FOREWORD
As per item 8 of State List (List II) of the Constitution of India, the power to legislate on IntoxicatingLiquor (its production, manufacture, possession, transport, purchase and sale) lies with the StateGovernment. As per item 51 of the aforesaid List, the State Government has the power to collect Dutiesof Excise on alcoholic liquors for human consumption.
The policy of the State Government is not to encourage indiscriminate growth in consumption ofintoxicants but to socially regulate it in a manner such that even with respect to the existing pattern ofconsumption, drinking is conducted in a safe manner i.e. the persons who are in the habit of consumingintoxicants turn away from the consumption of illicitly distilled & or non-duty paid intoxicants to sociallyregulated consumption of intoxicants from legitimate sources which ensure safety against health hazardsand lead to a consequential growth in revenue as well.
The activity of the Excise Directorate centre around the enforcement of regulations relating to themanufacture, production, possession, distribution, transport, selling and buying of Liquor and otherintoxicants. The Excise Directorate strives to achieve the twin needs of preventing the manufacture,supply and distribution illicit/counterfeit/spurious and or non-duty paid intoxicants and attaining thefull realisable revenue potential of the State since prohibition is not a viable option.
The financial year 2016-17 saw the circulation of mandate of the establishment of “ChemicalExamination Laboratory” in every distillery and manufactory of potable liquor , setting up of a newbeverages corporation namely West Bengal State Beverages Corporation Ltd to take over the distributionof liquor throughout the state of West Bengal to curb the problem of illicit liquor ,introduction of digitisedflowmeters in the distilleries to scarp human intervention in physical issue of spirit from the distilleryand introduction circle level access to e-Governance applications through our departmental website.
The Annual Administrative Report of the Excise Directorate for the financial year 2016-17 is an effortto outline the activities of this Directorate and its field officers during the period both in qualitative andquantitative terms. This year emphasis has been given on compiling data in a functional and usefulmanner so that it can be used as a ready reckoner for all the stakeholders.
The publication of the Annual Administrative Report is a collective and sincere effort of the officers ofthe Excise Directorate. Although all efforts have been taken to ensure accuracy in compiling the statisticaldata received from the field officers, the possibility of error cannot be ruled out. As such, any additionsor corrections would be welcomed for inclusion in the next publication of this report.

FUNCTIONS OF THE EXCISE DEPARTMENTThe Excise Department, Government of West Bengal, is concerned with the regulation of the manufacture,supply, distribution and sale of liquor and other intoxicants in the State, and the collection of StateExcise Duties, Fees and other monies derived from such manufacture, distribution, sale and regulation.The Department achieves these objectives by :
a) Granting and regulating licenses for the manufacture, wholesale and retail sale of liquor and spiritsused for the manufacture of liquor;
b) Authorizing the manufacture and / or sale of brands of bottled liquor in the state, through a processof registration of brands of foreign liquor, coloured & flavoured spirit and country spirit and of thelabels under which they can be manufactured and / or sold;
c) Regulating the movement of liquor, and spirits used for the manufacture of liquor into, throughoutand from the state, through the grant and administration of relevant import, export and transportpasses;
d) Monitoring and maintaining records of inventories of liquor and spirits used for the manufacture ofliquor, at all the liquor-manufacturing, wholesale and retail locations in the state;
e) Operating mechanisms for the collection of state excise duties on liquor and fees and other leviescharged and imposed by the Government on the manufacture, distribution and sale of liquor;
f) Carrying out enforcement activities against the illegal manufacture of liquor and against thedistribution and sale of such illegally manufactured liquor and liquor on which the requisite StateExcise Duties and / or Fees has not been levied;
g) Carrying out enforcement activities against the manufacture, distribution, sale and possession ofnarcotics; and
h) Regulating the manufacture, supply, distribution and sale of spirits and narcotic drugs for medicinaland industrial purposes through the issue and administration of relevant licenses, permits andpasses.
In short, the main objective of the Excise Department is to manage the supply-chain of liquor and otherintoxicants in the State with a view to ensure that all liquor and other intoxicants manufactured orotherwise available are sourced through legal channels and to prevent the loss of revenue due to theGovernment on account of Excise Duties and Fees.

1. Establishment Section :
Establishment Section is headed by a Deputy Commissioner of Excise, Headquarter. He is assisted bythe Personal Assistant to the Excise Commissioner. It looks after the service matter of the employees ofall ranks in the Excise Directorate including the officers belonging to the West Bengal Excise Service. Inaddition, this section is also entrusted with the processing of all applications regarding grant of all kindsof retail Excise Licenses.
2. Distilleries & Warehouses Section :
The Section is headed by the Deputy Commissioner of Excise, Distilleries & Warehouses. He is assistedby the Superintendent of Excise, Distilleries & Warehouses and the Additional Superintendent of Excise,Distilleries & Warehouses. The Section looks after manufacture and supply of Country Spirit in theState. The Section also monitors manufacture and supply of rectified spirit by the distilleries of the State,regulates imports of Rectified Spirit for potable purpose and administers the provisions of the W.B.Molasses Control (Regulation, Storage & Transport) Notified Order, 1986 in the State. Compilation ofdifferent reports and returns in connection with consumption of intoxicants and collection of revenue isentrusted to this Section. The purchase of Excise Opium for medical purpose and its distribution to allOpium Depots over the State through districts treasuries is done by this Section. Regular meetings,conferences, seminars, etc. at the Excise Directorate are also arranged by this Section.
3. Law Section :
Law Section is headed by one Deputy Commissioner of Excise. He is assisted by one Superintendent ofExcise and one Addl. Superintendent of Excise. This Section is responsible for proper representationbefore different legal forums in cases where the Department is a party and to take steps to defend andprotect the interest of the Department in such cases.
4. Foreign Liquor Section :
The Section is headed by the Deputy Commissioner of Excise, Foreign Liquor. He is assisted by theSuperintendent of Excise, Foreign Liquor. The Section looks after the manufacturing and supply ofForeign Liquor in the State. This Section regulates import of ENA and other kinds of Spirit required in themanufacturing of potable Foreign Liquor. The Section control export of India made Foreign Liquor andsupply of the same out of India.
5. Organisation Section :
The Organisation Section is headed by the Deputy Commissioner of Excise, Organisation. He is assistedby Special Superintendent of Excise, Organisation and the Administrative Officer.
The Section looks after among other matters construction, repair, maintenance of Buildings, Barracks,Warehouses, Lands of the Excise Department including their up-keeping etc. The Section also overseesthe supply of office furniture, apparatus, instruments, uniforms, stationeries and vehicles – bothGovernment and hired.

Budget and allotment of fund to the outlying districts and organisations under the control of ExciseDirectorate, which is essential for running the day to day administration is done from this Section.
6. Excise Divisions :
Under the general control of the Excise Commissioner, West Bengal, there are now eight Excise Divisions– two in Jalpaiguri administrative division, three in Burdwan administrative division and three inPresidency administrative division. Each such Division is headed by a Deputy Commissioner of Excise.There shall be a striking force under the control of the Deputy Commissioner of Excise in each Division.This striking force comprises of Superintendent of Excise, Additional Superintendent of Excise, andDeputy Excise Collector(s), Sub-Inspector of Excise, Assistant Sub-inspector of Excise and ExciseConstables.
7. Narcotic Cell :
Narcotic Cell is headed by a Deputy Commissioner of Excise. He is assisted by one Superintendent ofExcise and one Deputy Excise Collector. This Cell is entrusted for prevention and detection of crimesrelating to Narcotic Drugs and Psychotropic Substances Act, 1985 and prosecution of offenders underthe Act.
8. Special Section :
Special Section is responsible to administer provisions of the Medicinal and Toilet Preparations (ExciseDuties) Act, 1955 (Central Act 60 of 1955). The Section is headed by one Deputy Commissioner ofExcise who is assisted by two Superintendents of Excise and one Addl. Superintendent of Excise.Administration relating to Industrial Alcohol and import of Rectified Spirit for medicinal purposes arealso entrusted to this Section.
9. Training Institute :
Training Institute is headed by one Deputy Commissioner of Excise, who is assisted by one Superintendentof Excise. This institute imparts both theoretical and practical training to the new entrant Excise officialsof different cadres as well as organises in-service training programmes for the officers at different traininginstitutes viz. Police Training College, Administrative Training Institute, National Academy of CentralExcise and Narcotics etc.
10. Computer Cell :
There is a Computer Cell in the Excise Directorate under the general control of Excise Commissioner.An excise officer of the rank of Deputy Commissioner of Excise (Systems) is in charge of this cell. ThisCell is manned by two Deputy Excise Collectors and two Systems Analysts in this cell. This cell isentrusted to look after the e-governance programme in the Excise Directorate.
11. Statistics and Analysis Cell :
The Statistics and analysis cell will be headed by one Deputy Commissioner of Excise (Statistics andAnalysis) at the Excise Directorate under the general control of the Excise Commissioner, West Bengal.This cell shall be manned by such officers and personnel as may be arranged by the Excise Commissionerfrom within the sanctioned strength of Excise personnel.

12. Chemical Examination Laboratory :
The Laboratory is headed by the Chemical Examiner to the Government of West Bengal. He is assistedby two the Deputy Chemical Examiners. The Laboratory is entrusted with the analysis of samples ofseized intoxicants sent by different Investigating Officers detected under the B.E. Act and the N.D.P.S.Act. The reports of such analysis play an important role in prosecution. Besides this work the Laboratoryalso tests samples of different intoxicants received from manufacturing units and warehouses. SpecialSection also sends samples to this Laboratory for analysis and test to oversee as to whether themanufactured products conform to the prescribed standard and norms.
13. Internal Audit Unit :
Internal Audit Wing at Excise Directorate is an independent organisation under Excise Commissioner.This Wing is headed by one Deputy Commissioner (Audit & Accounts) who is assisted by three AssistantCommissioner (Accounts) & three Auditors.
The main function of this Wing is to ensure that the existing regulations and procedures are beingcarried out in proper manner in respect of Govt. Receipts & Expenditure. The Unit is responsible forscrutinising and detecting irregularities in assessment and levy of State Excise Duty and different Feespayable by the holders of Licenses in accordance with the provisions of the Bengal Excise Act, 1909 andN.D.P.S Act, 1985 and the rules framed thereunder.
This Unit also helps in replying the queries raised by Hon’ble Public Accounts Committee, C.A.G. ofIndia, Principal A.G. (Audit), West Bengal & A.G. (E.R.S.A.), West Bengal.

ACTS ENFORCED1. Acts Administered :
Following Acts and rules framed thereunder were administered during the period under report :
1. The Bengal Excise Act, 1909 (Ben. Act V of 1909),
2. The Narcotic Drug and Psychotropic Substances Act, 1985 (Central Act 61 of 1985),
3. The Medicinal and Toilet Preparations (Excise Duties) Act, 1955 (Central Act 60 of 1955)
4. The West Bengal Molasses Control Act, 1973 (W.B. Act VI of 1973).
2. Amendments in the Bengal Excise Act, 1909 up to 2016-17 :
Necessary amendments have been made in the Bengal Excise Act, 1909 (Government Notification No.1137-L, Dated 2nd August, 2012) to make the penal provisions more stringent. A new Section 46 AAhas been introduced in the said Act to increase the punishment of the offenders involved in adulterationof liquor or any intoxicating drug which is likely to cause disability and death to the people toimprisonment for life, or imprisonment of either description for a term which may extend upto ten yearsand fine. Barring a few, all the offences under the Bengal Excise Act were made non-bailable. In addition,fine and imprisonment in various contravening sections of the Bengal Excise Act have also been increased.

REVENUE EARNINGS DURING 2016-17Excise Revenue collection during the Financial Year 2016-17 has crossed Rs.5000 Crore mark. Thetotal collection was Rs.5201.21 Crore which is 29.58 % higher than the collection of the previous yearwhich was Rs.4014.00 Crore.
Of the total Excise Revenue collected in 2016-17 Rs.2839.67 Crore i.e. 54.59 % was from ForeignLiquor. On the other hand, collections from Country Spirit and Beer were Rs.1752.80 Crore and 557.81Crore which were 33.69% and 10.72% respectively of the total revenue.
Consumption of Country Spirit during the Financial Year under review has shown a growth rate of 6.94% in comparison to previous year. Total amount of Country Spirit consumed during the period was1433.37 Lakh LPL.
During the Financial Year 2016-17 consumption of Foreign Liquor (excluding Beer) was 1116.43 LakhBL showing 6.31% increase over previous year.
Consumption of Beer has registered a 15.3 % growth in this Financial Year. Total consumption of Beerin 2016-17 was 1207.33 Lakh BL.

PREVENTIVE ACTIVITY DURING 2016-17
During the year under reference special emphasis was laid on preventive activities so the departmentundertook round the clock preventive activity throughout the year. In 2016-17 total 61354 cases werelodged against illicit distillation of liquor and 17.759 lakh litre of Illicitly Distilled Liquor was seized. Inaddition128.655 lakh litre of Fermented Wash was also seized and destroyed.
Notable seizure of Fake Liquor and Over Proof Spirit has also been registered in the period concerned.Total 19060.63 litre of Fake Liquor and 12471.0 litre of Over Proof Spirit were seized in 2016-17.
Under the Narcotic Drug and Psychotropic Substances Act,1985 total 20 cases were lodged by theExcise Department in this financial year. 13 persons were arrested in connection to these cases.Nonetheless, Department was also successful in seizing and destroying huge poppy and Ganja plantation.Throughout the state 62.4 Kg of Ganja, 89502 Ganja Plants, 13173 poppy plants were seized in thisfinancial year

SPECIAL SECTION
Excise department also administers and regulates use of alcohol for Industrial, Medicinal and Cosmetic
purpose through the Special Section of Excise Directorate. This section is headed by a Deputy
Commissioner of Excise, subject to the general control of Excise Commissioner, West Bengal. He is
assisted by one Special Superintendent of Excise, and two Superintendents of Excise, one Additional
S.E, seven Deputy Excise Collectors, twenty three Sub-inspectors of Excise, forty nine Excise Constables
and two Group D staffers. There is also one Cash and Accounts Officer. Special Section maintains a
separate establishment of two Head Assistant, three U.D Assistants, one L.D Assistants and one Typist
(One Grade I typist).
Special section is responsible for regulation, control and implementation of the central act and rules
mainly Medicinal and Toilet Preparation Act, 1955 and Medicinal and Toilet Preparation Act, 1955
and Medicine and Toilet Preparation (Excise Duties) Rules, 1956. This section also deals with the
B.E. Act, 1909 as amended up-to date in regulating and controlling the provisions relating to Rectified
Spirit including self-generated Spirit and Special Denatured Spirit, Ordinary Denatured Spirit and
Methanol for use in the medicinal and Toilet preparation and also for other industrial purpose. This
section also administers the N.D.P.S. Act, 1985 and N.D.P.S. Rules, 1985 framed in West Bengal by
regulating and controlling Narcotics Drugs and manufactured drugs such as Opium, Ganja, Morphine
and Pethidine etc.

PROCEDURE FOR GRANT OF FOREIGN LIQUOR “ON” CATEGORY LICENSES
The procedure for grant of foreign liquor “On” category retail licenses, viz., F.L “On” Shops, Restaurant-cum-Bars, Hotel-Restaurant-cum-Bars and Hotel-cum-Bars, is governed by the proviso to sub-rule (1) ofRule 9 of the West Bengal Excise (Selection of New Sites and Grant of License for Retail Sale of Liquorand Certain other Intoxicants) Rules, 2003 as amended. In terms of the extant rules an applicant desirousof obtaining a F.L “On” category license has to apply to the Collector of the concerned district in prescribedform with requisite fees. The application is then processed taking into consideration the demand of thearea, the site restrictions applicable, public grievances, if any, and other requirements and if the Collectoris satisfied he sends the proposal to the Excise Commissioner, West Bengal along with his opinion andrecommendations for onward transmission to the Government. Only after the Collector receives intimationfrom the Excise Commissioner regarding accord of approval to the proposal by the Government, hegrants a temporary F.L “On” category license to the applicant for a period not exceeding six monthssubject of realization of requisite monthly fees. Grant of regular license is considered only after thetemporary license has functioned smoothly for six months and the revealed demand justifies the locationfor grant of regular license.
Further, in order to realize the full potential of the existing F.L “On” shop sites a provision was made bythe Government vide Notification No. 1175-Ex dated 03.12.2012 whereby regular F.L “On” shopswhich have functioned at the existing site at a stretch for six months or more were allowed to sellforeign liquor “Off” the site on application being made to the Collector with requisite fees and fulfillmentof certain criteria.

LICENSING OF COUNTRY SPIRIT BOTTLING PLANTS
Prior to 2010 the pricing, supply and distribution of Country Spirit was under exclusivegovernment control. The bottlers of Country Spirit were also awarded exclusive privilegefor supply of Country Spirit in a particular area or district. The retailers were bound tosource their supplies of country spirit from the select bottler enjoying exclusive privilegein the area. However, since December 2010 the country spirit segment has been deregulatedto an extent. New country spirit rules were published by the government vide NotificationNo. 1320-Ex dated 12.11.2010 and the practice of granting exclusive privilege was doneaway with vide Notification No. 1321-Ex dated 12.11.2010. Government control overpricing of country spirit was also deregulated vide Notification No. 1322-Ex dated12.11.2010. With the opening up of this segment new bottlers have been emerging and acompetitive market has led to a considerable growth in consumption of country spiritover the last three years. With the abolition of exclusive privilege the retailer are now atwill to do business with any bottler and such an arrangement has also prevented themarkets from going dry at times due to short supply which was the case earlier. With ahealthy supply side the risk of illicit liquor finding its way into the markets for meetingunfulfilled demand has also been minimised.

EXCISE DIRECTORATE GOVERNMENT OF WEST BENGAL
LICENSING OF FOREIGN LIQUOR MANUFACTORIES
Persons desirous of having a license to run a foreign liquor manufactory in West Bengal are required to
apply in writing to the Excise Commissioner, West Bengal along with non-refundable application money
of Rs. 50,000/- and requisite documents including documents in support of financial capability. If the
Excise Commissioner is satisfied with the financial capability and other particulars and documents, he
recommends the proposal to the State Government for issuance of Letter of Intent (LOI). Once the State
Government issues the LOI, the Excise Commissioner asks the applicant to deposit earnest money of
Rs. 5,00,000/- to the Collector and on submission of original challan showing payment of earnest
money, the LOI is issued to the applicant. The applicant has to submit the application for license along
with requisite documents to the Collector within six months of the issuance of LOI failing which it
stands cancelled and earnest money forfeited to the Government. On receipt of the application for
license the Collector examines the suitability of the site, the building and other points and sends the
application along with his opinion to the Excise Commissioner who, after such further enquiry as he
deems necessary, forwards the same to the State Government along with his opinion. Once the State
Government sanctions the grant of license the applicant is called upon to make arrangements for the
construction of the manufactory within six months of such communication. After completion of
construction the applicant submits two fresh copies of plan to the Collector who causes verification of
the same and sends one copy to the Excise Commissioner for examination. The applicant is further
bound to conform to any instruction from the Excise Commissioner regarding any addition or alteration
to the buildings, vats or other permanent apparatus or plant which he considers necessary. Only after
compliance of the instructions, if any, the Excise Commissioner asks the Collector to grant license to the
applicant. Before the license to work the manufactory is granted the manufacturer has to deposit a
security of Rs. 50,000/- and initial grant fee as applicable against the installed capacity of the plant in
addition to execution of bond as prescribed.

LICENSING OF BREWERIES, MICROBREWERIES AND BREW-PUBSPersons desirous of obtaining a license to work a Brewery of any kind (Brewery, Microbrewery orBrewpub) in West Bengal are required to apply in writing to the Excise Commissioner, West Bengalalong with non-refundable application money of Rs. 50,000/- and requisite documents includingdocuments in support of financial capability. If the Excise Commissioner is satisfied with the financialcapability and other particulars and documents, he recommends the proposal to the State Governmentfor issuance of Letter of Intent (LOI). Once the State Government issues the LOI, the Excise Commissionerasks the applicant to deposit earnest money of Rs. 2,00,000/- to the Collector and on submission oforiginal challan showing payment of earnest money, the LOI is issued to the applicant. The applicanthas to submit the application for license along with requisite documents to the Collector within six monthsof the issuance of LOI failing which it stands cancelled and earnest money forfeited to the Government.
Persons desirous of obtaining a Microbrewery or a Brewpub license are required to additionally applyfor grant of retail outlet license under the new site rules apart from the above requirement.
On receipt of the application for license the Collector holds such enquiry as he deems fit and subject toany directions which may be issued by the State Government or the Excise Commissioner regardingsuitability of the site, the building and other points, having regard to demand and necessity and sendsthe application along with his opinion to the Excise Commissioner who, after such further enquiry as hedeems necessary, forwards the same to the State Government along with his opinion. Once the StateGovernment sanctions the grant of license the applicant is called upon to make arrangements for theconstruction of the brewery. After completion of construction the applicant submits two fresh copies ofplan to the Collector who causes verification of the same and sends one copy to the Excise Commissionerfor examination. The applicant is further bound to conform to any instruction from the ExciseCommissioner regarding any addition or alteration to the buildings, vats or other permanent apparatusor plant which he considers necessary. Only after compliance of the instructions, if any, the ExciseCommissioner asks the Collector to grant license to the applicant. Before the license to work the breweryis granted the brewer has to deposit a security of Rs. 50,000/- and initial grant fee as applicable inaddition to execution of bond as prescribed.

DISTILLERY
At present, only one grain based distillery is functioning in the State catering to only fraction of the totaldemand of rectified spirit in the State. As a consequence, the State is dependent almost entirely on otherStates for meeting its requirement of rectified spirit for manufacture of country spirit, coloured and/orflavoured spirit and foreign liquor. It is also completely dependent on other States for meeting itsrequirements of Extra Neutral Alcohol/Grain Neutral Spirit and alcohol for manufacture of medicinaland toilet preparations and for meeting its requirements of ethanol for blending with petrol as per theEthanol Blending Programme of the Government of India. Such large scale dependence on importsmakes the State vulnerable to the risk of not being able to maintain a continuous and uninterruptedsupply of alcohol in general and of rectified spirit and/or Extra Neutral Alcohol and/or Grain NeutralSpirit (GNS) in particular. Besides, such large scale imports necessarily give rise to avoidable regulatorymeasures relating to administration of permits and passes for preventing leakages in revenue. There is,therefore, a need to create conditions whereby the State Government can source its entire requirementsof potable alcohol from within the State and avoid imports, so that leakages in the process of outsourcingof spirit can be plugged efficiently.
The availability of broken rice in our state and other coerce cereals in other states indicates that there issufficient scope for grain based distilleries for
a. Right use of broken rice
b. Employment generation
c. Self sufficiency in availability of alcohol for potable and non-potable purposes
d. Improving collection of revenue by doing away with imports and consequent leakages andavoidable regulatory overheads in imports.
e. The export and employment prospects of the sector and its potential as a major agro-basedindustry are high, particularly since oil companies have initiated efforts to developalcohol-based substitutes for motor spirit.
At present any person who desires to setup a distillery in this State has to apply in a plain paper to theExcise Commissioner, West Bengal The applicant needs to specify in this application the exact purposefor which the distillery is proposed to be set up and the details of nature of business, his proof offinancial capacity of investment and their solvency ,current income tax and professional tax clearancecertificate, copy of the documents showing the applicants right, title & interest on the proposed areaand a project report of the proposed distillery. If the Excise Commissioner is satisfied with theapplication, he/she recommends the proposal to the State Government for issuance of “PrincipleAgreement” to this proposal.Once the State Government agreed to this proposal, the Excise

Commissioner asks the applicant to deposit an application for license for onward transmission to theCollector of the concerned district. On receipt of the application for license the Collector examinesthe suitability of the site, the building and other points including the clearance of the project regardingpollution from the Ministry of Environment and Forests, Government of India and sends the applicationalong with his opinion to the Excise Commissioner who, after such further enquiry as he deemsnecessary, forwards the same to the State Government along with his opinion. After completion ofconstruction the applicant submits two fresh copies of plan to the Collector who causes verificationof the same and sends one copy to the Excise Commissioner for examination. The applicant is furtherbound to conform to any instruction from the Excise Commissioner regarding any addition or alterationto the buildings, vats or other permanent apparatus or plant which he considers necessary. Only aftercompliance of the instructions, if any, the Excise Commissioner asks the Collector to grant license tothe applicant. At present the non-refundable application fee for grant of license to set up a distillery isRs10,000/-,proof of payment of this fee is to be submitted with the application and the initial grant feefor grant of license to set up a distillery is 25,00,000/-.

NOTES ON MOLASASES
The West Bengal Molasses Control Act, 1973, defines molasses as the final residue by-product of factoriesmanufacturing cane,or by refining gur, by means of vacuum pans and includes molasses prepared byopen pan process from the sugarcane with the aid of power. In the case of “Krishi Utpadan MandiSamiti & Anr.etc -vs- M/s Sankar industries & Ors etc” the Hon’ble Supreme Court observed asfollows:”…… Sugarcane is an agricultural produce out of which juice is extracted. The said juice getsthickened by dehydration and when it reaches a particular pigment, it takes the form of rab which issemi solid form of sugarcane juice. After the process of boiling this rab is put in crystallizer where it isallowed to get cooled and crystals are formed when the same is rotated in the crystallizer .The crystallizedrub is then put into centrifugal machine in which through the process of infusion of sulphur, the sugarcanejuice is cleaned and whitened. The rab which is not put into centrifugal machine but is dehydrated andis allowed to be hardened by the open pan process takes the shape of gur which is normally used forhome consumption. The rab which is not allowed to be hardened is also sold semi-solid form but thosepersons who desires to make further profits put the rab into centrifugal machine and by the process ofinfusion of sulphur they obtain khandsari in the dry powder/crystalised form and the waste of rab whichis obtained in the liquid is known as molasses. The residue which is known as molasses is furtherutilized by many people by boiling in the open pans and the same is again re-processed by cleaning anddehydrating and later by sulphination is taken in powder form. The first process out of molasses of rabin the semi solid form is also sold in the market because their inferior quality contains less content ofsucrose and is called rab-galwat. Rab-salwat is also prepared by the same process out of molasses andis futrter inferior quality of rab. It has also been submitted that so far as gur –lauta or other forms of gurlike kala gur, gur-budha etc. are also prepared from the molasses by re-boiling the molasses in the openpans which is allowed to thicken after dehydration in the boiling pans.” So molasses is basically thewaste of the rab, which is obtained in the liquid form. Molasses, therefore is quite different in physicaland chemical properties from rab (which is semi solid form of sugarcane juice),rab salwat or rab galwat(inferior quality of rab), Molasses is liquid in form ,it can be pumped and transported in Tanker Truckswhile rab,rab salwat or rab galwat cannot be pumped like a liquid. So rab, rab salwat or rab galwat areinvariably carried in tins or other containers but not in tanker-trucks.
As per the provisions of the West Bengal Molasses Control Act, 1973 and the Control Orders madethere-under import of molasses (of quantity exceeding 5 MT) can only be allowed when suchconsignment is accompanied with a valid NOC and transport pass issued by the Excise Commissioner.In the financial year 2015-16 NOCs were given in 13cases for import of molasses from Nepal amountingto 2370 MT of molasses and 22 cases for import of molasses from other states within India amountingto 7110 MT molasses .

CHEMICAL EXAMINATION LABORATORYThe Chemical Examination Laboratory has a Chemical Examiner at its apex, with two Dy. ChemicalExaminers and nine Assistant Chemical Examiners working under him. There are also a few laboratoryassistants, a store keeper and Group D staffs to assist the analyses of samples in the laboratory. TheChemical Examiner also gets the support of Office Superintendent, Head Assistant and other U.D. andL.D. Assistants.
In the year 2007, the Govt. decided to shift the Chemical Examination Laboratory from its erstwhilepremises at the Medical College and Hospital, to the excise building at 46, and 46A, Christopher Road,Kolkata – 46. Several old and unanalyzed samples could no however be removed from the laboratorypremises at the Medical College & Hospital, Kolkata, due to paucity of space at the new premises. TheChemical Examination laboratory started to function at its new site from 28.1.2009.
Things however went wrong very soon, since the representatives of the Fire Department visited theLaboratory and instructed to stop the use of fire necessary for distilling the I.D. Liquor or Rectified Spiritsent to the Laboratory for analysis. It may be mentioned here that though the Fire Department issuedinstructions mentioned above, necessary steps were taken to install fire fighting systems on the adviceof the Fire Department. To overcome the impasse, the Chemical Examiner started using hot plates as asubstitute of gas burners. The rate of analysis of samples however, did not pick-up and the rate ofdisposal never exceeded the inflow of the number of samples in the laboratory. This has created a hugestock of un-analysed samples. However steps have been taken in this year to set up a
state of the art laboratory at a new address to tide over the critical situation here.

e-GOVERNANCE IN THE EXCISE DEPARTMENT, GOVERNMENT OF WEST BENGALDURING 2016-17
Backdrop:
Prior to 2011 digital inclusion in the Excise Directorate was minimal. Computerisation was by andlarge limited to the directorate headquarters and some district head offices. All administrative processeswere manual and hard file based and thereby time consuming with ample scope for manual inaccuracies.In order to address these issues and improve service delivery, avid initiatives were taken for e-Governancein the Excise Department under the project e-Abgari. Since 2011 the department has come a long wayin e-Governance and the financial year 2016-17 has seen digitization of a host of services offered by thedepartment that has considerably reduced processing time as well as scope for human error whileaugmenting revenue generation as a corollary.
Achievements in 2016-2017
1. Circle level access to eGovernance applications: The Officers-in-Charge of Excise Circles, whichis the grass root level of Excise Administration, were given access to various e-Governanceapplications like Excise Offender Database Management and verification of monthly revenue andconsumption returns filed by retailers.
2. Excise Offender Database Management: An e Abgari module has been developed and deployedwhereby data on Excise offenders / arrestees are being regularly entered and updated. This providesa history sheet to officers across the organisation for enhanced coordination and handling of crime.
3. Integration with Kolkata Police: The application and processes related to late closing of bar licenses,including NOC from Kolkata Police authorities wherever applicable, have been automated throughdeployment of a dedicated e-Abgari software module.
4. Import and Export Permits and Passes for Molasses: All processes related to import and export ofmolasses have been automated through deployment of e-Abgari software modules.
5. Criminal Case Information System: The Criminal Case Information System was revamped toautomate all processes related to prosecution of criminal cases instituted by the officers of theExcise Directorate, including preparation of Preliminary Reports, Reports to Magistrates etc. alongwith online Summons to Witness generation facilities.
6. Spirit Accounting System: The electronic Spirit Accounting System and Spirit Inventory ManagementSystem was revamped to make it more efficient and error free.
7. NIC E-Office: NIC eOffice solution was implemented at the Excise Directorate making it the firstdirectorate in West Bengal to go paperless. Under the new system all files are handled electronicallywith workflow driven seamless integration system having file tracking facilities.
8. Microsoft Office 365: Cloud based collaborative computing solutions were implemented connectingthe Excise Directorate with the various District and Division offices.
