Nagtanong po kami sa CIDG mismo kung meron SPO2 Gina Lucero dun, sabi nila tanunging kung from anong unit. Nung nag txt po kami dun sa number na bigay nila (GINA LUCERO) at tanungin anong unit, ang sagot lng kailangan daw tawagin namin sila. Is this another modus to make us call them? My father is worried syempre although knowing na walang GINA LUCERO sa CIDG nung mag verify kami.

Ask ko lng po if anyone here experienced the same situation?

I'm Mommy Ann, plainhousewife and unemployed, due to financial difficulties di ko na rin nabayaran mga cc ko. The same thing happened to me few hours ago po, may pumunta dito sa bahay a representative from our barangay at may kasamang 2 pulis around 6:45pm, as in tumigil pa sa tapat ng nirerent naming bahay ung mobile car. The lady from our barangay told me to call this number, 02-782-9552/0917-901-2769 kasi daw parang me reklamo against me. Nung tinanong ko sila kung sino and tungkol saan, sabi nya wala siyang idea inutusan lang daw siya, and she handed me this piece of paper nakasulat ung name ko with my address and Art. 315 RPC #3815. Sabi nya tawag na lang ako or text ko ung number to know the problem. And then sabi nya dun sa isang pulis " Oh text mo na sila pakisabi nakausap ko na ung concern na tao" and then they left. Grabe ang kaba,takot at stress level ko, im alone with my 2 kids aged 6 at 7 at nagtatanong sila bakit me dumating na pulis dito sa bahay, ung husband ko po nasa work pa that time... i havent called or text those numbers till now. Banker para sa inyo po tawagan ko ba sila?Napansin ko para po yatang mga babae ang target nila sa ganitong style ng pag collect.

I went to the barangay this morning to confirm nga kung bakit sila pumunta ng bahay. I asked them paano at bakit sila sumunod sa order ng so called SPO2 Gina Lucero of CIDG Camp Crame. Sabi ng secretary sa barangay ay tumawag daw ung SPO2 sa barangay office at ang bungad agad ay "Kailangan namin ang iyong cooperation na mapuntahan si "MR.___" dyan sa barangay nyo. Tapos sabay forward daw dun sa txt containing that message agad naman pumunta ung mga barangay tanod sa bahay namin. Nakuhag masindak ang Tatay ko, sya pa nman mag-isa sa bahay nun. Sabi ko nga sa kanila how sure ba sila na totoo ung tumawag what if it's only a scam or a way to impose authority? Sabi ko nga kailangan ko ma report yung ganyang gawain eh. What if naatake ang tatay ko sa nerbyos? Basta na lang sila sumunod without verify if it's a valid call bsta sinabi lang na from CIDG?

Ang ginawa po namin ay tumawag mismo sa CIDG to confirm if there is a SPO2 Gina Lucero, but nobody there seems to know. Nag-txt naman ako dun sa number na bigay nila at gusto call kmi so we decided not to.

Ano kaya ang next strategy nila? Hay grabe...

came upon your site upon the recommendation of my sister, both of us struggling with cc debt. i got a payment agreement with hsbc (yes not from their ca, i made sure)to settle my 104k debt by depositing 16k last november and 7k for the next 12 months pero grabe hirap na hirap na ako being a solo parent with a 22k take home pay. paano ko napagkasya yun 15k in the last 4 month is by some kinda miracle. ang sister ko naman just keeps ignoring the ca's dahil din sa budget constraints. ngayon naiisip ko sino kaya sa amin ang better ang ginagawa?

anyway, just wanted to share lang yun true story na kinwento ng pinsan ko last week. my cousin was waiting for her turn sa makati rtc para sa isang kaso hinahandle niya dun and ang naunang kaso sa kanila is credit card debt. nang tanungin nung judge yun babaeng may utang na over 200k kung magkano sweldo niya at nalaman nun judge na 8k lang at solo parent pa at dinismiss na yung kaso. sabi nung judge sa plaintiff, "wala ibabayad sayo yan kahit pigain mo! mas importante sa anak na lang niya gastusin ang pera!"

hahahaha!

i wanted to share lang my experience regarding din sa cc ko last tuesday kase may pumunta din sa hauz namin na 2 pulis daw, sinabi lang na may tumawag sa kanila to check if im still residing dun sa address namin tapos may iniwan na papel sinulat dun name and address ko at may pinatatawan na fiscal medina ng qc prosecutors offce branch 38 daw. sympre natako ako kase pulis na yun at madami sinabi na baka next time eh warrant of arrest na daw dadalhin nila. but thanks sa blog dito and specially kay dragon76 dahil naliwagan ako kase kanina tinawagan namin ang number na iniwan pero ang sabi ng sumagot eh sa manila trial court daw yun at si fiscal medina ay sa branch 319, so ibig sabihin mali at hindi totoo ang sinasabi nila para lng maka pang harass eh gumagawa sila ng kahit na anong paraan para makacollect sau.

May tanong lng po ako, ung sis ko kc nag request ng SOA sa Metrobank to know how much pa balance nya kung meron man para makipag arrange to pay. After that they replied saying Php 55.00 per page daw kung gusto nya request yon. Grabeeee naman pla sila, clearly they don't want to show it in detail kc lilitaw ang totoo. So ang sagot lng ng Sis ko "I have been dealing with other banks and they are not charging me for such request. A simple detailed proof that I still need to pay the bank is all I ask for. No proof, no debt, no payment." Are there any instances na nangyari na kya ito sa iba? Just thought I'd share this.

Yung sa father ko naman dahil complete ang mga billing statement nya sa BPI since 1996 to present naisipan nya compute all purchases, all bank charges or interests at lahat ng payments nya. Lumitaw po na may overpayment sya ng P80k dahil nung may work pa sya lagi sya bayad ng bayad ng credit card nya. Ngayon continuous parin send ng demand letter ung CA at offer na P435k na daw ung utang nya. To think na may over payment pa nga sya eh. Should this be reported to BSP? Pati kc sa HSBC nya may P40k pa sya overpayment eh pero still P400k daw ung utang nya ewan ko lng paano nakarating ng ganun at di ko maintindihan ang computations nila. Ang tindi tlaga!!! Nag email na sya sa kanila pero ayaw naman sagutin ung concern about over payment. As in deadma na lng pag sila ang may kulang? para pag sila kung makapang harass eh akala mo kung sino. Ano po say nyo Banker?

Nagkaroon sila ng malaking prob at naghiwalay ng landas. Since then hindi na nakapag bayad si B ke A kahit interest. May times na hinaharass ni A si B sa wall nya sa fb at don naniningil. Nakiusap si B na tigilan na ang ganon at tumigil naman si A lalo dahil nangako si B na magbabayad kapag nakaluwag na. Walang trabaho ang asawa ni B, 3 anak nila at may kanser Nanay nya. Tuwing sinisingil ni A si B thru email or fb, lagi lang nangangako si B na magbabayad. Hanggang makarating sa ibang bansa si B. Hindi pa din sya nakakapag bayad at hindi na nakikipag communicate kay A dahil sa obligasyon sa family at dahil na rin sa iniisip nya na parang habang panahon na lang nyang bababayaran ay interest. Wala syang evidence pero may pakiramdam si B na binayaran na ni A ung utang at gusto na lang syang pagkakitaan sa interest. Hanggang sa harassin na naman si B ni A sa wall nya sa fb.

The agreement was never in written and formal document.

Questions:1. Can A use as evidence ang mga communication nila thru fb at email para sa pag amin or pag acknowledge ni B ng obligations nya? Can A bring this to court for evidence? At anong kaso?

2. Can B use the messages on her wall to file a case of harassment to A?

3. What are the articles of law both parties can use in court?

4. Can A claim B's properties if any for the settlement of alledged obligation kahit walang written at formal docs?

1) A guarantor will ONLY pay if, by the use of due diligence, the debt cannot be made out of the principal debtor.

Why would the guarantor then pay if there is NOTHING TO SHOW that the lender is demanding payment? something is fishy.

2) FB - what cant you simply change your personal settings into "private"?

Thank you for helping people like me. I had RCBC Bankard Visa and Mastercard for more than 1 year but when I had a miscarriage (sadly my second one), i wasn't able to settle even the minimum balance of both cards. I was out of work for 2 months and SSS Maternity benefit was not enough to cover our basic needs. I am willing to settle the balance but I kept getting emails from a certain Law Office demanding me to pay 16k outright. I ignored their emails for the simple reason that I could not produce such amounts. The emails stopped but recently I received a call from certain Ronel of Blah Blah Blah Law office. In all fairness, he was polite when he called me at work so I entertained him. He offered me payment arrangement and discounts of the penalties and interest. He gave me 16k payable in 3 months. He asked me to sign an agreement that he will send at my work address. I told him I will look into it but I asked him to send me my SOA first (which I learned from your Blog, so thank you very much). He then replied saying that the Bank won't provide one because they already have sent one and that they already processed the SOA before they forward my account to the external agencies or law office.

You were absolutely right Banker, they are just a bunch of clueless people. Good thing, we have you to enlighten us of our rights. We are not criminals, we are just people who made mistakes and has financial difficulties.

Nonetheless, I am still willing to pay my debt but like what you mentioned, in my own terms :)

anyway, after 4 years of no calls from collectors (because i've applied the diskarte i've learned before), this Liezel called my new cell number and my company's number. am shocked coz i don't know how they knew about these records (i have no post in FB, twitter, etc on these). at first, kinabahan ako at nagkadandautal ako... as in... then sobrang kabado, kasi unexpected call kasi.... hayyssstttt... ganun pala ang feeling pag naunahan ka ng takot...

We regret to inform you that we will finally recommend to our client, MCC, your account for JUDICIAL ACTION due to your failure, neglect and refusal without just and valid grounds to pay your ling overdue account.With this judicial action, MCC will demand 25% of the accounts due as Attorneys fees, another 255 as collection charges/liquidated damages and ohter related litigation expenses.

We have tried to arrange an out of court settlement but you declined by failing to voluntarily pay your just obligation. While the case is not yet filed, you have the chance to settle the account directly wiht our client, thus avoiding the trouble of going through a costly judicial process.

Need your advise on this po. Please help.

also, i advised my "kapitbahays" to tell future visitors that im no longer in this address 'because nagtanan/lumayas na ako'

question is, dun ba sa expired number palang, mayayari na ako? pano nila ako 'kakasuhan', if ever?

and then, sa 'lumayas', makakasuhan rin ba ako?

lastly, how can i evade mailman/collectors who caught me at the doorstep?
