    By the end of August, 84political prisoners wereincarcerated in Burma, while

    approximately122 individualshave been charged for politicallymotivated actions and awaittrial.

    The number of politicalprisoners has continued to risesince the beginning of this year,with the use of Section 18 of thePeaceful Assembly and PeacefulProcession Act accounting formany of the newly incarceratedindividuals. Barring anysignificant political turnaroundor change of policy, the numberof political prisoners is likely tocontinue to increase throughoutthe remainder of 2014.

    There can be no national reconciliation in Burma, as long as

    In August, AAPP recorded the sentencing oftwenty-eight individuals for politically relatedactivities, as well as the release of one politicalprisoner and the torture of five people.

    AAPP also co-hosted a two day workshop withFormer Political Prisoners Society (FPPS) thismonth aimed at defining the term politicalprisoner. The forum brought together civilsociety groups, political party representativesand former political prisoners, domestic civilsociety actors, as well as international NGOexperts.. The outcome of the workshop is a

    broad definition of political prisoners that hasbeen agreed upon by all parties present.

    Following the rise of media censorship and thearrest of numerous journalists in the first halfof 2014, the month of August also witnessed anincrease in dialogue between the governmentand different media groups within Burma. OnAugust 1, President Sein Thein met with theInterim Press Council (IPC), at which time thepresident agreed to recognize the Press Councilas a mediation body in future disputes

    involving media freedom. Newly appointedInformation Minister U Ye Htut met with theIPC on August 16, and the Chairman of theMyanmar Journalist Association (MJA), U KoKo, on August 17, to discuss similar issuessurrounding media freedom and the best waysto solve such problems in the future. Inaddition, the parliament is consideringamendments to the Penal Code to removeArticle 499 and 500, both of which areremnants from the colonial era that have beenused recently to jail journalists. Despite thesemore amicable relations, President Sein Theinstill warned that media should exercise itsfreedom responsibly and harmoniously.

    Land confiscation also continued to be an issuein the month of August: Fourteen farmers wereincarcerated for staging plough protests and

    nineteen more farmers were charged in relation tland rights claims. Meanwhile, police an

    Lawyer Imprisoned

    A lawyer from Pyin Oo Lwin District, Mandalay

    Division, has been charged under Section 18 ofthe Peaceful Assembly and Procession Act, aswell as Section 109, 147 and 505 of the PenalCode, and sent to Obo Prison in Mandalay onAugust 25. U Zaw Win, who works as a pro-bono lawyer for farmers, had staged a soloprotest on May 28, 2014 against theinadequacy of the judiciary system in Pyin OoLwin; he had been interrogated at one pointsince then, and was finally charged andarrested this month. On August 29, a prayerceremony was held at Shwe-Myin-Tin pagodain Nyantaw quarter for the safe release of UZaw Win.

    Court Accepts Lighter Charges, DeniesBail, for Bi Mon Tae Nay Journalists

    On August 4, Pabedan Township Court inYangon accepted lighter criminal chargesagainst five Bi Mon Tae Nay employees.

    Originally, the employees were charged underArticles 5(d) and 5(j) of the 1950 EmergencyProvisions Act, which held maximum sentencesof seven years each. The five employees willnow be charged under Section 505(b) of thePenal Code, which holds a maximum sentenceof two years and could also be settled with afine. Of the original seven employees facingcharges, Ye Min Aung and Dr. Ei Ei San havebeen released for lack of evidence against them.

    On August 14, the Pabedon Township Court

    rejected the bail application by the Bi Mon TaeNay journalists on the basis that relevantwitnesses had not yet been questioned, anecessary precondition for granting bail insedition cases. It has also been stated that bailcannot be granted to individuals charged withsedition under Article 505 of the Burmese

    Penal Code, the Article the journalists are beingcharged under.

    Protester Sentenced

    On August 28, Ko Win Hlaing, an activist from

    Prome Township, was sentenced to threemonths imprisonment Under Section 18 of thePeaceful Assembly and Procession Act. WinHlaing protested three months ago againstwhat he felt were unfair motorbike helmet lawsrequiring an individual caught not wearing hisor her helmet to pay two fines instead of one.

    Activists Wailu and Win Cho Sentenced

    to Three MonthsOn August 25, activists Ko Wailu and U WinCho were sentenced to three monthsimprisonment by Rangoons KyauktadaTownship Court for violating Section 18 of thePeaceful Assembly and Procession Act. The twohad held a demonstration without priorpermission against a sudden electricity pricehike on March 26, 2014. Ko Wailu received anadditional month for protesting against theeviction of the Moehti Moemi gold miners in

    January of 2014. U Win Cho was recentlyreleased from Insein Prison on June 25, 2014,after serving a three month sentence for hisinvolvement in an unrelated protest inJanuary.

    Protest Leader Sentenced to Eight

    Months Hard Labor

    At his first court hearing on August 12, SeinThans bail was set at 60 million kyat by BahanTownship Court. The Michaungkan protestleader was then indicted under Section 18 ofthe Peaceful Assembly and Procession Law by

    four more Townships, leading KyauktadaTownship to set an additional bail at 30 million

    kyat. Sein Than was originally indicted forprotesting at the Michaungkan Protest Campand participating in a procession to theresidence of Aung San Suu Kyi. Unable to meetthe high bail cost, Sein Then remained in jailuntil his sentencing.On August 19, Sein Than was sentenced to fourmonths imprisonment with hard labor underSection 18 by the Latha Township Court. OnAugust 20, Sein Than was sentenced to anadditional four months imprisonment under

    Section 18 by Bahan Township Court. LawyerRobert San Aung has argued that allowingmultiple trials in multiple townships for thesame charge is against the law according toArticle 234 of the Code of Criminal Procedure.This article states that a person must undergoonly one trial for three different counts of thesame kind of offence if they are committedwithin one year. Sein Than has also beenindicted by Kyauktada and Pabedan TownshipCourts on the same charges.

    Farmers in Mandalay DivisionSentenced

    On August 19, fourteen farmers from SingaingTownship, Mandalay Division, received prison

    sentences of four or eight months for staging aploughing protest in May of 2014. They werecharged for trespassing and destroyingproperty, which stemmed from disputes over1,200 acres of land that had been confiscatedby the military in 1989.     Htin Kyaw Receives Multiple One YearSentences

    Htin Kyaw, the leader of the Movement forDemocracy Current Force (MDCF), was

    indicted under Section 505(b) of the PenalCode an additional five times in August, witheach indictment carrying a sentence of one yearimprisonment with hard labor: On August 1, hewas sentenced by the Southern Dagon MyothitTownship; on August 5, he was sentenced by aThingangyun Township Court; on August 11, hewas sentenced by Mayangone Township Court;on August 15, Hlaingthaya Township Court;and on August 19, he was sentenced by Dagon-Myo-Thit-Seik-Kan Township Court. HtinKyaw was originally charged by eleventownship courts for the distribution of anti-government pamphlets in April, and has beensentenced by ten of those courts. This includesfive sentences received in June and July. Hiscurrent convictions amount to eight yearsimprisonment in Insein Prison.

    Eight Protesters Sentenced to OneMonth Imprisonment

    U Tin Win, U Mya Swe, U Win Myint, U NyuntAung, Ko Zaw Myo Khine, Ko Zin Ko Win, Ko

    Phoe Toat, and U Tun Hlaing were sentencedto one month imprisonment under Section 18

    of the Peaceful Assembly and Procession Lawby Pakokku Township Court on August 12.They had originally protested in February,2014, over having to pay for units of electricitythat they had not used.

    Aung Soe Incarcerated

    On August 6, Aung Soe, a member of the

    Rangoon Peoples Support Network, wassentenced to one year and six months underSection 505(b), one year and six months underSection 145, and six months under Section 143of the Burmese Penal Code at the Pyin-Oo-Lwin Township Court. The sentences totalthree years and six months.

    CONDITIONS OF DETENTIONS

    Five People Tortured in Shan State

    Five individuals of the Naugmata Village in

    Shan State were tortured during aninterrogation over the deaths of two Burmesesoldiers in the area. On July 29, 2014, thebodies of two soldiers of the 88th LightInfantry Divisions 16th Battalion were founddead near the village. The village chairman,secretary, and three community leaders werethen summoned and brutally tortured for 48hours. Sai Hseng Wan, chairman of thecommunity group Namkham Development andAssistance Committee, assured frightened

    villagers that the Commander and DeputyCommander who oversaw the torture weredemoted and transferred out of the region. Thefive victims are currently being treated in ahospital in Ruili, China.

    Kantbalu Farmer Forced to MakeIncense Sticks

    U Kaung Tun, one of the imprisoned farmersfrom Kantbalu Township, has been forced tomake 700 sandalwood incense sticks per day inPakokku Prison. Kaung Tun is a coordinator ofFNI (Facilitator Network with ILO) and isapproximately seventy years old. Of theconvicted farmers from Kantbalu Township, heis the only one known to be forced to makeincense.

    Unity Journalists File Appeal

    On August 28, Robert San Aung, the lawyerrepresenting the five Unity employees,submitted an appeal to Judge Myint Thein atMagwe Regional Court. The appeal stated thatthe five were innocent of any crime, anddemanded the release of the four journalistsand a reduction of sentence for the journalsexecutive, Tint San.

    Charges against Reporters Dropped

    On August 21, charges brought againstapproximately 50 journalists were dropped byRangoon's Kamayut Township Police. Thegroup was originally charged under Section 18of the Peaceful Assembly and PeacefulProcession Act for a protest held on July 12,2014, opposing the sentencing of the Unity

    journalists. Shwe Hmon, one of the journalistscharged, said that the process had not beentransparent; they had not been officiallynotified about the charges, nor had theyreceived notification about the closing of thecase. Deputy Station Officer Maung Maung Oo,who originally levied the charges, warned, Aswe all have to live under the law, anyone whobreaks the law again will be charged. Noexplanation was offered for the suddendismissal of the case.

    Leader of ABFSU Freed on 600,000Kyat Bail

    Min Thway Thit, Joint-Secretary of the All

    Burma Federation of Student Unions(ABFSU), was released on 600,000 kyat bailon August 12, the same day he was arrested.He, along with eleven farmers, was indictedon July 3, 2014 for trespassing during aploughing protest in Thegon Township, PeguDivision. Min Thway Thit was accused ofleading the protest. He failed to appear to hisfirst two court hearings, leading to his arrestby the Thegon Township police on August 12.

    Five Activists Charged for Protest

    On August 5, five individuals were chargedunder Section 18 of the Peaceful Assemblyand Processions Act by No. 2 Police Stationin Prome, Pegu Division. Kyaw San, Myo ThuHtut, U Kyaw, and Maung Maung Toe fromthe NLD, as well as Wunna from theDemocratic Party for a New Society, had

    organized a protest on August 4 inopposition to the proposed parliamentarychange to proportional representation. Theyhad requested permission for the protestAugust 1, which was denied. Lastmonth, the five filed charges at BahanTownship Court against twenty leadingmembers of the Mahana (official Buddhistmonastic committee) for their arbitrarydetention there. Bahan Court rejected thecharges, citing the fact that the main trial isbeing prosecuted in Tamwe Township Court.The monks then submitted charges atTamwe Court, and were again rejected. Themonks lawyers have also stated that their

    clients are not receiving a fair trial. If thehigher courts within Burma will not allowthem to submit their countersuit, Ottara, oneof the five monks, has threatened to taketheir case to the UN or UK, where he is acitizen. The five monks were originallyarrested on June 10, when police andmembers of the Mahana raided theirmonastery, whose ownership is underdispute.

    Proposal for New Political PrisonerCommittee

    Members of the current Committee forScrutinizing the Remaining PoliticalPrisoners have proposed the formation of anew body at a meeting on July 26, 2014.They argue that the current name of the

    committee no longer suits the currentsituation in light of the number of newpolitical prisoners incarcerated this year. Atthis meeting, members also shared theirfrustrations over government failing tocooperate with their efforts to examine thecases of prospective political prisoners and

    restricting them from visiting the prisons.

    Police Open Fire on Farmers inMandalay Division

    On August 14, fifty police opened fire on agroup of around 200 farmers attempting toreclaim confiscated land in Nyaung WunVillage, Sint Gu Township, Mandalay Division,injuring three people. Two received minorinjuries while one, San Kyin Nu, wastransferred to a hospital in Mandalay. Most ofthe police then took refuge inside a villageschool, where they were trapped for hours bylocal villagers before eventually being allowedto leave the school unharmed. The villagers are

    now preparing a lawsuit against the policemen.The 121 Logistic Battalion of the Burma Armyconfiscated around 7,000 acres of land fromthe Nyaung Wun village in 1991. Local villagershave been staging a ploughing protest sinceJune of 2014.

    Sentencing of 173 Farmers DelayedThe Kantbalu Township Court postponed thesentencing of 173 farmers from KantbaluTownship, Sagaing Division, from August 3,2014, until August 15, 2014. The judge statedthat he was postponing the decision becausehe was busy. The farmers were indictedfollowing the staging of a ploughing protest inApril 2014. They were protesting for the returnof 13,000 acres of land confiscated by themilitary in 1999, which they received no

    compensation for. The land is currentlyoccupied by a sugar plantation.

    The hearing was postponed a second time untilAugust 26. On this occasion, the delay can be

    attributed to the farmers awaiting trial, whosubmitted a request to allow farmers who had

    already been sentenced to be present at thehearing. The judge postponed the hearing todiscuss this latest requests with the otherlawyers.

    Nineteen Farmers Charged, Appear inCourt

    Nineteen farmers in Irrawaddy Division,

    including seventeen from Sin-Toe Village,Einme Township, and two from Kone-ShanVillage, Kyaung-Kone Township, have beenaccused of trespassing, stealing, and holdingillegal assemblies. They had their first courtappearance on August 5, and are scheduled toappear again on August 15. In the region, over200 farmers have been charged in relation toland ownership disputes, with more than 60having already been sentenced. In the nearbytownship of Pantanaw, ten thousand acres

    were seized by the regional army battalion,with only 800 acres having been formallyreturned to the farmers.

    AAPP and FPPS Jointly Organize

    Workshop to Define Political PrisonerAAPP was repeatedly featured in the media thismonth due to its involvement in a politicalprisoner workshop held at Dhamma PeyaMonastery in Rangoon. AAPP and FormerPolitical Prisoners Society (FPPS) jointlyorganized a two day workshop from August 17-18, 2014, in Rangoon to consolidate adefinition of what constitutes a politicalprisoner. There were over 50 participants,including representatives from NGOs and

    political parties, activists, lawmakers, lawyers,and international experts. The workshopreleased the following definition:

    1. Anyone who is arrested, detained, orimprisoned for political reasons under politicalcharges or wrongfully under criminal and civilcharges because of his or her perceived orknown active role, perceived or knownsupporting role, or in association withactivities promoting freedom, justice, equality,human rights, and civil and political rights,including ethnic rights, is defined as a politicalprisoner.

    2.

    The above definition relates to anyone who isarrested, detained, or imprisoned because ofhis or her perceived or known active role,perceived or known supporting role, or inassociation with political activities (includingarmed resistance but excluding terroristactivities), in forming organizations, bothindividually and collectively, making publicspeeches, expressing beliefs, organizing orinitiating movements through writing,publishing, or distributing documents, orparticipating in peaceful demonstrations toexpress dissent and denunciation against the

    stature and activities of both the Union andstate level executive, legislative, judicial, orother administrative bodies established under

    the constitution or under any previouslyexisting law.

    AAPPs Aung Myo Kyaw said that thedefinition has now been submitted to theParliament. Previously, the government and

    political activists have been at odds over

    the definition. One such issue was the factthat politically motivated individualswere often being charged under criminallaw; although the current government hasgranted a number of general amnesties,they were usually based on the chargesfor which individuals were indicted,leaving out this crucial demographic.Aung Myo Kyaw argued that since groupshave now come to a consensus on adefinition, the government should

    approve it so that any remainingprisoners can be freed. The results of thisworkshop will be submitted to thegovernment. If possible, we want adefinition that is recognized by thegovernment and Parliament nationwide,said Bo Kyi, Joint Secretary of AAPP.

    US Government to Continue Helping

    Former Political Prisoners

    Assistant Secretary of State for Democracy,Human Rights and Labor Tom Malinowskistated that the US government will continue itssupport to improve the livelihoods of Burmasformer political prisoners and in the educationof their children. At a meeting at the USEmbassy in Rangoon, members of FPPS andAAPP met with Mr. Malinowski, where heshared this statement and requestedinformation for over 2000 political prisonerswho were released in the last four years,including those suffering from mental trauma.In addition, during his visit to Burma for the47th ASEAN Foreign Ministers Meeting, USSecretary of State John Kerry met withPresident Thein Sein and requested the releaseof all remaining political prisoners in thecountry.

    Eight months have passed since PresidentThein Sein promised to release allpolitical prisoners in Burma. However,the number of political prisoners has onlyincreased since that deadline. In thisperiod, AAPP has come to recognize anumber of serious problems associatedwith obtaining the release of all politicalprisoners in Burma.

    Primary among them is the ongoingCommittee for Scrutinizing theRemaining Political Prisoners process,and their attempts to secure the release ofcurrent political prisoners. TheCommittee has met much less frequentlythis year than in 2013, and needs to bemade more effective. Given the factpolitical prisoners still remain despite lastyears presidential promise and repeatedstatements to the contrary, serious

    questions still remain over thegovernment's commitment to the releaseof all political prisoners in Burma.

    In addition, the increasing number offarmers being arrested and incarceratedin relation to land rights claims andploughing protest has also highlighted theneed for an agreed upon definition ofwhat constitutes a political prisoner. Justthis month, an additional fourteenfarmers were sentenced while nineteen

    had charges brought against them.These issues, amongst others, providedthe impetus for the two day workshopheld this month to define the termpolitical prisoner. The result of the two

    day workshop is a definition that isbroadly conceived. It focuses on theintent and actions of individuals, ratherthan the specific section of law anindividual is charged under, as the maincriteria for what constitutes a politicalprisoner. AAPP views this as animportant first step, and the definitionhas now been submitted to parliament.

    Approval by the parliament, andsubsequently the government, is the nextcrucial step towards solving the problemslisted above. It will help to remove muchof the uncertainty surrounding theCommittee for Scrutinizing theRemaining Political Prisoners, and wouldbe an official recognition of the existenceof political prisoners currently being heldwithin Burma. It would also be adefinitive move away from the currentapproach to the issue of politicalprisoners, and would provide a strongfoundation for guaranteeing not onlytheir recognition, but their rights andfreedom.
