Fourth Quarter Thoughts and looking ahead to 2017
Fourth quarter brings thoughts of the year as it winds down and the excitement of looking ahead to 2017.
Everyone can agree that it’s been a good year! As of this writing, pending and closed sales are up 14% over last year. The biggest challenge we face is the shortage of inventory. New listings are down 7% -- and when you have a buyer needing to find a home it feels like listings have dropped by 50%!
The strong market, and the work of active members, is strengthening our association. Our membership numbers are up over 3,000, which we haven’t seen since prior to 2008.
We had an extremely successful Trade Show in September. Many thanks to Janet Besheer and Leah Slocum, who served as Chair and Vice Chair, respectively, as well as to an outstanding committee and a cadre of very generous sponsors. If you missed it, make sure to look for next year’s Trade Show at the new Albany Convention Center.
The lawsuit involving the MLS is winding down. The court-appointed
receiver is doing his due diligence and will report back to the court to finish up the case work ordered and close it out. We will be sure to update all GCAR members on these and other important issues as developments arise.
If you were able to attend the NYSAR meetings at Turning Stone in September, good for you. There was a lot of valuable information from committees, a great speaker at the general session, and a very educational Legal Update. I would strongly encourage you to attend a statewide and/or National meeting at some point in your career. Getting involved at that level gives a broader picture of our industry and increases your knowledge to help you reach peak performance.

GLOBAL FOUNDARIES COMMUNITY DAY
On September 14th the Greater Capital Association of REALTORS® Executive Committee toured GlobalFoundaries in Malta with J. Gregory Connors, Sr. Director of U.S. Government Relations, Regulatory Affairs & Strategic Initiatives-Global Foundries. Fab 8 is located in the Luther Forest Technology Park and sits on approximately 293 acres. It is currently among the largest semi-conductor manufacturing facilities, performing the most advanced
research, development and manufacturing in the world. GlobalFoundaries represents around 15 billion dollars in the private and public investment in Saratoga County.
GlobalFoundaries invites all GCAR members and their families to join them on Thursday, November 10th from 5:30 – 7:30 p.m. for their 2016 Community Day. Attendees will learn about the chip fabrication plant and ask questions about the factory.

Don’t Forget Ethics!
The New York State Real Estate Education Foundation announced the award of $13,840 in scholarships recently at the New York State Association of REALTORS® business meetings held at The Turning Stone Resort in Verona, NY.
Since 2004 the New York State Real Estate Education Foundation (NYSREEF) has awarded more than 874 tuition scholarships totaling $234,416 for national REALTOR® designation courses. These courses help to provide participants with the latest industry-based information helping in the growth of their business and careers.
These scholarships are made possible through the generous funding received from NYSAR, Local boards and
REALTOR® members, who are committed to delivering excellent service to today’s consumers.

Scholarships are now awarded twice each year. The deadline for application is December 31st.

Remember, the National Association of REALTORS® requires all REALTORS® to take an ethics class between January 1, 2013 through December 31, 2016. The only members exempt from this requirement are those with Emeritus status.
If you have taken your ethics class at GCAR or through our online partner, the CE Shop, we automatically log your compliance into our database and report to NAR. If you took your class elsewhere, please fax your certificate to GCAR: 518-464-0196 so we can update our system.

BY: JENNIFER VUCETICA delegation of 36 REALTORS traveled to Italy on
October 10th, 2016, representing NYSAR. Our delegation met with members of the Italian Federation of Real Estate Professionals (FIAIP) in Venice. We learned about how real estate transactions are conducted in Italy as well as the current market conditions and real estate opportunities there. The group included, myself, NAR Liason to Italy, Louise Giuliano, NAR Liason to European Countries, Barbara Schmetzler, New Jersey REALTORS® President, Tg Glazer, New Jersey REALTORS® Treasurer, Jeffrey Jones, along with NYSAR President, Linda Lugo, NYSAR President-Elect, Dawn Carpenter, NYSAR Secretary/Treasurer, CJ DelVecchio, NYSAR Past President Mike Smith and NYSAR CEO, Duncan MacKenzie
We saw amazing properties in Milan, Venice, Verona, and Lake Como among them were condos, villas, single family homes, and multifamily homes. NYSAR and FIAIP have made great strides in recent years, developing relationships for future business together. We had wonderful events with our FIAIP partners. All in all it was a very successful and eventful trip.
The Italian Federation is the principle real estate trade association in Italy with 10,106 real estate agents and more then 45,000 members who are agents and related professionals. It has 20 regional offices throughout Italy and is recognized as the primary source of information and advice. It also provides professional union protection for its members. The Federation works to support efforts to enhance real estate ownership, industry standards, and property rights.

With the proverbial “silly season” of this election year in full swing, NYSAR held its annual fall business session to focus our collective attention on what the REALTOR® agenda will be once the smoke clears after Election Day. While attending this year’s meetings at Turning Stone a few weeks ago, NYSAR’s Government Affairs director Mike Kelly laid out our statewide legislative agenda for 2017, which is as follows:
1. First-time home buyer tax credit gaining traction – www.myfirsthome.com for details
• Similar to 529 college savings accounts
• Up to $5000/year for singles and $10,000/year for married people can be deposited into these accounts
• These savings accounts would grow tax-free, similar to 529’s
• They can also be funded by parents of those first-time home-buyers
2. Co-Op reform – calling for greater transparency in the application process and setting a timeline within which co-op boards must respond to offers
3. Agency Law - Continuing Education requirement of 2 hours for new agents and 1 hour as part of every agent’s 2-year license renewal – due to continuing issues with agents who are either unaware of agency law or simply not disclosing agency to buyers
4. Zombie home legislation – NYSAR is supporting the effort to require
banks to maintain properties PRIOR to and during foreclosure if they become vacant
5. Water testing is becoming a hot issue - NYSAR still opposes mandatory well testing that is TIED to the real estate transaction. The Governor is entering discussion after Hoosick Falls water crisis and NYSAR has scheduled meetings with the Governor’s staff on it
6. AirBnB – NYSAR is supporting a ban in NYC on advertisement of listings under 30 days
7. Ride-sharing – NYSAR is supporting Uber/Lyft for the entire state but no deal yet
8. STAR tax credit – the latest change requires new home-owners to register and be reimbursed by a check and not a credit against their property tax bill
9. Repeal of cease-and-desist orders against Realtors – Realtors are forbidden by law from marketing (calling, mailing, etc.) to any homeowners in the Bronx, Queens, and Rockland counties…these are pending.
Please remember that the REALTORS® Political Action Committee (RPAC for short) is the funding vehicle to advance the REALTOR® legislative agenda on both the state and federal level. Look for upcoming announcements of the RPAC Committee’s autumn gathering – and please remember the importance of making those investments. When REALTORS® speak in a single unified voice, Congress and our state legislature listen.

Per the Department of State, due to a recent statutory amendment to the Real Estate Property Law, effective January 1, 2017, any real estate licensee who renews their license must have completed 22 ½ hours of approved continuing education, three hours of which must include fair housing and/or discrimination in the sale or rental of real property or an interest in real property along with the updated requirement of at least 1 hour of law of agency. If a salesperson is within their first license term, they must complete 2 hours of agency along with the other designated educational hours. This change does not apply to those licensees who are exempt from the continuing education requirement.
To assist you in locating courses or help you determine
whether you have already met the requirement, a list of courses which meet the agency requirement can be found on the Department of State website: www.dos.ny.gov/licensing/. Click on ‘Real Estate Broker,’ then ‘List of approved Agency Law Courses.’ Any existing approved course that contains the topic of agency within the coursework will satisfy either the 1 or 2 hour requirement. For instance, the following courses meet the requirement: GRI-3 Agency and the Accredited Buyer Representative courses. GCAR and their online partner, The CE Shop, will have independent courses approved shortly.
