4.b Consider recommending appointment of Elaheh Esfahanian as an alternate for California Water Service, and George Thomas Merrifield as Chevron's primary representative and Andrea Bailey as Chevron's alternate representative The Committee voted to approve the appointments as recommended.

4.c Receive report on status of the USGS Salinas Valley Integrated Hydrologic Model and Salinas Valley Operational Model for use in Subbasin Planning and 180/400-Foot Aquifer Groundwater Sustainability Plan Update, and conduct discussion and provide guidance on use of the models for 2022 Groundwater Sustainability Plan development and 180/400-Foot Aquifer GSP updates Derrik Williams presented a PowerPoint presentation and answered Committee members’ questions. Tom Virsik stated the gold standard would be an independent run of the model. Heather Lukacs believes it is a requirement of SGMA, the Brown Act and good practices to make information available. In response to Ms. Lukacs, Mr. Williams stated that this was the best approach when considering alternatives. Robin Lee would like timelines for monitoring wells. In response to Eric Tynan, Mr. Williams stated that the model would not change based on the Board of Supervisors’ action on the deep aquifer moratorium, but could change what future conditions look like. There was no vote on this item.

4.d Receive report from from staff on Seawater Intrusion Working Group and review actions by Monterey County Board of Supervisors and Monterey County Water Resources Agency on Deep Aquifer Well Moratorium Ordinance No. 5303 Gary Petersen presented a PowerPoint. Les Girard stated that this group would not be subject to the Brown Act because it is being formed by staff. Norm Groot stated that farm owners and land owners should be included in stakeholder involvement. Nancy Isakson stated landowners from other areas of the Valley should also be included. Abby Taylor Silva stated that landowners should have a voice, especially those who have been actively engaged and own multiple acres. Tom Virsik stated the SWIG scope could include not only regulations and projects but could look at CSIP experience, regulations, and benefits. There was no action.

5. General Manager's Report Donna Meyers reported that the Bord extended the application deadline for the Subbasin

Committees for two weeks, with emphasized outreach for the Langley Subbasin. 6. Committee Members' Reports Dallas Tubbs expressed appreciation for the Committee’s work and wished continued success following his and Jeff Johnson’s retirement. 7. SUBJECT: 180/400 Aquifer Subbasin GSP Public Comment Summary Document

RECOMMENDATION: Review Summary Report and Provide Comments to Staff

BACKGROUND:

The process for developing the Groundwater Sustainability Plan (GSP) for the 180/400 Foot Aquifer included multiple opportunities for stakeholders to provide public comment. These comment opportunities were provided on a chapter by chapter basis as well as through a comment period allowed for the entire plan. Multiple channels for comments were provided both electronically and in person.

The result of the comment period were over 700 pages of comments being submitted.

Following submittal of the GSP to the Department of Water Resources another ninety-day comment period was provided allowing any interested parties to provide comments on the overall plan. Related to Covid-19 issues the comment period was extended to ensure that adequate time was provided for all interested parties to submit comments.

Twelve letters were received by DWR within the designated timeline.

DISCUSSION:

During the approval process of the GSP significant concern was expressed by members of the GSA Board and multiple stakeholders regarding the management of the high volume of public comments provided.

Staff confirmed that going forward they would begin to analyze and summarize the public input on the 180/400 Aquifer Subbasin GSP so that it could be used as a tool to organize and explore future plan changes in 2022 and help guide other subbasin planning efforts underway.

Staff also determined that letters submitted to DWR should also be studied and summarized so that a complete set of summarized comments could be developed.

Staff has been working with the comment data since the plan was approved and found that analyzing and summarizing “quantitative” data was an effort that required outside expertise to complete. Additionally, the area of “quantitative” data analysis is an area of limited expertise and required an extensive search to find a consultant willing to take on this project.

Attached to this report is a draft of the summary that has been produced as our first “high-level” effort to summarize, analyze and quantify the public comment information provided as part of our planning process.

In order to arrive at the summary and analysis a variety of word search algorithms were used as well as efforts to sort information into similar ideas and concepts.

Working with the consultant, staff agreed that the information should be sorted in three ways. The first is a chapter by chapter summary analysis of comments. This is followed by a sort and analysis of all information categorized as it relates to sustainable management criteria. The final summary looks at letters received by DWR sorted by topic area.

It is important to understand that this document is a draft summary designed to provide guidance in developing new plans and altering the 180/400 Aquifer Subbasin GSP as necessary. It is also important to understand that this document is a summary of the complete set of comments. The complete set of comments will be retained as the official record.

FISCAL IMPACT: The beginning cost of this information analysis is $2500. Expansion or adjustment of this report will increase costs. All costs are absorbed in the GSA budget and will be used as matching funds for planning grants.

BACKGROUND:At the approval of the 180/400 Aquifer Subbasin Groundwater Sustainability Plan (GSP) in January 2020, the SVBGSA Board expressed an interest in understanding more about Disadvantaged Communities (DAC) experiences as stakeholders in the Basin and utilizing GSPs to better understand groundwater conditions in the Basin affecting these communities.Following extensive written comments filed by stakeholders on the 180/400 GSP regarding documentation of water quality conditions in DACs as well as location of DAC drinking water systems, staff develop Appendix E11 to document DAC locations geographically throughout the Salinas Valley Groundwater Basin. Appendix E11 also presents information on domestic well water quality as compiled by the Central Coast Groundwater Coalition using the State Water Board’s Groundwater Ambient Monitoring and Assessment (GAMA) Groundwater Information System. Finally, Appendix 11E provides discussion of conditions related to water quality in DAC communities and provides maps of both seawater intrusion and nitrate concentrations in relation to DAC community locations.

Information in Appendix 11E was largely excerpted from the Integrated Regional Water Management Plan for the Greater Monterey County Region completed in 2018. That report, entitled Integrated Plan to Address Drinking Water and Wastewater Needs of Disadvantaged Communities in the Salinas Valley and Greater Monterey County IRWM Region, identified 25 small disadvantaged, severely disadvantaged, and suspected disadvantaged communities in unincorporated areas in the IRWM region which includes the entire SVBGSA area.

During the development of Appendix 11E and after meeting with stakeholders regarding DAC comments, staff and SVBGSA consultant Montgomery and Associates updated DAC mapping in the 180/400 Subbasin GSP and conducted further analysis of DACs within the Basin. As a result of this work, Staff made the decision to include a request in the Proposition 68 Planning Grant for a dedicated task to develop a Strategic Engagement effort with DACs regarding SGMA and GSP development throughout the Basin. That was approved by DWR in the grant and staff has contracted with Gina Bartlett with Consensus Building Institute (CBI) to assist SVBGSA with this work over the next six months. 19

DISCUSSION:

Staff seeks feedback from the Advisory Committee on activities for strategic engagement with DACs. One focus of DAC comments on the 180/400 Subbasin GSP is domestic well water quality. A report produced by Stanford University Water in the West Center entitled A Guide to Water Quality Requirements Under the Sustainable Groundwater Management Act, provides a good outline for the consideration of how GSPs fit into the overall regulatory framework for groundwater quality and provides some key steps for GSAs to consider when developing a meaningful relationship with DACs concerned with water quality and domestic wells.

An outline of suggested actions included in the Stanford report includes the following:

Understand and monitor the existing regulatory regime for groundwater quality in the Basin.

Consider existing federal, state and local groundwater standards when developing groundwater quality thresholds in the Basin.

Work closely with the Regional Water Quality Control Board to address all groundwater quality issues including Region 3 Irrigated Lands Program which also encompasses monitoring.

Use existing water quality data and information and evaluate additional needs.

In general, SVBGSA is already conducting these activities, however, a more intentional engagement with DACs around these activities and possibly others will be useful to build a productive and programmatic approach to engage with DACs as an essential stakeholder in the Basin. Success as a GSA includes all beneficial users and while roles are clearly defined in state and federal law regarding water quality, SVBGSA can be a valued partner for DACs in the region on other identified concerns and information needs. The local management and technical focus requirements embedded in SGMA provide a platform to have a constructive conversation with DAC stakeholders. Staff will present possible pathways of engagement for Advisory Committee feedback and discussion. This feedback will be provided to CBI for incorporation into the first phase of their work which will ultimately be presented to the SVBGSA Board of Directors.
