Adv Shri. Ram Jethmalani
Adv Ram Jethmalani born 14 September 1923, is a popular Indian lawyer and
politician. He has served as India's Union Law Minister and as Chairman of Bar
Council of India. He has represented a large number of cases from the high-
profile to the controversial.
Adv Ram Jethmalani is known as a maverick lawyer with many distinctions to
his credit. He obtained a law degree at an early age of 17 and started practising
law in his hometown (in today's Pakistan) until the partition of India. The
partition led him to move to Mumbai as a refugee and he began his life afresh
with his family. He was elected a Member of Parliament in 6th and 7th Lok
Sabha on a Bharatiya Janata Party (BJP) ticket from Mumbai. He has served as
Law Minister of India and also as Minister of Urban Development during the
Prime Ministership of Atal Bihari Vajpayee. In 2010 he he was elected to Rajya
Sabha. He is a well-known face amongst the legal community in India. Even
though his forte lies in criminal law, he has appeared in many high-profile civil
cases. On 7 May 2010 he was elected to be the president of Supreme Court Bar
Association.
Shri Ram Jethmalani first came to spot light with his appearance in the famous
K. M. Nanavati vs. State of Maharashtra case in 1959 with Justice Y V
Chandrachud, later to become Chief Justice of India.
He has taught Comparative law at International Law at Wayne State University
in Detroit, Michigan. He has also been the Chairman of Bar Council of India for
four tenures both before and after the emergency. He was also a member of
International Bar Association 1996.
He is Professor Emeritus at Symbiosis Law School, Pune since 2003 & has been
a guiding force not only to the Law students but also for healthcare students and
doctors.
Shri Jethmalani will be touching on certain issues related to Euthanasia &
Surrogacy.
Key Learnings
Euthanasia is legal in India. On 7 March 2011 the Supreme Court of India
legalised passive euthanasia by means of the withdrawal of life support to
patients in a permanent vegetative state.
It’s a landmark law which places the power of choice in the hands of the
individual, over government, medical or religious control which sees all
suffering as “destiny”. The Supreme Court specified two irreversible conditions
to permit Passive Euthanasia Law in its 2011 The high court rejected active
euthanasia by means of lethal injection. In the absence of a law regulating
euthanasia in India, the court stated that its decision becomes the law of the land
until the Indian parliament enacts a suitable law. Active euthanasia, including
the administration of lethal compounds for the purpose of ending life, is still
illegal in India, and in most countries.
Surrogacy: A Surrogacy arrangement or surrogacy agreement is the carrying of
a pregnancy for intended parents. There are two main types of surrogacy,
gestational surrogacy (also known as host or full surrogacy) and traditional
surrogacy (also known as partial, genetic, or straight surrogacy. In gestational
surrogacy, the pregnancy results from the transfer of an embryo created by in
vitro fertilization (IVF), in a manner so the resulting child is genetically
unrelated to the surrogate. Gestational surrogates are also referred to as
gestational carriers. In traditional surrogacy, the surrogate is impregnated
naturally or artificially, but the resulting child is genetically related to the
surrogate.
Intended parents may seek a surrogacy arrangement when either pregnancy is
medically impossible, pregnancy risks present an unacceptable danger to the
mother's health or is a same sex couple's preferred method of procreation If the
surrogate receives money for the surrogacy the arrangement is considered
commercial surrogacy, if she receives no compensation beyond reimbursement
of medical and other reasonable expenses it is referred to as altruistic. The
legality and costs of surrogacy vary widely between jurisdictions, sometimes
resulting in interstate or international surrogacy arrangements.

Thumbay Group, is a multinational conglomerate headquartered at DIFC -
Dubai, United Arab Emirates (UAE) has been described as “a man of vision

It is easy to imagine a successful healthcare system – that goes on forever,

A medical device is any instrument, mechanical assembly, machine,
programming, material or other article, whether utilized alone or as a part of

application, expected by the maker to be utilized for individuals with the end

The global medical device market reached roughly $209 billion in 2006.
India is one of the largest medical device markets in Asia, and is still growing at
an impressive rate. Increased health awareness, a growing middle class and
government health initiatives, mean the medical device market is expected to
grow about 15% per year for the next several years, albeit from a small base.
Successful Healthcare model includes adapting how we deliver services, health
promotion, more prevention, corporate social responsibility and to ensure so as

The main way forward for medical devices is to remotely monitor a patient’s

Communication derived from the Latin word commūnicāre, meaning "to share",
is the act of conveying intended meaning to another entity through the use of
mutually understood signs and semiotic rules.
Communication is the key word now; everyone’s talking about the need for it,
so why should we, the healthcare professional, be a step behind? Especially
since communication is utmost in healthcare.
Healthcare providers don’t talk to each other enough. Members of the care
team—physicians, nurses, social workers and even caregivers—don’t spend
enough time communicating with each other about the patient’s needs, and even
less time is spend communicating with the patients. The increasingly complex
needs of patients, an explosion of medical knowledge, and seismic shifts in
healthcare systems have set the stage for a need for more effective
communication.
Success demands team-based approaches that are centred on close
collaboration among all types of providers from across the care continuum. As
a result, achieving the triple aim of improving quality, lowering costs and
enhancing the patient experience can only be done with a significantly altered
and improved communication strategy.
