Disaster Recovery Purchasing (Section 833)

Disaster Recovery Purchasing makes all GSA Multiple Award Schedules availableto all state and local governments to enable them to respond and assist in therecovery from a disaster.

State and local governmental entities may use GSA Schedule contracts topurchase products and services in advance of a major disaster declared by thepresident, as well as in the aftermath of an emergency event. State and localgovernmental entities are responsible for ensuring that the products or servicespurchased are to be used to facilitate recovery.

This is a voluntary program for Schedule contract holders and state and localgovernments.

All GSA Multiple Award Schedule contracts are open to state and localgovernment agencies for the specific purpose of disaster recovery only.

Contractors under this SIN are available tohelp you promote public awareness of youragency’s mission and initiatives, enable publicunderstanding of complex technical and socialissues, and disseminate information toindustry and consumer advocacy groups.

Typical tasks cover the full spectrum of anadvertising campaign, and include:

Advertising objective determination:

Identify the direct objectives anddevelop strategies for conducting the advertising campaign in order toprovide the best methods of publiceducation. Typical tasks associated withthis phase include the identification ofthe target market, the target responseand target frequency to align withavailable budget.

Message decision/creation:

Develop the advertising message andcorresponding brochures/ collateralmaterials to accomplish the advertisingobjectives

Media development and selection:

Conduct market research to identify theappropriate media vehicle (print, radio,television, etc.) to promote the agency’smessage. These services includeproviding recommendations as to the best mix, frequency of advertisingand vehicles to track performance of advertising, and then acquiring the necessary media spots (radio,television, print, etc.) in order to place

the agency’s advertising campaign.Some examples of the types of mediathat may be considered include, but are not limited to:

Success Story: A large agency used this SIN to develop a new media plan. Included in the plan wererecommendations on which media to utilize (i.e. direct mail, print advertising or web banneradvertising). Once the agency examined thecontractor’s recommendations and made a final decision on the proposed media plan, thecontractor developed a new advertising conceptthat aligned with the agency’s current brandinginitiative and progressed from its formeradvertising campaign. The contractor alsorecommended various avenues to track theawareness of the campaign by creating adspecific web addresses and phone numbers. Theend result was an effective advertising conceptplaced in various media that generated a largeinterest (based on phone calls andweb hits).

GSA e-Buy, an Electronic Wayto Order Services

e-Buy, a component of GSA Advantage!®, is anonline Request for Quote (RFQ) tool designedto facilitate the request for submission of quotes for a wide range of commercialservices and products that are offered by GSA Multiple Award Schedule contractorswho are on GSA Advantage!®.e-Buy allows federal agencies (buyers) tomaximize their buying power by leveraging the power of the Internet to increase schedulecontractor participation in order to obtainquotes which will result in a best valuepurchase decision. e-Buy provides agencieswith a tool that will result in savings in bothtime and money.

Using the e-Buy system, buyers may prepareand post an RFQ for specific services andproducts for a designated period of time. Each RFQ is assigned to a GSA Multiple AwardSchedule, Special Item Number (SIN) categoryby the buyer.

The category assignment determines whichsellers may receive the e-mail notice to quote.Sellers are automatically listed under theirawarded SIN categories. Buyers may notify allsellers listed under a particular SIN categoryor may choose to notify a lesser number ofsellers. (FAR 8.4 and the Ordering Proceduresfor Services Requiring a Statement of Workstipulate that buyers must submit their RFQ tothree or more sellers for purchases over themicro-purchase threshold.) Sellers not notifiedmay still submit a quote for an RFQ placedunder their awarded SIN.

Contractors who wish to quote must do so at the e-Buy website. Only those contractors who have submitted their catalogs for inclusionin GSA Advantage!® will have an opportunity toparticipate in e-Buy and receive requests for quotes.

Once an RFQ has closed, buyers may thenevaluate and accept the quote that representsthe best value. Buyers may then issue an orderto any contractor whose quote was accepted.To visit GSA e-Buy, go to www.gsa.gov/ebuy

Total Solutions throughContractor TeamingArrangements

For complex tasks, Contractor TeamingArrangements (CTAs) may be desirable fromboth a government and industry perspective. A Contractor Teaming Arrangement allows two or more GSA schedule contractors to work together to meet agency requirements,allowing them to compete for orders for whichthey may not qualify independently.

Contractors on the same schedule or acrossmultiple schedules can team. By using CTAs,contractors can complement each other’sunique capabilities while offering governmentagencies the best turnkey solutions based on acombination of performance, cost and deliveryof acquired services. You can benefit fromusing CTAs by buying a solution rather than making separate buys from variouscontractors. See FAR 9.6 for more informationor visit www.gsa.gov/schedules.

Contractors can provide you with customizedmedia and public relations services such as: development of media messages andstrategies; recommendations of media sourcesfor placement of campaigns; preparation ofmedia materials such as background materials,press releases, speeches, presentations andpress kits; and execution of media programssuch as press conferences, distribution ofpress materials and management of broadcastand print interviews.

Typical tasks include:

Media training: training of agency personnelto deal with media and media responses

Success Story: A small federal agency realized it had a need for the creation of a video news releasecampaign to publicize a new exhibition openinglater that year. After researching differentprocurement methods, the agency opted to use SIN 541-2 to meet its public relations needs. The agency researched different vendorsand awarded the task order to a small firm. The scope of the work included: developing,producing and distributing a video news releaseto television stations across the United States;developing news feed press releases with aneditorial focus; conducting telephone campaignsto solicit interest before and after the exhibitopening and submission of a comprehensivemarket analysis report of nationwide storyplacement based on survey demographics.

SIN 541-3Web-Based Marketing Services(Small Business Set-Aside)

You can use schedule contractors to developstrategies to maximize the use of your Internetcapabilities. Media will be provided in a formatthat is compatible with your agency’s softwarerequirements. Continual website updates andmaintenance are also available.

The goal of therequirement was to successfully recruitstudents into the agency using web-basedmarketing and communications. In order tosuccessfully complete the task, the federalagency contracted with a leading higher-education marketing and communications firm.The firm first developed a branding image usedto market the agency. Then they incorporatedthe new agency image into the websitedevelopment, online admissions processing,sales training for employees and a direct e-mail campaign.

(10) The terms and conditions included in this BPA apply to all purchases made pursuant to it. In the event of an inconsistencybetween the provisions of this BPA and the Contractor’s invoice, the provisions of this BPA will take precedence.

Small Business Means Big Business

The General Services Administration and theSmall Business Administration (SBA) stronglysupport the participation of small businessconcerns in the Multiple Award Schedulesprogram. To enhance small businessparticipation, SBA policy requires agencies toinclude in their procurement base and goalsthe dollar value of orders expected to beplaced against the Multiple Award Schedules,and to report accomplishments against thesegoals. This information should be used as a tool to assist ordering activities in meeting or exceeding established smallbusiness goals. Blanket Purchase Agreements

If you are dealing with repetitive buys, BlanketPurchase Agreements (BPAs) are for you!

A BPA is a simplified method of fillingrecurring needs for services and products,while leveraging your buying power by takingadvantage of quantity discounts, savingadministrative time and reducing paperwork.Think of the BPA as an “account” establishedbetween you (the customer) and a schedulecontractor. By setting up a BPA, you save time and resources. Simplify your ordering byprocessing a BPA once and then use it as youragency’s needs occur.

With an MAS BPA, you can order as little asyou want, as much as you want, and as oftenas you want. You are not restricted by anydollar limitations when placing orders under anMAS BPA. A BPA can be set up for your fieldoffices across the nation to use, thus allowingthem to participate in your BPA and placeorders directly with schedule contractors. Bydoing so, your entire agency reaps the benefitsof additional discounts negotiated into your own BPA.

A BPA cannot exceed the contractor’sschedule contract period. You should alwaysperform an annual review of your BPA todetermine whether it is still a “best value.”Agencies can locate the guidelines for establishing a BPA in the section titled“Placing Your Order” on page 10. Under this SIN, you will find assistanceconceptualizing, designing, and producingexhibits and their accompanying materials,including making all necessary arrangementsfor exhibits in various venues (museums, malls,tradeshows, etc.). Media and Exhibit Illuminationservices are also available. Support servicesmay include:

Set-up and dismantling of exhibit property

Shipping and storage of exhibit property

Success Story: A national museum needed to develop a welcomecenter exhibit with a lighting and sound conceptto greet visitors as they entered the museum. Themuseum used SIN 541-4C to contract with anexhibit design firm to produce the results theyneeded. The firm worked to develop a wall of large High Definition (HD) projection displays as the focal point. The firm then researched andutilized various iconic images that representedthe purpose of the museum and includeddifferent languages that said “welcome” to bebroadcast through the projection display. Theresult was a spectacular and high-tech way towelcome visitors to the museum.

Success Story: A prominent agency program office neededconference planning services. The agency optedto use SIN 541-4D to raise public awareness oftheir mission, services and challenges through a conference setting. The requirement wascompeted among several of the contractorsunder this SIN and awarded to a woman-ownedsmall business firm. The firm was tasked withusing a measured approach to research potentialconference locations, conduct market researchand perform media analysis to assist the agencywith making pre-event, on-site and post-eventdecisions. Throughout the process of planningfor the conference, the firm’s staff wasresponsible for branding the event to potentialattendees through print media such as posters,newsletters, newspaper and trade journaladvertisements and brochures. Although GSA has made the determinationthat the price awarded on a service schedule is a fair and reasonable one, GSA has notdetermined that the level of effort or mix oflabor proposed in response to any specificrequirement is in itself, fair and reasonable.When buying services that require a statementof work, only you can make a determinationthat the task or delivery order price isreasonable and represents best value.

It is a proven best practice that orderingoffices should seek additional pricereductions/increased discounts and/orconcessions when placing an order under aGSA Multiple Award Schedule (MAS) contract.Contractors will often “sharpen their pencils”to obtain a large MAS contract order. GSAMAS contractors are not required to pass on toall MAS users a price reduction extended onlyto an individual customer for a specific order.

You are encouraged to seek further pricereductions as requirements may warrant! Pricereductions allow agencies to take advantage ofthe flexible and dynamic commercial market-pricing environment that is the hallmark ofMAS. When you ask for price reductions, it canmaximize your use of MAS by taking advantageof competitive forces, technological changes,labor conditions, supply and demand, industrysales goals, inventory reductions and more!

The ability to seek additional price reductionsand concessions allows the government to notonly leverage its combined requirement toobtain favorable terms, conditions, and pricing,but to also leverage agency requirements thattake advantage of quantity or spot discountsavailable in a fluid, commercial pricingatmosphere!

Reasons to seek price reductions includeinstances where you have determined that a service or product is available elsewhere at a lower price, or when establishing blanketpurchase agreements (BPAs) to fill recurringrequirements. BPAs offer an easy-to-use,flexible purchasing option that allows you totake advantage of quantity discounts, saveadministrative time and reduce paperwork. The potential volume of orders under BPAsoffers the opportunity to secure pricereductions/increased discounts, regardless of the size of individual orders. If you areinterested in setting up a BPA with a GSAMultiple Award Schedule contractor, take a look at our suggested BPA format on page 17for guidance.

While ordering offices are encouraged to seekprice reductions for any size MAS contractorder, they are required to seek pricereductions if a requirement exceeds a MAScontract’s maximum order (MO) threshold. The MO under a GSA MAS contract is thedollar value threshold at which the orderingoffice must seek additional price reductions forits requirement. The MO threshold varies fromschedule to schedule and sometimes evenfrom SIN to SIN. The MO threshold for theAIMS schedule is $1,000,000 per SIN. Inaddition, the MO threshold is listed in everyGSA MAS contractor’s price list and in GSAAdvantage!®. In response to the orderingoffice’s request for a price reduction, thecontractor may offer a lower price, offer thecurrent schedule contract price, or decline the order. If further price reductions are not offered, the order may still be placed if the ordering office determines that it isappropriate, since GSA has already determinedthe contract prices to be fair and reasonable.

The Multiple Award Schedule(MAS)

An MAS, also known as a Federal Supplyschedule or GSA schedule, is one of the mostpowerful procurement tools available. It isessentially a listing of awarded contractorsthat can be used by all federal entities to achieve their missions. GSA awardscontracts to responsible companies that offercommercial items falling within the generaldescriptions of the schedules. ContractingOfficers determine that prices are fair and reasonable by comparing the prices or discounts that a company offers the

government with the prices ordiscounts that the company

offers to its commercialcustomers. Thisnegotiation objective is commonly known

as “most favoredcustomer” pricing.

You and other interestedordering agencies simply

develop a task order requestoutlining the scope of work

to be performed and inviteschedule contractors to respondwith a quote. The contractors’responses are usually split into two parts: technical and price.

Ordering agencies thendetermine which

contractor is the bestvalue (see “Placing

Your Order” on page10).

It’s That Easy

The MAS program mirrors commercial buyingpractices more than any other procurementprocess in the federal government. GSAprovides customers access to professionalservices at volume discount pricing on a directdelivery basis. This means you’ll experienceshorter procurement lead-times, loweradministrative costs, and reduced internalstaff hours devoted to obtaining theseservices. The MAS program was designed withyou and all our federal customers in mind. Itprovides a vast array of commercial items andservices that can be purchased quickly andeasily. Not only does your agency receive fast,direct access to industry leaders in the area of advertising and marketing services, but you can also obtain many other services andproducts through other schedules as well.

When placing orders under an MAS, you do not need to synopsize your requirements, setaside for small business, or make a separatedetermination of fair and reasonable pricing.GSA has already complied with theserequirements and determined that prices arefair and reasonable. By utilizing our schedules,you can avoid the stress and work normallyassociated with conducting your ownprocurement.

Using GSA Schedules Is Simple

contractors for consideration or competitionfor award of an order or BPA. At aminimum, ordering activities shouldconsider, if available, at least one smallbusiness, veteran-owned small business,service disabled veteran-owned smallbusiness, HUBZone small business, women-owned small business, or smalldisadvantaged business Schedulecontractor (FAR 8.405-5). GSAAdvantage!® and Schedules e-Librarycontain information on small businessrepresentations of Schedule contractors.

1. Single or Multiple BPAs: BPAs may beestablished with one or more Schedulecontractors. The number of BPAs to beestablished is within the discretion ofthe ordering activity establishing theBPAs and should be based on astrategy that is expected to maximizethe effectiveness of the BPAs (FAR8.405-3). In determining how many BPAsto establish, consider —

• The scope and complexity of therequirements;

• The need to periodically comparemultiple technical approaches orprices;

• The administrative costs of BPAs;and

• The technical qualifications of theSchedule contractors.

BPAs shall address the frequency ofordering, invoicing, discounts,requirements (e.g., estimatedquantities, work to be performed),delivery locations, and time. Whenestablishing multiple BPAs, the orderingactivity shall also specify theprocedures for placing orders under theBPAs.

2. Duration of BPAs: A GSA ScheduleBPA should not exceed five years inlength, but may do so to meet programrequirements (FAR 8.405-3(c)). ASchedule contractor may be awarded aBPA that extends beyond the currentterm of its GSA Schedule contract, so

long as there are option periods in theGSA Schedule contract that, ifexercised, will cover the BPA's periodof performance. An ordering activitythat establishes a BPA shall conduct anannual review to determine whether —

• The underlying Schedule contractis still in effect;

• The BPA still represents the bestvalue; and

• Estimated quantities/amounts havebeen exceeded and additional pricereductions can be obtained.

The ordering activity shall documentthe results of its review (FAR 8.405-3(d)(2)).

C.DocumentationAt a minimum, the ordering activity shalldocument:

• The Schedule contracts considered,noting the contractor from whichthe service was purchased;

• A description of the servicepurchased;

• The amount paid;

• If applicable, the circumstances andrationale for restrictingconsideration of Schedulecontractors to fewer than requiredin these ordering procedures (seeFAR 8.405-6);

• The evaluation methodology used inselecting the contractor to receivethe order;

• The rationale for any tradeoffs inmaking the selection;

• The fair and reasonable pricedetermination; and

• If applicable, the rationale for usingother than a firm-fixed price orderor a performance-based order.

the SOW. Note: Each Schedulecontractor has a maximum orderthreshold, which will vary by specialitem number. The maximum orderthreshold represents the pointwhere, given the dollar value of thepotential order, the ordering activityshall seek a price reduction.

b.) Orders exceeding the maximumorder threshold or when establishinga BPA. In addition to meeting therequirements, above, for ordersexceeding the micro-purchasethreshold, but not exceeding themaximum order threshold, theordering activity shall

Provide the RFQ (including the SOWand evaluation criteria) to anappropriate number of additionalSchedule contractors that offerservices that will meet the needs ofthe ordering activity. Whendetermining the appropriate numberof additional Schedule contractors,the ordering activity may considerthe complexity, scope, and estimatedvalue of the requirement, and themarket search results. See pricereductions.

c.) Distribution of the RFQ. Theordering activity shall provide theRFQ (including the SOW and theevaluation criteria) to any Schedule

contractor that requests a copy.

3. Evaluate Responses and Place theOrder or Establish the BPA:The ordering activity shall evaluate allresponses received using the evaluationcriteria in the RFQ. GSA has alreadydetermined that the hourly rates forservices contained in the Schedulecontractor’s pricelist are fair andreasonable. However, the ordering activityis responsible for considering the level ofeffort and the mix of labor proposed toperform a specific task being ordered, andfor determining that the total firm-fixedprice or ceiling price is fair and reasonable.The ordering activity should then place theorder, or establish the BPA, with theSchedule contractor that represents thebest value (see FAR 8.404(d). After award,the ordering activity should provide timelynotification to unsuccessful offerors. If anunsuccessful offeror requests informationon an award that was based on factorsother than price alone, a brief explanationof the basis for the award shall be provided.

B. Blanket Purchase AgreementsThe establishment of GSA Multiple AwardSchedule Blanket Purchase Agreements(BPAs) for recurring services is permittedwhen the procedures outlined herein are asfollows: BPAs under the GSA SchedulesProgram are established using GSASchedule ordering procedures; i.e., theOrdering Procedures for Supplies, andServices Not Requiring a Statement of Work(SOW) (FAR 8.405-1) or the OrderingProcedures for Services Requiring aStatement of Work (SOW) (FAR 8.405-2) An

GSA has determined that the prices forservices contained in the contractor’s price list applicable to this schedule are fair andreasonable. However, the ordering office usingthis contract is responsible for considering thelevel of effort and mix of labor proposed toperform a specific task being ordered and formaking a determination that the total firm-fixedprice or ceiling price is fair and reasonable. Foradditional guidance, review the “A Word aboutPrice” section on page 15.

A. When ordering services, ordering offices shall—

1. Prepare a Request (Request forQuote or other communicationtool):a.) A Statement of Work – To the

maximum extent practicable,agency requirements shall beperformance-based statements. AllSOWs shall include the work to beperformed, the location of the work,the period of performance, thedeliverable schedule, the applicableperformance standards, and anyspecial requirements (e.g., securityclearances, travel, and specialknowledge).

b.) The evaluation criteria (e.g. projectplan for performing the task, price,experience, and past performance).A firm-fixed price order shall berequested; unless the orderingactivity makes a determination thatit is not possible at the time ofplacing the order to estimateaccurately the extent or duration ofthe work or to anticipate cost withany reasonable degree ofconfidence. When such adetermination is made, a labor-houror time-and-materials quotationmay be requested. The firm-fixedprice of the order should alsoinclude any travel costs or otherdirect charges related toperformance of the servicesordered, unless the order providesfor reimbursement of travel costs atthe rates provided in the Federal

Travel or Joint Travel Regulations.A ceiling price must be establishedfor labor-hour and time-and-materials orders. Orderingactivities may considersocioeconomic status whenidentifying contractors forconsideration or competition foraward of an order or a BlanketPurchase Agreement (BPA). At aminimum, ordering activities shouldconsider, if available, at least onesmall business, veteran-ownedsmall business, service disabledveteran-owned small business,HUBZone small business, women-owned small business, or smalldisadvantaged business Schedulecontractor. GSA Advantage!® andSchedules e-Library containinformation on small businessrepresentations of Schedulecontractors.

c.) A requirement for pricinginformation that ties the offeredprices to the Schedule contractprices and seeks additional pricereductions where appropriate.

2. Transmit the RFQ to GSASchedule Contractors:Based upon an initial evaluation ofcatalogs and price lists, the orderingoffice should identify the contractorsthat appear to offer the best value(considering the scope of servicesoffered, pricing and other factors suchas contractors’ locations, asappropriate).

a.) Orders exceeding the micro-purchase threshold, but notexceeding the maximum orderthreshold. The ordering activityshall provide the RFQ (including theSOW and evaluation criteria) to atleast three Schedule contractorsthat offer services that meet theagency’s needs. The orderingactivity should request thatcontractors submit firm-fixed pricesto perform the services identified in

Authorized Users

Agencies and activities named below may usecontracts established under GSA’s MultipleAward Schedules:

All federal agencies and activities in theexecutive, legislative and judicial branches;

Mixed ownership government corporations(as defined in the Government CorporationControl Act);

The government of the District of Columbia;

Government contractors authorized inwriting by a federal agency pursuant to 48 CFR 51.1; and

Other activities and organizationsauthorized by statute or regulation to use GSA as a source of supply.

1) Domestic, which covers the 48 contiguousstates; Washington, DC; Alaska; Hawaii and Puerto Rico

2) Overseas only, which covers overseasdestinations other than Alaska, Hawaii and Puerto Rico, and

3) Worldwide, which covers deliverydomestically AND overseas.

Placing Your Order

FAR 8.403(b) contemplates that GSA mayestablish special ordering procedures forindividual GSA Multiple Award Schedules orfor some Special Item Numbers (SINs) within a schedule. In the case of a conflict betweenthese special ordering procedures and FAR8.405 prescribed procedures, these specialordering procedures take precedence over theprocedures at FAR 8.405. FAR 8.405-2 providesordering procedures for services that require astatement of work.

The contracting officer, when placing an orderor establishing a BPA, is responsible for applyingthe regulatory and statutory requirementsapplicable to the agency for which the order isplaced or the BPA is established. The requiringagency shall provide the information on the applicable regulatory and statutoryrequirements to the contracting officerresponsible for placing the order. FAR 8.404(b)

In particular, when ordering services over$100,000, Department of Defense (DoD)ordering offices and non-DoD agencies placingorders on behalf of DoD must follow thepolicies and procedures in the Defense FederalAcquisition Regulation Supplement (DFARS)208.404-70 – Additional ordering procedures forservices. When DFARS 208.404-70 is applicableand there is a conflict between the orderingprocedures contained in this clause and theadditional ordering procedures for services inDFARS 208.404-70, the DFARS procedures takeprecedence.
