 11-13 October. The new sails will provide shade over both the playground equipment and the picnic setting area. Fixing Country Roads Project – During October staff will recommence the finishing touches to the several intersections associated with the FCR program along Swells Creek Road. Repairs to several pavement failures along Beaconsfield Road will also be completed. This will finalise the objectives of this $990K project. Edith Road Repair Project – resources permitting during October staff will commence this financial years repair Program on the Edith Road. Following on from the 2015/2016 road improvements, staff will undertake up to an additional 2km of road reconstruction works. This will include road realignment, road widening, drainage, new bitumen pavement and new guard rail installation. 2. 1. Council requests the removal of trees along a section of Lowes Mount Road.

1. Oberon Council engage in tree removal on Lowes Mount Road from half way down Lowes Mount to the boundary of “Newstead” property on the western side of the road for safety reasons.

2. Council contact Forestry Corporation for their assistance as their EIS should have identified this danger of removing the forest and exposing wind protected trees.

2. Council resolved to provide $30,000 from the Section 94 Urban Roads Funds towards the construction of the new car park to accommodate up to another 20 car parking spaces in and around Oberon.

3. WORKS ON LOCAL ROADS, BRIDGES, PARKS AND PRIVATE WORKS UNDERTAKEN

DURING SEPTEMBER

Maintenance Grading – Maintenance grading has been undertaken at Schumacher’s, Burraga area roads, and Edith area. Heavy Patching works are also being undertaken on Abercrombie and O’Connell Road. Pothole Repairs – Pothole maintenance was again an increasing problem during the month of September with continued rainfall. The amount of repairs required on local roads, Regional Roads and the State Highway required were above average attention to repair. Heavy Patch Repairs on Sealed Roads – Staff repaired several patches on the Abercrombie Road and O’Connell Road subject of wet weather pavements failures. Wet Weather Repairs - The wet weather and high winds during September required the outdoor crews to clear roads of trees and fallen debris as well as clearing low level crossings so that they

are trafficable. Many wet weather bogs from springs continues to open up on unsealed roads, due to saturated ground water tables. Water Springs on Unsealed Roads – Staff have attended to customer requests for temporary repairs on the following roads due boggy road failures: Swatchfield, Isabella. Loch Erin, Springmount, Gilholmes, Arkstone, Mackie, Kanangra Walls, Jerula, Jerrong, Felled Timber, Knapsack, Tilsbury, Sloggetts and Millers and Curry’s Lane. 4. WORKS FOR ROADS AND MARITIME SERVICES (RMS) Monthly Works update September 2016:

RMCC Routine road patching maintenance.

Continued wet weather during September required increased inspections and maintenance works on Duckmaloi Rd and O’Connell Road.

MR54 Trunkey Project – $1.2M road works have now commenced at Trunkey and are anticipated to finish mid- November

Forward Works Program:

$60,000 of repairs to O’Connell Road to repair a water spring at the bottom of the Mount will be undertaken during October.

RMS discussions for Oberon Council to undertake upgrade to section of O’Connell Road between Mayfield Road to the top of the Mount is in the planning stages.

Inspections and routine maintenance works on both Duckmaloi and O’Connell State Roads.

5. WORKS ON TOWN IMPROVEMENTS Albion Street Footpath – Staff have now fully exhausted the allocated $20,000 of funding to extend the concrete footpath along the southern side of Albion Street. The footpath has been extended some 200m short of the Albion Street Church and will require additional funding to complete. Shade Sails – An official order to start manufacture of new shade sails for the frontage to the Oberon Pool Complex has been commissioned during August. It is expected to take delivery late September and Construction to complete the installation fully operational by 15 October 2016. Recreation Ground Watering System Upgrade – New Water sprinkler heads and a system revamp of the in-ground watering system at the Recreation Ground is programmed during October. Staff have taken delivery of the new materials with arrangements to install during October. Oberon Common – Council staff to commence site preparation works ready for construction of the new Picnic Shelters before the end of 2016.

For the period 1 July to 30 September 2016 Council staff processed 43, 603 certificates, and conducted 12 special water meter readings. 5. COMMUNITY SERVICES Oberon Library The library was visited by Biblio Turismo on Friday 16 September. Biblio Turismo is dedicated to the two worlds of Library professionals and motorbikes. Or if you like Librarian's on motorbikes! Participants travelled on motorbikes visiting public libraries to promote rural libraries in particular. The ride is now an annual event.

During September, there were 1,640 visitors to the Library, the Library issued 1,312 articles, with 1,266 returns. The Library registered 13 new members, with 166 new items available. We had 16 Interlibrary Loans. The computers had 241 uses, with 28 of these over 65 years old. Library has facilitated the first week of the September/October School Holiday Activities. Numbers are low for some activities. Cooking for 8 - 12 year olds and craft for children aged 5 -12 years have still been popular. The Community Display Space will display parts of the Alan Brown Collection for October.

OBERON YOUTH COUNCIL The Oberon Youth Council (OYC) raffle raised $765. This raffle was to assist a local youth, Tyson Rice, with his travel in and around Sydney while he attends the Bangarra Dance Academy. The OYC have discussed raising funds for two youth per year within the Oberon LGA, aged between 12 -25 years. The funds are to assist them achieve their potential in any area they wish, whether it be academic, cultural, employment, theatre, etc. Nominations for 2017 youth can be made to the Finance & Community Services Director at [email protected] Currently, the OYC are preparing for the Halloween Disco to be held on Friday 4 November at the Oberon RSL. SELF CARE UNITS One of the units in Balfour Street is currently available and another will be becoming vacant in the near future. There are four community members on the waiting list who have shown interest in

taking up the vacancy. The Self Care Panel will meet to discuss the list of eligible people and determine who is most suitable to take up the vacant units. COMMUNITY NOTICE BOARDS Council is looking to upgrade all the community notice boards within the Oberon Local Government Area. They have aged considerably and with the extreme weather of late, spiders are taking refuge in them. Quotes will be sourced in the upcoming months to gauge the cost of replacement. BLACK SPRINGS COMMUNITY HALL It appears that the hall has been used without Council’s knowledge. The hall was inspected on Monday 5 September and was in relatively clean condition. The hall was booked for a party on Saturday 1 October and the hirer complained that the bins were full of unhygienic material and the floors were filthy. The next Black Springs Community Hall meeting on 26 October will discuss changing the locks to eliminate unapproved usage and drainage work to reduce the excess water from the grassed area at the front entrance. LG PROFESSIONALS NEW ZEALAND STUDY TOUR Council’s Finance & Community Services Director travelled to Christchurch and Auckland between the 12 and 24 September 2016. Lynette will be providing both LG Professionals and Oberon Council with a report outlining how the New Zealand Councils are dealing with Community Engagement.

Comment 1. Successful Grant Applications and Funding Notifications a) Regional Water and Waste Water Backlog. Council were successful in their application for funding to upgrade the Sewage Treatment Plant. Minister for Local Government, Paul Toole, announced on Tuesday 4 October that Council would be provided with $4.6m, on a dollar for dollar basis. A report will be provided to Council by senior management in the coming months. b) Local Government Taking Action to Protect Ecosystems. Bathurst and Oberon Council were successful with their joint application for incentive funding from Local Land Services to continue willow control and revegetation work on the river bank opposite Hassall Park at O’Connell. As the project area is on privately owned land within the Bathurst Council LGA, the project will be managed and administered by Bathurst Regional Council staff. 2. Current Grant Application Status Report a) Community Hub. Council are now required to submit a request for information (RFI) to the Community Development Grants programme to secure the election commitment of $100,000 for the Oberon Community Hub Project. This RFI will include the design plans, which are the subject of a separate report. Once the plans are approved, a project budget will be formulated to be included in the RFI which must be submitted by 1 December 2016.

b) NSW Disaster Assistance. The next step in the NSW Disaster Relief Assistance (NDRA) process is for the NDRA Administrator to prepare a grant offer to Council for the $93,300 cost of clearing fallen trees and vegetation following the 22 July 2016 storm event. 3. 4. Grant Applications in Progress and Current Grant Opportunities a) Sports Facilities Development Grant. Grants for this program from The NSW Office of Sport are currently open and close on 11 November 2016. Local Councils are ineligible to apply for this funding. It is proposed that a local sporting group be asked to apply for matched funding of up to $20,000 to purchase portable tiered seating to be used at various sporting locations in Oberon. Oberon Council would supply financial assistance for the project 5. Grant Project Implementation a) Safer Streets Program CCTV Cameras. A stakeholder meeting was held to identify final locations for the upgraded CCTV network in the main street. Due to technical issues in extending the network to cover Cook Park and the section of Oberon Street west of Fleming Street including the Oberon Medical Centre the plans for this project are being revised. Advances in camera technology since the original Safer Streets Program application was made provides Council with new options for this project. Council has requested new quotes from two security companies in Bathurst. b) Green Army. Council’s Green Army project involving willow clearing, revegetation work and other conservation works on Council managed reserves will commence in late November 2016. Skillset are now in the process of recruiting participants aged between 17-24, including Indigenous Australians, school leavers, gap year students and job seekers. Participants are paid a trainee allowance based on their age and are provided with training in first aid and Certificate 2 level training in various topics related to environmental projects. A minimum of 4 participants are required to run the project. Skillset will hold an information day at Oberon High School. Anyone who would like more information about the project or how to apply should contact Skillset in Bathurst. Potential participants can also complete an online application at the following link: http://campbellpage.com.au/green-army/. As project hosts Oberon Council are not involved in the recruitment, training or supervision of the Green Army team. Council’s Grants Officer is currently preparing a work schedule for a number of sites along the Fish River, including at Hassall Park O’Connell, Flat Rock on Mutton Falls Rd and Kings Stockyard Creek off Shakespeare Close. Participants will also be assisting with the Local Government Taking Action to Protect Ecosystems project for Bathurst Regional Council.

Note: Oberon Dam level was reported at 100% on Monday 3 Oct, and currently remains at 100% Top Water Level (TWL). The dam level was reported at 75mm above Full Storage Level (FSL), causing the dam to disperse water over the spill way. When the dam commenced spilling water over the wall , the spill-rate and gauged water catchment inflow was estimated at 500 ML/d, as reported by WaterNSW. 2. 3. WATER & SEWERAGE COMPLAINTS No reports of discoloured drinking water, water odour or taste issues logged in Council’s complaints system during the month of September 2016. There were no reports of faults with the sewerage reticulation system during the month of September. 4. Total Waste Water volume into Oberon STP during September was 76,407kL. This was an increase of 17,603kL during August.

5. PLANT FAULTS Water Treatment Plant Water Treatment Plant Operators have reported a fault with the back wash dosing pump which has now been replaced with a new pump. The raw water pump from the Oberon Dam failed to operate during the 3rd week of September, the replacement of an auto drive system and pump reset resolved the issue. Waste Water Treatment Plant A faulty thermostat was replaced in the water heaters for the digesters at the Treatment Plant during September. 6. PLANT UPGRADES AND MAINTENANCE Water Treatment Plant: New replacement parts have been installed to fix the inlet outlet filling pipes on the Hypochlorite tanks. Upgrades to the existing analogue telemetry system between Oberon Dam and Water Treatment plant with a new digital Wi-Fi telemetry service will be completed during October. The sedimentation drying beds are currently being renewed with new equipment, the old filtration geo-tubes and full bladder have been removed from site. Quotations are currently being sought for the upgrade and or the total replacement of the 16 year old water aerator motors. Proactive maintenance requirements indicate that the units are due for replacement, notably a bearing noise has been detected. Waste Water Treatment Plant: Several Inlet Valves to the Waster Water Treatment Plant have been replaced as preventative maintenance scheduling. Proactive maintenance to the Sewerage Treatment Plant ‘Screen Machine’. Works have been carried out, including the replacement of brushes that assist with the removal of foreign objects. Pump Stations All pumps stations have been checked and are running satisfactorily.

Summary In accordance with Clause 241 of the Local Government (General) Regulations 2005 business may be transacted at a meeting of Council even though due notice of the business has not been given to the Councillors. However, this can happen only if:
