At the time of penning this message, the Government had just announced the three-phased resumption of activities and reopening of the nation’s economy.

The financial impact brought about by the COVID-19 pandemic is felt deeply at the Club. Since March, F&B outlets and facilities had been progressively ordered to shutter, culminating with a full Club closure on 7 April. The Club saw a sharp dip in operating performance during this period—our loss in revenue in April and May alone was an estimated $3 million.

The Management Committee has prepared for this downturn and planned for its recovery to meet both immediate and longer-term needs with the aim to survive the transition into the future.

The Finance Review Committee (FRC), formed last year to help the Club develop a long-term and forward-looking strategy to stem the financial deficit and build financial sustainability, has provided the Management Committee with useful inputs for our ongoing discussion and fine-tuning.

Among these is a recommendation to capitalise on and lease the Club’s under-utilised spaces to bring in additional income, which can be considerably substantial. We will be evaluating some business proposals and will present to members a plan for discussion when ready.

FRC has also advised promoting GIRO as a mode of payment to members. Those who use credit cards for their bills may have to pay the administrative fees that accompany payments using credit cards. The Club has been absorbing this expense, which amounts to about $180,000 every year.

In the midst of this pandemic, the Club Management continues to take steps to contain costs. For example, it has re-negotiated contract terms with vendors and suppliers, which gave a saving of $110,000 in the months of April and May.

The Club Management is discussing with workers’ union to look into pay-cut matters. It is also applying to the Singapore National Employers Federation for a grant to engage a consultancy to study the jobs at the Club in order to collapse multiple job roles into fewer, thereby resulting in a leaner workforce.

To the same end, the new Club Management IT System, which integrates a few of existing archaic standalone systems, will streamline some of the complex work processes and automate certain manual tasks currently undertaken by staff to drive efficiency across the business. This new system, requiring no initial capital outlay in its development, will be launched soon.

The Club is making preparations to resume business once we receive the go-ahead from the authorities to do so and I hope to see all of you at the Club when it reopens. Meanwhile, I wish all members good health. Hold firm, take courage and stand strong!

THE GOOD, THE BAD AND THE UGLYDifficult times and crises such as the current COVID-19 pandemic bring out the best and worst in a person. Fighting the good fight against an unfathomable and invisible enemy is already tough. It can be made all the more difficult when people behave in a self-serving manner out of fear and anxiety, revealing their true characters.

During this trying time, many Singaporeans conscientiously adhere to the various measures implemented by the Government. They stay home and only head out for essential services.

Unfortunately, where there is good, bad is lurking not far behind. There are a handful who are socially irresponsible and adopt an “I will do what I want, when I want, where I want” attitude, potentially endangering the lives of the people they come into contact with. You would have read in the news of Singaporeans flouting circuit breaker measures such as gathering with their friends and abusing Social Distancing Ambassadors who were simply doing their jobs. One such safe distance enforcement officer was even stabbed in his line of duty!

In times like these, there is always no lack of armchair critics who are having a heyday on social media playing to the gallery. They seem to have a solution to every problem but hindsight is always 20/20 of course. The ugliness of it all is that they would, in the process, tear down every piece of good work that has been rendered by the incumbents.

Before DORSCON Orange was announced, two members were drinking at Cabana and I overheard one of them trying to convince the other that the Club was “dead” and lacking in activities. The second member, who thankfully was still sober despite having downed several glasses of liquor, was visibly irate, defended the Club and refuted the other’s words as he rattled off a string of recent events that were well attended by members. Choosing to spread untruths to undo whatever good that has been done is detrimental to the Club. These talks are the very root of fake news and rumours. We must save the Club from such.

When the Club reopens, I hope that every member can comply with all the safe management measures imposed by the Government, including putting on masks, checking in and checking out, and observing safe distancing. Our staff are duty-bound to ensure that these measures are strictly observed during this extraordinary time.

We need to be in solidarity during this time. We want to make our Club a safe place for everyone but the staff can only do so much. Comrades, we look forward to your support, cooperation and understanding as we continue to fight this insidious enemy. Let us keep our spirits up and press on!

F&B Vouchers for Unavailability of Club Facilities During Circuit Breaker PeriodAs a one-off gesture of goodwill to members for the unavailability of Club facilities during the circuit breaker period, each principal account holder would have received a F&B voucher ($50 for two-person accounts and $30 for one-person accounts).

The voucher is enclosed with a copy of a letter by the Club President Mr Yeo Chui Hee dated 4 May, which everyone would have received by mail as of now.

The Club had deliberated on the waiver of the subscription fees for April and May and decided that we are not in a financial position to do so.

Club ClosureIn light of the Government’s announcement on 19 May on

the three-phase approach of resuming business activities

Postponement of AGM 2020 With reference to our letter of 6 April 2020 seeking members’

consent to postpone Annual General Meeting (AGM)

2020, almost all of the membership have agreed to the

postponement.

The Club will therefore monitor the situation and convene the

AGM once it is feasible and practicable to do so, and we will

inform members accordingly.

Extension of Terms of Office of Management Committee (“MC”) Members Until Next Annual General Meeting (AGM) 1) In light of the postponement of AGM 2020 due to the

continuing Circuit Breaker measures and with reference

to the Club’s Notice dated 4 May 2020 confirming the

same, our Club’s lawyers have advised the following:

a) The election of MC members whose terms will be

ending this year will accordingly be deferred until the

AGM can be held,

b) The terms of office of the existing MC members will

continue until the Club is able to hold an election of

MC members during the AGM.

2) The Club will announce details of the AGM in due course.

Members Not to Visit Club if Unwell In view of the escalating COVID-19 pandemic we ask members and their guests not to visit the Club if they are unwell, particularly if they have fever, cough or running nose.

Our staff have been authorised to conduct temperature screening for all members and guests before they enter the Club, and deny anyone with a fever, cough or running nose, entry to the Club. We urge members and guests to remain vigilant and adopt good personal hygiene practices. MOH has advised to adopt the following precautions at all times:

- Avoid contact with live animals including poultry and birds, and consumption of raw and undercooked meats;

- Avoid crowded places and close contact with people who are unwell or showing symptoms of illness;

- Practise frequent hand washing with soap (e.g., before handling food or eating, after going to toilet, or when hands are dirtied by respiratory secretions after coughing or sneezing);

- Wear a mask if you have respiratory symptoms such as a cough or runny nose;

- Cover your mouth with a tissue paper when coughing or sneezing, and dispose the soiled tissue paper in the rubbish bin. Wash your hands immediately;

- Seek medical attention promptly if you are feeling unwell.

DC/OSS 189/2019 Taken Out by Mr Radakrishnan S/O KannusammySomalingam (“Mr Rada”) Against Chairman, Disciplinary Panel

(“DP Chairman”) and Singapore Swimming Club (“the Club”)

Mr Rada took out an Originating Summons (DC/OSS 189/2019) against the DP Chairman and the Club, amongst other assertions, to declare the Complaint null and void and the Club’s disciplinary process be set aside and declared null and void.

Following a Complaint by the DP Chairman, Mr Rada faced disciplinary proceedings for allegedly casting unjustifiable aspersions without any reasonable basis on:

a) the DP Chairman who was empowered under the Club Rules to appoint the Disciplinary Committee (“DC”) to hear a Complaint against a member and

b) the DC appointed to hear the said Complaint.

The DC was fixed for hearing. Before the hearing, Mr Rada decided to commence DC/OSS 189/2019 instead of going through the Club’s disciplinary process as mandated by the Club Rules.

The Club’s lawyers, M/s Wong Partnership, has advised the Club that Mr Rada’s DC/OSS 189/2019 is premature in that Mr Rada failed to go through the disciplinary and appeal process as mandated by the Club Rules before instituting legal proceedings. The Club’s lawyers therefore advised the DP Chairman and the Club to take out the following application:

a) That proceedings against the DP Chairman in DC/OSS 189/2019 be struck out on the grounds that Mr Rada’s claim discloses no reasonable cause of action and/or is scandalous and/or frivolous or vexatious, and/or is otherwise an abuse of process of Court.

b) Alternatively, that all further proceedings in DC/OSS 189/2019 against the DP Chairman be put on hold until Mr Rada complies with the disciplinary and appeal process as mandated by Rules 13 and 14 of the Rules of the Club.

c) That all further proceedings against the Club be put on hold until Mr Rada complies with the disciplinary and appeal process as mandated by Rules 13 and 14 of the Rules of the Club.

A Pre-Trial Conference to fix a hearing date for the aforesaid application has been fixed on 28 February 2020.

We shall keep the members posted of any further development.

DC/OSS 189/2019 Taken Out by Mr Radakrishnan S/O Kannusammy Somalingam (“Mr Rada”) Against Chairman, Disciplinary Panel

(“DP Chairman”) and Singapore Swimming Club (“the Club”)

The appointment of the Disciplinary Committee to hear the Complaint against Mr Rada was made by the Disciplinary Panel Vice Chairman and not the DP Chairman.

It was Mr Rada who sued the Club before he went through the disciplinary and appeal process as stipulated in the Club Rules. The Club did not sue him. The Club therefore had no choice but to defend the action as advised by the Club’s solicitors.

Attorney General’s Chambers’ (“AGC”) Refusal of Consent to Mr Radakrishnan S/O Kannusammy Somalingam (“Mr Rada”)

to Institute Contempt of Court Proceedings Against Singapore Swimming Club (“SSC”) and

the Disciplinary Panel Chairman (“DP Chairman”)

Dear Members

We are pleased to inform that the AGC has, on 17 March 2020, refused to give consent to Mr Rada to institute contempt of court proceedings against the Club and the DP Chairman.

On 27 February 2020, Mr Rada through his solicitors M/s Wong Tan & Molly Lim LLC (“WTML”) sought the AGC’s consent to institute contempt of court proceedings against the Club for publication of a Notice dated 21 January 2020 (“the Notice”). This was despite WongPartnership’s reply to WTML on 30 January 2020 stating the Club’s position that there is no contempt of court as it is the Club’s usual practice to update its members of litigation involving the Club. Besides, the contents of the Notice do not prejudice or interfere with the legal proceedings.

Contempt of Court is an infraction punishable with a fine up to $100,000 or with imprisonment of up to 3 years or with both. Mr Rada’s attempt to initiate contempt proceedings against the Club would have invited unnecessary and adverse publicity for the Club and would not have been in the best interests of the Club. If found guilty of contempt, the Club could also have suffered severe financial consequences.

Rightfully, the AGC has refused to give consent to Mr Rada but the Club has been made to incur unnecessary legal expense.

Unauthorised Circulation of WhatsApp Message by Expelled Member, Mr Eddie Leong Regarding his Expulsion and on the Legal

Proceedings Taken Out by Mr Radakrishnan S/O Kannusammy Somalingam (“Mr Rada”) Against Chairman, Disciplinary Panel

(“DP Chairman”) and Singapore Swimming Club (“the Club”)

It has come to the Club’s attention that an expelled member, Mr Eddie Leong has been circulating the abovementioned WhatsApp message to members. Some recipients have also circulated this same message to other members.

The contents of the circulated message are inaccurate and distorted. The full facts on Mr Eddie Leong’s expulsion can be found in the Club’s Notice of 21 June 2019 on our website in the members’ domain.

The Club wishes to remind members of Club Rule 13(b) which states:

Any circulation of letters, notes or documentation whether in hard copy or in electronic medium which pertain to matters relating to, having to do with or otherwise concerning the Club, its members, Nominees or the conduct of its members or Nominees (“the circulation”) by members or Nominees without the prior written approval of the Management Committee or the General Manager may be subject to disciplinary action. Any unauthorised or unapproved circulation, whether signed or unsigned by a member or Nominee, shall be dealt with strictly by the Management Committee, including the confiscation of all such copies, and members or Nominees who have taken part in the production, issuance, publication and distribution of the circulation may be subject to disciplinary action under Rule 13, Provided Always that this rule shall not be used to prevent any member from circulating a call for an Extra Ordinary General Meeting.

Members who receive such WhatsApp messages should forward the information to the General Manager, who will investigate the matter.

The Events Department organised, for the fi rst ti me, edutainment workshops for kids virtually via Zoom and the parti cipati on was encouraging. Over 35 children spent half a day online, learning how to perform magic tricks, conducti ng science experiments to make their own lava lamps and creati ng a dreamcatcher from recycled materials, and all in the comfort and safety of their homes. They were also treated to a digital magic show by Singapore's one-and-only Golden Buzzer winner at Asia's Got Talent TK Jiang as he enthralled them with various magic tricks.
