5 DISCUSSION The Audit Committee (AC) met on 4 September 2017 to review and discuss the draft 2016-17 Financial Statements for the Council of the City of Gold Coast including its controlled entities. The following executive officer reports were provided to and discussed by the committee:

Draft 2016-17 Council of the City of Gold Coast Financial Statements tabled by the Coordinator Financial Accounting, Corporate Finance;

2016-17 Interim Infrastructure Revaluation Reports tabled by the Accounting Coordinator, Asset Reporting, Policy and Improvements;

2016-17 Water And Sewerage Revaluation Reports and an update on Landfill Remediation tabled by the Manager Business Performance, Gold Coast Water and Waste;

Draft 2016-17 Financial Statements for Council’s Controlled Entities tabled by the Manager, Office of the Chief Executive Officer;

City of Gold Coast Insurance Company Limited final 2016-17 Financial Statements Report tabled by the Chief Executive Officer and City Solicitor;

Legal services update by the City Solicitor; and CEO quarterly update.

The committee's specific recommendations resulting from its consideration of the above matters are included in the recommendations section of this report for resolution by Council.

The meeting was also attended (in part) by representatives from the Queensland Audit Office (QAO) who tabled a briefing note on progress with the 2016-17 external audit and other matters of relevance to Council who discussed the following matters with the committee:

Dale Dickson CEO Yes 14 STAKEHOLDER IMPACTS Directors and Council officers may need to respond to information requests from the Audit Committee as a result of this meeting. 15 TIMING This report is being provided to the next available Council meeting following the Audit Committee meeting as required by legislation. 16 CONCLUSION This written report of the deliberations and recommendations of the Audit Committee from its meeting 4 September 2017 is provided to Council in accordance with section 211(1)(c) of the Local Government Regulation 2012 for adoption. As evidenced by the specific recommendations contained in this report, committee members have reviewed and considered a wide range of reports and engaged in robust discussions with Council management, internal auditors and external auditors, in order to satisfy themselves that a sound process has been undertaken to prepare Council’s 2016-17 draft financial statements. Members of the committee reviewed and discussed the draft 2016-17 financial statements and concluded that they were appropriate to be provided to the external auditors, subject to a number of amendments discussed in the meeting. The detailed recommendations of the committee are included in this report for the consideration of Council, and incorporate specific recommendations on matters where the Audit Committee members felt Council may appreciate additional comment.

1 BASIS FOR CONFIDENTIALITY Not Applicable. 2 EXECUTIVE SUMMARY Not Applicable. 3 PURPOSE OF REPORT The purpose of this report is for Council to resolve to:

a make Regulated Parking (Amendment) Subordinate Local Law (No. 1) 2017 (“the proposed subordinate local law”) as advertised; and

b adopt a consolidated version of Subordinate Local Law No. 2 (Regulated Parking) 2006 incorporating the amendments specified in the proposed subordinate local law.

4 PREVIOUS RESOLUTIONS At its meeting on 18 November 2014, Council resolved to approve the City Parking Plan 2015 which included an action relating to the review of the City’s Traffic Area and Parking Permit Scheme. Ex minute G14.1118.023 That Committee Recommendation CP14.1112.001 be adopted, with an additional Part 5, 6, 7, 8 such that it reads in its entirety as follows.

1. That the Gold Coast City Parking Plan 2015 be approved.

2. That a Broadbeach and Burleigh ParkInCentre Scheme pilot, consistent with the program outcomes of the Gold Coast City Parking Plan 2015, is approved to commence in July 2015.

3. That a report outlining how the ParkInCentre Scheme pilots will be actioned, including stakeholder engagement, be provided to Council in May 2015 for information purposes.

4. That a comprehensive review of the City Parking Plan, including the results of the Broadbeach and Burleigh PICS, be considered by Council at 12 months and 24 months after commencement of the pilot.

5. That a review of residential and visitor parking permit best practice be undertaken in 2015. (Part of Action 6 of the City Parking Plan)

6. That the City Parking Plan and the Draft City Plan 2015 be amended to address the impacts of development on the supply of on-street parking.

7. That a review of parking for Robina and Varsity Lakes be undertaken in consultation with the Divisional Councillor in 2015.

8. That the Director of Planning and Environment be authorised to make minor editorial amendments to the City Parking Plan prior to its publication.

At its meeting on 25 July 2017, Council resolved to make amendments to Subordinate Local Law No.2 (Regulated Parking) 2006. Ex Minute GA17.0720.005 That Council resolves to propose to make Regulated Parking (Amendment) Subordinate Local Law (No. 1) 2017 (‘proposed Subordinate Local Law’) per Attachment A.

5 DISCUSSION 5.1 Introduction Council resolved to propose to make the proposed subordinate local law as per Attachment 1 at its meeting of 25 July 2017. Staff have been progressing the making of the proposed subordinate local law in accordance with the local law making process previously adopted by Council by resolution. The process so far undertaken has included consultation with the community about the making of the proposed subordinate local law. The results of consultation with the public, both generally, and about possible anti-competitive provisions, are as follows: 5.2 Results of consultation with the community Community consultation about the making of the proposed subordinate local law was undertaken in accordance with the requirements of the Local Government Act 2009 (LG Act) and the local law making process previously adopted by Council. Public consultation included the placing of an advertisement in the Gold Coast Bulletin on Wednesday 23 August 2017. The notice invited the public to make submissions. The Consultation Notice on Council’s “gchaveyoursay” site advised that the object of the changes to the subordinate local law is to facilitate the management of on-street parking adjoining core commercial precincts and in residential areas.

identifies traffic areas, including the Bundall/Chevron Island Traffic Area, the Central Traffic Area, the Gold Coast Health and Knowledge Precinct Traffic Area, the Main Beach Traffic Area, the Robina Stadium Traffic Area, the Southern Traffic Area, the Southport Traffic Area, the Stadium Residential Traffic Area and the Varsity Lakes Traffic Area;

facilitates the undertaking of major events, including the Commonwealth Games, by creating a new category of parking permit, a Main Beach Event Parking Permit;

identifies other information which must accompany a Parking Permit application, and in particular, an application for a Main Beach Event Parking Permit;

identifies conditions of a Parking Permit, including a Main Beach Event Parking Permit. As part of the law making process, Council must accept and consider every properly made submission. Council received a total of sixty one (61) submissions for the law. The participation rate by the public on the “gchaveyoursay” site included 180 page site visits with 57 documents downloaded, including:

Subordinate Local Law No. 2 (Regulated Parking) 2006 tracked consolidated 2017 version (15 downloads)

Consultation notice for Regulated Parking Amendment 2017 (6 downloads).

Furthermore of the sixty one (61) submissions received fifty eight (58) were made by committee group members, patrons and/or clients of businesses or other organisations located within Nikiforides Family Park, Broadbeach. The submissions received include:

Patrons of the Royal QLD Arts Society (40 submissions)

Patrons of the Broadbeach Kindergarten (16 submissions)

Patrons of the Broadbeach Croquet Club (1 submission)

Patrons of the Broadbeach Surf Life Saving Club (1 submission)

No comments (3 submissions). In the submissions received the organisations objected to the proposed timed parking limit for the Central Traffic Area within the proximity of the Nikiforides Family Park. The submissions also raised safety concerns for children and parents at the kindergarten during drop off/pickup times. (Refer: Attachment 3 – Submissions received during community consultation for Subordinate Local Law (No. 1) 2017). Consultation has occurred with businesses/community organisations within Nikiforides Family Park to ensure concerns raised during the community consultation period were addressed. The outcome of the consultation included:

installation of a drop off/pickup zone for the kindergarten which will be greatly improve safety for children and parents and increase short term parking availability

installation of two additional disabled parking spaces on Armrick Avenue installation of four hour parking in the angle parking spaces adjacent to the park.

ITEM 3 (Continued) MAKING OF REGULATED PARKING (AMENDMENT) SUBORDINATE LOCAL LAW (NO. 1) 2017 LG222/365/02/02/01(P1) 5.3 Public interest testing of possible anti-competitive provisions The LG Act requires that where a local law contains an anti-competitive provision, Council must comply with the procedures specified in the Local Government Regulation 2012 (LG Regulation) for reviewing anti-competitive provisions. Council undertook a review of the proposed subordinate local law and determined that the proposed subordinate local law did not contain any possible anti-competitive provisions. 5.4 Next Steps in the Local Law Making Process In accordance with Council’s law making process, Council may now resolve to make the proposed subordinate local law as advertised. It should be noted that any decision by Council, at this late stage, to change a provision of the proposed subordinate local law may, depending upon the significance of the change, require further public consultation, which would delay completion of the subordinate local law making process and possibly impact GC2018 works. Once Council resolves to make the proposed subordinate local law, the public must be informed that the subordinate local law has been made by publishing a notice of the making of the subordinate local law in accordance with the requirements of Section 29B of the Local Government Act 2009. The notice must be published:

a in the gazette; and

b on Council’s website. Furthermore Traffic and Transport Branch have developed a communications plan for the project. Following approval of the subordinate local law amendments a letter that outlines the changes will be sent to residents residing within the proposed traffic areas. Within fourteen (14) days after the notice is published in the gazette, Council must give the Minister:

a a copy of the gazette notice; and

b a copy of the subordinate local law. Under section 29 (5) of the LG Act, Council must ensure its local laws are drafted in compliance with the guidelines issued by the Parliamentary Counsel under the Legislative Standards Act 1992. The subordinate local law complies with this requirement. 5.5 Parking restrictions for the proposed traffic areas It is proposed that Council apply the following time limits, hours, days of operation to the traffic areas (Refer: Table 1 - Traffic Area Restrictions).

The proposed Traffic Areas including Southport Traffic Area, Gold Coast Health and Knowledge Precinct Traffic Area, Robina Stadium Traffic Area, Main Beach Traffic Area and the Central Traffic Area will be utilised for enforcement of parking regulations on days and times when GC2018 parking restrictions apply. 8 FUNDING AND RESOURCING REQUIREMENTS Council’s adopted 2017/18 budget provides funds for the making of the proposed subordinate local law. 9 RISK MANAGEMENT

There is no current corporate risk directly associated with this plan. However, as the CPP2015 is related to actions from the Gold Coast City Transport Strategy 2031, the following risk is noted:

Risk Number: CO00507 Risk Name: Transport Strategy is not fully funded resulting in whole of City impacts with poor transport infrastructure and transport service choices for the community. 10 STATUTORY MATTERS Council is required to comply with the local law making requirements of the Local Government Act 2009 and its adopted local law making process. Council must ensure its local laws are drafted in compliance with the guidelines issued by the Parliamentary Counsel under the Legislative Standards Act 1992. The proposed subordinate local law complies with this requirement. 11 COUNCIL POLICIES Development of the City Parking Plan 2015 was a key action of the Gold Coast City Transport Strategy 2031 with two key actions related to parking permits: Action 2 Parking Regulations – “Undertake strategic reviews to: (d) Enhance parking

conditions and information to improve safety and residential amenity in residential areas.”

Action 6 Special Parking Management – “Review the use of technologies, including e-permits, to enhance the provision and management of the Residential and Visitor Permit System”.

Regulated parking matters are governed under Council’s Local Law No. 2 (Regulated Parking) 2006 and its associated subordinate local law.

14 STAKEHOLDER IMPACTS The proposed subordinate local law provides a holistic regulatory framework to best facilitate major events. Such events deliver substantial social and economic benefits to the Gold Coast community. 15 TIMING If Council now resolves to make the proposed subordinate local law as advertised, as recommended, Council must (pursuant to the requirements under the subordinate local law making process and the LG Act):

a within one (1) month of the date of the resolution, let the public know that the proposed subordinate local law has been made by publishing a notice in the gazette and on Council’s website (which notice must comply with the requirements in section 29B of the Local Government Act); and

b as soon as practicable after the notice is published in the gazette, ensure that a copy of the subordinate local law may be inspected and purchased at Council’s public office; and

Council will also be required to update its register of local laws. 16 CONCLUSION Council has previously resolved to propose to make the subordinate local law which is contained in Attachment 1. Council has complied with the steps detailed in Council’s law making process and the LG Act that are required to be met in order for the proposed subordinate local law to be made. It should be noted that any decision by Council at this late stage to change a provision of the proposed subordinate local law may, depending upon the significance of the change, require further public consultation, which would delay completion of the subordinate local law making process. It is recommended that Council resolves to: make the proposed subordinate local law as advertised

adopt the consolidated version of Subordinate Local Law No. 2 (Regulated Parking) 2006 contained in Attachment 2.

(iii) a multi-residential premises visitor parking permit; or

(e) the number of main beach event parking permits which may be

granted for a residence is—

(i) if the residence identified in the application for the permit is situated in a high rise building or a medium rise building—nil;

(ii) if the residence identified in the application for the permit is situated in a low rise building and—

(A) the measured frontage of the residence is less than 6m—nil;

(B) the measured frontage of the residence is 6m or more, but less than 12m—1;

(C) if the measured frontage of the residence is 12m or more—2.’.

5 Amendment of s12 (Other information to accompany a parking permit application—Local Law, s29(f))

(1) Section 12(1)(d), ‘.’

‘(e) if the application is for a resident’s event parking permit or a main beach event parking permit—the details or information specified in subsection (8).’.

(a) written evidence that the applicant resides at the residence identified in the application, for example, a copy of the current driver licence of the applicant; and

(b) written particulars of the measured frontage of the residence; and

(c) written particulars of all off-street parking facilities on the land on which the residence is situated which are, or can reasonably be, made available for use by—

(i) the applicant; or

(ii) a person who is visiting, or attending at, the residence; and

(d) other details or information as is necessary to satisfy the local government that the circumstances of the applicant—

(i) if the application is for a resident’s event parking permit—satisfy the criteria specified in section 11(13); and

(ii) if the application is for a main beach event parking permit—

satisfy the criteria specified in section 11(14).’.

6 Amendment of s14 (Conditions of parking permit — Local Law, s31(3))

After section 14(10)—

insert—

‘(11) The conditions that will ordinarily be imposed in a main beach event parking permit are—

(a) the permit must be used only in respect of the parking of a vehicle at the location identified in the permit, which must be the road immediately adjacent to the residence identified in the permit; and

(b) the holder of the permit must only use the permit whilst the holder resides at the residence identified in the permit; and

(c) a main beach event parking permit is not specific to any particular vehicle.’.

(b) a mezzanine is a storey; and

(c) a roofed structure on or part of a rooftop that does not solely accommodate building plant and equipment is a storey; and

(d) a basement is not a storey.

Part 1 Preliminary

1 Short title

This subordinate local law may be cited as Subordinate Local Law No.2 (Regulated Parking) 2006.

2 Object

(1) The object of this subordinate local law is to supplement Gold Coast City Council Local Law No. 2 (Regulated Parking) 2006 to establish a comprehensive legislative scheme.

(2) The objects of the legislative scheme are to

(a) regulate parking on roads in the local government’s area; and

(b) define the boundaries of traffic areas in the local government’s area; and

(c) give the local government power to

(i) issue commercial vehicle identification labels and parking permits; and

(ii) impose temporary parking prohibitions and restrictions; and

(d) protect the safety, environment and amenity of land in built-up areas from the adverse effects of the parking of vehicles on roads; and

Examples of adverse effects—

1. Noise, including the use of air start mechanisms and air compression braking which have a detrimental effect on the amenity of an area;

2. Parking and the use of roads for access and egress purposes could create a safety risk to road users, pedestrians or residents;

3. The parking of vehicles on a road on an ongoing or long term basis may have a detrimental impact on the amenity of an area.

(e) specify off-street regulated parking areas in the local government’s area; and

(f) prescribe infringement notice penalties for minor traffic offences committed in the local government’s area.

3 Definitions—the dictionary

The dictionary in schedule 1 defines particular words used in this subordinate local law.

4 Subordinate local law repeal

This subordinate local law repeals Gold Coast City Council Subordinate Local Law No. 2 (Regulated Parking).

Part 2 Regulation of parking

5 Declaration of traffic areaLocal Law, s7(1)

For the purposes of section 7(1) of the local law—

(a) the area indicated by a bold line circumscribing an area shaded in grey on the map in schedule 1A is declared to be a traffic area and the name of the traffic area is the “Bundall/Chevron Island Traffic Area”; and

(b) the area indicated by a bold line circumscribing an area shaded in grey on the map in schedule 1B is declared to be a traffic area and the name of the traffic area is the “Central Traffic Area”; and

(c) the area indicated by a bold line circumscribing an area shaded in grey on the map in schedule 1C is declared to be a traffic area and the name of the traffic area is the “Gold Coast Health and Knowledge Precinct Traffic Area”; and

(d) the area indicated by a bold line circumscribing an area shaded in grey on the map in schedule 1D is declared to be a traffic area and the name of the traffic area is the “Main Beach Traffic Area”; and

(e) the area indicated by a bold line circumscribing an area shaded in grey on the map in schedule 1E is declared to be a traffic area and the name of the traffic area is the “Robina Stadium Traffic Area”; and

(f) the area indicated by a bold line circumscribing an area shaded in grey on the map in schedule 1F is declared to be a traffic area and the name of the traffic area is the “Southern Traffic Area”; and

(g) the area indicated by a bold line circumscribing an area shaded in grey on the map in schedule 1G is declared to be a traffic area and the name of the traffic area is the “Southport Traffic Area”; and

(h) the area indicated by a bold line circumscribing an area shaded in grey on the map in schedule 1H is declared to be a traffic area and the name of the traffic area is the “Stadium Residential Traffic Area”; and

(i) the area indicated by a bold line circumscribing an area shaded in grey on the map in schedule 1I is declared to be a traffic area and the name of the traffic area is the “Varsity Lakes Traffic Area”.

6 Off-street regulated parking areasLocal Law, s11(1)

For the purposes of section 11(1) of the local law, the areas of land (including structures on the land) described in schedule 2 are defined as off-street regulated parking areas.

7 Classification of commercial vehicles1ALocal Law, s16(1)

For the purposes of section 16(1) of the local law, each of the following vehicles is classified as a commercial vehicle

(a) any horse drawn vehicle constructed, fitted or equipped for the carriage of goods;

(b) any motor vehicle if—

(i) the motor vehicle is constructed, fitted or equipped for the carriage of persons; and

(ii) the current registration certificate for the motor vehicle states that the purpose of use of the vehicle is commercial use.

8 Other information to accompany a commercial vehicle identification label application Local Law, s17(h)

The other detail or information which must accompany an application for approval to obtain a commercial vehicle identification label is a copy of a current registration certificate for the vehicle which states that the purpose of use of the vehicle is commercial.

9 Commercial vehicle identification label conditions of approval Local Law, s19(3)

The conditions that will ordinarily be imposed in an approval for a commercial vehicle identification label are

(a) the holder of an approval for a commercial vehicle identification label must affix the label to the commercial vehicle identified in the label within 3 days after the issue of the label; and

(b) if the commercial vehicle has no windscreen, or is a motorcycle, the commercial vehicle identification label must be

(i) displayed and kept displayed in a holder clearly visible and similar to that in which is displayed the vehicle registration label issued by the Chief Executive of the Department of Transport; and

(ii) affixed to clear glass in the holder in a manner such that all the particulars on the label are clearly visible through the glass; and

(c) the holder of the approval for a commercial vehicle identification label must keep the label affixed to the commercial vehicle at all times during

An official traffic sign must be installed in a way specified by the Manual of Uniform Traffic Control Devices (Transport Operations (Road Use Management) Act 1995, section 72A (Way to install official traffic sign)). Under the Manual, a loading zone may be reserved for commercial vehicles, for example, by the use of the text “LOADING ZONE COMMERCIAL VEH 20 MINS MAX” on an official traffic sign. Under the Transport Operations (Road Use Management – Road Rules) Regulation 2009, section 179 (Stopping in a loading zone), a driver must not stop in a loading zone unless the driver is driving an authorised vehicle. For example, if an official traffic sign for a loading zone indicates that the loading zone is reserved for commercial vehicles, a vehicle other than a commercial vehicle is not an authorised vehicle.

10 Term of approval for commercial vehicle identification label Local Law, s20(2)

(1) The term for which an approval for a commercial vehicle identification label is granted or renewed will ordinarily be 12 months.

(2) However

(a) the local government may fix some other term for an approval if it is desirable to do so

(i) to provide common expiry dates for approvals; or

(ii) for some other reason; and

(b) an approval expires on the sale of the commercial vehicle by the holder of the approval.

Part 4 Parking permits

11 Persons to whom parking permits may be granted Local Law, s28

(1) This section specifies

(a) the classes of persons to whom parking permits may be granted; and

(b) the circumstances in which parking permits may be granted.

(2) A parking permit (a multi-residential premises resident parking permit) may—

(a) be granted in circumstances where—

(i) a person resides in multi-residential premises1 on a section of road and parking immediately adjacent to the multi-residential premises is regulated by time; and

(ii) the current registration certificate for the vehicle identified in the application for the permit identifies—

(A) the applicant as the person in whose name the vehicle is currently registered; and

(B) the multi-residential premises as the garage address for the vehicle; and

(iii) if the permit is granted—there would not be in force—

(A) if the multi-residential premises does not have, and cannot reasonably be provided with, any off-street parking—more than 2 multi-residential premises resident parking permits for the same multi-residential premises; and

(B) if the multi-residential premises does not have, and cannot reasonably be provided with, off-street parking for more than 1

vehicle—more than 1 multi-residential premises resident parking permit for the multi-residential premises; and

(b) not be granted in circumstances where the multi-residential premises identified in the application—

(i) has, or can reasonably be provided with, off-street parking for 2 or more vehicles; or

(ii) are situated within the boundary of an Event Traffic Area.

(3) A parking permit (a detached premises resident parking permit) may—

(a) be granted in circumstances where—

(i) a person resides in detached premises on a section of road and parking immediately adjacent to the detached premises is regulated by time; and

(ii) the current registration certificate for the vehicle identified in the application for the permit identifies—

(A) the applicant as the person in whose name the vehicle is currently registered; and

(B) the detached premises as the garage address for the vehicle; and

(iii) if the permit is granted—there would not be in force—

(A) if the detached premises does not have, and cannot reasonably be provided with, any off-street parking—more than 3 detached premises resident parking permits for the same detached premises; and

(B) if the detached premises does not have, and cannot reasonably be provided with, off-street parking for more than 1 vehicle—more than 2 detached premises resident parking permits for the detached premises; and

(C) if the detached premises does not have, and cannot reasonably be provided with, off-street parking for more than 2 vehicles—more than 1 detached premises resident parking permit for the detached premises; and

(b) not be granted in circumstances where the detached premises identified in the application—

(i) has, or can reasonably be provided with, off-street parking for 3 or more vehicles; or

(ii) are situated within the boundary of an Event Traffic Area.

(4) A parking permit (an eligible organisation parking permit) may be granted to an eligible organisation2 if the local government is satisfied that—

(a) the eligible organisation does not have and cannot reasonably acquire adequate off-street parking; and

(b) the permit will only be used to facilitate the parking on an off-street regulated parking area of—

(i) a vehicle which is—

(A) owned by, or under the control of, the eligible organisation; and

(B) primarily used by the eligible organisation for the undertaking of a charitable activity of the organisation; or

(ii) a vehicle which is—

(A) owned by, or under the control of, a volunteer of the eligible organisation; and

(B) being used by the volunteer whilst the volunteer is actively engaged in a charitable or not-for-profit activity of the organisation.

(5) A parking permit (an eligible volunteer parking permit) may be granted to a volunteer of an eligible organisation if the local government is satisfied that—

(a) the eligible organisation does not have and cannot reasonably acquire adequate off-street parking; and

(b) the permit will only be used to facilitate the parking on an off-street regulated parking area of a vehicle which is —

(i) owned by, or under the control of, the volunteer; and

(ii) being used by the volunteer whilst the volunteer is actively engaged in a charitable or not-for-profit activity of the organisation.

(6) A parking permit (a temporary parking permit) may be granted to allow the holder of the permit to park 1 or more vehicles in a designated parking space or spaces for a period specified in the permit despite an indication on an official traffic sign to the contrary and despite the fact that paid parking would otherwise apply to the space or spaces.

(7) A temporary parking permit may only be granted if the local government is satisfied that

(a) the applicant is engaged in some temporary activity affecting premises immediately adjacent to the designated parking space or spaces to which the application relates; and

(b) it is not reasonably practical for the applicant to carry out that activity unless the designated parking space or spaces to which the application relates are allocated to the applicant’s exclusive use for the duration of the activity.

(8) A parking permit (a works zone parking permit) may be granted if the local government is satisfied that

(a) the part of the road to which the application relates is adjacent to the site of proposed building or construction work; and

(b) the carrying out of the building or construction work is lawful; and

(c) having regard to the nature of the building or construction work and the characteristics of the site of the work, it is not reasonably practical for all work activity involving vehicle loading and unloading and associated

vehicle movements to be confined within the site.

(9) A parking permit (a local government employee parking permit) may be issued to a person whose circumstances are as follows

(a) the person is a local government employee; and

(b) for the primary purpose of carrying out his or her duties as a local government employee, the person parks his or her vehicle in a designated parking space on an off-street regulated parking area which is designated by the local government for the parking of vehicles by the holder of a local government employee parking permit.

(10) A parking permit (a multi-residential premises visitor parking permit) may be granted in circumstances where—

(a) a person (the resident) resides in multi-residential premises on a section of road and parking immediately adjacent to the multi-residential premises is regulated by time; and

(b) the permit is to be made available by the resident for use by another person who—

(i) is visiting, or attending at, the multi-residential premises; and

(ii) intends parking on the section of road immediately adjacent to the multi-residential premises; and

(c) the multi-residential premises does not have, and cannot reasonably be provided with, an off-street parking space for use by visitors of the resident; and

(d) if the permit is granted—there would not be in force more than 1 multi-residential premises visitor parking permit for the multi-residential premises; and

(e) the multi-residential premises are not situated within the boundary of an Event Traffic Area.

(11) A parking permit (a detached premises visitor parking permit) may be granted in circumstances where—

(a) a person (the resident) resides in detached premises on a section of road and parking immediately adjacent to the detached premises is regulated by time; and

(b) the permit is to be made available by the resident for use by another person who—

(i) is visiting, or attending at, the detached premises; and

(ii) intends parking on the section of road immediately adjacent to the detached premises; and

(c) the detached premises does not have, and cannot reasonably be provided with, an off-street parking space for use by visitors of the resident; and

(d) if the permit is granted—there would not be in force more than 3 detached premises visitor parking permits for the detached premises; and

(e) the detached premises are not situated within the boundary of an Event

Traffic Area.

(12) A parking permit (a special parking permit) may be granted if the local government is satisfied that the grant of the permit—

(a) is consistent with the objects of the local law; and

(b) will—

(i) promote the effective and efficient management of road use in the local government area; or

(ii) contribute to the strategic management of road infrastructure, and in particular, vehicle parking facilities, on roads in the local government area; or

(iii) protect the environment and public health, safety and amenity within built-up areas in the local government area from the adverse effects of the parking of vehicles on roads.

(13) A parking permit (a resident’s event parking permit) may be granted in circumstances as follows —

(a) a person resides in a residence3 situated on a section of road and parking immediately adjacent to the residence is regulated by time; and

(b) the section of road immediately adjacent to the residence is situated within the boundary of the Robina Stadium Traffic Area or the Stadium Residential Traffic Area; and

(c) the grant of the resident’s event parking permit would not unduly impede the flow of traffic either on the road or in the area; and

(d) if the resident’s event parking permit is granted — there would not be in force for the same residence, the resident’s event parking permit and any of—

(i) a multi-residential premises resident parking permit; or

(ii) a detached premises resident parking permit; or

(iii) a multi-residential premises visitor parking permit; or

(iv) a detached premises visitor parking permit; and

(e) the number of resident’s event parking permits which may be granted for a residence (other than a residence which forms part or the whole of a lot in a community titles scheme) is—

(i) if the measured frontage of the residence is less than 6m—nil;

(ii) if the measured frontage of the residence is 6m or more, but less than 12m—1;

(iii) if the measured frontage of the residence is 12m or more—2; and

(f) if a resident’s event parking permit is granted for a residence (other than a residence which forms part or the whole of a lot in a community titles scheme) — there would not be in force more than 2 resident’s event parking permits for the residence; and

(g) if a residence forms part or whole of a lot in a community titles scheme —

(i) only the body corporate for the community titles scheme may be granted a resident’s event parking permit; and

(ii) the maximum number of resident’s event parking permits which may be granted to the body corporate is 2.

(14) A parking permit (a main beach event parking permit) may be granted in circumstances as follows—

(a) a person resides in a residence situated on a section of road and parking immediately adjacent to the residence is regulated by time; and

(b) the section of road immediately adjacent to the residence is situated within the boundary of the Main Beach Traffic Area; and

(c) the grant of the main beach event parking permit would not unduly impede the flow of traffic either on the road or in the area; and

(d) if the main beach event parking permit is granted—there would not be in force for the same residence, the main beach event parking permit and any of—

(i) a multi-residential premises resident parking permit; or

(ii) a detached premises resident parking permit; or

(iii) a multi-residential premises visitor parking permit; or

(iv) a detached premises visitor parking permit; and

(e) the number of main beach event parking permits which may be granted for a residence is—

(i) if the residence identified in the application for the permit is situated in a high rise building or a medium rise building—nil;

(ii) if the residence identified in the application for the permit is situated in a low rise building and—

(A) the measured frontage of the residence is less than 6m—nil;

(B) the measured frontage of the residence is 6m or more, but less than 12m—1;

(C) if the measured frontage of the residence is 12m or more—2.

12 Other information to accompany a parking permit applicationLocal Law, s29(f)

(1) The other details or information which must accompany an application is—

(a) if the application is for a multi-residential premises resident parking permit or a detached premises resident parking permit— the details or information specified in subsection (2); and

(b) if the application is for an eligible volunteer parking permit— the details or information specified in subsection (3); and

(c) if the application is for a works zone parking permit— the details or information specified in subsections (4) to (6) inclusive; and

(d) if the application is for a multi-residential premises visitor parking permit or a detached premises visitor parking permit—the details or information specified in subsection (7); and

(e) if the application is for a resident’s event parking permit or a main beach event parking permit—the details or information specified in subsection (8).

(2) The other details or information which must accompany an application for a multi-residential premises resident parking permit or a detached premises resident parking permit is—

(a) a copy of the current registration certificate for each vehicle identified in the application; and

(b) written evidence that the applicant resides at the residence identified in the application, for example, a copy of the current driver licence of the applicant; and

(c) written particulars of all off-street parking facilities on the land on which the residence is situated which are, or can reasonably be made, available for use by the applicant.

(3) An application of a volunteer for an eligible volunteer parking permit must be accompanied by written evidence from the eligible organisation identified in the application that the eligible organisation—

(a) does not have and cannot reasonably acquire adequate off-street parking; and

(b) has authorised the volunteer to engage in an activity which is consistent with the objects of the eligible organisation.

(4) A person who applies for a works zone parking permit must also apply to the local government for declaration of a specified part of the road adjacent to the site of the proposed building or construction work as a works zone.

(5) The applicant for the works zone parking permit must be the person undertaking the building or construction works.

(6) The application must be made at least 3 weeks prior to the date of commencement of the building or construction work to which the application relates.

(7) The other details or information which must accompany an application for a multi-residential premises visitor parking permit or a detached premises visitor parking permit is—

(a) written evidence that the applicant resides at the residence identified in the application, for example, a copy of the current driver licence of the applicant; and

(b) written particulars of all off-street parking facilities on the land on which the residence is situated, which are, or can reasonably be made, available for use by a person who is visiting, or attending at, the residence.

(8) The other details or information which must accompany an application for a resident’s event parking permit or a main beach event parking permit is—

(a) written evidence that the applicant resides at the residence identified in the application, for example, a copy of the current driver licence of the

applicant; and

(b) written particulars of the measured frontage of the residence; and

(c) written particulars of all off-street parking facilities on the land on which the residence is situated which are, or can reasonably be, made available for use by—

(i) the applicant; or

(ii) a person who is visiting, or attending at, the residence; and

(d) other details or information as is necessary to satisfy the local government that the circumstances of the applicant—

(i) if the application is for a resident’s event parking permit—satisfy the criteria specified in section 11(13); and

(iii) if the application is for a main beach event parking permit—satisfy the criteria specified in section 11(14).

13 Term of parking permit Local Law, s30(4)

(1) The term for which a parking permit is granted or renewed will ordinarily be—

(a) for a special parking permit—3 months; and

(b) for any other parking permit granted under section 11—12 months.

(2) However, the local government may fix some other term for a parking permit if it is desirable to do so

(a) to provide common expiry dates for parking permits; or

(b) for some other reason.

14 Conditions of parking permit Local Law, s31(3)

(1) This section specifies the conditions that will ordinarily be imposed on a parking permit.

(2) The conditions that will ordinarily be imposed on all parking permits are

(a) the holder of the permit must affix the permit to the vehicle identified in the permit facing outwards and as near as practicable to the registration label for the vehicle; and

(b) a replacement permit will only be issued after completion by the permit holder of a statutory declaration detailing the facts and circumstances of the loss, destruction or damage of the original permit.

(3) The conditions that will ordinarily be imposed in a multi-residential premises resident parking permit and a detached premises resident parking permit are—

(a) the permit must be used only in respect of the parking of a vehicle identified in the permit at the location identified in the permit which must be—

(i) the road adjacent to the residence identified in the permit; or

(ii) the 1 or more segments of road in close proximity to the residence identified in the permit; and

(b) the holder of the permit must only use the permit whilst the holder resides at the residence identified in the permit.

(4) The conditions that will ordinarily be imposed in an eligible organisation parking permit are—

(a) the permit must be used only in respect of the parking of a vehicle at an off-street regulated parking area identified in the permit; and

(b) the permit must only be used by the holder of the permit if the holder is actively engaged in an activity which is consistent with the objects of the eligible organisation; and

(c) the permit may be used by a volunteer of the eligible organisation but only if the volunteer is actively engaged in an activity which is consistent with the objects of the eligible organisation.

(5) The conditions that will ordinarily be imposed in an eligible volunteer parking permit are—

(a) the permit must be used only in respect of the parking of a vehicle at an off-street regulated parking area identified in the permit; and

(b) the permit must only be used by the volunteer if the volunteer is actively engaged in an activity which is consistent with the objects of the eligible organisation identified in the permit.

(6) The conditions that will ordinarily be imposed in a works zone parking permit are

(a) the permit must specify the part of the road to which the permit relates; and

(b) the holder of the permit must pay the prescribed fee, as determined by the local government, for the installation of official traffic signs, or other signs and markings, as determined by the local government to be appropriate, to identify the boundaries of the works zone identified in the permit; and

(c) a vehicle must not be parked within the works zone except while it is being loaded or unloaded in connection with the building or construction work to which the permit relates; and

(d) materials of any kind must not be stacked, placed or otherwise left on the road or footpath (either within or outside of the works zone); and

(e) a vehicle must not be parked, and loading or unloading or other operations must not be carried out, in a manner which obstructs pedestrian movement along a footpath within or adjacent to the works zone.

(7) The conditions that will ordinarily be imposed in a local government employee parking permit are

(a) the permit must specify 1 or more off-street regulated parking areas to which the permit relates; and

(b) the permit will ordinarily specify that the holder of the permit may only park the vehicle identified in the permit on an off-street regulated parking area identified in the permit

(i) for the primary purpose of carrying out his or her duties as a local government employee; and

(ii) during specified days and times; and

(iii) for the duration of one or more specified events.

(8) The conditions that will ordinarily be imposed in a multi-residential premises visitor parking permit and a detached premises visitor parking permit are—

(a) the permit must be used only in respect of the parking of a vehicle at the location identified in the permit which must be—

(i) the road adjacent to the residence identified in the permit; or

(ii) the 1 or more segments of road in close proximity to the residence identified in the permit; and

(b) the permit must only be used by a person visiting, or attending at, the residence identified in the permit; and

(c) the permit is not specific to any particular vehicle.

(9) The conditions that will ordinarily be imposed in a special parking permit are

(a) the permit must be used only in respect of the parking of a vehicle on a road or at an off-street regulated parking area identified in the permit; and

(b) the permit is not specific to any particular vehicle; and

(c) if the permit specifies that the permit may only be used in specified circumstancesthe permit may only be used in the specified circumstances.

(10) The conditions that will ordinarily be imposed in a resident’s event parking permit are—

(a) the permit must be used only in respect of the parking of a vehicle at the location identified in the permit, which must be the road immediately adjacent to the residence identified in the permit; and

(b) the holder of the permit must only use the permit whilst the holder resides at the residence identified in the permit; and

(c) a resident’s event parking permit is not specific to any particular vehicle.

(11) The conditions that will ordinarily be imposed in a main beach event parking permit are—

(a) the permit must be used only in respect of the parking of a vehicle at the location identified in the permit, which must be the road immediately adjacent to the residence identified in the permit; and

(b) the holder of the permit must only use the permit whilst the holder resides at the residence identified in the permit; and

(c) a main beach event parking permit is not specific to any particular vehicle.

Part 5 Minor traffic offence infringement notice penalties

15 Infringement notice penalty amounts—Local Law, s36(1)

For section 36 of the local law, the infringement notice penalty amount4 for an offence mentioned in column 1 of schedule 3 is the corresponding amount stated in column 2 of schedule 3.

local government employee has the meaning given in the Local Government Act 2009.

local government employee parking permit see section 11(9).

low rise building, means a building which has—

(a) a height which does not exceed 9m above ground level immediately adjacent to the building; or

(b) up to 2 storeys, with option for a partial third storey, provided the height of the building does not exceed 9m above ground level immediately adjacent to the building.

Main Beach Traffic Area see section 5(d).

measured frontage, of a residence, means—

(a) the length, measured in metres, along the alignment of the residence abutting a road; but

(b) does not include the width of the driveway of the residence abutting the road.

medium rise building, for multi-residential premises, means a building which has

(a) a height which exceeds 9m, but does not exceed 32m above ground level immediately adjacent to the building; or

(b) 3 or more, but not more than 8 storeys.

multi-level building —

(a) means a building in which 1 or more residences in the building —

(i) share a ceiling or floor with at least 1 other residence in the building; and

I would find this parking alterations of signage depicting "Limited Time" a disruption of my Activities inside the Gallery, being either Reception, Committee member, Art Student. Closing the Gallery, or packing up my materials to relocate my vehicle to another space, if available. Closing the Gallery would inconvenience the Public within the Art Gallery itself and by vacating them from the premises just to move my vehicle. I am not in favour of this at all.

I wish to complain about timed parking that is planned for the Central Area around Broadbeach (ocean side) it will be extremely difficult for us members (visitors to functions) of the Royal Queensland Art Society to go to classes as we have a lot of material to bring with us and we would have to spend a lot of time going out and finding somewhere else to park (probably blocks away). Some being seniors it would be even more difficult. We paint there from for up to 5 - 7 hours and make several trips to the car each time we come and go. Limited parking could mean a drop in membership if it becomes too difficult. Specially as we are just putting in a lift at great expense to help people come up stairs where we paint.

The RQAS has been so helpful in the Gold Coast Arts and Cultural community and this move would definitely cripple their chances of growth as it would inconvenience many many artists (old and young) that frequent that establishment 7 days in any given week. Workshops are constantly held there all throughout the day and night and this would be such a deterrent to all participants. I am a member of RQAS the gallery is situated at 25 Broadbeach Blv Broadbeach 4218. As there is no parking directly next to the buildings, members are required to park their cars in surrounding streets and walk carrying their equipment with them. As I suffer from MS (have a disability parking sticker) I would find it almost impossible to manage a restricted parking time if I was required to move my car and try and find another park. As a lot of our members are in their senior years, many would find restrictions in parking very difficult. I appreciate your consideration in this matter.

I am artist and a member of the Royal Queensland art Society. I therefore have to do a duty every month to man the gallery for five hours. I often do this duty on my own. I therefore would be unable to keep moving my car if there was limited parking because I would have to leave the gallery unmanned. A lot of work in the gallery is on a voluntary basis and the extra costs of parking will influence how much time members will give to the society. I furthermore attend a pastel demonstration each month on a Saturday and attend an art class weekly. The art class is for several hours. Imagine that every member would have to leave the lesson to address parking; some workshops go over two days in the weekend. Every two months I swap over my art works. I am not sure if I and other people could financially continue being a member if we have to pay that much extra costs in parking on a weekly basis. Not just me, but it would mean that a lot of older women and men who are members of RQAS would stop attending workshops and volunteering because of this added stress and interruption. The RQAS would subsequently reduce in numbers and a traditional and longstanding club that has taken many years to build, would eventually close up. The Gold Coast would lose a valuable asset and all the people who love to do art (that are not professional) will be devastated. I implore you to reconsider the parking restriction

We have thousands of visitors annually. We are hoping that the needs of our members and visitors can be accommodated in your plans with either designated parking spaces (we have on average 20 pax per class) or by leaving the free parking hours available on the Boulevard. The proposed amendment would make it impossible for me to attend art classes at RQAS Broadbeach without leaving a 3-4 hour class to shift my car or put more money in a meter. As it is I drive quite a way to attend classes. Taking the bus is not an option with a big bag of art supplies and a large wet canvas so if more parking becomes 3 hours or less I wouldn't attend classes anymore and nor would a lot of other students I expect, sending the RQAS broke. I hope the mayor as patron doesnt let this happen.

As one of many members of RQAS, I regularly attend its premises at 25 Broadbeach Boulevard Broadbeach to participate in painting workshops, seminars and other art related activities which requires me to carry painting equipment. These activities usually involve a minimum of four hours. The membership of RQAS is located across the Gold Coast. This involves travel to the premises by public transport or by vehicle. If City of Gold Coast is to impose regulated parking in the area which limits time to a maximum of two hours, there is currently no provision made for regulated offstreet parking to use for longer periods. Perhaps the City can offer our members parking permits for our use in that area.

We are a Not-For-Profit kindergarten situated on the corner of Armrick Avenue & Broadbeach Boulevard Broadbeach. We understand that Nikiforides Park precinct and quite possibly our shared kindergarten, croquet & lawn bowls car park will all be zoned three hour parking only should the plan go ahead. What prompted this change? Was it due to the Commonwealth Games? Our kindergarten has been operating since 1953 and our families have used this car park to safely alight their children through our car park entry gate for many, many years. Families often have a younger sibling who must also be brought in to the kindergarten to sign their child in and out for the day for insurance purposes and by law. At times the car park is full with other cars and the parents use the street parking directly in front and across the road from the kindergarten. Due to the ever-increasing traffic flow we approached City of Gold Coast for a pedestrian crossing, however,

Realising the actual and imminent danger to our children and families City of Gold Coast instead installed “Children Crossing” signs before and after the kindergarten. Since the car park has been surfaced several parks were lost and parents were forced to park further away and across the road, making entry to the kindergarten more dangerous. Our main consideration and worry is for the safety of our children, families and staff. We therefore request that this car park have designated staff and kindergarten spaces for their continued safe access through our car park gate directly into our grounds. We also ask that between the hours of 8.30am and 9.30am and between 2.15pm and 3.15pm a “drop off” zone be marked immediately in front of the kindergarten to allow 15 minute access for parents to park and bring their children in and sign them in. The other pressing issue for us is staff parking. Our three teachers work five days per week. Should no designated parking be assigned to them we have a problem, as under our duty of care and National Quality Standards and Regulations, staff are not permitted to leave the children at all during contact time. This is a legal issue and one that cannot be compromised by staff, or by our Committee as employers. We ask that you address this issue in consultation with our committee and with the committees of our tight-knit community of not-for-profit neighbouring organisations including the Broadbeach Bowls Club, the Broadbeach Croquet Club, the Broadbeach Surf Club, the Royal Queensland Art Society, and the Broadbeach Soccer Club prior to any changes. Our organisations consist primarily of very young

FURTHER IMPACTING INFORMATION TO HAND THIS MORNING VIA – BUS STOP TAKING UP TO FIVE MORE CAR SPACES! DIRECTLY IN FRONT OF THE KINDERGARTEN! We received registered mail letter this morning from {REDACTED}A/Director (Infrastructure), TransLink Division, Dept. Transport & Main Roads in relation to a bus stop being erected late September on our western boundary shared with our car park. This will mean we will lose at least another FIVE car spaces. Have you given any consideration to the safety of our children and families who travel by car from as far away as Kingscliff and Labrador to attend our kindergarten as it assessed by ACECQA as “Exceeding”. If our present and future families are not able to park and enter the safely we will lose enrolments and jeopardize our 64 year old kindergarten program. Will you please add this information to our previous submission in relation to the car park and make it reserved for use by our kindergarten staff and families permanently? It appears to be that all this is being carried out for the

Removing the current spaces at the front of the kindergarten will mean parents will be having to cross the road with young children in an area that does not have adequate signage that it is a school zone and no school zone speed limit, however Hedges Ave has no schools and a 30kmp limit! This area is another spot that commuters speed through to avoid the Gold Coast Highway. Change the speed limit, not limit the parking. These changes will effect businesses in the area and the safely of the children attending Broadbeach Kindergarten.

As a parent of a child at the Broadbeach Community Kindergarten at 2 Armrick Ave, Broadbeach I am concerned about the lack of parking that might result from changes to the kindergarten car park or on-street parking in the immediate vicinity of the kindergarten. The area is already very busy during drop-off and pick-up times and any loss of spaces would result in parents needing to park further away. This is of concern as many parents are juggling more than one small child, along with their bags and other belongings. We have entry to Croquet club via Chelsea Ave and Armrick St Broadbeach. Our club is part of the vibrant sports and cultural precinct and regulated parking will impinge on access to the club and hours of attendance. Members are generally 60 years plus and need to keep playing their sport of choice and access to parking is paramount as they come from near and far to enjoy this active and brain training mode of sport. It would be unfair for all of our local precinct users to have to worry about timed parking and it would be a deterrant for all people associated with this precinct to continue supporting their preferred activity and have to look away from the facilities that Broadbeach offers.

parks each in Chelsea Ave & Broadbeach Blvd. Should this ridiculous parking limit be imposed upon us the Council will need to provide a lot more than 4 parking spaces for surf club members. Broadbeach SLSC is hosting surf & IRB carnivals during summer and winter and a 2 hour parking limit will cause chaos for officials and competitors attending these events. The Committee believes that this is a retrograde step for the tourist capital of Australia. The person/s who thought this idea up should do a site inspection to see what not for profit clubs are up against should their idea be implemented.
