Small Business Advantage Grant Program

The Pennsylvania Small Business Advantage Grant Program (AGP) provides 50 percent

reimbursement matching grants, up to $9,500, to enable Pennsylvania small businesses to adopt or acquire equipment or processes that promote Energy Efficiency (E2) or

Pollution Prevention (P2). Eligible projects must save the small business a minimum of $500.00 and at least 25 percent annually in energy consumption or pollution related expenses. Well-designed energy efficiency or pollution prevention projects can

encourage growth of the energy infrastructure by helping businesses cut operating costs, while simultaneously protecting the environment.

The statutory authority for this grant is Section 204(h) of the Act of Dec. 19, 1996 (P.L. 1478, No. 190), known as the Small Business and Household Pollution Prevention

Program Act (35 P.S. 6029.201 et seq.) Funding is limited and projects are reviewed in the order in which they are received until the appropriated grant monies have been

depleted for the fiscal year.

The Department of Environmental Protection (DEP) will begin accepting new applications for this program on July 25, 2016. A small business may submit more than one

application; however, no business or business with ownership in common can be awarded more than $9,500 from the program during the fiscal year. Business owners or business

representatives with an ownership stake of greater than 20 percent in any one of multiple businesses’ subsidiaries may only receive up to the maximum grant award of $9,500 per

year for those subsidiaries.

Applicants are encouraged to submit completed applications in as timely a fashion as possible.

Only project costs incurred on or after July 25, 2016 will be eligible with the exception of a deposit to hold a project price or contractor’s commitment. However, grants will be

awarded based on the application post marked date, date stamp for hand delivered applications, or date deficiency documents are received, WHICHEVER IS LATER.

Awards will be made until the fiscal year funding is depleted. At that point, applications

will be put on a waitlist in the event that funding becomes available during the fiscal year. Any applications remaining on the waitlist at the end of the fiscal year period will not be

funded. Based on the guidelines for the next round, if the applicant/project is eligible for the next round, the applicant would need to submit a new application.

ELIGIBILITY REQUIREMENTS

PROJECT ELIGIBILITY

Eligible Projects

Eligible projects must save the small business a minimum of $500 and at least 25 percent annually in energy consumption or pollution related expenses.

DEP requires clear and readily understood calculations that demonstrate the project provides a savings of a minimum of $500 and at least 25 percent annually in energy

consumption and/or pollution output, over the equipment, process, business protocol or system components that are being replaced.

Direct savings must be generated from reduced energy consumption or pollution output. In most cases, projects eligible for a Small Business Advantage Grant will be

upgrades or replacements of existing equipment. Power factor correction penalties are not eligible energy cost savings.

A project that involves a new business or facility with new equipment rather than an upgrade or replacement may be eligible. The applicant in such a case must show that

the project, or project component for which funding is sought, provides a 25 percent savings over the average commercially available product or system of its type on the market today. Calculations of savings must be clear, concise and accompanied by

equipment examples for comparison when proposing new construction.

Eligible projects must install equipment that results in E2 or P2, adopt processes that reduce energy consumption, reduce consumption of raw materials, increase the reuse of raw materials on-site or reduce the production of waste.

Some examples of eligible projects include: energy efficient lighting, high efficiency furnaces, boilers and air conditioners, geothermal heat pumps, energy efficient

refrigeration, process equipment upgrades, waste recycling systems, or solvent recovery systems.

ENERGY STAR rated equipment is required if the type of equipment being installed is covered under the ENERGY STAR program (refer to

www.energystar.gov). (Exceptions to this include DLC Lighting, Commercial Boilers and APUs).

Applicants may receive electric utility incentives and Small Business Advantage Grant funding. Eligibility for the utility rebates or incentives is determined by the utilities

offering the incentives and is separate from this grant program. The rebate or incentive dollar amount must be included in the application where indicated and must be subtracted from the “Total Cost of Project.” Applicants are encouraged to review

E2 incentive offerings from their utility and should choose the incentive which best suits their needs but will not be permitted to make use of the rebate/incentive to

increase the “Total Eligible Cost of Project.” If a rebate not previously available for the project is acquired after the grant award is paid to the Applicant, the Applicant will be

required to reimburse DEP the appropriate amount as it would have affected the grant award. The partial rebate should be noted on the application if known.

Projects involving the purchase of commercially available Auxiliary Power Units (APUs), bunk heaters, or other anti-idling technologies listed on the EPA Smartway Transport

Partnership website for trucking concerns are eligible and must be in compliance with the Pennsylvania’s Diesel Idling Restrictions (Act 124 of 2008). The purchase and

installation of high purity nitrogen tire inflation systems for use by small business's fleet vehicles are also eligible. All equipment must be installed in Pennsylvania to be eligible for this grant.

Trucking businesses and owner/operators must be domiciled and pay taxes in

Pennsylvania and must be able to prove that they are commercially licensed (CDL) by Pennsylvania. A photocopy of the Pennsylvania-issued CDL must be attached to the application.

No other projects related to mobile sources are eligible for funding under this program.

Ineligible Projects/Project Costs

Equipment or processes purchased or installed before July 25, 2016. For purposes of this program, "purchased" means that the project has been at least 50 percent paid for or that the applicant has entered into an agreement legally requiring the project be

installed prior to July 25, 2016.

Technology that is infeasible, unproven, unsound, or unsafe.

All residential rental units and dwellings, including rental housing, apartments, condominiums, student housing, independent living homes, and extended stay hotels with monthly rentals.

Window and through-wall air conditioning units, outdoor wood furnaces or outdoor wood boilers, wood stoves, and pellet stoves.

Vending or coin operated machines, including food and beverage coin operated machines, and washer and dryer coin operated machines, waste or recycling

dumpsters, transportation containers, or composting receptacles.

Coin operated car wash machines.

Thermostat.

Weather envelope related projects including roofing, siding, windows, doors, and insulation/air sealing.

Equipment and processes focused solely on pollution control or pollution treatment, such as scrubbers, dust collectors, or filters.

Used or refurbished equipment.

Routine maintenance or repair of existing equipment or processes – for example:

Construction related energy efficiencies such as, roofing, siding, wiring or steam trap replacements or equipment that has failed due to improper operation or faulty preventative maintenance.

Research and development projects, demonstration projects or pre-production prototypes.

Fuel switching projects for power generation or heating that install technologies that increase pollution output; and projects that increase net pollution.

Electrical power runs, transformers, breaker panels, or electrical wiring.

Oil/natural gas transmission or distribution system piping.

Thermal or photovoltaic solar power wiring or piping systems or appurtenances.

Labor costs of the applicant’s own employees, even if such costs are incurred in the acquisition and installation of the project.

APPLICANT ELIGIBILITY

Eligible Applicants

Must be a for-profit business and be taxed as a for-profit business in Pennsylvania, and be appropriately registered with the Pennsylvania Department of State, Pennsylvania Bureau of Corporation & Charitable Organizations, 1-888-659-9962 or 717-787-1057.

Must have 100 or fewer employees for the entire company. This includes all employees worldwide for parent companies, subsidiaries, branch offices, and businesses under

management in common.

To count part-time employees, applicant should include its full-time equivalent employees. Small businesses are still eligible if they have 100 or fewer full-time equivalent employees.

Businesses that are attached to a residence are eligible if the building is equipped with all of the following:

Separate utility meters;

A separate designated customer entrance; and,

The property is zoned for commercial business.

Commercial real estate landlords are eligible if they meet the following two requirements:

The landlord must be a small business located within Pennsylvania.

The building space or facility space being upgraded must be commercial space that is either currently occupied by a small business tenant or the space receiving the grant has a named small business tenant under contract

for planned occupation.

o Authorization from the property owner must be obtained by the tenant if the tenant is the grant applicant.

o A Land Owner Consent Form is required with the application.

Ineligible Applicants

For profit businesses that are not appropriately registered with the Pennsylvania Bureau of Corporation & Charitable Organizations may be deemed ineligible.

Non-profits, tax exempt organizations, local governments or municipal organizations, churches, charities and social clubs.

Applicants with current environmental violations.

Franchises. A franchise is defined as a form of business organization in which a firm which already has a successful product or service (the franchisor) enters into a continuing contractual relationship with other businesses (franchisees) operating under

the franchisor’s trade name and usually with the franchisor’s guidance, in exchange for a fee which often includes the payment of royalties and/or a percentage of profits. Examples of some include Subway, McDonalds, Taco Bell and car dealerships – Ford,

Chevy, Dodge, etc.

STEP-BY-STEP GUIDE TO APPLYING

Any questions regarding the Small Business Advantage Grant Program should be directed to the Small Business Ombudsman’s Office – refer to the “DEP and other useful contacts

page”. 1. Identify the Project: Identify one or more P2 and/or E2 opportunities that will

enhance the company’s efficiency and productivity. Develop a plan for a project to implement those opportunities. Ascertain the cost of the proposed project and

determine the cost savings and potential environmental benefits that should result from the project’s implementation. A consultant, equipment vendor or small business assistance provider can help determine the cost and savings by determining the

current energy or resource consumption.

2. Application: Complete the Small Business Advantage Grant Application. Only the 2016 Application, 1020-FM-SBOO0140 7/2016 will be accepted for review. Applicants should keep a copy of all documents submitted to the Department. The

completed application must be post marked or hand-delivered on or after July 25, 2016. For a copy of the application package and to review the Program’s

administrative requirements, contact the DEP Grants Center at 717-705-5400 or from DEP’s website at www.dep.pa.gov search “Small Business Advantage Grant” and then click “Small Business Ombudsman’s Office”. To ask a technical question concerning a

project, write to [email protected] before submitting an application.

For an application to be considered complete it must contain the following items or it will be deemed deficient and be routed through the Deficiency Process.

Current 2016 application, publication number 1020-FM-SBOO0140 7/2016.

Small Business Advantage Grant Program Land Owner Consent Form (if applicable to your project).

Additional attachments and all applicable project literature, equipment

specifications, brochures, etc.

3. Application Review Procedures: Applications will be reviewed on a first-come,

first-served basis using the eligibility criteria stated in this document. Applications that do not meet program eligibility requirements will be deemed

ineligible.

Applications that lack required information will be deemed deficient. 4. Deficiency Process: If an application is missing any required information, it will be

deemed deficient and the application will be routed through the deficiency process. The applicant will have a one-time 15 day period in which to submit corrected

documentation.

When an application is deemed deficient, the application is no longer in the sequential

order of the original post marked date or hand delivered date as applicable. If the

corrected documentation is received by DEP as noted above, the application will be placed in sequential order based on the date the documentation is received.

If an application remains materially deficient, the application will be deemed ineligible.

5. Project Selection: Project selection is made at the discretion of DEP, and is further

subject to the availability of funding.

Applicants selected for funding will receive a formal grant agreement as noted on the

next page.

IF THE PROJECT IS AWARDED…

Grant Agreement: A formal grant agreement with DEP will be developed that includes a scope of work, budget and terms and conditions. Grantees will be required to sign the grant agreement and return the signature pages within 20 calendar days.

FAILURE TO DO SO MAY RESULT IN THE GRANT AWARD BEING RESCINDED. If all conditions are met, the applicant will receive the fully executed grant agreement via

U.S. mail.

Project Implementation: Only project costs incurred on or after July 25, 2016, will be eligible. Incurring project costs prior to receiving a fully executed grant agreement

is at the grantee’s own risk. No reimbursement will be made if the grant agreement is not approved and executed for any reason.

Project Completion Date: The project must be completed by June 30, 2017. NO TIME EXTENSION REQUESTS WILL BE REVIEWED OR APPROVED.

Project Change Of Scope Requests: If a change in the project is requested, a Change of Scope Request form must be completed and submitted as soon as possible. Each request for project scope change will be reviewed on a case-by-case basis. Please

note that the submission of the Change of Scope Request form does not guarantee approval.

Project Completion Reimbursement Request: Upon completion of the project, the grantee must submit a Project Completion Reimbursement Request (PCRR) form. Grant

disbursement cannot be made without approval of the PCRR form.

Payment: The grantee will be reimbursed for up to 50 percent of its total eligible

project costs. The grantee must prove that they have paid for the project in the PCRR. If the project is financed through a lease arrangement, the grantee will only be reimbursed for 50% of the amounts paid through June 30, 2017 up to $9,500.

Payment will be made to the grantee generally within 45 days of receipt of an approvable PCRR. If the grantee receives a rebate from a utility for any equipment or

component submitted as part of this grant application, eligible project costs will be reduced by the amount of the rebate. Utility rebates may not be used for match.

DEP may decline to pay the final invoice if it is received more than 30 days after project completion date. The grant may be closed and all funds liquidated.

One Year Follow-Up Report: The grantee must submit a One Year Follow-Up Report that includes 12 months of savings data occurring after the project completion date. The completed report must detail the environmental benefits and financial costs and

savings of the project realized over a 12-month period.

The follow-up report is used to enable the department to assess the program’s effectiveness. Note: failure to provide the One Year

Follow-Up Report within 13 months of completion of the project may result in revocation of the grant and may adversely affect applications

for future grant consideration.

GRANT TERMINATION: DEP may terminate a grant agreement upon the request of the grantee. DEP may terminate a grant agreement and/or require the grantee to repay the grant

if:

The grant is used for any purpose other than the approved project.

The grantee made a material misrepresentation in the project application.

The grantee fails to comply with the follow-up reporting requirement.

The project is not or will not be in compliance with all applicable federal, state,

and local laws.

The grantee sells business to an otherwise ineligible applicant.

This grant may not be transferred or assigned to any other party absent explicit written approval from DEP. Approval of any such transfer or assignment is at the sole

discretion of DEP.

Each application will be reviewed as submitted. If an application is missing any required information it will be deemed deficient and the application will be routed through the Deficiency Process identified in the Step-By-Step Guide to Applying. Prior years’ application forms will be returned without review. All application fields must contain a response. If a portion of the application does not apply to a project, the abbreviation “NA” should be written in the information field. Utilize the fields on the form, if more space is needed attach additional sheets as required. Write the owner’s name and the application section number at the top of all extra pages. Staple all the sheets together. Type or print legibly all items except the owner’s signature in Section 10. Printed applications must be in black or blue ink. SECTION 1 - OWNER INFORMATION

Commonwealth of Pennsylvania Vendor ID#: An accurate Commonwealth of Pennsylvania vendor ID is required. The vendor ID number can be obtained by visiting www.vendorregistration.state.pa.us, click on Non-Procurement Vendor Site then Non-Procurement Registration Form or by calling 1.877.435.7363, Monday through Friday. Please note that the process to obtain a vendor ID number takes several days.

Federal Employee Identification Number (EIN): This information must be identical to that on file with the PA Vendor Data Management Unit.

Owner Name – Name of the owner, president or CEO of the applying business.

Company Legal Name – Must be legal name of the applying business. If operating under a fictitious name, include the legal name and fictitious name. Example: Jane Smith DBA Jane’s Flower Shop. This information must be identical to that on file with the PA Vendor Data Management Unit.

Amount of Rebate/Incentive – Amount of rebate/incentive received for any equipment submitted as part of this application. Example: Act 129 rebate from utility company

Total Eligible Cost of Project – Total cost of project minus amount of rebate/incentive.

Amount of Grant Request – The amount of funding you are requesting.

Estimated Project Start Date – Estimated date that the project is to start. MUST BE ON OR AFTER July 25, 2016.

Estimated Project Completion Date – Estimated date that the project will be complete. MUST BE ON OR BEFORE JUNE 30, 2017.

SECTION 4 - PROJECT LOCATION Identify location where project investment is to be made. Do not use PO Box numbers.
