Commissioner Fowler opened the Public Hearing at 9: 03 a.m.

Peter Town, RVCOG, reviewed Josephine County Senior Resource Center( Exhibit 1). The Board discussed the opportunityto watch this project from the beginning while serving in the City Council to the very end and what ajoy it has been to watch thiscome to fruition.

Commissioner Fowler stated," Every year the United States holds ` Police Memorial Week' ceremonies across the nation. Thisyear our fallen brothers and sisters in law enforcement are remembered and recognized from May 10t thm May 16th,

2020. Traditionally the Josephine County Sheriff' s Office annually hosts a ceremony on the front steps of the Courthouseduring this week of honor and remembrance. We are sad to inform our citizens there will be no public ceremony this year dueto COVID- 19. The law enforcement community asks that our citizens take just a moment during the Police Memorial Week toreflect on our fallen. These men and women gave their all while serving this great country. c. Grant Agreement between Emergency Management and Oregon Department of Forestry to Implement the KingMountain Fire Detection Warning System ( One original Agreement returned to Emergency Managementforfullexecution)

Board Discussion and Action:

Commissioner Morgan made a motion to approve the Consent Calendar Agenda Items 5( a) through 5( c) as listed seconded by

Commissioner DeYoung. Upon roll call vote, motion passed 3- 0; Commissioner Morgan- ves, Commissioner DeYoung- yes,and Commissioner Fowler- yes.

6. OTHER:( ORS 192. 640( 1)) `.. . notice shall include a list ofthe principal subjects anticipated to be considered at the meeting,but this requirement shall not limit the ability ofa governing body to consider additional subjects.')

Commissioner Morgan made a motion to # 1 During this emergency period and its impact on staff Planning shall not process

any applications for new cellular antennas, as new antennas fall within non- essential services. # 2 The primary goals of theupdates to our cellular antenna codes shall be twofold.. a.) to retain as much local control as legally possible of the installation

of cellular antennas in the county, and b.) to do the utmost to protect citizen choice and individual freedoms, and # 3 It isrecommended that Planning immediately hire an expert telecom legal consultant who has extensive experience with exactly howthese the local codes should best read to meet the above two goals, seconded by Commissioner DeYoung. Upon roll call votemotion passed 2- I; Commissioner Morgan- yes Commissioner DeYoung- yes, and Commissioner Fowler- no.

7. MATTERS FROM COMMISSIONERS:

Commissioner Morgan discussed the decision for which counties will reopen into Phase I through the Oregon Health Authoritywill be announced on May 14, 2020. Commissioner DeYoung commented on the timelines of the State' s stay at home ordersand how this does not work for business owners, if someone is not comfortable with the reopening of Josephine County, they arefree to continue to stay home. Commissioner DeYoung also discussed the airport runway extensions at both the Grants PassAirport and the Illinois Valley Airport. Commissioner Fowler updated the residents of the Fire Protection Committee' s work andrecommendation. The Board discussed hiring a consultant for the task to research the different options Josephine County has indealing with unprotected areas. Commissioner Fowler also mentioned how the timelines of the State' s Stay at Home orders arenot based on geography and facts and it seems as though the Governor is overreaching to assert power.

My colleagues and I are presenting information to you today within 3public inputs, the final one concluding with our request.

We had hoped, along with you, that wireless 5G was only a future concernbecause the " small cell facility" distribution method is too expensive forless populated areas. However, now there are other methods of 5G

dissemination which put rural areas at more immanent risk, like AT& T's

AirGig" which turns the length of existing power lines into 5G radiatingantennas. Also, the reality is that US Cellular just received effective permit

approval by Josephine County Planning to install antennas utilizing thelower band of 5G frequencies.

Please note we are cautioning specifically about WIRELESS 5G. We believeit is this WIRELESS infrastructure which strips away Citizen Choice and ourright to privacy, and threatens individual freedoms and safety.

5G is about massive data capacity and almost instantaneous data analysis.A wireless 5G network will give whoever has access to it (telecom compa-

nies, the government, entities that buy and mine data and hackers ) accessto citizens' private communications and personal preferences. Your per-

sonal data is Big Business, and there are many buyers.

Credible articles report that the 5G WIRELESS network will enable the

ability to track citizens' movements via facial recognition software utilizedby cameras installed in our neighborhoods and communities, promotedfor various " helpful" sounding purposes. searches and censored by popular social media sites, while whistle blowersare being discredited. One wonders, What is going on that inspires suchcensorship in a country that exalts freedom of speech?

Have you also not wondered, Why is the FCC so adamantly stripping localcontrol over wireless 5G, and attempting to force antennas onto ourstreets, next to our homes, and into the skies via tens of thousands of

satellites? Could the FCC really care that much that your videos play

faster? What is really going on here? I urge you, my Commissioners, to

take the action we are proposing today in order slow down the installationof wireless 5G in Josephine County giving you time to institute thecontrols you do have to protect individual rights and Citizen Choice.

Thank you for allowing me to continue my colleague Cassidy' s brief and hopefully informative and thoughtprovoking input. The request we all make to you today will follow in Sha' ana Fineberg' s input.

According to the online " INTERNATIONAL APPEAL to Stop 5G on Earth and in Space,"the harm to humans,animals and plants from WIRELESS 5G has been documented in literally over 10, 000 peer reviewed scientificstudies. I suggest that you glance at its 123 references. But the issue, as the previous citizen input implied,

goes beyond health. The wireless 5G infrastructure has the potential to drastically impact citizens' right to

privacy as well as their safety.

Where Citizen Choice enters in to this arena is that non- wireless 5G data services avoids many of theseharms. Businesses and citizens can have the choice for access to these services if they wish. And they canhave that choice by what actually often ends up being be alocal money maker, fiber optic cable straight tobusinesses and homes where 5G services are wanted. This protects everyone' s rights. ( I know Dr. Fineberg

can provide you with resources regarding creating locally owned fiber optic networks.)

Local leaders are being intimidated into thinking that they have no power, and too often cower to the threat oftelecom lawsuits for violating FCC rules. According to expert telecom Attorney Andrew Campanelli, the realityis that if a locality is sued for denying a permit based upon rules that purportedly violate FCC rules, the case is

decided quickly in a summary judgement and the locality cannot be liable for any damages or telecom attorneyfees - at worst the permit must be granted. At this point, the local level is EXACTLY where we can best legallyassert and protect our rights.

Dr. Fineberg will conclude with our direct request for specific action on your part, this morning. at this meeting,if at all possible.

And by the way, you would do well to ask her to meet with you for an educational and Q and A session aboutwireless 5G - her breadth and depth of knowledge in that arena never fails to astound.

Greetings Commissioners.

I' m glad to be speaking to you sort of in person today. I' m bringing onespecific request to you to actually do this morning, at this meeting if at allpossible.

I do believe that it is each of your desire to retain local control to provide

Citizen Choice to Josephine County citizens. Thus, before local authorityis eroded any further, and before more new antennas are installed inresidential areas opening the door for 5G via slam dunk " upgrades" andcolocations, I urge you to approve an official and clear Directive to

Planning encompassing three things — and the suggested wording forthem is in bold in your written copy of my Public Input.

1- During this emergency period and its impact on staff, Planning

shall not process any applications for NEW cellular antennas, as newantennas fall within non-essential services.

my comment: This power has been explicitly given to you by the FCCand Homeland Security and I have already sent Wally, the legal references.Let's slow this thing down so we can get local controls in place, and youhave the time to find out more of what is really going on.

2- The primary goals of the updates to our cellular antenna codesshall be twofold:

a) to retain as much local control as legally possible of the installationof cellular antennas in the County

b) to do the utmost to protect Citizen Choice and Individual

Freedoms

3- It is recommended that Planning immediately hire an experttelecom legal consultant who has extensive experience with exactlyhow these the local codes should best read to meet the above two

goals.

my comment: This is because this is an extraordinarily complicatedfield. It would take Planning and Legal personnel weeks if not months to

integrate the complex new technology and volatile legal landscape and

create the ideal codes, while an expert legal Consultant could create the

most effective codes to meet your goals in the shortest time possible, at

the least expense.

Attorneys Andrew Campanelli and Kenneth Fellman are two top experts inthis field. Either one of them could take the information we already havecompiled and give us, rather quickly, a superb set of codes.

I ask that this threefold Directive be ideally approved today at this meetingif at all possible, in order to secure Citizen Choice, Individual freedoms,

and the maximum possible local control.
