Pg 5 By Zuber Ansari T he Vakola police are claiming to have busted a human trafficking racket with the arrest of a 49- year-old disabled man from his residence at Gajdharband locality in Santacruz (W ). The man was allegedly luring minor girls on the promise of providing them with a good lifestyle and was then pushing them into prostitution. He was reportedly running his racket from localities in Kandivli, Vakola, Santacruz and Virar. Around 10 girls have gone missing from the Vakola police station jurisdiction in the last six month and the po- lice are still busy with the in- vestigations in these cases. In a recent incident, a 16 year-old girl went missing on July 7 after she left her home to collect her SSC result from the Public High School in Vakola. When she did not re- turn even on the next day, her parents filed a missing com- plaint at the local police sta- tion. The police report that the girl was lured into a life of prostitution by the man. According to Police Sub In- spector and investigation offi- cer in the case, Kisan Mane, “We have arrested Nandlal Patil under section 366A of the IPC (procreation of minor girl). It is too early to say any- thing more in this case, but we are searching other people too in this case.” The mother of the victim has alleged that Patil and his accomplice, Nisha, were the masterminds. She said Nisha knew her daughter very well and also stayed over at their home for a week after she was thrown out of her own house because of her bad character. However, noted jurist and MP Ram Jethmalani, has wel- comed the SC verdict arguing that politicians will have to accept the apex court verdict, while the BJP national spokesperson Prakash Javadekar called upon the government to hold a serious debate on electoral reforms. Four people died in differentaccidents across the city afterheavy rains paralysed the city

roads and air traffic on Friday.The Brihanmumbai Municipal

Corporation (BMC), initially red-faced after the city suffered fromwater logging, got a reason to smilewhen the Tulsi Dam started over-flowing.According to metrological re-

ports, from 8.00 a.m. to 8.00 p.m.Colaba recorded 47 mm rainfalland Santacruz recorded 102 mmrainfall. According to the IMD fore-cast, the city will experience heavyrainfall in the next 24 hours.Students were seenmaking their

way to school through thigh deepwaters.The BMC has been spending

hundreds of crores annually ontheir nullah cleaning projects. Sev-eral councillors objected to theamount of money that was spenton these projects and even criti-cised the lack of development inthese projects. All of those criti-cisms withered away when a mere80mm of rainfall for ten hoursbrought the city to a standstill.Even civic officials admitted that

at least 24 different places, includ-ing Hindmata, Hindu Colony, KingCircle, Mukhyadyapak Nullah andDharamvir Raje Marg, had water-logging for several hours. The BMChad installed dewatering pumpsbut to no avail.In the Eastern suburbs LBSMarg,

Bhoir Nagar, Vikroli Link Road andVashi Naka suffered fromwater log-ging. Similarly in the western sub-urbs, Milan subway, Dindoshi,Tiwari Chawl in Goregaon,Lokhandwala circle, Talao Road inKandivli and Air India building’smain gate at Santa Cruz also facedwater logging.Due to water logging at Hind-

mata, King’s Circle, ElphinstoneRoad and Bhandup traffic was di-verted from other substitutes. Sim-

ilarly, rail tracks of suburban trainswere submerged inwater thus forc-ing slow trains to be tracked ontofast lines.According to civic reports

around 38 trees fell down in variousparts of the city. However, 21 ofthese fell in the island city.The city’s lifeline, the suburban

railways was in disarray with waterovertopping the tracks at severalplaces on theWestern, Central andHarbour lines, railway sources said.Tracks have been flooded at sev-

eral places including Chinchpokli,Vikroli, Sion andMasjid on Central

and Harbour lines and severaltrains are running late.OnWestern line, suburban serv-

ices have been suspended be-tween Nalasopara and Virar,sources said.Weatherman has forecast fre-

quent spells of rain or showersover the next 48 hours.While Mumbai city received

36.5mmof rain, suburbs recorded59.2 mm of rain till 2.30 pm.Heavy rains in parts of Gujarat,

bordering Maharashtra, have re-sulted in disruption of railwaytraffic between Mumbai andAhmedabad.

Tulsi started overflowingTulsi, one of the small lakes supply-ing potable water to the city hasstarted overflowing from yesterdayfrom 11.00 a.m. onwards. Last year,this lakewas started overflowing onSeptember 4.According to Hydraulic Engineer

reports, the total water stock in allreservoirs that supply drinkingwater to city was recorded 7,69,836million litre (ML) which is morethan 60 per cent of total annual re-quirement of the city. Every year,the city needs estimated 12.5 MLwater tomeet its both ends of year.

As many as five villages and 17hamlets in Vasai have lostcontact with the outside

world after the only Medha Bridge,the only road over-bridge connect-

ing Virar and Vrajeshwari, was leftsubmerged under water due toheavy rains which continued tolash the region since Thursdaynight. The affected villages ofMedha, Ambode, Bhinar, VadharandKalbhon, as well as the hamlets

of Lendipada, Sakhaar, Bhogad,Palat, Baraf, Geti and Dongri haveno alternate road to establish com-munication. The district adminis-tration was still to extend a helpinghand to the 5,000 stranded resi-dents till reports last came in.

Suburban train services were indisarray on the Vasai-Virar sec-

tion of theWestern Railway, as se-verewater loggingwas reported onthe railway tracks at Nalasopararailway station. Railway personnelwere seen trying to flush out thewater from the tracks. Even as serv-ices stared limping back to nor-malcy after 3 pm, trains continued

running late by 30 to 40 minutes.Heavy rains in parts of Gujarat,borderingMaharashtra, resulted indisruption of railway services be-tween Mumbai and Ahmedabad.Despite being a working day onFriday, trains and platforms weremostly empty as people chose tostay indoors heeding the warningissued by authorities.

It was the same old story in the Mira-Bhayandar region as the heavy down-

pour resulted inwater-logging in severalparts of the twin-city including, KanakiaComplex, Ramdev Park, Naya Nagar,Lodha Complex, Munshi Compound inMira Road as well as Bakery Lane andGovind Nagar areas in Bhayandar(West). While electric supply to severalbuildings situated in low lying areas wasdisrupted, an electric short circuit wasreported from Silver Park. There werealso reports of the walls of two tene-ments in Mahajanwadi having col-lapsed. However, no one was injured.The disaster management cell of theMira-BhayandarMunicipal Corporation(MBMC) and Fire Brigade, received callswith information of dug-up roads pos-ing threats to pedestrians and severaltrees that had been uprooted due tostrong winds.

tices D. Y. Chandrachud andS. C. Gupte issued a notice tothe state government and thePrincipal Secretary of theHome Department, andasked them to file their affi-davit by August 2. “Does thestate government not know

The Sessions Court inSouth Mumbai on Fri-day awarded life im-

prisonment to 13 policemenalong with eight others, whowere convicted in the 2006fake encounter case of RamNarayan Gupta alias LakhanBhaiya, an alleged aide of un-derworld don Chhota Rajan.While senior InspectorPradeep Suryavanshi, TanajiDesai andDilip Palandewereconvicted for murder, otherswere convicted for aiding andabetting the encounter of

Lakhan bhaiya on last Fridayby sessions judge V.D. Jad-hwar. Encounter specialistPradeep Sharma, who hasmore than 100 encounters onhis name, was one of the 22accused in the case. However,he turned out to be the onlyaccused to be acquitted of allthe charges.The prosecution had

sought death penalty for allthe policemen and includingtwo others. They had arguedthat the all of them hadplayed active role in thekilling. The defense, however,argued that the capital pun-

ishment should be avoidedsince the conviction of the ac-cused in based on circum-stantial evidence. “We will beapproaching the higher courtagainst the acquittal ofSharma and also demandingdeath penalty to the police-men,” said RamprasadGupta,Lakhan Bhaiya’s brother.A police team had picked

up Lakhan Bhaiya fromVashiinNaviMumbai on suspicionthat he was the member ofChhota Rajan gang on No-vember 11, 2006. The policehad also picked up AnilBheda, his associate along

with him. Lakhan Bhaiya waskilled on the same day in anencounter near Nana-NaniPark inVersova area of subur-banMumbai.Lakhan Bhaiya’s brother

and lawyer, RamprasadGupta approached differentauthorities in the case and itwas only after that the Bom-bay High Court ordered amagisterial inquiry in thiscase in 2008. The inquiry re-port submitted to the HighCourt in August 2009 statedthat Lakhan Bhaiyawas killedin cold blood from point-blank range.

State Home Minister R.R.Patil has ordered Mum-bai Crime Branch chief

Himanshu Roy to probe thealleged suicide of Tata Steel’sformer head of corporatecommunications, followingwhich the officer’s team hasbegun a parallel investigationinto the case.Charudatta Deshpande,

Tata Steel’s 57-year-old for-mer chief of Corporate Com-munications, was foundhanging at his Vasai home onJune 28. No suicide note wasfound. His friends and formercolleagues alleged that hehad been harassed.A case has been registered

at Vasai police station and thepolice are already probing thematter.“I have received orders

from the Home Minister, fol-lowing which a parallel inves-tigation is being done by myteam. I am personally lookinginto the case,” Joint PoliceCommissioner (Crime) Hi-manshu Roy told PTI, yester-day.One of the crime branch

teams today visited Vasai po-lice station to meet the inves-tigating officers there andcollected the case docu-ments, police said.The crime branch is also

going through the technical

gress corporator and formerLeader-of-House, tabled aproposal under rule “J” of theMBMC Bye Laws, which wasunanimously approved inJuly’s monthly general bodymeet. The health departmentof the MBMC, had retained130 women as link workerson a contractual basis at amonthly honorarium ofRs.500, under the govern-ment-funded Reproductiveand Child Health (RCH) pro-gramme, an ambitiousscheme aimed to reduce therate of infant and maternalmortality, and to improve thetotal fertility rate.

LIKE TREES, THEIR LIVES ARE IN DANGER… The Brihanmumbai Municipal Corporation(BMC) had entrusted the job of trimming and cutting of trees to private contractors. However, thesecontractors have hired unemployed and needy people for the task without any safety gear. Earlier,horticulture staff of the civic body used to trim branches of trees. They have BEST-bus mounted cranesto climb on to and cut branches. However, private labourers have no such privileges and instead, haveto climb on to the trees. Labourers were seen perched high up on the trees, cutting away brancheswithout any safety harness. None had shoes, hand gloves or rain coats. In all, the BMC had put acondition of safety and security of labourers employed by private contractors, but hardly any contractorsfollow this condition and even the BMC is not bothered about labourers risking their lives.

WHAT is needed is a National LandUse Policy which is people-centric,scientific, environment friendly,

livelihood enhancing. Enough data andanalyses are already available which shouldmake it possible to delineate such a policy fordifferent agro-climatic zones in the country.We need to set up a high level Commissionwhose task will be to lay down such policynorms. The whole question of land acquisi-tion will fall in its place, once such norms areset and appropriate policies are adopted onland use.One pre-condition for the success of such

an approach is that there must be an imme-diate moratorium on transfer of agriculturalland to non-agricultural purposes eitherthrough the mechanism of land acquisitionlaw or through the market process.Simultaneously equitable redistribution of

land must be brought back on the politicalagenda, particularly in regions where largescale absentee landlordism prevails underone pretext or the other andwhere huge landholdings are owned by the corporates forplantation or similar purposes.But redistribution though necessary is not

enough. It is essential to find an institutionalsolution to the problem of fragmentation oflandholdings which was always there butwhich has now acquired a crisis proportion.Pooling of land is the only lasting solution. Amassivemobilization in favour of cooperativefarming is necessary.

The ‘blind’beneficiariesSimultaneously, creation of suitable av-

enues for absorption of surplus labour re-leased as a result of pooling of land will haveto be organized. Such avenues can be createdthrough co-operativising both the procure-ment of inputs and processing of output.Clearly, this would require a fundamentalredirection of the presentmode of industrial-isationwhich is geared to global competitive-ness. Instead the new mode will be yoked toproductive use of released surplus labour. Itwill be part of a wider vision of social solidar-ity.Closely related is the question of water, for-

est and mineral resources. Present policieshave resulted in large scale displacement ofpeople dependent for their livelihood onforests, mineral bearing lands and rivers,ponds and coastal waters. The policies un-abashedly promote such displacement, onthe one hand, and, on the other, encourageloot of such natural resources which belongto people.Themarket is allowed to determinethe dynamics. Simultaneous initiatives willhave to be taken in these areas to restore peo-ples’ sovereignty over these resources andpromote policies which will enhance liveli-hood creation, conserve environment and

promote social solidarity.Galloping inflation and burgeoning unem-

ployment are inevitable consequences of thepolicy of “reforms” set inmotion two decadesago. They have made the life of working peo-ple increasingly intolerable. The rulingclasses have been the greatest beneficiaries ofthe dispensation of “reforms”. Their onlyworry is that the bubble of unprecedentedprosperity that they have enjoyed so far issomehowmade to survive. To that end, theywould not mind sacrificing all policy spaceand tying the economic destiny of the coun-try to the goals and requirements of theglobal capital. They are not only blind to themisery of the masses; they are also blind tothe burgeoning crisis that is engulfing thecore of global capital.

What is needed is a complete break withthe policies of “reforms” and adoption of anew path of people-centric development . Atthe core of such path will be a radical resolu-tion of the question of land and peasantry.Restoration of peoples’ sovereignty over nat-ural resources will be the guiding principle.Enhancement of livelihoods , protection ofenvironment, assurance of a decent livingstandard and a life with dignity for all willconstitute immediate imperatives.On the political side, there are four main

concerns of the people. They revolve aroundthe central concern : The idea of India whichinspired the long freedom struggle is underserious threat.The latent or patent communalism prac-

ticed by the ruling classes has resulted in adeep sense of insecurity and alienationamong the Muslims. The last two decadeshave witnessed steep deterioration in thecommunal situation. Political opportunismpractised by the mainstream political partiesis certainly responsible. However, there isother, more fundamental reason. US-Israelcombine has conveniently created and sus-tained the bogey of Islamic terrorism on aglobal scale tomask its imperialist designs on

the oil-richWest Asia. It is also an economicand strategic necessity of the US ‘military-in-dustrial complex’ to promote the conceptand practice of a global war on terrorism, as itcomes handy to interfere with the regimes inthe third world and provides a strong stimu-lus to the US economy, particularly after theend of the cold war era. The Islamophobiasystematically generated by US-Israel com-bine has its willing takers in the retrogradeHindutva politics. The revival of majoritariancommunalism poses a serious challenge tothe integrity of polity. This challenge has tobe met frontally and unambiguously. Firstand foremost this requires that we as a coun-try disengage ourselves from the strategic ob-jective of US-Israel combine.

The plight of the backward classesAdivasis too are getting alienated fast. It is

true that they have borne disproportionateburden of the development process eversince independence. However, in the era ofeconomic reforms, they are being dispos-sessed of their livelihood, their habitat andtheir very life on a scale which has had noparallel before. Consequently, there has beena strong reaction. In some places their dis-content has taken the formof challenging theIndian State. This has provided an excuse tothe ruling class to treat the discontent as“threat to national security” and use itsarmedmight to eliminate the challenge. Nei-ther the armed challenge to the Indian Statenor the armed might of the ruling class con-stitute the answer to the deep alienation ofthe Adivasis. What is needed is a decisivebreak from the present path of growth pur-sued by the ruling classes which has posed athreat to the survival of Adivasis with dignityin their traditional habitat.Dalits continue to suffer atrocities,

discrimination, insecurity and denial ofaccess to life of dignity, despite theConstitutional dispensation and variousenabling laws and measures. The mostbackward sections of other backward classestoo suffer exclusion and deprivation. It isnecessary to carve out a sub-regime of reser-vations for most backward classes. The poli-cies of reforms, however, are increasinglymaking measures such as reservations inpublic sector jobs less and less meaningful.Even so, the upwardly mobile sectionsspawned by the reforms are clamouring forending reservations in government jobs aswell as in educational institutions.

IN the first month of the monsoonitself, a large number of people

have become victims of water-bornediseases. Cholera - a dangerous dis-ease - has hospitalised 12 victims.Other diseases like gastroenteritis,jaundice have been reported from thecity and suburbs. In the next threemonths of the monsoon, a largenumber of citizens are likely tobe affected.The reason for the outbreak of the

diseases has been traced to contami-nated water supplied by the BMCwhich has the familiar argument: Thepipes supplyingwater to the city werelaid years ago and until they arereplaced, there is danger of leaks andcontamination of water.The levels and the extent of con-

tamination is a matter for grave con-cern. The state public healthlaboratory tested 5,177 samples fromMumbai and found 1,356 were con-taminated. Not all people inMumbaidrink boiled or filtered water. Theydrink water straight from the tap. Itcan be seen from this that a largenumber of people are falling a prey towater-borne diseases.The citizens evidently cannot ex-

pect any help from the municipality.It has only a long-term solution to theproblem: All old pipelines in thewater supply network have to be re-placed. This cannot be done in a dayand it will take years to do thework. Itis a desperate, frustrating situation. Itlooks like 26 per cent of people inMumbai who drink tap water can getwater-borne diseases. And cholera, adeadly disease, is infectious and thepossibility of an epidemic breakingout cannot be ruled out.

WE fool ourselves thinking we are ademocracy!

Just because we have elections every fouror five years, just because we fill Parliamentwith elected representatives we feel we are ademocracy. But we are not, because in ademocracy, elected Parliament and theCourts are well balanced. In our countrythere is no balance at all.We have a constitution; we have laws,

sluggish, slow and sleeping!We have elections on time, but justice in

courts takes a decade or two. Which meanthe only law of this land is the law of might.Numbers win: Majority opinion whether itis right or wrong takes precedence overwhether the opinion is based on truth.There is no attempt whatsoever to rectify

this imbalance because the wily politicianknows if there are more courtrooms, andmore judges, then the law is strengthenedand his power diminishes. In our countrythis imbalance has been carried out so sub-tly that when we hear that a case takes

twenty years to be settled we think mistak-enly we have toomany cases in our country.Wrong. It is not too many cases but too

few judges.We do not need AnnaHazares trying to go

on fasts to weed out corruption, we need

you and me insisting that the party whichcomes to power next starts seeing to it thatthousands and thousands of courts comeinto being. As soon as this happens corrup-tion will start disappearing as cases will beresolved immediately and people will beafraid to break the law, especially politicians.Today the rich and powerful are not afraid

to break the law, because they know they

have nothing to fear till the judgement day.What happens before the judgement?Wit-

nesses are bought. Many turn hostile. Quitea few die and finally in frustration, even if wehave right on our side we move towards a‘compromise’ or an ‘out of court settlement’which is generally a victory of the one withmore muscle!I was listening to a friend of mine telling

me yesterday of how a real estate broker,broke in and occupied his empty house inthe suburbs.“After the fifth year Bob,” he toldme, “I re-

alized I would win the case after my death,so I paid him twenty lakhs to get out!”It was a sad story but the story of thou-

sands in our country.Let the new government promise usmore

courts. Let that be part of their manifesto.Just as the press tookmany years to becomea free press in India, we need to free the Lawand our Constitution.Till then we are fools to call ourselves a

They’re not feathered pests...‘BIRD-BRAINED logic’ (ADC, July8), reveals a very awkward andridiculous initiative in the felling oftrees in the Aareymilk colony by thepoultry authority. Their view thatthese trees facilitate the nesting ofcrows and other migratorybirds and thereby spread the avianvirus has not yet been scientifi-

cally proved. Until and unless thereis evidence that these trees are har-bouring these ‘feathered pests’, theyshould be savedwith immediate ef-fect. More than 300 trees are natu-rally uprooted with the onset of themonsoon. If this initiative by the au-thorities continues, the green lungof Mumbai will cease to exist inno time.The BMC should arrange toengage horticulturists,botanists and ornithologists to dis-cuss the issue immediately, or thiswill end up being seriously detri-mental to the safety of thiscity against the fury of nature.

It has been observed thatgovt has failed to control the ris-ing prices of vegetables and hasbeen blaming drought condi-tions in the state which is noth-ing but bogus and rubbish asthey should have taken the ac-tion at an earlier stage by makingarrangement for support/ reliefto struggling farmers so that themiddleman and transporters donot take undue advantage.

THE government’s initiativeto sell vegetables at 30 per centcheaper rates than the marketprice through 10 of its newly setup outlets all over the city islaudable and the housewives arealready making a beeline to theseoutlets. This is the only way tosee that the households are notfleeced by the retailers who al-ways create artificial scarcity and

hike the prices at will becausethey are there only to make prof-its and nothing else is of concernto them. This year the monsoonhas been good so far and theyield of vegetables in the fieldshas not been adversely affected,yet our retailers are quotingprices of most of the vegetablesin the range of Rs.60 to Rs.80 perkg. It is good that the govern-ment is paying for the trans-portation charges from theAgricultural Produce MarketCommittee at Vashi. This is anexcellent move and the govern-ment should continue this on apermanent basis for the benefitof the aam aadmi.

Even a filmmakerlike GuillermodelToro could not re-sist the temptation tomake a big 3Dblockbuster, and he is probably thereasonwhymanywho are fed-up ofbig, splashy CGI movies might at-temptPacific Rim, to see whatthe Pan’s Labyrinth director canbring to the table.At a time close enough from the

present to cause nightmares, thethe Kaiju— angry, ugly, reptilianmonsters— rose from the sea and

totalled several cities. They werehalted by gigantic manned robotscalled Jaegers. But they come backand so it’s a big, noisy humans vscritters battle, which progresses ex-actly as you’d expect it to. It’s meantto provide enough bang for themoviegoer’s buck, and that it does.Each Jaeger is controlled from in-

side its massive metal body, by twohumans and in an early battle,Raleigh (Charlie Hunnam) lost hisbrother Yancy. A few years later,Raleigh is asked by Pan Pacific De-fense Corps commander StackerPentecost (Idris Elba), to return tohis old Jaeger, Gipsy Danger, with anew co-pilot, Mako Mori (Rinko

Kikuchi), for a crucial fight againstthe Kaiju. Not to add spoilers, sosuffice to say that co-pilots share adeeper connection than just spacein the metal behemoth, and this iswhere a director likeDelToro showswhat he can do, to take PacificRim several notches above filmsfrom the Transformers and Godzillafranchises, which are obvious inspi-rations for this one. Even so, it is aspectacle aimed at fans of the genre,it might just leave others cold, or atleast wondering why so much po-tentially rich sci-fi material is leftunder-developed.The film is happyenough to just “cancel theapocalypse.”

THE thoughts that come tomind while watching BhaagMilkha Bhaag are uncon-

nected to the film. India is so shortof heroes—sports heroes in partic-ular—that Milkha Singh who wonhis medals (no Olympic gold, alas)over half a century ago, can be thesubject of a grand biopic. Imagine ifChina or Russia started makingbiopics of their star atheletes, theworld would be swamped by simi-lar-looking films. There is some-thing common on all strive-to-winfilms—the protagonist’s dedication,superhumanwill and so on.That byitself is not all that interesting towatch, so Milkha has to be given adramatic back story, which involvesthe Partition. Sadly, so many years(and several Partition carnage films)later, there’s not much juice to beextracted there. But to link this toMilkha Singh’s loss at the 1960RomeOlympics, is stretching it a bittoo much.Not to undermine Milkha Singh’s

achievements, especially whensports heroes (barring cricket stars)are not exactly lionised in the coun-try, but his success had no long-last-ing impact in Indian sports; thestate of athletics is still pathetic, andIndia’s medal tally still shockinglylow.Still, it is commendable that after

all these years, RakeyshOmprakashMehra chose to honour an almost-forgotten hero, even if that means

piling on the melodrama sky high,andmeandering over episodes thathad no real bearing on his life. Notto mention the tepid romances(Sonam Kapoor and Rebecca

Breeds being the objects of his af-fection). So overdone is the film,that you agreewith the saying abouttruth being stranger than fiction.After all the suffering bornewhile

training, and the truly excruciatingscene ofMilkha Singh running withlegs wounded, the bandages unrav-elling in slow motion, Mehra keepsgoing back to his Partition timetrauma, which brings the filmsweak conflict over Milkha refusingto go to Pakistan and Pandit Nehru(Dalip Tahil) himself persuading

him. Mehra uses flashbacks withinflashbacks as Milkha’s first coach(Pavan Malhotra) narrates his storyto the delegation sent to bring therecalcitrant hero from Chandigarhto Delhi.The actor playing a youngMilkha

is bright, andDivyaDutta asMilkhaSingh’s sister a scene stealer, but it isFarhan Akhtar who is outstanding,training body and mind to be-come the character, moving easilyfrom innocently charming lad (theway hewoos village belle with buck-ets of water) to runner whippinghimself to win. If India’s sports es-tablishment was so caring and theathletes so driven, themedal tally inthe international arena would havebeenmuch higher. Perhaps this filmserves a kick in the shin to wake upeverybodywho needs to be inspiredto chase excellence. As entertain-ment it is wanting inmany areas, it’sinordinate running time being theleast of its problems. A more ruth-less editing and excising the forcedsong-and-dance numbers mighthave helped.Finally, you emerge from the

moviehall with Binod Pradhan’s cin-ematography and Farhan Akhtar’smatchless performance, that willgivemany a star a run at the awardsnext year.

Redevelopment has two sides to it.With every benefit, as is the case,there’s an associated ill. For one,the issue of redevelopment, how-

ever enticing, is closely accompaniedwith rancor and acrimony directed usu-ally towards the Managing Committeemembers who are perceived as enjoying‘special favours,’ with the developer inquestion. Also, in the absence of a crys-tal-clear lottery system in processes orequalitarian benefit distribution, there’sthe certainty of chaos.So, in order to ensure transparency

among cooperative housing societiesundertaking redevelopment projects, theMaharashtra Cooperative Department,with a view to ensure transparency insocieties seeking to undertake redevel-opment projects, issued guidelines forsocieties to follow under section 79 (A) ofthe Maharashtra Cooperatives Act 1960.These issued by a committee compris-

ing the co-operatives commissioner andCIDCO chairman. Among the features,the most important being that a redevel-opment scheme would be approved bythe general body only if three-fourths ofthe society members were present atthe meeting.The Registrar will need to attend a gen-

eral bodymeeting which will approve thebid of the successful bidder in a proceed-ing which will have to be video-recorded.Also, once the agreement is accepted interms of area and corpus fund, it cannotbe revised. A bank guarantee to the tuneof 20 per cent of the total project cost willhave to be provided by the successfulbidder to demonstrate his financialstrength and proof that he will not aban-don the project midway.In respect of most of the Co-operative

Housing Societies, the nature of com-plaints relating to redevelopment thatthe Maharashtra CooperativesDepartment included:

1. Resistance in taking members in con-fidence in the process of redevelopment.2. Absence of transparency during thetender process.3. The arbitrary appointment of con-tractors.4.Violation of the provisions of Co-oper-ative Act, Rules and Bye-Laws.5. Lack of order in the works of theArchitect and Project Consultant.6. Failure to plan the RedevelopmentProject Report.7. Failure to adopt proper procedure infinalising tenders.8. No similarity in agreements withDevelopers.

So, in the absence of a concrete policywith regards to the above issues, Co-operation Commissioner and Registrar,Co-operative Societies,MaharashtraState, Pune had appointed a Study Groupunder the Chairmanship of JointRegistrar, Co-operative Societies(CIDCO) to study the complaintsreceived at various levels and for consul-tations with all constituents working inthe relevant fields. The Study Group has

expressed the opinion that it is essentialto frame regulations for redevelopmentof buildings of Co-operative HousingSocieties after consultation with allthe constituents in the field ofCo-operative Housing.The government hence issued the

directive under Section 79(A) ofMaharashtra Co-operative Societies Act,1960. It was termed as ‘Directive forRedevelopment of Building of Co-opera-tive Housing Society’.For one, not less than ¼ members of

the Society the building of which is to beredeveloped should submit a requisitionto Secretary on theManaging Committeeelected as per provisions of Bye-Lawsand lawfully formed along with theirscheme and suggestions for redevelop-ment of the Society’s building for con-vening Special General Body Meeting tofinalise the policy on redevelopment ofthe building.On receipt of an application, the

Managing Committee should take a notethereof within 8 days and secretary of thesociety should convene General BodyMeeting of all the members of the socie-ty, Agenda of the Meeting should be fur-nished to each member 14 days prior tothe day of meeting and acknowledge-ment thereof should be kept on record ofthe society.Before convening the said meeting,

Society should obtain list of Architects /Project Management Consultants on thepanel of Government / Local Authorityand obtain quotations from minimumfive experienced and expert persons forpreparing project report for redevelop-ment work of the building and oneexpert person from among them willbe selected in the Special GeneralBody Meeting.

At the said Special GeneralBody Meeting:1. A preliminary decision by taking into

consideration demand of the membersfor redevelopment of society’s buildingand suggestions received in respect ofthe same should be taken.2. Expert and experienced Architect /

Project Management Consultant on thepanel of the Government / LocalAuthority for work of redevelopment ofthe building should be finalised. Also,items of work to be done by them andterms and conditions of work too shouldbe finalised.3. An outline of the programme for

redevelopment of the building shouldbe submitted3. Written suggestions from members

relating to redevelopment of the buildingshould be accepted.Members of the cooperative housing

society will be entitled to submit in writ-ing to the committee, eight days prior tothe meeting their realistic scheme, sug-gestions and recommendations for rede-velopment of the building in the name ofexperienced and expert Architect /Project Management Consultant knownto them. However, that Architect /Project Management Consultant shouldsubmit a letter that he is desirous ofdoing work of redevelopment.4. The quorum for the Special General

Body Meeting convened for redevelop-ment of building of the Co-operativeHousing Society will be ¾ of the totalmembers of the society. If quorum is notformed, meeting will be adjourned foreight days and if there is no quorum forthe adjournedmeeting, it will be deemedthat members are not interested in rede-velopment of the building and meetingwill be cancelled.

steel inside concrete beams and columns startcorroding after 15-20 years. The corroded steelsimply cannot be treated in repairs and needsto be replaced. In case of redevelopment, as thebuildings are new, such issues just do not arise.In the case of redevelopment, society mem-

bers not just get a brand new building; they alsoget monetary benefits and top-up areas to theirflats that would otherwise have cost a fortune.The advantages accrued include brand new

flats that are free of cost thus indirectly fetchingan earning for members. Popular fears of beingleft homeless during the period are tackled bythe inherent provision of alternative accommo-dation during the course of construction afterthe demolition of the buildings. NEW DELHI: Indian hockeycaptain Sardar Singh is infavour of a foreign coach as

Michael Nobbs's replacement, butsaid Olympian M K Kaushik too canlive up to the job under High Per-formance Director, Roelant Olt-mans' guidance.

Welcoming Kaushik's appoint-ment as a coach with the Indianmen's hockey team, Sardar said theOlympian has the credentials toproduce results but needs a foreignexpert like Oltmans to constantlyguide him.

"India has good coaches, there isno doubt about it. Kaushik sir is avery good coach. He doesn't have toprove it to anyone. It was a good de-cision to bring him in. He can re-place Michael Nobbs but he willneed someone like Oltmans toguide him," Sardar told PTI.

"But I feel a foreign coach hasbetter knowledge about the re-quirements of modern-day hockey.

If Kaushik takes up Nobbs position,Oltmans will have to spent moretime with us", he said.

"At end of the day the decision

rests with Hockey India and theyhave already made it clear that aforeigner will be appointed as chiefcoach," he said.

Legendary Australia coach RicCharlesworth has recently said thatIndian coaches are not goodenough and the eight-time Olympicchampions need a foreign expert tomeet the requirements of modernhockey. India's High PerformanceDirector and Dutch legend Oltmansis currently in charge of the team tillnext month's Asia Cup after Aus-tralian Nobbs' association with thecountry ended prematurely lastweek.

Even though Nobbs' claimed thathe resigned from the post becauseof his deteriorating health condi-tion, Hockey India said his non-per-formance had a role to play in theAustralian's unceremonious ouster.Sardar, however, said he was takenby surprise by Nobbs' suddenouster.
