Claims for additional payment and/or extension to the time to complete the works in terms of the FIDIC 1999 (First Edition) and 2017 (Second Edition), the NEC 3 (April 2013 Edition) and NEC 4 (June 2017), GCC 2015 (Third Edition) and the JBCC (Principal Building Agreement) March 2018 (Edition 6.2) standard form construction contracts are a mechanism to manage changes to the contract price and time for completing construction of the works, and a necessary component in the construction process itself. Course content The Advanced Programme in Claims Under Standard Form Construction Contracts will equip delegates with a practical understanding and working knowledge of the contractual mechanisms prescribed in terms of the FIDIC 1999 (First Edition) and 2017 (Second Edition), the NEC 3 (April 2013 Edition) and NEC 4 (June 2017), GCC 2015 (Third Edition) and the JBCC (Principal Building Agreement) March 2018 (Edition 6.2), the applicable principles of South African (and international) law and general commercial considerations relevant to effectively manage, formulate and compile, prosecute and resolve claims for either or both additional payment and extension to the time to complete the works. Learning outcomes The advanced programme is presented over a four-day period split over two months with lectures taking place on both Friday and Saturday once each month. Lectures will deal with several broad topics in the context of and with reference to the standard form construction contracts, the applicable principles of South African (and international) law, general commercial considerations, and actual practical examples, including: Commercial Risks and Risk Management mechanisms generally; Primary causes for claiming either or both additional payment and extension to the time to complete the works; Methods and principles in quantifying the additional payment claimed; Methods for analysing either or both the delay and disruption resulting from a claim event , to determine the duration of the extension to the time for completing the works claimed; Procedural requirements, evidentiary substantiation (including relevant documentation, contemporary records, and expert reports) and techniques to comply with, furnish and implement in formulating, compiling, submitting, and proving the claim; The contractor’s and contractor’s representative’s role and responsibilities in prosecuting the claim from submission through to either agreement or determination of either or both the additional payment and extension to the time to complete the works; and The engineer, project manager and principal agent’s roles and responsibilities in managing, assessing, and determining the claim, after receiving the claim through to either agreement or determination of either or both the additional payment and extension to the time to complete the works. This course is ideal for you if you are construction professional who is responsible for looking after a contractor and/or subcontractor’s interest under a construction contract, compiling and submitting notices and claims for extensions of time and/or additional payment.
