No other profession has faced so many challenges from public, press and politicians in the last two decades like our Medical Profession. It all stemmed out from our dissatisfied patients precipitated by our own unethical professionals.

Affected patients transformed themselves into consumer activities and fought and influenced to be includedinto CPA to start with. But IMA came out with PPLSSS to rescue from the clutches of CPAsuccessfully in 90 - 98% of the complaints by effective initial reply and authentic arguement in the form of filing our version.

Then they started attacking doctors and hospitals. IMA shielded our members by fetching Prevention of Attack on Hospitals Act. Then they resorted to filling criminal complaints stressing for the arrest of doctors. IMA got beautiful G.O. 58 giving the guidelines for dealing a criminal complaints against doctors.

This powerful lobby posing themselves as major vote bank had influenced the Central Government by enacting Clinical Establishment Act without any discussion in the parliament with a power to close the erring clinical establishment by an unilateral decision of District Collector.

It has been introduced into all Union Territories and five small congress ruled states. All other states are being pressed to adopt or alter the central act at the earliest with precondition to release central funds to the states.

Fortunately we already had Private Clinical Establishment Registration and Regulation Act in 1997 itself which was kept in abeyance by stiff opposition from IMA & TNGDA.

With few modification in the Act and Rules, this act will be definitely for better than the Central Act and it is in the final process of discussion with sincere and empathetic Health Secretary and other officials.

Health Secretary was graceful enough to permit the top ten state IMA office bearers in the place of two permitted in the earlier two meetings.

We request our members to have faith on the IMA office bearers under my president ship for the best possible Act and Rules.

Other states IMA are also eagerly waiting for our Act so as to fight to implement the same in their states. IMA can crush any challenges possed from the so called consumer activists and make our member cherish.

But let us all remember Lord Buddha's words "IT IS BETTER TO CONQUER OURSELVES THAN WIN THOUSAND BATTLES".

IMA CGP conducted Exams for Fellowship Certificate Courses in Endocrinology, Diabetology, Nephrology, Echo-Cardiology and Practical Cardiology. Soon the results will be published.

Paramedical Course.

IMA TNSB has given accreditation for following New Institutions to conduct Paramedical Courses.Sri Sakthi Hospital, Tirunelveli. National Pharma Hospital and Research Institute, Tanjavur.Salem Gopi Hospital Pvt ltd., Salem. Velan Eye Hospital, Karur. SBS Institute of Paramedical Science, Hosur. 142 students enrolled for the academic year 2014-2015.

IMA AMS

IMA AMS is going to start a New course on Medical Emergencies on May 25th at Salem. We invite our members to take up this course.

Membership Drive.: Our slogan for this year is “Let us reach out to uphold our honour and dignity”. We are in the process of reaching Non-IMA Doctors through 148 branches. The reduction for the enrolment in Life Membership fees is till June 2014. I request all Branches to motivate non IMA Doctors to join IMA. This month we have enrolled 230 New Life members.

Blood Bank: A New Blood Bank on behalf of IMA TNSB will be started soon at Thambaram Head Quarters Building. MOU signed on 9th March 2014 with THE LANDSTEINER LAKSHMI MEMORIAL RESEARCH FOUNDATION PUBLIC CHARITABLE TRUST, Chennai.

Blood Donation Camps: As per the instruction of the Head quarters we must conduct Blood donation camps during last week of June and get the maximum units of Blood during that period. I request all the branches to do this camps along with other NGO's, College students and make this a grand success before the Doctors Day Celebration.

New Branch Inaguration: Happy to inform IMA TNSB inaugurated the 148th Branch IMA SIMS VADAPALANI by our President Dr.M.Balasubramanian on World Health Day 7th April 2014. Last year we were subjected to rude shocks by the not well thought of decisions and unfriendly “Acts of Central Minister Shri GULAM NABI AZAD. Clinical establishment Registration and Regulation Act 2012 of Central Govt was a real blow to the freedom hitherto enjoyed by Medical Profession and virtual take - over of the private health sector by the Central Govt without compassion for public and compensation for medics. Is it because we study for longer years? - Is it because we settle in life in our late thirties? - Or because we are kind - humane and - lead a self sacrificing life to save others life. It gives us great pleasure in addressing you

through this letter. After the successful

centenary meet we are planning 101st meet at

Cuddalore on 22-06-2014. We request you all to

continue to encourage us to serve you better in future by your

active participation.

Clinical establishment act is here at our door steps. NHB is trying to get maximum

concessions from our Government through constructive negotiations. We are sure

the final draft will be doctor friendly. Next in our agenda is level of hospitals and

standard guidelines as put up by government of India. The national government is

grading hospitals into 4 levels starting from primary, secondary, tertiary and

teaching. They have put forth guidelines for the division. Next they are coming out

with standards for all specialties which we otherwise call protocols. Our NHB has

taken up both the issues seriously before our state government start talking about

it. We have managed to come out with an application of grading along with this

issue of NHB Express. We have also sensitized our members to the issue of

standardization by sending mail to all the members who have given their mail id to

us. We intend to collect feedback from as many members as possible, so that we can

give a consolidated opinion to the state government when asked for. All these

efforts of NHB need your co-operation. We request you to help us work and fight for

our rights. Unity is need of the hour NHB thanks state office for the excellent co-

operation and guidance, we are getting from our president Dr.M.Balasubramanian,

Secretary Dr.C.N.Raja and finance secretary Dr.V.Madhavan.

Aao Gaon Chalen'(Let us go to the villages Project) You will appreciate that almost 75% of our population lives in villages but 75% of the country's health infrastructure is concentrated in cities. Most of the villages still fall short of health man-power and infrastructure. The popular myth in the public mind is that doctors do not want to serve in rural areas. Indian Medical Association with its nine Decade Old History had launched an ambitious project. AAO GAON CHALEN a dream project of IMA. In the year 2004. National IMA is once again giving thrust to this Nation wide Rural Health Project — Aao Gaon Chalen (Let us go to the villages) to sensitize the medical fraternity to village health problems, which will serve the poor and build a positive image of the profession in the minds of the people. The Project will bring various health and related agencies together to care for the needy and the deserving population of the villages. Let us join hands to make this Project not only a success, but a land mark in the history of IMA. As the National Chairman of this Project, may I request you and your vibrant team of Office Bearers in your Branch to motivate your members towards the successful implementation of the Project. Kindly Identify and adopt a specific village within the area of jurisdiction of your branch, based on the need, to provide preventive, promotive and curative aspect of health care services on a regular basis. A three member Implementation Committee can be formed in the Branch level under the chairmanship of the Branch President. Branch Secretary will be the co-ordinator. Plan the schedule of activities you propose to undertake and inaugurate the Project in your branch and inform the State President and the State Secretary.

Dear colleagues,

On the eve of summer I trust you will be enjoying the vacation with clutches of children and grandchildren which you have been longing for quiet sometime.

IMA CGP has successfully completed the 10 courses for the year 2013-14 and we have trained more than 200 doctors in various specialities to empower them to practice with evidence based medicine in those particular areas of medicine.

Examinations for all the courses are completed and the results were already informed to the candidates.

For the year 2014-15, more than 125 candidates have already enrolled and we anticipate many more to join in the upcoming days. All the courses are likely to be commenced in the last week of May or June.

There has been an overwhelming response to join echocardiography course, as such the admissions are completed and the classes have commenced on 27th April well ahead of other courses. Cardiology course class is to commence on 25th may.

We request all the office bearers and members of IMA to motivate the younger generation to join the courses in large numbers.

We are very much indebted to our IMA Tamilnadu state president Dr.M.Balasubramanian and IMA Tamilnadu Hony.Secretary Dr.C.N.Raja for their wisdom and guidance in all our endeavours which makes us feel that we can do much better in the coming days.

Dear Colleagues, “Ability alone is not enough for success It must be sparked by Ambition and Sustained by Determination.”LEGAL PROCEEDINGS:: [CONSUMER] : Legal Proceedings are initiated by the patient by filing a suit or complaint. Notices or summons to appear along with copies of legal proceedings are served on the doctor. The doctor must ensure that the copies of legal proceedings are complete and legible or else the court must be informed about the same. Any notice or summons must not be refused. After the Supreme Court's judgment in Dr.Martin D'Souza's VS Mohd. Ishfaq's case, it has now become imperative for consumer courts to take second medical opinion, and if this opinion prima face points out to the negligence of the doctor, then only notice can be issued to the doctor and not otherwise, The doctor must therefore ask for a copy of this medical opinion from the court if it is not sent along with the notice. If the doctor wants to employ the services of an advocate, he can seek time for the same. Advocates will file their, vakilpatra, vakalat, vakalatnama or notes of appearance. There is no legal compulsion that a party must be represented in court by an advocate. The doctor must then prepare his or her reply. In order to prepare a reply, the doctor can seek inspection of all the original documents that are referred to or relied upon by the patient and seek their photocopies. If inspection and copies are not given by the patient, it must be pointed out to the court, which will direct the patient to give inspection of originals and also provide photocopies of the same. Before preparing reply, once again all the medical records, notes etc., must be referred. Nurses, paramedics and consultants who have dealt with that patient must be consulted.The reply must then be affirmed and filed in the court with counterclaim, if any ; list of witnesses that are to be examined; and also originals of documents relied upon by the doctor in defense. Medical literature in support of the case must also be filed at this stage. Reply must be filed within the stipulated period i.e 90 days from the date of receipt of summons / Notice by the doctor. The patient has a chance to file additional reply if any new fact is stated by the doctor in reply, to which the doctor can again reply. Issues between the parties in the form of questions are then framed by the court. Trial commences on the issues framed by the court. Both the parties bring their witnesses as well as the 'Medical Expert' in the witness box, who are then examined and cross examined. After evidence is closed, oral arguments are advanced by both the sides, culminating in the judgment pronounced by the court. It is advisable that the doctor must be personally present in the court during trial even if represented by an advocate. In a trial, there will be many instances where the

PRESIDENT NIXON PRO CLAIMED A NATIONAL NURSES WEEK IN 1974.


Dear colleagues, Warm greetings. Last month, we saw why medical practitioners cannot be prosecuted under 1PC 304 A Sec. or other sections for criminal negligence, unless the negligence is 'gross' and the police have to obtain an expert opinion saying that the negligence was gross from a specialist in the same field of medicine, before prosecuting them. Now we shall see the same case details under Consumer Protection Act. Please refresh your memory of the case by going through the short history of the case given in last month TIMA News letter. Kunal shah, complainant and husband of the diseased patient Anuradha, is probably a good friend of doctors of Kolkatta, D-1, D-2, D-3 and AMRI Hospital Authorities. Probably due to that, the above doctors were not serious about writing correct records. Kunal Saha probably have been allowed to carry out the doctors instructors in his own way and might have been adding his own treatment. Probably that is why, the authorities of AMRI Hospital, at Kunal Saha's behest, allotted a separate AC Room for his wife to prevent noscomial infection. But they did not record it. Kunal Saha took control of entrance and exit from the room, so much so, the nursing staff could not record the patient's vital parameters and as the nursing superintendent of the AMRI said “instructions for medication were carried out by Dr. Kunal Saha and not by my nurses”. But the same was not recorded by doctors who attended on her; nor the AMRI Hospital has raised any objections to the instructions being carried out by patient's husband, in writing. In the Hospital records, Kunal Saha's name was mentioned only once – that is at the time of admission to AMRI Hospital as the one who brought his wife for treatment. In a quite opposite way, when Kunal Saha dictated terms and insisted his way of treatment after transfer to Beach Candy Hospital, Bombay, the Doctor in charge, wrote in the case sheet itself that “ .. hence had great problems with the husband and brother in law (of the patient Anuradha). It is with great difficulty that I have controlled myself. When presented with his arrogance and condescends – (I tolerated) merely and solely for the patient's sake”. Their hospital records were of 370 pages, whereas AMRI Hospital records were mere 22 pages. Kunal Saha filed cases under CPA against 1. Kolkatta Doctors and AMRI Hospital and 2. Doctors and Beach Candy Hospital, Bombay. Later he withdrew the case against Bombay Hospital and its Doctors. Probably he might have thought correctly that the doctor's note will go against him. But he pursued the case against Kolkatta Doctors and AMRI Hospital, saying he never interfered with the treatment and got about Rs 11 and odd crores as compensation! Except for Rs 25 lakes of this amount, the remaining money was to be paid by AMRI Hospital, because they have failed to record the behavior of Kunal Saha and how he obstructed the nursing and other supportive care by the nursing staff, as told in the court by the nursing superintendent. The court observed “The professionals should have resisted the interferences and they cannot abdicate their responsibility to the patient” So, please understand the importance of keeping records and recording whenever there is some controversy or difference of opinion raised by patients or their relatives and obtain proper consent for any procedure to be undertaken.

How to Organize Blood Donation Camps

As per the instruction of the Head quarters we must conduct Blood donation camps during last week of June and get the maximum units of Blood during that period. I request all the branches to do this camp along with other NGO's, College students and make this grand success before the Doctors Day Celebration.

How to Organize Blood Donation Camps?

Aim : To do good work in society and help the needy on behalf of Doctors Day 2014.

Purpose: Shortage of Blood in all Blood banks and lack of motivation in society about Blood donation.

Procedure: 1) Contacts Blood Banks for fixing date (1st July, Doctor Day-for convenience nearing Sunday i.e. 26th June or 4th July + 1 week) and Venue.

2) Organizing Group: With IMA members you should contact in general AMC members and other groups like Rotary Club, Lions Club, Youth Club, Local Doctors Association, Railway Union, Medical Stores, Chemist Association, Non-Political social organization, Religious, corporate groups and other NGO's as a supportive group to bring donors, sponsors and Volunteers to work during the camp.

3) Fixing Venue: Fixing Common public places for Blood Donation Camps like Hall, Railway Station, Hospital, School/College etc., (Having are of approx 1500Sqft).

4) Eligible Donors: Age 18-60 years, Weight – more than 45kg, male or female.

a) History taking of the patients is very important.

b) Pregnant lady not permitted.

c) Hb level not less than 11.5gms

d) Heart diseases patients & certain medical condition like T.B, Cancer, Thallasemia, HIV etc.,

5) Motivation:

a) By sending SMS, Doing personnel phone calls to the eligible donors.

b) Print Banner (approx 5-10 nos) & Hand Bills (1000-5000 nos) for promotion having

footings of those who sponsor.

6) Preparation in the Venue: During day of camp preparation in the venue should be completed at least in one hour in advance (approx 8.00am) by keeping the following things ready.

1) Clean flooring (carpet sos if required)

2) Arrange 6 to 10 cots ( inquire if Blood Bank brings the cot, otherwise arrange yourself)

3) 4-6 Tables (for registration, Hb estimation, Blood Collection etc.,)

4) 30-40 chairs (variable for the Blood Bank people, donors, etc.,)

5) 4-5 fans(having nice air flow)

6) Ensure Electricity is there or might have to arrange generator.

7) Arrangement of Tea, Coffee, Biscuits for donors, Organizer, Volunteers.

8) Breakfast for the team of Blood bank (10-15) and Volunteers, doctor s(e.g Poha, Vada-

With appropriate visuals, posters and stickers may be prepared with these slogans. In hoardings and TV spots these Slogans may also be used:

1) Blood donation is friendly gesture.

2) Blood Owners should be Blood donors.

3) Blessed donation will cost you nothing but it will save a life!

4) Share blood- Share life.

5) A life is waiting for a bag of blood from you.

6) Blood is meant to circulate. Pass it around.

7) Let us be blood brothers.

“Initiate! Motivate! Adopt! – Organ and Blood Donations” was proposed as the slogan of IMA Tamil Nadu State in the year 2010 when I took over as the President of IMA Tamil Nadu State Branch. No of Blood donation camps and organ donation awareness seminars were conducted. Blood donors' register was uploaded in the IMA TNSB website branch wise consisting of our members and other voluntary blood donors. It was continued during my tenure as chairman, Research, Organ & Blood donation committee IMA TNSB.

Our IMA TNSB Secretary Dr.C.N.Raja in his report to IMA H.Q had informed about

the blood donation camps to be conducted in Tamil Nadu State. This matter was

discussed during State Presidents & State Secretaries meet in IMA H.Q New Delhi. Our

State President Dr.M.Balasubramanian stressed on it. After the discussion at the

meeting it was decided to conduct national wide Blood donation camps on

29.06.2014.

We feel that the camps spread over a week all over the State would be better than

conducting on the same day. So I request all our branch office bearers to contact the

nearby Blood banks, Voluntary Organisations, Colleges, Blood Donors' Clubs and

conduct blood donation camps from Sunday, 22.06.2014 to Sunday, 29.06.2014 and

report the matter on the same day to me and to the State Office. In the announcements

and pamphlets you can add the names of the Other Organisations also. Please contact

the Govt Hospital Blood Banks and other Voluntary Blood Banks now it self and fix a

date between 22nd and 29th June, 2014.

I am planning to award the maximum participating Branch and the Members and

appreciate all Branches taking part. The State Office also is keen on conducting this

programme in a grand manner. We must be the top in the country. Our State

President, State Secretary and the Vice Presidents will be guiding you throughout. I
