Adv Shri. Ram Jethmalani

Adv Ram Jethmalani born 14 September 1923, is a popular Indian lawyer and

politician. He has served as India's Union Law Minister and as Chairman of Bar

Council of India. He has represented a large number of cases from the high-

profile to the controversial.

Adv Ram Jethmalani is known as a maverick lawyer with many distinctions to

his credit. He obtained a law degree at an early age of 17 and started practising

law in his hometown (in today's Pakistan) until the partition of India. The

partition led him to move to Mumbai as a refugee and he began his life afresh

with his family. He was elected a Member of Parliament in 6th and 7th Lok

Sabha on a Bharatiya Janata Party (BJP) ticket from Mumbai. He has served as

Law Minister of India and also as Minister of Urban Development during the

Prime Ministership of Atal Bihari Vajpayee. In 2010 he he was elected to Rajya

Sabha. He is a well-known face amongst the legal community in India. Even

though his forte lies in criminal law, he has appeared in many high-profile civil

cases. On 7 May 2010 he was elected to be the president of Supreme Court Bar

Association.

Shri Ram Jethmalani first came to spot light with his appearance in the famous

K. M. Nanavati vs. State of Maharashtra case in 1959 with Justice Y V

Chandrachud, later to become Chief Justice of India.

Page 2: Adv Shri. Ram Jethmalani - sihspune.org May 2016.pdf · tertiary care hospital built as per global standards. He will be speaking about Sustainable models in hospitals. Dr. Karanjekar

He has taught Comparative law at International Law at Wayne State University

in Detroit, Michigan. He has also been the Chairman of Bar Council of India for

four tenures both before and after the emergency. He was also a member of

International Bar Association 1996.

He is Professor Emeritus at Symbiosis Law School, Pune since 2003 & has been

a guiding force not only to the Law students but also for healthcare students and

doctors.

Shri Jethmalani will be touching on certain issues related to Euthanasia &

Surrogacy.

Key Learnings

Euthanasia is legal in India. On 7 March 2011 the Supreme Court of India

legalised passive euthanasia by means of the withdrawal of life support to

patients in a permanent vegetative state.

It’s a landmark law which places the power of choice in the hands of the

individual, over government, medical or religious control which sees all

suffering as “destiny”. The Supreme Court specified two irreversible conditions

to permit Passive Euthanasia Law in its 2011 The high court rejected active

euthanasia by means of lethal injection. In the absence of a law regulating

euthanasia in India, the court stated that its decision becomes the law of the land

until the Indian parliament enacts a suitable law. Active euthanasia, including

the administration of lethal compounds for the purpose of ending life, is still

illegal in India, and in most countries.

Surrogacy: A Surrogacy arrangement or surrogacy agreement is the carrying of

a pregnancy for intended parents. There are two main types of surrogacy,

gestational surrogacy (also known as host or full surrogacy) and traditional

surrogacy (also known as partial, genetic, or straight surrogacy. In gestational

surrogacy, the pregnancy results from the transfer of an embryo created by in

vitro fertilization (IVF), in a manner so the resulting child is genetically

unrelated to the surrogate. Gestational surrogates are also referred to as

gestational carriers. In traditional surrogacy, the surrogate is impregnated

naturally or artificially, but the resulting child is genetically related to the

surrogate.

Page 3: Adv Shri. Ram Jethmalani - sihspune.org May 2016.pdf · tertiary care hospital built as per global standards. He will be speaking about Sustainable models in hospitals. Dr. Karanjekar

Intended parents may seek a surrogacy arrangement when either pregnancy is

medically impossible, pregnancy risks present an unacceptable danger to the

mother's health or is a same sex couple's preferred method of procreation If the

surrogate receives money for the surrogacy the arrangement is considered

commercial surrogacy, if she receives no compensation beyond reimbursement

of medical and other reasonable expenses it is referred to as altruistic. The

legality and costs of surrogacy vary widely between jurisdictions, sometimes

resulting in interstate or international surrogacy arrangements.

Topic: Successful Health Care Model – Hospital

It is easy to imagine a successful healthcare system – that goes on forever,

within the limits of financial, social and environmental resources. The challenge

is the current approach of delivering health and care, cannot continue in the

same way and stay within these limits.

A successful hospital system, is achieved by delivering high quality care and

improved public health, without exhausting natural resources.

Successful Health care involves ‘greening’ the sector with particular attention

to energy, water and adaptation of infrastructure.

Hospitals are a critical path of health systems worldwide. They serve as the first

point of care for many people, offer access to higher care and often set

standards and provide training for the national health system at large. Hospitals

also play a major role in responding to national health priorities from reducing

new-born deaths, to treating MDR-TB and so on. Despite the centrality of

hospitals, hospital policy and performance has largely been neglected by health

policy makers. The aim is to improve efficiency, safety, effectiveness and

impact of hospital care on health system objectives.

tertiary care hospital built as per global standards. He will be speaking about

Sustainable models in hospitals. Dr. Karanjekar has been associated with

NABH, JCI & QCI for more than 15 years and has successfully delivered a

Quality Care to the patients in various hospitals. He holds the degrees of

MBBS, D Ortho, DBM, DHA, and FIMSA and is known for his medical

services and quality aspect of the hospital. He is also the Chairman

Accreditation Committee-Quality Council of India.

Key learnings:

The physicians, hospitals, health insurance etc. have to work in unity

and encourage development of successful model for quality care.

Top down stewardship strategy that aligns with the organizations

goals that will re-define the three-pronged framework for quality

healthcare- patient experience, cost per capita and population health.

The need for the creation of a collaborative body for hospital

performance that will facilitate a network of individuals and

institutions dedicated to fostering improved policy making, and

management of investment in emerging markets.

Topic: Successful Healthcare Models – Medical Devices

A medical device is any instrument, mechanical assembly, machine,

programming, material or other article, whether utilized alone or as a part of

blend, including the product planned by its producer to be utilized particularly

for indicative and/or helpful purposes and fundamental for its legitimate

application, expected by the maker to be utilized for individuals with the end

goal of :-

Diagnosis, screening, checking, treatment or easing of illness

The global medical device market reached roughly $209 billion in 2006.

India is one of the largest medical device markets in Asia, and is still growing at

an impressive rate. Increased health awareness, a growing middle class and

government health initiatives, mean the medical device market is expected to

grow about 15% per year for the next several years, albeit from a small base.

Successful Healthcare model includes adapting how we deliver services, health

promotion, more prevention, corporate social responsibility and to ensure so as

to optimize the cost and resources.

The main way forward for medical devices is to remotely monitor a patient’s

health with the use of network of sensors, activators and other mobile

communication devices, referred to as the internet of things for medical devices.

This provides vital parameters of the patient and the data provided is secured.

Page 9: Adv Shri. Ram Jethmalani - sihspune.org May 2016.pdf · tertiary care hospital built as per global standards. He will be speaking about Sustainable models in hospitals. Dr. Karanjekar

Mr. Kaushik Sen

CEO & Co-founder at Healthspring

Topic: Successful Healthcare Model – Primary Care

Healthspring, an innovative model has successfully demonstrated that high-

quality primary healthcare can be provided at an affordable cost. It has shown

that the private healthcare sector can help in improving access and utilization of

primary health services, to significantly improve health outcomes and reduce

out-of-pocket healthcare expenditures. Successful health care becomes the most

relevant area in health care for optimization of human health and better care.

Primary care helps to prevent illness and death regardless of whether the care is

characterised by supply of primary care physicians, a relation with a source of

primary care or the receipt of important features of primary care. This sector has

an orientation towards provision of healthcare to individuals and community as

a whole at the lowest level. It is the first point of care and only cases that are

beyond its capability should reach the hospital so as to reduce congestion and

increase quality of treatment in hospitals.

in the primary care sector. He has completed his MBA from Harvard Business

School(2001 – 2003)and has a B.A., Mathematics and Economics from Colby

College(1994 – 1998) . Mr. Kaushik Sen has expertise in Strategic Consulting

and planning with national and international business, with an experience

spanning over a decade. The journey began as an Associate Consultant, then

Principal at BAIN & Company. But he left the lucrative job, to change

unorganised primary healthcare of India.

Health spring has spread all over in Mumbai with 16 centres and 3 centres in

Pune. The company is also expanding to Kolhapur and Nashik.

Key learnings

The importance of building a primary care model which provides quality

care.

The session will cover all the aspects that needs to build a successful

health care model.

The challenges of building a sustainable model of primary health care in

terms of universal approach.

The main aspect that needs to be looked into is the quality. This serves as

the main reason that people prefer hospitals. Steps need to be applied to

make primary care desired and of high quality so hospitals can focus on

higher care. Strategies should be undertaken to direct the patient flow

towards primary care centres instead of the hospitals.

Topic: Healthcare Communications

Communication derived from the Latin word commūnicāre, meaning "to share",

is the act of conveying intended meaning to another entity through the use of

mutually understood signs and semiotic rules.

Communication is the key word now; everyone’s talking about the need for it,

so why should we, the healthcare professional, be a step behind? Especially

since communication is utmost in healthcare.

Healthcare providers don’t talk to each other enough. Members of the care

team—physicians, nurses, social workers and even caregivers—don’t spend

enough time communicating with each other about the patient’s needs, and even

less time is spend communicating with the patients. The increasingly complex

needs of patients, an explosion of medical knowledge, and seismic shifts in

healthcare systems have set the stage for a need for more effective

communication.

Success demands team-based approaches that are centred on close

collaboration among all types of providers from across the care continuum. As

a result, achieving the triple aim of improving quality, lowering costs and

enhancing the patient experience can only be done with a significantly altered

and improved communication strategy.

Page 14: Adv Shri. Ram Jethmalani - sihspune.org May 2016.pdf · tertiary care hospital built as per global standards. He will be speaking about Sustainable models in hospitals. Dr. Karanjekar

Globally, providers are working to identify and implement programs to improve

communication. Even technology companies are creating new initiatives and

new tools to facilitate communication among the care team and drive better

patient outcomes. While in India we are climbing the first few rungs of the

communication ladder.

Evidence indicates that there is a strong positive relationship between a

healthcare team member’s communication skills and a patient’s capacity to

follow through. A clinician’s ability to explain, listen and empathize can have a

profound effect on biological and functional health outcomes as well as patient

satisfaction and experience of care. Ineffective clinician-patient communication

will increase malpractice risk, non-adherence, patient and clinician

dissatisfaction and poor patient health outcomes; the necessity of addressing

communication skill deficits is of utmost importance in the present scenario.

Speaker’s Profile

Dr. Nagesh Rao, President and Director of MICA, a premier management

institute, creating leadership in strategic marketing and communication will be

speaking on healthcare communication. Dr Rao’s scholarly interests lie in

Intercultural Communication and Health Communication. After completing his

doctoral work in Intercultural Communication at the Michigan State University

in 1994, he taught in several U.S. Universities, including the University of

Maryland, Ohio University and the University of New Mexico. Before joining

MICA, he was a Professor at the Indian Institute of Management, Ahmedabad.

Dr. Rao’s latest work focuses on the strategic role of communication in Indian

hospitals; the co-edited book is "Communicate. Care. Cure: A Guide to Health

Communication"

The wonderful journey accomplished by Dr. Nagesh Rao Makes him the

speaker to deal with a very important subject of health care communication as

he has been a teacher a mentor & an author in the domain of health care

communication.

Page 15: Adv Shri. Ram Jethmalani - sihspune.org May 2016.pdf · tertiary care hospital built as per global standards. He will be speaking about Sustainable models in hospitals. Dr. Karanjekar

Key learnings

Improving communication is essential, if we are to transform into a

value-oriented healthcare system.

To do so, we will need to define clear measures for success, identify

champions, and build consensus and educate the community based on

experience.

The patient’s perceptions of the quality of the healthcare they received is

highly dependent on the quality of their interactions with their healthcare

clinicians and team. The importance of communication training for

clinicians and members of the healthcare team can’t be ignored.

Communication remains one of the biggest challenges and one of the

greatest opportunities to improve patient care. Mobile, text-based

communication and other advanced automatic communication that is

interpreted with hospital systems are advancing communication.

The rapid paces of IT and device technology has accelerated speed and

accuracy to communication that was not available a few years or even a

few months back.

possibility of ‘false positives’.

Page 20: Adv Shri. Ram Jethmalani - sihspune.org May 2016.pdf · tertiary care hospital built as per global standards. He will be speaking about Sustainable models in hospitals. Dr. Karanjekar

Diagnostic tests improve patient care, contribute to the protection of consumer

health and help to limit health care spending. Diagnostic methods with high

degree of sensitivity and specificity aid in early detection of diseases and

disorders, and hence can provide better prognosis. Technology development

for medical diagnosis is one of the important fields of applied science.

Numerous techniques and assays are available for diagnosis, such as

immunoassay, genetic based tests, medical imaging and biosensing. Bioassays

commonly used in diagnosis are enzyme linked immunosorbent assay (ELISA),

polymerase chain reaction (PCR) based genetic assay and staining assay such as

Giesmsa and Gram, for viral and bacterial infectious diseases.

Robust, faster and economical devices are extremely desirable for substituting

the time-consuming laboratory diagnoses and for diagnostic results available at

the patient’s bedside i.e. point-of care diagnosis. New advancements are

fabricated to hold great promise for advanced diagnostics and biosensors. These

integrate with genomics, proteomics, and molecular machine systems, and

attribute to fast, reliable, and onsite effective medical diagnosis and has

revolutionized the modalities by producing novel materials and devices for

medical diagnosis.
