IFCI INTRODUCTION

IFCI Ltd., (IFCI) is the first Development Financial Institution of India (DFI), was set up in1948, having its Registered Office at IFCI Tower, 61 Nehru Place, New Delhi-110019 withpan-India presence across 18 key locations. IFCI is a Government of India Undertakingunder the Ministry of Finance.

INSTRUCTIONS TO BIDDERS (ITB)

1. Name of Work: Hiring of Taxi on monthly basis and/or call basis at IFCI Tower,Nehru Place, New Delhi.

2. IFCI Ltd. (IFCI) invites bids by E-tender system in two bid system (Technical &Financial Bid) from experienced and reputed taxi Operators for hiring of taxi onmonthly basis and/or call basis at IFCI Tower, Nehru Place, New Delhi havingminimum five year experience in the field, as under:-

time to non-availability of/hanging of website at last moments or any reason whatsoever.Either IFCI or the E-Tendering service provider shall not be responsible for any issues such asinternet connectivity or internet browser etc. The last date of submission of bids will not beextended if system is hang up in last hours or congestion. IFCI reserves the right toreject all or any tender wholly or partly without assigning any reason whatsoever.

3. Bidders who wish to participate in this tender will have to register on linehttp://ifci.etenders.in. To participate in online tenders, bidders will have to procureDigital Signature Certificate (Type-II or Type-III having signing & encryptioncertificates) as per information Technology Act-2000 using which they can sign theirelectronic bids. Bidders can procure the same from any CCA approved certifying agencyetc. or they may contact IFCI E-tender service provider M/s Nextenders India (P) Ltd.,Contact No.: 020-30187500 (Help Desk 09:30 AM to 05:30PM on all working days.)email : [email protected] who already have a valid Digital Certificate need not to procure a new DigitalCertificate. The bidders are requested to read carefully the user manual available atwebsite http://ifci.etenders.in before initiating the process of E-Tendering.

4. Bidder shall submit their offer online in electronic format both for “Technical” and“Financial bid”. However, cost of tender document and Earnest Money Deposit (EMD) asprescribed, in original should be submitted physically in the office of General Manager(Services), IFCI Ltd., IFCI Tower, 7th Floor, 61 Nehru Place, New Delhi -110019 on allworking days during working hours before the last date and time of submission of bid.

5. Before electronically submitting the tenders, it should be ensured that all the tenderpapers are digitally signed by the bidders.

6. On Line submission of bids: The online bidders will have to be digitally signed andsubmitted in time specified on website http://ifci.etenders.in the following manner:-

a) Envelop-I: Technical Bid: Scanned Copies to be uploaded (.pdf or .jpegformat):-

i) The bidder will have to deposit cost of tender document Rs.1,500/-(OneThousand Five Hundred Only) (non-refundable) and EMD Rs.50,000/-(RupeesFifty Thousand Only) in the form of Demand Draft/Pay Order (PO) drawn onany Nationalized/Schedule bank in favour of “IFCI Ltd. ” payable at New Delhibefore opening of “Technical Bid” in the office of General Manager(Services),IFCI Ltd., IFCI Tower,7th Floor, 61 Nehru Place, New Delhi -110019and obtain a receipt thereof and they shall upload the receipt as proof ofdepositing tender document cost and EMD (scanned copies) along withtechnical bid. Otherwise the technical bid in electronic form will not beconsidered.

ii) The technical information has to be prepared very carefully as indicated in thetender document since it will be the basis for the pre- qualification of bidders.Only relevant and to the point information/document should be uploaded.

Failure to provide any required information, may lead to the rejection of theoffer. Bidders must read the tender document very carefully before signing onit. Technical formats i.e. all Annexures, except Financial Bid Annexures, anyother relevant supporting documents including all the pages oftender document must be signed along with date as token ofacceptance of the terms & conditions of tender.

b) Envelop-II: Financial Bid : Scanned Copies to be uploaded (.pdf or.jpeg format):- This Envelop consists of financial format/schedules only must besigned along with date.

7. Proof for submitting cost of tender document and EMD are essential with technical bidotherwise bid in electronic form will not be considered.

8. Only one bid would be considered from one firm.

9. In case, no bid or single bid is received, the bid will get extended by 15 days. Theexact date and time of E-Tender will be displayed on the website.

10. Opening of Technical Bids: Technical bids will be opened on 23.12.15 at 14:00 HRSon http://ifci.etenders.in by the Tender Committee. IFCI shall evaluate the technicalbid to pre-qualify the bidders.

11. Opening of Financial Bids: Exact date and time shall be communicated throughofficial E-mail address given in the bid document to the qualified bidders.

12. Validity of bids: Tender submitted by Bidders shall remain valid for acceptancefor a minimum period of 90 (ninety) days from the last date of submission of Bid.

13. IFCI reserves the right to reject any or all the offers without assigning any reasonsthereof.

14. Conditional bids would be summarily rejected.

15. Pre-bid Meeting: For any clarification on the Bidding Document, a pre bid meetingwill be held on 14.12.15 at 14:30 HRS at in IFCI Tower, Nehru Place, New Delhi.

NOTICE INVITING E-TENDER FOR HIRING OF TAXIS

E-TENDER: : One year contract for hiring of taxis on monthly basis and/ or on call basis byIFCI.

Bids are invited in two bid system (Technical Bid & Financial bid separately)from reputed Tours and Travel Agencies/ Companies located in New Delhi, Delhifor hiring of DLY Taxis (a) Five Dzire (Diesel) on monthly basis and (b) ToyotaCamry, Toyota Corolla Altis, Honda City, Innova, Maruti (Swift/ Ritz), on call basisfor a period of one year for official use of IFCI Ltd.

The offers, in the prescribed format should be filled up online. The Draft/Pay Orderfor Rs.50,000/- (payable at Delhi) towards Earnest Money Deposit (EMD) in favour of IFCILtd. should be deposited at the office of General Manager (Services), IFCI Tower, 61 NehruPlace, New Delhi and obtain a Receipt which should be uploaded at website(http://ifci.etenders.in) subject to the following conditions. The detailed e-tender is availableon the website of IFCI i.e. www.ifci.etenders.in.

(a) The contractor/ firm should be in the business of providing taxi/ cab services for thelast five years out of which three years have provided services in PSUs/ PSU Banks/GOI/ MNCs/ Reputed Corporates.

(b) Contractor/ firm’s average turnover should be minimum Rs.15 lakhs in a year,(consecutively for the last 3 years ending March 31, 2015). An undertaking to thiseffect should be submitted.

(c) Should submit detailed profile of the contractor/ firm (giving list of earlier & existingclients, value of work, also give name of the concerned official/client, contact number,email ID of atleast 3 clients).

(d) The firm/company should intimate email address and telephone no. For allcommunication in order to avoid loss of time. All communications from IFCI shall besent by Email/ Speed Post/ courier.

(e) Offers of e-tenderers who are under suspension/banned/black-listed by any PSU/Govt.Department /PSU Banks/ or otherwise shall not be considered. Further, if any of thepartners/directors of the contractor’s organization /firm is blacklisted or having any

criminal case against him, his e-tender shall not be considered. An Undertaking tothis effect should be submitted online.

(f) The e-tenderer should also deposit non-refundable Processing fee of Rs.500/- &Tender Document Fee of Rs.1,000 totaling Rs.1500/- (DD/PO) (payable at Delhi) infavour of IFCI Ltd. and obtain a Receipt which should be uploaded at abovementioned website.

(g) Preference will be given to the MSE e-tenders, who are registered as MSE in any of therecognized body as specified by Ministry of Micro, Small & Medium Enterprises (MSME)as per the provisions of the Public Procurement Policy for MSEs Order, 2012 issued bythe Ministry of Micro, Small & Medium Enterprises, Govt. of India.

(h) MSE vendors are exempted from EMD, Tender Document and processing fee andApplication Money.

(i) The bids (Technical and Financial) are required to be submitted in two separatephases as detailed below :

Envelop 1 : Submission of Technical Bid as per Annexure I & II.Envelop 2 : Submission of Financial Bid, as prescribed in Annexure III showing

rates, financial terms & conditions, etc.

(j) Bidders may be required to bring their vehicles for inspection along with original RCs asand when intimated by IFCI.

ANNEXURE-IGENERAL CONDITIONS OF THE CONTRACT

1. The bidder should be an entity that is duly incorporated/ registered under the relevantlaws.

2. The contract shall be initially valid for a period of One year from the date of signing ofcontract.

3. The bidder should have an annual turnover of at least Rs.15 lakh during each of threeconsecutive financial years starting from 2012-13; (Attested copies of duly auditedFinancial Statements to be enclosed); and the bidder should have at least 10 numbersof DLY taxis registered in its name (Attested copies of Registration Certificates for atleast ten such vehicles to be uploaded at website http://ifci.etenders.in).

4. The Bidder shall provide all details required in the Technical Bid-Annexure II, alongwith the attested copies of the supporting documents.

5. At present IFCI Ltd. will be requiring 5 taxi- cars (5 Dzire (Diesel) on monthly basis andToyota Camry, Toyota Corolla Altis, Honda City, Innova, etc. on requirement basis.IFCI Ltd. reserve the right to increase or decrease the number of taxi-cars hiredfrom the concerned Taxi Operator as per their specific requirement. IFCI may hire 3Dzire (Diesel) and 2 Maruti Swift (Petrol/ CNG) or Diesel in place of 5 Dzire.

6. The rates quoted will be inclusive of all taxes and levies excepta. service tax, andb. parking and toll charges (which will be reimbursed on actuals on monthly basis)

No other charges will be paid extra. It shall be the responsibility of the bidder to meetall other costs applicable during the period of the contract, includinga. Repair/replacement of partsb. Regular as well as Emergency servicing of the vehiclec. Fuel expensesd. Expenses on account of breakdown of the vehiclee. Salary of the Driverf. Any other incidental expenses on operation & maintenance of the vehicle No

advance payment, in any case, would be made to the bidder.

The services shall be provided on 24X7 basis in the case of vehicle hired onmonthly basis.

7. The concerned Transporter(s) shall meet our transport requirements through hiring ofmonthly taxi-cars (Dzire and/or Swift) and Toyota Camry, Corolla Altis, Innova, HondaCity, etc. as per the requisitions made by the authorised person from time-to-time.The Transporter(s) shall always ensure punctual deployment of taxis to the concernedofficer and official guest(s) as and when requisitioned by the respective transport-in-charge and/or any other officer authorised by IFCI.

8. IFCI Ltd. shall reserve the right to detain a particular hired monthly taxi-car for dutybeyond the normal stipulated hours on any particular day without giving any priornotice to the concerned Transporter(s).

9. The concerned Transporter(s) shall ensure that the monthly taxi-cars and ToyotaCamry, Toyota Altis, Honda City, Innova, etc. car/ taxi deployed on hire to IFCI are notolder than 2012 model.

10. The concerned Transporter(s) shall ensure that the contracted taxi-cars, etc. deployedon hire to IFCI are in excellent working condition, engine-wise as well as appearance-wise. The taxi-cars offered shall have the following essential features :-

(a) Odometer/Speedometer in proper working condition.(b) Good quality fabric seat (upholstery) & A.C. in working condition.(c) Should conform to the statutory safety and pollution norms.

11. The concerned Transporter(s) shall ensure that each of the driver of the taxi-cars,etc. deployed on hire to IFCI is well dressed in proper uniform, well trained, wellbehaved, and punctual and should be possessing valid driving licence and mobilephone. The concerned Transporter(s) shall further ensure that no such driver is underthe influence of alcohol or any intoxicating drugs while on duty with the IFCI officials/guests. All the drivers should possess proper driving licence and follows instructionstraffic rules. It shall be the responsibility of the Contractor that the driver possessesproper Driving Licence and fully trained to drive the taxi-car. All the driver(s) shouldbe well versed with Delhi/ NCR area.

12. The drivers shall not be entitled to any scheduled and/or fixed breaks for lunch, tea,dinner or any other refreshments. In other words, for such purposes, the drivers shallhave to manage from within the time available in between any particular two journeyswithout causing inconvenience of any kind to the officer(s) concerned. Also, nomileage (extra) shall be allowed to the drivers for such purposes.

13. IFCI Ltd. shall have the absolute right not to accept a particular driver withoutassigning any reason, whatsoever, to the concerned Transporter(s). The concernedTransporter(s) on its/their part(s) shall be responsible to replace such a driver at once.

14. In case of any breakdown of a particular taxi-car deployed on hire to any of theconcerned officer (s) during the course of a particular journey, the concernedTransporter shall bear the actual cost incurred by the above mentioned officers tocomplete that particular journey by alternative means of equivalent standard. Theconcerned Transporter shall also be responsible to provide replacement of suchbroken-down taxi-car at once say within 30 minutes.

15. The concerned Transporter(s) shall be fully responsible in case of any violation oftraffic rule(s) by the drivers of the taxi-cars deployed on hire with IFCI as also in theevent of any loss, damage or accident involving such taxi-cars, IFCI shall have no

liability, whatsoever, in this regard. IFCI and its users shall not be responsible for anyinjury/ death caused to the driver during accident. It will be the responsibility of theTransporter to compensate as per law. The transporter shall be bound to rendercomplete indemnity to IFCI and its users against any liability criminal or civil arising onaccount of hiring taxi-cars by IFCI.

16. The concerned Transporter(s) shall be fully responsible for any loss, damage or injuryto any person, their belongings being transported by the taxi-cars deployed on hire.

17. The concerned Transporter(s) shall ensure that each and every taxi-car, etc. deployedon hire with IFCI is covered by an appropriate comprehensive insurance policy.

18. In case, the Transporter fails to deploy the actual number of monthly taxi-cars requiredby IFCI on a particular day/occasion, IFCI shall be free to make alternatearrangements of equivalent standard from other sources. The entire and actual costincurred by IFCI on making such alternate arrangements shall be fully borne by thedefaulting Transporter without any reference to the hire charges applicable under thecontract with him.

19. Normally, the vehicle will be required on all working days from Monday toSaturday. However, the services sometimes may also be required on allseven days in a week and also on national holidays. The transporter shall bebound to deliver the services on all days as & when asked for.

20. A duly nominated senior representative of the bidder should be available on adesignated telephone to respond to calls from the IFCI. The mobile number of thedesignated senior representative(s) shall also be provided at the time of the signing ofthe contract.

21. Outstation duty as and when required will be included in the monthly kms and hours.TA/DA etc. to the drivers during outstation duty will be paid. The bills raised by thebidder should have all tax registration numbers printed on the bills.

22. The taxi with the driver should be placed at the disposal of IFCI, as per the award ofcontract. IFCI would be free to use the hired car in any manner for carrying officials,office equipment etc. as per its requirements and the bidder will not have anyobjection to it.

23. The concerned Transporter(s) shall ensure that proper account of each and everyjourney made by the taxi-cars, etc. deployed on hire with IFCI, is maintained by therespective drivers and is submitted to the authorised officer of IFCI at the end of themonth or as per the instruction of authorised officer.

24. The concerned Transporter(s) shall be required to deposit with IFCI Ltd. an amount ofRs. 50,000/- (Rupees fifty thousand only) as performance guarantee-cum-securitydeposit from a nationalized Bank in the form of bank guarantee in favour of “IFCILtd., New Delhi” within seven days of commencement of the contract(s). The said

deposit or part thereof shall be forfeited for any deficiency in service and/or breach ofany of the terms and conditions of the proposed contract(s) by the Transporter. Inaddition, penalty as deemed appropriate may be imposed on the Transporter in thisregard.

25. If there is deficiency of service on the part of Contractor, the agreementshall be terminated without giving any notice.

26. No claim shall lie against IFCI in r/o erosion in the value or interest on the amount ofearnest money deposit/ security deposit. No interest shall be paid by IFCI againstEMD/SD.

27. An Agreement is to be Signed by the successful agency within 15 days fromissue of the job order.

28. The Contractor will have to pay atleast minimum rates of wage, circulated from time totime by Govt. Of Delhi under the Minimum wages Act, to the Drivers deployed by himat IFCI. Payment to the Drivers shall be made as per the latest guidelines of LabourDepartment. The Contractor shall submit a certificate every month to IFCI at the timeof submitting the bill in this regard.

29. The drivers of the monthly taxi-cars shall strictly follow the instructions of authorisedofficer of IFCI for carrying out day to day duty. The drivers shall daily after enteringshall report to the authorised officer and shall not leave without the instruction ofauthorised officer.

30. The Bidder should invariably ensure that the antecedents of driver(s) to be deployedshould be properly verified (by Police authorities) and their details (names, addresses,telephone numbers, photograph, copy of driving license etc.) will have to be providedto this office, immediately after the award of the contract. Prior permission has to beobtained from this office before change of any driver. Failing to adhere to the abovewould be treated as breach of contract and the contract would be terminated withoutany notice.

31. The vehicle and driver provided to IFCI shall not be changed except under compellingcircumstances and after prior consent of the IFCI.

32. E-tenderer shall not be permitted to withdraw his offer or modify the terms andconditions thereof. In case the e-tenderer fails to observe and comply with thestipulations made herein or backs out after quoting the rates, the aforesaid bankguarantee/ demand draft will be forfeited by IFCI.

33. IFCI reserves the right to cancel the contract at any time without assigning any reasonwhatsoever. The Bidder will not be entitled to claim any compensation against suchtermination. However, while terminating the contract, payment due, if any, to theBidder for services already performed/rendered would be paid as per the contractterms.

34. The Bidder may discontinue the contract by giving a notice of at least 30 days inwriting.

35. In case of any dispute arising under the proposed contract the dispute shall be referredto a sole Arbitrator to be appointed by IFCI. Any decision of such Arbitrator shall beconclusive and binding on both the parties. The arbitration proceedings shall be heldat Delhi and shall be governed by the provisions of the Arbitration and Conciliation Act,1996 as amended from time to time.

36. The Courts of Delhi will have an exclusive jurisdiction over any legal dispute arisingunder the proposed contract between the Transporter and IFCI.

37. IFCI reserves the right to reject any or all the quotations without assigning any reasonthereof. Decision of IFCI shall be final in this regard.

38. Bids incomplete in any respect shall be liable to be rejected.

39. The transporter shall submit an affidavit that it shall comply with all relevant laws.

INSTRUCTIONS

i) The General Conditions of Contract form part of the E-tender specifications. All pagesof the e-tender documents shall be duly signed, stamped and uploaded atwebsite http://ifci.etenders.in along with the offer in token of completeacceptance thereof. The information furnished shall be complete by itself. The e-tenderer is required to furnish all the details and other documents as required.

ii) E-tenderers are advised to study all the e-tender documents carefully. Any submissionin e-tender shall be deemed to have been done after careful study and examination ofthe e-tender documents and with the full understanding of the implications thereof.Should the e-tenderer have any doubt about the meaning of any portion of the E-tender Specification or find discrepancies or omissions in the scope of work or the e-tender documents issued are incomplete or shall require clarification on any of thetechnical aspect, etc., e-tenderer shall at once, contact the authority inviting the e-tender well in time (so as not to affect last date of submission) for clarification beforethe submission of the e-tender. E-tenderer’s request for clarification shall be withreference to Sections and Clause numbers given in the e-tender documents. Thespecifications and terms and conditions shall be deemed to have been accepted by thee-tenderer in his offer. Non-compliance with any of the requirements and instructionsof the e-tender enquiry may result in the rejection of the e-tender.

iii) The validity of Bank Guarantees towards Security Deposit shall be upto the completionperiod as stipulated in the Letter of Intent/Award +3 Months, (i.e. 15 months) and the

same shall be kept valid by proper renewal till the acceptance of Final Bills of theContractor, by IFCI.

iv) It is the responsibility of the bidder to get the Bank Guarantees revalidated/extendedfor the required period as may be advised by IFCI. IFCI shall not be liable for issue ofany reminders on expiry of the Bank Guarantees.

v) IFCI reserves the right of forfeiture of Security Deposit in addition to other claims andpenalties in the event of the Contractor’s failure to fulfill any of the contractualobligations or in the event of termination of contract as per terms and conditions ofcontracts with IFCI.

RETURN OF SECURITY DEPOSIT:

Security Deposit shall be refunded/Bank Guarantee(s) released to the Contractor afterdeducting all expenses /other amounts due to IFCI under the contract/other contracts enteredinto with them by IFCI.

BANK GUARANTEES:

i) Bank Guarantees shall be from Scheduled Banks/ Public Financial Institutions as defined in theCompanies Act.

ii) It is the responsibility of the bidder to get the Bank Guarantees revalidated/extended for therequired period as advice by IFCI. IFCI shall not be liable for issue of any reminders on expiryof the Bank Guarantees.

iii) In case the Bank Guarantees are not extended before the expiry date, IFCI reserves the rightto invoke the same by informing the concerned Bank in writing, without any advancenotice/communication to the concerned bidder/contractor.

iv) Bidders to note that any corrections to Bank Guarantees shall be done by the issuing Bankonly through and amendment in an appropriate non judicial stamp paper.

v) The Original Bank Guarantee shall be sent directly by the Bank to IFCI under Registered Post(Acknowledgement Due), addressed to the General Manager (Services), IFCI Ltd., IFCI Tower,61-Nehru Place, New Delhi-110019.

EXECUTION OF CONTRACT AGREEMENT:

The successful e-tenderer’s responsibility under this contract commences form the date of issueof the Letter of Intent by IFCI. The E-tenderer shall submit an unqualified acceptance to theLetter of Intent/Award within the period stipulated therein.

The successful tenderer shall be required to execute an agreement in the prescribed form, withIFCI, within 15 days after the acceptance of the Letter of Intent/Award, and in any case beforereleasing the first running bill. The contract agreement shall be signed by a person dulyauthorized/empowered by the tenderer. The expenses for preparation of Agreement documentshall be borne by the contractor.

REJECTION OF TENDER AND OTHER CONDITIONS:

i) IFCI reserves the right to accept or reject the tenders without assigning any reasonwhatsoever.

ii) Conditional tenders, unsolicited tenders, tenders which are incomplete or not in the formspecified or defective or have been materially altered or not in accordance with the tenderconditions, requirements, etc., are liable to be rejected.

iii) If a tenderer who is a proprietor expires after the submission of his tender or after theacceptance of his tender, IFCI may at their discretion, cancel such tender. If a partner of afirm expires after the submission of tender or after the acceptance of the tender, IFCI maythen cancel such tender at their discretion, unless the firm retains its character

iv) IFCI will not be bound by any Power of Attorney granted by changes in the composition of thefirm made subsequent to execution of the contract. They may, however, recognize suchpower of attorney and changes after obtaining proper legal advice, the cost of which will bechargeable to the contractor concerned.

v) If the tenderer gives wrong information in his tender, IFCI reserves the right to reject suchtender at any stage or to cancel the contract if awarded and forfeit the EarnestMoney/Security Deposit/any other money due.

vi) Canvassing in any form in connection with the tenders submitted by the Tenderer shall makehis offer liable to rejection.

vii) In case the proprietor, Partner or Director of the Company/Firm submitting the Tender, hasany relative or relation employed in IFCI, the authority inviting the E-Tender shall be informedof the fact as per specified format (Annexure-IV).

viii) The Bidder shall not transfer, assign, pledge or sub-contract the services it has bid forunder any circumstance without written permission of the IFCI.

ix) The Tender submitted by a techno commercially qualified tenderer shall become the propertyof IFCI who shall be under no obligation to return the same to the bidder. However,unopened price bids and late tenders shall be returned to the bidders.

x) Unsolicited discount received after the due date and time of Bid Submission shall not beconsidered for evaluation. However, if the party who has submitted the unsoliciteddiscount/rebate becomes the L-I party, then awarded price i.e contract value shall be workedout after considering the discount so offered.

xi) IFCI shall not be liable for any expenses incurred by the bidder in the preparation of thetender irrespective of whether the tender is accepted or not.

RIGHTS OF IFCI:

a) IFCI reserves the following rights in respect of this contract during the original contract periodor its extensions if any, as per the provisions of the contract, without entitling the contractorfor any compensation.

b) To terminate the contract by IFCI in the event of:-

i) Contractor’s continued poor performance (deploying old vehicles, etc.) and continuedmisbehavior of the Driver(s).

ii) Leave office during half way journey before reaching destination and continueddisregard to the instructions given by the Authorised Official of IFCI by the staff ofcontractor/ driver.

iii) Corrupt act of Contractoriv) Insolvency of the Contractorv) Persistent disregard to the instructions of IFCIvi) Assignment, transfer, sub-letting of contract without IFCI’s written permissionvii) Non fulfilment of any contractual obligationsviii) In the opinion of IFCI, the contractor is overloaded and is not in a position to execute

the job as per required schedule

RESPONSIBILTIES OF THE CONTRACTOR IN RESPECT OF LOCAL LAWS, ETC.:

i) The following are the responsibilities of the contractor in respect of observance of local laws,employment of drivers, payment of taxes etc. The contractor shall fully indemnify IFCI againstany claims of whatsoever nature arising due to the failure of the contractor in discharging anyof his responsibilities hereunder:

ii) The contractor shall ensure that no damage is caused to any person/property / vehicle of otherparties while driver or while at parking at site. If any such damage is caused, it is responsibilityof the contractor to make good the losses or compensate for the same.

General Conditions of the Contract (GCC) will form the part of the contract.
