He also talked to us about theresponse to the Maoist letter, and sayscabinet positions are being kept vacant forpolitical parties to join an all-partygovernmentNepali Times: How would you grade yourfirst 50 days?Prime Minister Thapa: Our problems areinterlinked, and they are three-fold: the Maoists,the parties and day-to-day governance.Governance is satisfactory, we have heldinformal talks with the Maoists, overall thepeace process is on track. The parties havetheir stand and I have requested themrepeatedly to reconsider it.But Baburam Bhattarai’s response to yourletter sounded uncompromising. Is thepeace process in jeopardy?In every negotiation process there are ups anddowns, it’s natural. It was going well with theMaoists, and the letter is a hurdle. But we willrespond to it. Things may look uncertain, butactually this is just them strengthening theirbargaining position. It’s a bit premature to saywhat our response will be. We are holdingconsultations.How soon will it come?Soon.But Baburam’s letter seeks guarantees fromthe king for the peace talks.There is a government here, there is no

question about dealing with anyone else. It is thegovernment that gives guarantees.What then is your message to the people?The people are understandably worried by theMaoist problem. And when they see thesehiccups, it’s natural they get nervous. But I wantto assure them, there is no need to fear that thetalks will break down.The parties seem more defiant than ever.We are still trying, and we have assured themthat we will be tolerant and not use force againstconstitutional forms of protest. Actually, I musttell you that we have been carrying out privatedialogues with the parties at various levels.Your cabinet has only six members. Isn’t thata problem?It is a strategic decision. We want to be able toinvite political parties to join the team, we kept itopen for them. If we had filled it up with our ownpeople there would have been allegations that weare not serious about working with them.So, can we deduce that the reason theparties haven’t accepted is because they arenot satisfied with the portfolios you haveoffered?Maybe I was not able to go as far as theywanted, but till recently I was part of their six-party alliance. We had three main demands:executive power should be with the government,the prime minister should be able to form hisown cabinet and we should function under thespirit of the constitution. We formed thisgovernment with those guarantees. Now, theparties want the reinstatement of parliament or

an all-party government, and even there we seea divergence between the UML and theCongress.What is your priority: to resolve differenceswith the parties, or resolve the Maoistproblem?The Maoist problem. The problem with theparties is a temporary phenomenon. The Maoistissue needs a longterm solution, it has greaterweight and importance. But we will try toaddress both issues simultaneously.What options are you looking at: parliamentreinstatement, elections, or otheralternatives?Reinstatement is a matter of debate, I don’thave any preferences either way. On elections,the entire resolution of the present politicalcrisis rests on holding them, the setting up of anew parliament and the formation of a newgovernment. We want elections as soon aspossible and we have even budgeted for it.What remains to be seen is how the peaceprocess with the Maoists goes ahead. That isthe crux of the matter.But can’t we look at elections also as a wayto resolve the Maoist issue?I agree. But it’s a chicken or egg question. Youcan’t have elections without the Maoist problembeing resolved and you need elections to beable to find a longterm solution to the problemsof representation.The Maoists have repeatedly said that theywill oppose elections now.The Maoists fear a new parliament will validate

the present constitution and they want aconstituent assembly. We have to work on acompromise with them, that is the only way wewill find a new direction.Is it really true that the king revertedexecutive power to you?Absolutely. His Majesty has been cooperatingvery sincerely, and the government hasenjoyed complete executive power. The onlytest of this will be to look at performance, whomakes decisions, and whether there isdelivery.The level of criticism of the monarchy

today is unprecedented in Nepali history.I think it is an emotional manifestation of aparticular moment when certain decisions hadto be taken. The criticism is born out offrustration in some quarters, and it is atemporary thing. The ones who are raisingslogans now will get tired pretty soon.Our headline, then, will be: noreinstatement of parliament and noderailment of talks.I am certain the talks will not be derailed. But Ican’t say there won’t be a reinstatement ofparliament. So, you don’t have a headline.(Laughs.)

Hari Prasad Pandey had publicly confessed through media two years ago (see‘Mea Culpa’, # 92). This week, he appeared on the NTV talk show Dishanirdesh totell Vijay Kumar Pande that since the government wasn’t interested in punishing him,he was punishing himself. He is still serving a three-year self-imposed house arrestin Pokhara, and surviving on a daily prison ration of Rs 15. He has set aside Rs 25million, roughly equivalent to the bribes he says he has given and the tax he evadedduring his career, which the government can use for a good cause. The governmenthasn’t taken him up on the offer, so he is spending the money on schemes like ascholarship program for 40 young women to get college degrees.

Hari Prasad Pandey says he didn’t accept bribes when he was minister, he isjust atoning for the ghoos he gave to further his business interests. Most otherpoliticians, bureaucrats, officials and businessmen aren’t as worried about badkarma. For anti-corruption watchdogs, the most difficult part is figuring out where tostart. When corruption is so endemic, so accepted, and is such a given, how do youdecide which crook to run after first, without making it look like political vendetta?

After a decision to investigate is made, and if you can penetrate the secretivenetherworld of officialdom that leaves no paper trails, then you hit the brick wall ofpublic apathy. This is the so-what’s-new mentality, and the conspiracy of silenceallows the corrupt to lie low for things to blow over, as they inevitably do. Thejudiciary, civil society and law-enforcement will ignore reports because they exposeinadequacies and also because it means more work. The politicians will makesanctimonious noises, but they will never rock the boat and will pretend to look theother way.

If someone gets rich quick, it always means someone else gets poor fast. Allcorruption ultimately affects the ordinary citizen. Often, the effect is direct: a patientwho dies because of fake pharmaceuticals, pedestrians who suffer chronic lungdisease because officials are paid off to allow unlimited diesel car imports, politicallyconnected borrowers who default billions from banks and endanger ordinarydepositors, children who die ofmeasles because money for thevaccines was stolen.

Then, there is the indirect effect:the high cost of electricity becausepast ministers were bought off byconscienceless contractors to ripthe country off, an official who triedto secretly sell Nepal’s geostationaryorbital slot to the highest bidder,another official who gave away ourfifth freedom rights to a foreigncarrier for free.

Like the garbage that liesuncollected because the municaplityis now run by unaccountable peopleno one elected, the stench is prettyoverpowering. Only by putting intoplace a credible mechanism to cleanup graft will we ensure long-termpeace.

The first alarm rang when experts found up to100 times more particulate matter in diesel exhaustthan petrol. Then researchers in the UK found that90 percent of the particles emitted by dieselengines are very tiny or less than 1 micron. Thismeans that almost all the particles in diesel exhaust,which are surrounded by toxic compounds such aspolycyclic aromatic hydrocarbons (PAHs), are smallenough to go deep into the human body.

There has been a dramatic increase of patientswith chronic lung disease in the past 10 years.

California Air Resources Board (CARB) declareddiesel exhaust to be toxic air contaminants and saidthat chronic exposure to just 1 microgram per cubicmeter of diesel exhaust will lead to additional 300cases of lung cancer per million people.

Environmentalists all over the world are nowcampaigning to ditch diesel vehicles and somecountries such as Brazil, Taiwan and Egypt havebanned private diesel cars. French journalists andthe famous Indian environmentalist the Late AnilAgarwal called diesel vehicles “Engines of theDevil”.

In Nepal, however, diesel continues to enjoysubsidies and driving a heavy diesel powered SUVsis fashionable. It’s not, it’s deadly. Kathmandu-basedinternational aid agencies are the largest users ofthese cars, followed by government ministers,projects and members of parliament who all orderedone during the Pajero scandal. It finally acknowledged that electricvehicles are a better option, it promised to lower electricity tariff forelectric vehicles, lift of the ban on electric vehicles in Kathmandu,resume the trolley bus service and implement the government’sprevious decision to ban commercial vehicles that are more than 20year old.

But the budget is silent on the issue of banning two-strokethree-wheelers, a decision that was taken by the government threeyears ago. It has lowered the customs duty on petrol and dieselvehicles by almost half. On the trolley bus, it says the system willbe handed over to the three cash-strapped municipalities with noexperience managing transportation systems. What was neededfrom the finance minister was a sincere commitment to have thebuses on the road again with active participation from themunicipalities and the private sector.

When NepalTelevision recently airedan uncut interview ofMaoist negotiator KrishnaBahadur Mahara earlierthis month, many wereshocked. Staying true to the original, which oftenrequires meticulous research, challenges

conservation organisations as much as thepressing concern of insufficient funds. Rohit

Ranjit, one of the chief architects for theKathmandu Valley Preservation Trust (KPVT)

recalls the hard work that went into renovatingthe Indrapur temple in Kathmandu Durbar

Square. When it was destroyed in theearthquake of 1934, Juddha Shumsher had itreconstructed but unfortunately, the roof was

redone without much regard to the original (seepic and drawing, left). When the KVPT began to

restore the Indrapur temple, which had onceagain started to crumble, they redesigned it

after tracking down rare pre-1934 photographs(below, right). Today, it stands close to its

original glory.

It sayshumanitarian assistance has tended to be focused on headline-grabbing disasters, diverting potential aid away from the crisesthat do not have a high profile in the media and do not involve theinterests of the world’s major political powers.

This is not a new phenomenon, admits Jonathan Walter, editorof the report. The largest volumes of aid are channelled to thecountries that have been targeted in the US-led war on terror,while those who suffer the consequences of armed conflict,disease and natural disaster in other countries go ignored, saysthe Federation. The humanitarian ethic means saving the lives ofthose most in need and at the same time respecting the dignity ofeach individual who has fallen victim to armed conflict, famine,disease or natural disasters, says the report. D*)==8>0$@71$*8>12UNITED NATIONS – The United Nations is expressing fears thatarmed troops, notably in strife-torn countries such asAfghanistan and Iraq, are increasingly doubling as humanitarianaid workers, threatening private relief operations. Secretary-General Kofi Annan says since the 1990s military forces havebeen assuming growing responsibilities for vital civilian functions,including delivery of food and water, provision of electricity, anddistribution of medicine and other relief supplies for victims ofwar.

The role of the military as aid workers has been enhanced inboth Afghanistan and Iraq, thereby diluting the distinctionbetween civilian relief workers and armed troops. The risingopposition to the concept of military aid workers has also comefrom INGOs and relief agencies working in war zones.

After nearly three years of deliberations, the United Nationsissued a set of guidelines last month that lays down basic groundrules for military participation in humanitarian activities. Developedin collaboration with the international humanitarian aid community,the guidelines say that any use of military and civilian defenceassets should be clearly limited in time and scale, and alsopresent an exit strategy. It also admits that many internationalmilitary forces provide assistance to civilian population in theirareas of responsibility. (IPS)

It is a matter of nationalshame to have Kathmanduon the Unesco list ofendangered heritage sites.After seven sites wereidentified in 1979, theentire Valley was put onthe world heritage list soresidents would feel more included and responsible for their protection. More thantwo decades later the picture is very different from what the Unesco hoped for.Unchecked urbanisation since 1990 has taken a toll on the sites.

Following the change in national politics, the leaders at the helm of the partiesignored the precedents set by the Department of Archaeology (DoA), which isresponsible for the protection of heritage sites. It even caved in to pressure fromBoudha residents who refused to dismantle buildings constructed against Unescostandards.

The United Nations body repeatedly warned the Nepali government to urgentlyimplement separate workplans for more sensitive sites like Boudha,Hanumandhoka and Patan to stop illegal construction. Three years ago the DoAannounced a plan to categorise houses built around heritage sites. It hasn’tmaterialised so far, although a year later, it did blacklist a few constructions fordisobeying building codes. This was a mere slap on the wrist as nothing furtherwas done. Later, a committee chaired by the prime minister was also proposed totackle the problem of illegal construction but it never saw the light of day.

Hints of what might happen were dropped at the World Heritage Committeemeeting in Helsinki last year. Immediately after, a three-member team of expertsvisited Kathmandu and met with political leaders, government officers and themedia. They examined the reasons for physical and cultural deterioration andrecommended immediate protective actions. The government did not take heed.

And this is how we find ourselves on the endangered list. All of us, both thegovernment and citizens, have a hand in this failure. Our inability to take care ofwhat is our shared heritage will probably lead to the arrival of international teams tostep in. To get Kathmandu off that list is a huge challenge. It requires an enormousamount of political commitment, bureaucratic determination, human resources, theinvolvement of local bodies and the general public.

In line with suggestions from the World Bank, the government has handedover Rastriya Banijya Bank and Nepal Bank to foreign management. Thisidea hasn’t worked anywhere else. In Nepal, the ‘reform process’ in thesegovernment-run banks has already begun, leaving us with no choice butto wait and watch.

The first move by the foreign managers was to address theexploitation of government banks by big businesses. It’s a reasonableresponse considering that many business houses have siphoned off hugeamounts from banks ostensibly for industrial investment, but really to linetheir own pockets.

With such precedence, Nepal Bank’s drive to collect ‘bad debts’cannot be faulted. It has rightly targeted influential industrialists andbusinessmen who are defaulters. After all, how can a bank survive withoutrepayment of loans? However, certain banking norms need to be followed.These have to do with agreements when the initial investment was made.The police or the CIAA have no job interfering, and to do so will be todouble-cross customers and erode the bank’s credibility.

If all else fails, the banks always have the recourse of seizingcollateral assets and auctioning them off. These are normal bankingprocedures for defaulters. The question is, given the political andeconomic situation in the country, can banks realistically pursue suchforceful methods? They may make short term recovery, but damage theiroverall existence. The government and Nepal Rastra Bank are on atightrope.

Private industries and businesses face tough times, most situationsare outside their control. Not all businessmen are intent on cheatingbanks, and the fact remains that a majority have suffered due tomismanagement and the deteriorating security situation. That said, ifbanks exert pressure on business houses, the latter will be probably haveto liquidate. Just as well that the private banks have not started turningthe screws yet.

If the industries still running with some degree of efficiency come to agrinding halt, the plight of our economy will only worsen. Thegovernment must not be a mute spectator. It must come up with viablealternatives to rescue sincere and able industrialists. Banking and

industry share a symbioticrelationship—one cannot exist

without the other.

SundarijalI was expecting Sushila today, because yesterday the AssAnchaladish had given me the impression that the interviewwould take place soon to speed up the legal proceedingsalso. I was in great excitement and tension the whole day. Inthe afternoon I read today’s Gorkhapatra and R Nepal both ofwhich carry the statement by the National Panchayatmembers who have condemned the statement of somemembers of the Indian parliament demanding my release.Thereafter, I start suspecting that since the Nepal govt istrying to create an impression that legal proceedings havestarted against us, yesterday’s visit of Ass Anchl was infurtherance of that objective. A show of motion. I don’t knowwhat was the statement from the Indian side in our support,but from the condemnatory statement from the panchayatside I could gather that there is a demand in certain politicalcircles, in India at least, for my release. It would be moreappropriate if our supporters in other countries emphasisedthe barbarous character of my detention—in solitaryconfinement—and demand an open and fair trial. Thequestion of human rights, which has been so forcefully put onthe agenda of human freedom and dignity by US PresidentCarter should be taken up in our case. That would carry moreweight and wouldn’t invite the change—specious, I agree—of

interference in the internal affairs of a country. Human rights are notjust a question of concern to our country—it is the concern of all themembers of the UN.

Today in the afternoon, Dr Bhattarai came without notice with amobile set of x-ray apparatus. Two x-ray photos of my chest were taken.The culture finding of my sputum was positive this time—pneumococci—for which Dr Bhattarai has prescribed an antibiotic. What is thispneumo cocci? Something connected with a lung disease? I havebeen progressively feeling run down and getting emaciated day byday. Dr Bhattarai has asked me to send my 1st urine tomorrow morning.Missing of pulse beats ESB continues. Today also there was someblood in the sputum, but in diminished quantity. My blood pressure isunusually high and unusual for me who has been used to low bloodpressure. I am very tired today. I did not do my usual routine workeven. Partly it was due to my tension expecting Sushila any time ofthe day.

I did some writing today—a rambling history of the NepaliCongress but it kept me busy most of the morning and part of the day.I go on writing whatever occurs to my mind without caring for thelanguage and bothering to discriminate what to keep in or what toleave out, ie leave it…wider dissemination—so everything ishaphazardly piled up together. The primary purpose of this exerciseis to keep my mind busy, but at the same time to do some useful workwhich can be set in proper order later on when the primary need ofthe occupation of the mind is not so pressing.

I have started taking an anti-biotic for pneumo cocci whatever itis—since this morning—6 hourly for 6 days. I am most reluctant touse anti-biotic but I thought that in view of the serious nature of theinfection I should take it. I took anti-biotics more than 4 months ago. Ithink 3 times a year is not an excessive intake of this kind of drug. Ihad suggested some other anti-biotic but Dr Bhattarai thought thatampicillin to be the specific for this kind of trouble. I had suggestedeither Erythromycin, or minycillin, or Mantidex, but he sent Rosicillin.Anyway, I have to depend upon Dr Bhattarai’s judgement now morethan anybody else because he is the only man made available tome. Dr Bhattarai is very fond of new medical gadgets because at theslightest pretext he puts the patient—at least he had done so withme—on all kinds of pathological and other examinations. He ishandicapped in the discharge of his medical function because allthe exams have to be done here in the prison itself. He can’t take meto the hospital. Moreover, it appears no doctor from a civilianhospital is allowed, hence I am not getting an eye specialist toexamine my eyes, because obviously the military hospital has no eyedept or an eye specialist. Otherwise Dr Bhattarai would have sent himhere. I think Dr Bhattarai is director of the military hospital with therank of colonel—boss of the hospital dept in the army. Dr Basnet isperhaps his assistant. Basnet is a more congenial person but hebelieves in overmedication.

Fine dust below 10 microns (PM10) is the most dangerous air pollutant since ittends to get stuck deep within the lungs. PM10 levels in Kathmandu valleyhave improved because of the rains (see p4-5) as this week’s figures forPutali Sadak and Thamel show. Thamel showed fine particulate concentrations50-71 micrograms per cubic meter all of last week, much lower than thepre-monsoon figure for the same location of 312. For Kishore, appreciation forthe delectable dumpling began inhis childhood growing up nearHanuman Dhoka. As he and hisfriends gobbled down platefuls ofmomos at Jharna Restaurnat, ahole in the wall on a small laneleading towards Freak Street, he’dwatch in fascination as theshopkeeper deftly pleated thedelicate flour wrappers.

Years later, as a young hotelmanagement graduate fromGermany, he joined the Yak & YetiHotel, where he worked his way upto assistant general managerbefore moving on to a seven-yearstint at Hotel de la Annapurna. Hisfirst independent project wasBhanchha Ghar, a Nepalirestaurant set in a faithfullyrestored aristocratic house thatoffered more than the routine dal-bhaat-tarkari. As locals, expats andtourists flocked there, Kishorenoticed one thing: everyone lovedthe momos, whether as a mainmeal, an entrée or a snack washed

down with local firewater.He was struck by its universal

appeal and noticed that while foodfads like the burger and pizzacraze came and went, the littlemomo was always king. So, whenthe time came to expand hisbusiness he went with his gutinstinct and took the momo southof the border to posh ConnaughtPlace in the heart of New Delhi.Now, Kishore has brought BelleMomo home to Darbar Marg. In thepleasant outdoor seating area,Kishore expansively charts themomo’s journey across themountains. “The momo originatedin China as dim sum and wasadapted by the Tibetans,” he
