    THE GAZETTE OF INDIA, JANUARY 19, 2013 (PAUSA 29. 1934)15No. 14-42/2011(CPP-II)In exercise of the pow ers conferred by clauses (f) and (g) of sub-section (1) ofSection 26 of the U niversity Grants Commission Act, 1956, the U niversity Grants Commission hereby m akesthe following Regulations' namely :

    1.hort Title, Application .and Commencement:1.1hese Regulations shall be called the University Grants Commission(Mandatory Assessment and Accreditation of higher Educational Institutions),Regulations, 2012.1 .2hese regulations shall apply to:(a ) all universities established and / or incorporated by or under a CentralAct, a Provincial Act or a State Act;(b ) all institutions, other than technical institutions, declared by notification

    under Section 3 of the 'University Grants Commission Act to be deemedto be universities;

    (c ) all colleges, other than technical institutions, including autonomouscolleges.

    1.3hese Regulations shall come into force form the date of notification in theOfficial Gazette.2.efinitions:a) 'Accreditation', with its grammatical variations, means the process of

    quality control in higher education, whereby, as a result of evaluation orassessment or by any other scientific method followed by AccreditationAgenties, a Higher Educational Institution or any programme conductedtherein recognized as conforming to parameters of academic qualityand benchmarking of such academeiquality determined by theUniversity Grants Commission.

    b) 'Act' means the University Grants Commission Act, 1956

    d) 'Asse ssm ent and Accredi tation Agency ' means an agency su ch asNatidriat Assessment and Accreditation Council already recognized byUniversi ty Grants Commission, Nat ional Board of Accreditat ion andNational Accre ditation Board, or an Agency es tablished by or under anAct of Parliament to carry out accreditation.

    e ) 'Col lege' means a col lege as defined under se ct ion 12 A (1) (b) of theUniversity Grants Commission Act, 1956.'Commission' means the Univers i ty Grants Commission as defined inthe Act.

    g) 'Highe r Educat ional Inst i tution' means a unive rsi ty as def ined in sub -section (f) of Section 2 of the Act, and includes, an institution declaredby noti ficat ion unde r the A ct as an inst i tut ion deem ed to be univers i tyunder S ect ion 3 of the Act and colleges as def ined above in c lause (e ),other than a T ech nical institution.

    h ) "Tech nical Inst itut ion ' means an inst itut ion as defined under c lause (h)of sec t ion 2 of the Al l India counci l for Te chnical Edu cation Act, 1987but excluding Technical Universit ies and Universit ies offering technicalprogrammes;

    3.bjec t ives:The process of assessment and accreditation shall have the followingobjectives:a) to accord recognition to the q uality and e xcellence of education imparted

    by Higher E ducational Institutions 4 apd thereby to advance academicquality;

    b ) to ea le s tudents and o the r s takeho lde rs to make in fo rme d cho iceswith re gard to Higher Educational institutions;

    c ) To e nable students, teachers and other stakeh olders to provide inputsconcerning the quality of education imparted by the Higher EducationalInstitutions :

    other ince ntives, if found eligible, from appropriate regu latory and orfunding agencies;

    f) to facilitate High er E ducational Inst itut ions to acq uire internationalrecognit ion, cross-borde r and trans-national collaborations;

    g) to facil itate students achieve learning outcomes appropriate to their courseand re levant to their context , as shal l be de clared by Higher Edu cat ionalInstitutions;

    h ) to faci l itate s tudents ent i tlements, as pres cr ibed by the C ommiss ion ordeclared by the Higher E ducat ional Inst itut ion, as the case may b e, to bemet by Higher E ducational Inst itutions.

    I)o faci li tate teache rs ach ieve and maintain teaching and res earchstandards as shal l be declared by Higher E ducat ional Insti tut ions;to facil itate effect ive teaching-learning and access to quality. teaching-learning mater ia l in a ll the languages permit ted by the Higher E ducat ionalInst itut ion as mediu m of instruct ion or ex amination; andk )o facil itate Higher Educational Inst itut ion achieve effect ive governancemechanisms in their managem ent and adm inisrat ion.

    4.andatory Assessment and Accreditation4.1t shall be mandatory for each Higher Educational Inst itut ion to get accredited bytheAc creditation Agency af ter passing out of two batche s or s ig years, wh iche veris ear l ier , in accordance with the norms and me thodology prescr ibed b y su chagency or the Comm iss ion, as the cdse may be . '4. 2very Higher E ducat ional - Insti tut ion, wh ich has completed s ix y ears of exis tenceor two batches having passed out , whiche ver is ear l ier , shal l apply with in s ixmonths from the date of coming into forceOf thes'e regulat ions, to theAccreditat ion Agency, for accreditat ion.

    4. 3he Higher Educat ional Inst i tut ions, which haVe rwhcom pleted s ix years ofexis tence or two b atches h aving passed out , whicheve r is ear l ier , shal l , with in aperiod of six months from date of such . complet ion, apply to the Accre ditationAgency for accreditat ion.1 1 - 1 1 9 0 1 1 2 0 1 2

    5eriod of Validity and Reaccreditation5.1he accreditation will be valid for a period of five years5.2.t shall be mandatory for each accredited Higher Educational Institution to applyfor Reaccreditation six months before the expiry of the five year period inaccordance with the norms and procedures prescribed by the relevantAccredi tat ion Agency.6 .uties and Obligations of Assessment and Accreditation AgencyThe Assessment and Accreditating Agency shall:6.1nsure complete transparency in its operations and strictly abide by a code ofethics.6 .2rovide an opportunity to all stakeholders in the Higher Educational Institutionincluding students, teachers and non-teaching employees, to submit their viewson matters of academic quality.6.3rovide an opportunity tb all Stakeholders in the Higher Educational Institution

    including students, and non-teaching employees, to file suggestions or objections,if any, on the Self Study Report (SSR) prepared by the Higher EducationalInstitution for submission to the ftsccreditation Agency, which shall be taken note ofby the Assessment and Accreditation Agendy while finalizing the accreditation.

    6.4ublish on its website the final accreditation together with all documents based onwhich-such accreditation was given to the Higher Educational Institution.6.5omplete the accreditation pr n i cess / take a final deasion on theaccreditation application within six months of receipt of application form the HigherEducational institution.

    6.6ake a decision on application, submitted within 90 days of grant ofaccreditation, for withdrawal/ modification of accreditation, against which anyperson or body is aggrieved, within 90 days of receiving the application:

    PART 111Sse. 4]HE GAZETTE OF INnIA, JANUA RY 19, 2013 (PAUSA 29, 19 34)197.ssessment and Accreditation as Pre-requisites.7.1o Higher E ducat ional Inst i tut ion or i ts F acult ies, Sch ools, Departments, Ce ntresor any other units therein, by whatever name cal led, shal l be el ig ib le for apply ingor receiving financial assistance from Commission under any of its schemeswithout having undergone assessment and accreditat ion within st ipulated periodas def ined in Clause 4.1 above.

    7 .2o inst i tut ion, other than thos e u nder de novo c ategory, sh al l be e l ig ib le to applyor be considered for being declared as an institution deemed to be universityunder section 3 of the Act, without having undergone assessment andaccreditat ion as laid down by the C ommiss ion.7.3o univers ity sh al l be not i f ied or reco gnized under S ect ion 12B of the UGC Act, ifnot duly accredited as per Clause 4.1 above, after coming into force of theseregulations.

    7.4o college shall be notified a recognized under Section 2 (f) of UGC Act, if notduly accredited as per Clause 4.1 above, after coming into force of theseregulations.IncentivesTh e C omm iss ion sha l l a l loca te any h igher leve l o f fund ing, as i t may dee m f i t, tosuch h igher e ducat ion inst itution as are acc redited in the h ighes t grade.

    9.enalt ies9.1he re a High er E ducat ional Inst i tut ion'fails to comply w ith the provis ions of any ofthe prece ding c lauses, notwithstanding any other act ion that may b e taken againstthe Highe r Educ at ional Insti tut ion by the appropriate Asse ssme nt andAccreditation Agency, the Com miss ion may, af ter providing reasonableopportunity to such Higher Educational Inst itut ion to be heard, impose any of thefollowing penalties or any c ombinat ion of such penalt ies on Higher E ducat ional

    Institution, namely :a) Repeal of the notif ication in respect of such Higher Educational Inst itut ion

    from the l is t of Higher E ducat ionallnati tut ions recognized u nder S ect ion 12B of the U GC A ct;

    b ) Rec omme nding to the C ent ral Govern inerbrhere i t is an ins t itu tiondeemed to be university, that the notif ication declaring such inst itut ion asan inst itut ion, as an inst i tut ion deem ed to be univers i ty under s ect ion 3 ofthe Act may be revoked;

    d) Withholding of all grants, whe re applicable, allocated to su ch Highe rEdu cational Institution;e ) Declaring such higher Educational Institution to be ineligible for

    consideration for any ass istance under any of the gene ral or specialassistance programmes of the C ommission;

    fieclaring, for the purpose of general information of the public, that theHigher Educational Institution is not an accredited institution, andcautioning potential candidates see king admission to such HigherEducational Institution of the s ame, through various forms of the mediaincluding the webs ite of the Comm ission.

    10.i spute Re dressal Mechanism10.1ny dispute arising out of the implementation of thes e regu lations w ill bediscussed and resolved by the C ommission (or Universi ty as the case may be)wh ose decision shall be final and binding.10.2he Commission reserves the right to amend these regulations from time to timeand same wi l l be binding mutat is mutandis on the Highe r Educ ational Institutions.
